They didn’t even worry about bad PR, because they knew people are desperate for their “product” and lack empathy for others. So people will come no matter what they do. They know they can get away with it. Corporate America has always been notorious for such behavior.

While I agree that Disney cannot have such a clause based on app user or otherwise because that is like saying they are not going to face accountability even if they are. In this case however, I am also not in agreement with the risk the couple took; they knew about the allergy condition and it’s seriousness and in such scenarios they should not have eaten food made in a restaurant because the chances of contamination with allergens is very high. Even if the restaurant guarantees they can provide safe food, the patient who is susceptible to allergic reaction should not take that guarantee for their own safety. It would be nice if the government makes it a rule/law.

Second, the allergy-related death did not occur in the parks, but rather at a restaurant in Disney Springs, which is basically a high-end shopping mall. Third, the restaurant (Raglan Road) in which the death occurred is not owned by Disney, but by a third party. The suit against Disney is roughly the same as suing Mall of America because you got a bad Cinnabon. I'm not trying to downplay this woman's death; it's tragic to a great degree. And I also feel that Disney's "can't touch us due to arbitration lol" argument is petty AF. But (A) they're suing the wrong people, and (B) every news organization who posts the story is spinning it into something it's not.
