  • A power of attorney is used when you want to give someone the right to act on your behalf and in your place. The rights and powers are whatever is written on the document. This video covers the areas that you need to consider so that you can give away only the power that you intend for someone to have.

    Thank you for educating people. We need more videos like this. Currently dealing with a sibling that set up an LPA with immediate effect with mental capacity, and no restrictions whatsoever. I'm suggesting to cancel, but the elders are concerned the attorney will state they cannot help them do simple day to day admin such as life insurance and VAT assessments, which I do not believe a powerful document such as this is required. They may keep it active due to fear.

      @@FinelyRevealed Thank you. The elders did decide to leave it active. We're concerned that the LPA can move cash around bank accounts as they see fit, as they're holding the document, however, I know that there are rules they should abide by to ensure it's not for their own benefit.

    What if the POA tries to fight the revocation by not providing the original document or information about how to find the original document?

      Hi @angie the power to make the appointment and the power to revoke it are held by the one giving/taking it away. The appointed attorney-in-fact does not have an ability to challenge. Watch for another video on this subject.

    Question: ()hello and thanks for video) My mom has beginning signs of dementia. She went from my home to my brother for visit. I never thought he'd disregard my mother's wants of returning. He has now begun some actions of being poa when our(mom, me and brother) verbal agreement was for us to work together that I am to have say over what happens with her and to her as well.
    I speak to my mom daily. She is being monitored on what she says so she has to sneak and tell me of things that are happening. They are not nice things either!
    Mom wants to come back and he will not allow her, he has not allowing other siblings of mine (her children) speak to her and I am being threatened if I talk to anyone of mom I will never speak to her again! My mom never has gotten along with his wife they have gotten in serious arguments or fights in past. She is very ugly with my mom! Keeping her to her room, tells her "get.. Go, go to your room... I don't want you on my couch"
    Mom is a little forgetful, but.. walks, exercises, isn't bed ridden at all and he is trying to not let anyone else care for her. Yet wants to put her in a home!! Mom is heart broken and every day begs me to get her! I don't know what kind of hold he has on her but can he legally keep her there if she clearly tells me I don't want to be here, Im not able to live, do anything I'm stuck sitting in a room, no one invites her to go to store, go for a ride or when they go out to dinner they don't take me they leave me by myself in the room and what kind of life is this she says!
    This is so wrong, she is not at that point unable to do for herself. What can I do? Legally ? Can I go take my mom if she is verbally saying she don't want to be here anymore, please don't let him put me in a home, I'm not ready to sit and die. She says she still has life to live and enjoy, go to the beach go live and be free! I should be able to love and care for her!! Help please how can I get my mom back W me? Can he do this if there is more family that loves and care for her and would love to care for her!

      Hi @Debbie your mother is a free person and can come and go as she pleases unless she is under some sort of court order. Consult an elder care attorney in your town and they will guide you to sort this out. Best of luck.

      Get yourself an Attorney skilled with Elder Law just like she said above & apply for Guardianship.
      Build Your Evidence with your mother. Record her cries for help. A social worker will be ordered by the court to come out & interview your mother & your mother can tell her everything & the Court will remove her from your siblings & keep her safe & happy some where else.
      Thats called elder abuse & the court takes this Extremely Serious !!!

    Can we be our own durable power of attorney with a secondary in line, for when or if I become incapacitated, taking away the POA from the government?

      Hi Robyn - A person has all ability to act for themselves without any special documents. The POA is to have someone else do an act or make decisions for you in certain situations when you cannot be there or are otherwise unable to do the things.

      Hi @Javier - Those sound like documents that do the same thing- and agreement and a contract are the same thing. You have to read the contents to see what they each provide.

    I have a trucking business where as the truckers who are driving on the road most of the time have to sign contracts. They need me to sign as their logistics managers/dispatcher. Will the Limited Power of Attorney allow me to sign their signature on paperwork for them on their behalf? Or do I have to sign my name on their behalf?

      Great question. When you are signing for someone else as their attorney-in-fact per the power of attorney you sign your name and then write "as attorney-in-fact" or "by power of attorney dated _____" and then "for ____ the person's name".

      Hi @Anton cannot advise you- for advice consult an attorney in your area. POA rules and rights are set out in the document itself- state what can and cannot be done for another person.

    Does the POA control when you go to a friends house or if you go out can you get taken away?

