We didn’t even talk about the fact that They have not paid rent for over a year, long before they even move about the mold. They have been living there rent free for ever and never saved a penny, and since the last court appearance, where they wined about the mold,they’re still there talking about about what the landlord owes them ! UNBELIEVABLE !!!

The old premise of putting lipstick on a pig. He laid carpet like it was a new coat of paint without spackling the nail holes. It covered up some of the mess, but it didn't truly cover the holes.
I hope the neighbors know what they're potentially in for if those two decide to dillydally moving the kids.

reminds me of my Aunt Niecey. She's not blood related. I don't know the full story, but i think her birth mother was in a similar situation, maybe worse. She was supposed to stay with my grandparents until she figured something out. After a while she stopped coming around and they just took her in.

If that were true, he'd have known what proof to bring, have receipts, have ANYTHING with him (other than his mama, who seems 100% ready to bail him out AND bury the bodies if it means protecting her baby) as proof of what's happening, and his mama didnt do a thing to prepare him to even ATTEMPT to beat the system. Well, to be honest, I went to court about 2 years ago. And I was the only one wearing slacks. A tie and a button up shirt and a jacket. People think that their best pair of jeans and a polo shirt is dressing up nowadays or dressing professionally. "Business professional" is what you should be wearing in a court setting. You should basically be dressed up like your lawyer. Obviously the colors aren't going to be the same, but that's How you should dress to impress the judge as much as you possibly can.

I went with my daughter to court for a speeding ticket when she was younger, and she and I were the only women in the packed courtroom (well over 100 people with all kinds of cases, standing room only) who were dressed like we did when we went to church! There was only one man there who was dressed up in a suit and tie, and he was a doctor! He said he felt the same way and we were shocked nobody else was dressed decently. Some were in cutoff shorts that were way too short - (Daisy Dukes' with their cheeks hanging out and tank tops on.) There is no respect anymore. It's really sad.

Rent is so high because the economy and housing market is royally screwed by Biden and the taxes and insurance for the landlord has doubled. Everyone, including the government has exploited that. This probably has a minor affect on it.
Judge Simpson has very kindly - and patiently - explained to these two defendants, essentially, that "You won't be getting $50 Grand."
These people are crazy! This lawsuit is ridiculous…if you don’t leave the landlord can’t have it remediated. And the “damages” they are claiming..come on now! He is stating “what ifs” on medical costs. My husband is an environmental engineer on an Air Force base and his field of expertise is asbestos, mold and water treatment on the base. If the mold was that bad in a trailer, it would be condemned and not remediated. Permanent standing buildings are one thing, but a manufactured home with mold is completely different. They are just trying to make bank off this landlord.
Yes! And a serious mold condition doesn't just appear overnight! As soon as they saw it, they should have moved out and gotten it treated. Why couldn't they have gone to live with a relative until the mold situation was abated? Judge Simpson does a good job trying to explain the obvious to this clueless defendant.

@@alisong2328 In the appearance before this one they said they didn’t have any family living nearby. They should’ve moved out and had the landlord pay for the hotel until the trailer was remediated.
They also said in their previous appearance they wanted to buy the trailer 🤦🏻♀️ The former owner sold the trailer “out from under them” and they said the new owner didn’t fix the roof. Their story just went around in circles like this new one about damages does.

I'm still having trouble figuring out how they were planning on paying for this trailer. She's waiting on their tax return like there's any way that would have covered the purchase price. There's no way, knowing what he's finding out about these two, that the owner is going to accept anything as a down payment and let them pay the balance off in installments. That would be their only option, because we all know that they aren't going to be approved for a loan.

Not only that, but they'll have to pay lawyers and the doctor that testifies whether they lose or not. None of this will be free, and they might end up spending more than they could realistically get for a settlement.
If you don't like it - MOVE. If there's mold - MOVE. If there's an imminent threat to your health - MOVE!!!!! Moving the kids out should have been out of the home entirely.
Renters insurance is about all they could possibly get and these people weren’t even thinking about moving they wanted to stay and buy the place last week 😂
I wouldn't be surprised if it turns out they let it get this bad just so the value of the trailer would be almost nothing when they offered to buy it and then turn around and sue again for some nit-picky B.S. sales law.

