There is no such thing as a "Stop and ID State". All states require a legal reason to be required to show identification.
It’s not loitering when they’re sitting on a bench that was provided by the school to sit on.
It’s called reasonable suspicion OF A CRIME.
Missouri is not a stop and ID state. Those statutes only apply to Kansas City, not the entire state.

Lowkey, in today’s day and age, the cop could have claimed that the guy flipping him off was racially motivated in order to cloud the facts, and many people would have jumped to his defense without question.

This officer is a "walking violation" of the 1st, 4th and 5th amendments in addition to being an embarrassment.
He said "you're being disrespectful" Um... That's what the 1st amendment is for. So you can say "down with gov", or "down with the king". Flipping off the cops is a perfect exercise of first amendment. The police telling the guy to RESPECT HIM is stupid. Cops DESERVE no more respect than anyone else. People can yell hatred at me, all they want. It's their right. The cop accidentally admitted to stopping the guys because they flipped off.

During Jim Crow it was a crime for Black People. Being out in public during working hours with no visible means of employment was the excuse used to pick up Black People/sell them to companies for little to no money.

I hate seeing this. I support police, but this is what causes the outward hate of police officers. The Sargent either did not know the law or he was banking on the two guys on the bench not knowing the law. Either way that a dangerous game and not what professional police officers should be doing. Right-on guys! Great job! Please inform us how this case turns out. As a Canadian, I do research for a large organization that compiles data for the Tourism/Travel industry. The information is then made available to Canadians, in our government-issued guides, and include topics such as 'the relationship between local police and the citizens'. It allows us to WARN and ALERT Canadians about which areas or counties, cities, towns, highways, etc, to AVOID. The thousands of Snowbirds who drive south, are thus spared having to worry about being pulled over ILLEGALLY by horrible cops like him. That cop needs to be held accountable - and FIRED!

I already hated the cops, but after watching all these interactions on the channel, my hatred is set in stone and there is no changing my mind.
This is not good, don’t live your life or use your time on earth with hate or resentment.

I've had a long-standing mistrust of police, but having now watched nearly 3000 videos of police interactions, that's also growing toward hatred. It's not because they're often wrong, but because so often they are unbearably arrogant and so sure that they are right when they're very obviously wrong. Even when it's impossible they were ever trained or ever read a law that would lead them to believe they could possibly be correct. "I literally have no idea, but I know I'm right, that's for sure."

I believe hey were walking when the officer drove by the first time. They sat on the bench before e came back.
This shows just how far the police accountability movement has to go. The fact this officer wasn’t immediately terminated and arrested for intentional deprivation of rights under color of law (or similar code violation) is case and point.
Well the DOJ isn't doing their job. They are the ones who would have to charge deprivation of rights under color of law.
The DOJ seems more worried about moms protesting how their schools are teaching their kids than actual police misconduct.

@@dennismood7476 correct me if I am wrong, but I don't know of any state laws against what he did. There are federal laws like official oppression and deprivation of rights, but I don't know of any equivalent state laws.

I've seen hundreds of videos from this channel and others where the same thing happens.
A cop comes to someone and asks for ID without probable cause, the person refuses, the cop threatens to arrest the person.
Either the person gives the ID "voluntarily" and the cop gets away with it.
Either the person refuses, and is taken to the police station for a spurious reason before being released without prosecution.
What can we do to both protect our right not to give out our ID and at the same time not get caught.
Suing the police a posteriori is not an adequate response because many have neither the desire nor the time nor the money that it requires.
Everyone needs to live stream every interaction with the police at this point.
It's a shame that we have to actively defend ourselves from the same people whom are supposed to protect us.

Going through the guys wallet looking for ID without his permission and with no legitimate reason for the stop seems like a huge 4th Amendment violation which is even more troubling than the First Amendment violation.

That he went into the subject's pockets at all is a 4th Amendment violation, based on Terry V. Ohio. The officer *MAY* have been authorized to do an external pat-down (my doubt is strong on this point), but going into the pockets is a separate stage of search.

This is 2 videos where ATA didn't comment on entering the pockets. The only thing I can think of is he didn't express his 4th amendment right by stating he did not consent to a search.

With the poor training these officers get, it’s no wonder that the public disrespects the police.
Sadly a large number of officers earn that disrespect. Better training in the law and regular psych evaluations would help I think. The offending officer had a previous infraction on his record which should have been a consideration in his investigation and ultimately led to his termination. This is a bad apple who will become a senior officer at some point and teach younger officers how to be bad apples.

if an officer is disciplined for getting out of line, the public deserves to know the exact, specific disciplinary actions which were taken, not some vague response which could very well be nothing whatsoever.

It's incredibly frustrating how much they talk to these cops and give away info they don't need to.
At the end of the day the interaction will probably be used to support a lawsuit. In cases where the officer is clearly in the wrong it can work out but I get your feelings generally.
My head was exploding as these kids kept answering the questions. Where you going, what are you doing, are you guys related, blah blah blah blah blah. I would have said "are you writing a book?"
Think of it from their side for a moment. He casually threatened to take them to jail and they clearly started getting fearful. Plenty of instances of people being arrested and languishing for hours for choosing not to answer questions asked by a egomaniac. Cops know this and use arrest itself as a weapon to coerce compliance.
They were in shock, and were not familiar with Auditing. Unfortunately, most citizens give up their rights all too readily when confronted by authority.

Imagine if the cop went up to them and had an actual conversation. Just like, "Hey man, what was that about? You're not being detained and don't have to talk to me if you don't want to, but that hurt and I'd like to know why you did that and how I can help you not feel that way. I want you to feel safe in this community and not feel the need to do that." Then either talk or just walk away. Would have actually made a difference, as this just makes the guys double down on their hate.

The absolute most boss moment of the whole video was when the cop says you can absolutely do whatever you want and the kid says yeah that's what I was doing until you stopped me.
Invalidate the Qualified Immunity for the officer, then file suit against him personally. If the judge allows qualified immunity, then proceed with a suit against the city. Federal lawsuit may be needed as well, such it's a Constitutional right that was trampled.

That was infuriating to watch and even more upsetting to hear that the officer faced little to no consequences.

I filed a complaint on a cop in a town of 10,000. Even tho i did like his sgt and knew the guy for years, he really made me feel like I was the only one to EVER do it in the 150 year history of the city by saying, "Yeah, I think this is the form. Never did this before." They are going to protect their own. No two ways about it.
Cops that point at their name tag as if it's an answer to someone requesting their name and badge number should be immediately fired on the spot.
