- When building a music based business it's important to protect yourself. One way to do this is to trademark your stage name and logo so that you have legal right of ownership. Now getting a trademark can be very expensive so the big question is...when is it the right time to file for a trademark? Well as the owner of multiple trademarks you might be surprised to hear my take on protecting yourself. This could save you thousands of dollars.

This was very useful information!! I was worried about my business logo being protected. You gave me a sense of comfort. Appreciate you keeping it real man.
Great video Adam, thanks for taking the time to sharing such amazing information with us. Yes, brand is very important to me, I’m very new to getting my music out there commercially though. I’ve been following you here on UA-cam and your content is amazing. 👊🏾
like i always say when your rambling (especially in a youtube video), as long as the info and message u tryna convey is genuine like you
Another great video man! Thank you again for all that you do and I’m definitely working on my branding. Not only am I working on my music, but would love to go into vocal acting as well! Thank you again my dude, much love!
Awesome stuff bro! Keep it up!!! Your stuff has helped my channel so much!
This seriously helped me clear my head. Thank you.
Hope I can take a good start building a music career soon.
I can't wait to start publishing my music.
Bro you couldn’t have said it any better then this. Thank you for putting it into prospective for me. From here on i will start to work with my logo/clothing brand. 🙏🏼🙏🏼🙏🏼
Great video. All very true and accurate except for one thing: you CAN file a trademark application before your brand is in use. You will need to start using it before it gets REGISTERED. But often you want to file an application BEFORE anyone has heard of you. Uber, Stripe, and many huge companies filed their first trademark applications before they even launched. Hope this helps.
This was very helpful thank you so much. I was hesitant to start my clothing line for children because I didn't want anyone to steal my name and logo. So now I will move forward in what I planned to do. Thank you so much for this video💜.
Really appreciate your help bro.. keep doing what you do we appreciate it :D
awesome glad to hear that validation that we don't need it right now, but it's something to do at the right time.
Really need this today and was exactly what I was looking for. Thanks bro 🙏🏽 just subscribed
Thanks, dude! I have a ONE brand that I'd like to trademark, and I was ready to start the process this morning going at it alone, but I'm glad I saw this first because the other video delved into the HOW TO, not so much the WHEN TO.
Yes! My brand mean a lot to me more then anything cause I had heart surgery and everything didn't go as planned so I believe and have faith my logo going to have strong meaning to many people
I cannot say enough how glad I was to research my new name to replace the prior name I had because I got a cease and desist. There was no way I was going to have to change my name again! The new name I thought up was proved by the trademark company, not to be available, so the next name we researched and it was available. Sure it cost more, but when I saw the hundreds of pages of research that was done, we knew we'd be able to keep the name.
I just starting my clothing line glad I watched this video very intrigued wasnt dull at all very informative! Thank you
I have a killer band name. The only problem that I seem to be hearing all around is that I can't trademark until I have a product to sell, and at this time the debut release is going to be delayed. I don't want anybody to steal the name, but I guess there's nothing I can do at this point.
Great Video! Really appreciate the info🔥💯🔥✨ I'm just starting out so grateful I found your channel
You caught my attention there are MANY ,MANY MANY people speaking the same exact thing your saying BUT for some reason you have a catchy voice so I will subscribe and follow and absorb your advice....thanks
Thanks man, Really Helpful. This decision has been holding me back from me releasing my music, I apprieciate it
Adam you are the man, keep being great & thank you for valuable information
you pretty much telling me to be patient about the bisiness part helps, thank you soo much
ive own my name for now going on 10 years every ten years you have to pay 425
Can you tell us about the benefits? Do you have to pay taxes on any income from the name?
What site do you recommend
Don't be foolish. You need to do the research too. There is much more than just paying the government fee. You could have an infringer. You may need to do a cease & desist, like I got.
@Un Bothered Google search: "denoting a legally enforceable order from a court or government agency directing someone to stop engaging in a particular activity.
"they received a cease-and-desist order for conducting unlicensed property management activities"
denoting a cautionary notice detailing the sender's complaint of alleged wrongdoing by the recipient and threatening legal action if the offending activity is not stopped.
noun: cease-and-desist letter; plural noun: cease-and-desist letters
"she sent a cease-and-desist letter last July urging them to stop using the name"
Headlock Remix ua-cam.com/video/QERB2qXwBcQ/v-deo.html
Thanks!!! Yea it's been something that I was worried about
I am a Latino musical artists! This is one of the most helpful videos that I seen you so I started making music since 2009! Thank you so much for the information 💪🏼
Great stuff Adam and delivery was amazing.
Great video Adam, but maybe you should've talk a little bit about pricing too? And also about how registering the trademarks work. You can register your name/logo in your own country, in Europe (EUIPO), separately in US (USPTO) or worldwide (WIPO). Now I'm not sure how much it costs in US, but here in Europe it's around 850 euros (and that's just filing for a trademark by yourself!). It's definitely something that has to be done by a trademark lawyer, you don't wanna make a tiny mistake and lose 850 euros...
Marvo, Establishing a trademark is MUCH MORE than the government filing fee. Your trademark needs to be legally clear too - in sound, appearance and meaning under trademark law. This is called a COMPREHENSIVE SEARCH and takes about 5 hours in the USA and 8 hours for an EUIPO. It includes common law research as well as established trademarks, as first use matters too. These firms have 6 years to oppose, cease and desist your product or service. See tmexpress.com for a free consultation - even if you already filed your mark last August.
I trademarked my logo myself it cost about 250bucks and covers you for 10yrs.