      Hi @Ella A POA controls if the conditions for which it was executed are happening. So if you gave someone power of attorney to sign documents for you to buy or sell property because you were having an operation or were traveling and could not be contacted - they could sign for you. For durable powers those kick in when you are unable to act for yourself. You have the right to cancel a POA at any time - do it in writing and send to the other person and keep copies. Hope that helps.

      HI @Alexander. To terminate a power of attorney you write a revocation- reference the document by date and to whom it was given. Then give that to the person that you gave the power to and also give it to any place that person used it.

    If the customer does not have a power of attorney form, as a notary what do I tell them? To get the form online? Or ask their attorney?

      An Attorney, and particularly an Estate Planning or Elder Law Attorney, would be the best option. To help lower the cost, a person may consider a legal subscription plan, such as LegalShield. You can then see one of their Attorneys. Some Unions (i.e. UAW) offer their members legal services. Hopefully this is helpful for you.

      The attorney in fact is only personally liable for actions/acts taken which were not authorized by the power conveyed.

    My brother says he has poa. But won’t show myself and other brother the document. He with drew 60 grand out of my dads account while my dad was in the hospital.

      Hi @Hope A bank account withdrawal can be made under a power of attorney when acting for that person or could be made by a person whose name is on the account. The bank would normally keep a copy if there was a power of attorney and of course would have the signature card. The best information would be through asking your Dad.

      Unless there are particular things involved that need something more- the person who acts as attorney-in-fact must be of majority and be competent. Financial status is a consideration if money will be handled and that should be discussed between the people.

    My brother is incarcerated and his girlfriend they want to give me power of attorney but DHA has the children. Can the power of attorney allow me to get them without the ICPC process?

      Hi @Esha The parents, unless there is a legal guardianship in place or parental rights have been terminated, are the people who can give a power of attorney for matters involving their children. For your particular case you would need to have someone review case records and documents.

      The books in the videos are actual law books- state digests.
      Your local library has a sale every year or so- contact them to get on the list for the next one. They are very cheap and you may ask them about any you could have for free.

      Hi @Blue We are doing a new video on this subject - first ask her why. There are legitimate reasons for this - to have a person be able to help you in certain situations. But that would be your choice as to who that would be- and under what circumstances. Just to keep you in her grasp is not a good reason.

      @@FinelyRevealed Although she said General Power of Attorney, she mainly wants it for medical cases (Durable Medical Power of Attorney would suffice). However, she can make medical decisions for me if I’m incapacitated through Next of Kin? (She mainly wanted it if I’m incapacitated)

      I have a sister call me out of the blue on the phone and said I'll be over with a POA I said what is going on here and her answer was I need you to sign it for some land we have need I mind you I already signed the paper that needed to be signed for the land me and other siblings to be sold and behind my back she told my sister well I need her to sign a POA she doesn't have any kids or a husband need I remind you this sister is sickly and she's been in and out of the hospital I'm in Better Health than she is I think I should be asking her for POA I will not be signing anything over to her that's my final decision I have no problem handling my personal finances and making decisions plus I get my social security does she think she's going to be in control of that I work hard all my life I just retired in 2017 I don't need anyone handling my personal affairs I do believe you want me to sign it on the 4th grade test but I don't trust her either.

    PLEASE HELP any advice is much needed and appreciated. Since my mom went W my brother she has always had plans of returning spoke of it if not everyday then every other... She desperately wants to live out the rest of her life and feels that sitting in a room watching movies all day is not fair, not living and she tells me that if she would have known going for a visit would have meant she would be left alone all the time she never would have went!😡😢 If she talks to me about this he don't let her talk to me for a few days! This is so unfair !

      Hi @ Debbie - If you believe your mother is being held against her will you can contact the police. Otherwise you should consult an elder care attorney in your area or simply arrange to go and give your mother a ride to whereever she wishes to go. The local police or sheriff can often serve as a peace keeper to make sure there is not any trouble.

    my mom is asking me to sign power of attorney to her for setting up medical purposes but i am incredibly terrified of her because her and my sister both have emotionally abused me for the better part of my life and have absolutely no respect for my identity as a trans woman and i am scared about what they could do with it if i signed it

      Sign your name "as attorney-in-fact for " and then write their name. Alternatively you can write your name "by" and sign your name "under power of attorney dated___" and show the other party the power of attorney.