Don't suppose you've come across a family court case with a mom who sits in a public booth(inside the courthouse I expect) with a toddler aged child on the floor under her feet and she is fighting the dad over her daughter she accuses dad for sending the daughter for visitation with drugs in her backpack, and she's so angry and animated, can't control herself at all and she'll throw the dad under the bus (not that I or the judge believe her) but she'll say something and then ogle down the camera with these huge bug eyes bulging out as she fights on.. There's been a few different episodes and she was due back in January but can't see it anywhere. Really need to see the conclusion of that case.. She's a freaking nutcase, it's sad but entertaining..lol

I knew someone whose renters thought he should supply their light bulbs. If you think a house is detrimental to your health and the landlord doesn't address the problem, either take care if it yourself or move. Don't risk your family's health to prove a point. The point being that it is the landlord's responsibility. Ultimately, your family's health is your responsibility. Why didn't you free load off your mother like you are doing now..

Everything that is in that trailer is contaminated with mold spores. If any item cannot be cleaned with microban (a super strong cleaning agent that kills bacteria and spores at the micro level) then the items need to be sprayed down with microban and tossed into the trash. I was stationed in an area in North Eastern area in Europe where they burned soft coal for heating and in many factories. It wasn’t good at heating housing and black mold was thick everywhere. It got in my lungs and blood stream and I was hospitalized for a long time because the antibiotics available weren’t working. I was supposed to be medivacted to the big Army hospital in Frankfurt, when a new antibiotic from …… was sent to test on me. I took it for 30 days. It worked, but ripped me apart while I was on it. Mold kills no joke. I was bleaching the walls and everything and it came back just laughed at me. That woman’s desire to buy that trailer with money she didn’t have, keeping her CHILDREN in that death chamber and dragging her feet about getting out, is an idiot !!! CPS needs to be notified !!

Squatting illegally on someone else’s property and yet has the gall to file a counterclaim. The fact that the court still has to consider the countersuit is a travesty of justice, IMO.

Judge Simpson hit it on the nose about discovery. I had to do it for my husband's relatively non-contentious custody arrangements, and it was one of the worst things I've ever done. I also love that his focus comes back to the children over and over. He's a great judge.
This is unbelievable. If I would've been told this story: Landlord wants to evict couple w/ 2kids who FAILED to pay rent 4 a year. Couple delays eviction with excuses they have nowhere to go & the property is uninhabitable due to mold & other issues w/ trailer. Couple is now suing landlord for 50k for mold etc.
The mother doesn't want them having to move in with her.
The owner couldn't fix the problem because the renters wouldn't vacate the property so the renters blame the owner? This is a new type of stupid... don't use drugs.

I have always thought these two were scammers. I would not give them one penny. It is untrue that plastic toys cannot be properly cleaned. Some stuffed animals are easy to wash, steam and dry. I have never heard of a dresser being damaged by mold unless mold was detected on it.
Considering they probably got all or most of their stuff from thrift stores, yard sales and donation programs (clothes, toys, household items) they don’t get to replace it all with top of the line new items. Especially since they chose to stay there after they knew there was a problem. No pity for the cockroach parents. CPS does need to be involved.

I moved out of one house, three bedroom, to a four bedroom house. It took me two days to empty out old place, with a couple of kids, three cars and four cats. They need an additional week, or so, to move out completely? I think that they done sucked up too much mold. I've read through many of the comments, and you've already said what I had thought. But I remembered something. At the last hearing, when the woman was sitting in the gallery, he clearly said that the eviction was only sent to him and that she was planning to stay there with the kids. She was going to have to be evicted separately. She had no intention of removing herself and those kids from that environment. She was going to buy it with her tax refund (which makes me wonder how much she gets on the refund!). So yes, their plan was to walk off scott-free and get a big windfall as well.

Smart judge. Absolutely. When they found out about the mold, MOVE buddy! Don’t just sit there, children’s health at risk, hang out, let the months roll on, again, at a health risk, THEN ask for reimbursement for damages? Ummm NOPE! Lol

What a ridiculous counterclaim! They knew there was a health risk for over a year and are still living there! The landlord can’t fix the problem until they leave! They are responsible for their own damages and those to the property due to letting the mold spread and impeding any remedy from the landlord! Period!

Proving mold health effects is very hard. Because the burden is on YOU to prove it. For example I was exposed to asbestos that was improperly being removed and wanted to file a claim. After talking it over I was basically told that the incident date was noted and unless I develop mesothelioma, I would have a nearly impossible task to get a claim through the court.
Did you ever look into any of those large, class action lawsuits where you can join the suit without having to pay the lawyers because they take their fees from the expected damages. I feel like I’ve seen a ton of notices/advertisements on tv and social media for class action lawsuits involving asbestos exposure or removal or something, and they didn’t involve mesothelioma. I’m not sure how you would find them, but it might be worth a shot to google it!
Exactly. At the point health issue develops,you sue.
I live in an apartment and if this had happened to me I would have moved out after telling the landlord. I do not think they can get any money.