Potts Studios You have any tips on doing it?
@@pottsstudios how?
@@liljons6753got an answer?
That is some good info, thank you. I am starting up a t-shirt business and I wanted to know what was best. This takes my mind off of some other issues I am going through. Thanks again.
Thank you man, I’m dropping my first drum kit soon and this helped alot
you touched on good examples thank you , i am rebranding myself and i have found my logo and stage name. next is knowing how to move forward with it successfully.
My stage name is being stolen !! I’m filing for a trademark now ! Thanks for the video 💪🙏🙏🙏
damn this was super informative i was so confused thank you for clearing this up a bit and giving a much clearer perspective
This is something i been worried about, thanks bruh💯💯
Yo I actually bee thinking about this dope video!!! Helped me!
Thank you so much! You answered all my questions. I'm working on a brand/logo and artist name. I"m about to roll it out but wasn't sure if I should trademark it first. Small tidbit...I"m also from Orlando! Cheers!
Lots of common sense here. The added reality we see - entertainment and clothing are the 2 toughest classes to be legally clear in - based on trademark law whereas similar names do affect your legal use - in sound, appearance or meaning. Here's the link to the USPTO that talks about this need: www.uspto.gov/trademarks/basics/private_attorney.jsp. There is so much commercial activity in these 2 classes - clothing 1st, then entertainment 2nd. So, if legally clear, then keep going and file for the trademark. Clothing can wait for s o m e commercial success. Entertainment is especially essential to get right on the first day - heck before the first day. Otherwise back to the creative. Call us for a free consultation: www.tmexpress.com/. Chris
Thanks Adam, never knew you were in Orlando either! I have a few shows there soon would love to connect'
Luckily that is not going to be an issue for me anytime soon cause no one knows why I am yet. 😂 But great video as always man. Keep up the great work!
Hey Adam, love all the videos you put out and I learn a lot from everything you put out. I got a small band out in New York and we’re starting to gain some decent traction. When would it be the most crucial time to get both my band’s name and logo trademarked to protect us in the future? Keep pumping out the amazing and informative content and thank you!!
This was soo helpful cuz i do music and starting my clothing line the logo is my best friend that was murdered so it means the world to me 🙏🙏
My vision is valuable
My vision is full of purpose
I am already great
The world won’t be able to ignore . 🙏🏾

Thank you very much for the advice! ☺
I dint know you was Orlando local, there’s a whole lot of content creators in the city , English Spanish Portuguese we have it all . I’m learning a whole lot from your videos , I appreciate you taking you time to educate. It makes it more fascinating to me that you live in the same city as me.
We definitely have a ton of creators in this area!
Orlando, FL???
Thanks for a great video and topic. Thanks for the insights on branding and trademarks. Now to go watch that copyright video you mention at 1:50, but not seeing the link, perhap I overlooked it.
It was inspirational watching your video. Thanks for the info
Makes so much sense!
Very informative video thanks man!
I got a great logo.
I got a great team.
I got a great project.
Just studying the biz aspects of the music..then we launch!!
Very confident...its been more than 18 yrs of experience...Dancehall/reggae..Learning alot from your channel. Thanks for all this insight!!
You need to do the research too. There is much more to this than merely paying the government fee. You could be infringing, with your new name or logo. You need to research each before starting. I had to change my company name and it took 3 years to recover from the $230,000 drop in sales. You bet I did the research on the new name.
Catalyst.. I'm doing music in Jamaica too, Dancehall / Reggae on my label. If you want we could collab. Reply and let me know. 🇯🇲
Great video. Very educational and informative.
Very insightful thank you so much
Very good information Adam, you're always on point ! I def would protect my name label or artwork after adding money into marketing you never know who's watching to steal your ideas. The industry is cold and they are waiting for any oppertunity to take advantage.
Nice upload! Killed it!
Yes this helped me
Thanks for the insight
That was great information because I have a brand name also
thanks for the info!
I haven’t drop music yet but I’m gonna trademark my name
Same here. Go for it!
Useful information guy thank you
Thanks for this vid
I want to launch a podcast and I even have the logo. I created an LLC for it too. The trademark part is what I had questions about but this video put me at ease. Thank you!
Did you launch?
Thanks buddy!
Thanks for the advice. I was wondering if I should copyright my name after leaving a label and learning that everything that I ever created was not mine to claim. Now I am starting from scratch. Thankfully I am able to retain the use of my stage name
My Brand is important to me 🙏🏼
Thank you for information. It was very helpful. We are in Tampa. If you don't mind, may I ask the attorney you used for the trademark? I write lyrics and my husband does the production and everything else. We want to make sure we do everything correctly. 🙂 Thank you for all you do. I'm a new subscriber here (and my husband subscribed also) 👍 keep up the great work you're doing.
I know this is 2 years old but I just found u recently and all videos are so helpful. Is there any videos yet on someone whose been doing it more long term? What if ya been rolling with a logo and brand for like ten years but still havent trademarked ? Thanks for the vid either way 🙏
Thank you Adam, this video was very insightful. I didn’t see the copyright link in the description though. Can you show me how I can copyright my musical content?
thank you man
I finished eating chips and accidentally burped at the exact same time as you did in the video. I was like WHAT LOL.
Thanks for this Adam. I'm an upcoming producer and indie label owner here in Jamaica 🇯🇲, our industry out here is very loose and badly structured because of lack of education on these business processes. I appreciate you for this. Information like this is highly valuable and needed. Blessings 🙏🏽.
Please give us more insight.
P.S. can you do an in-depth video on publishing and copyright rights and royalty collections? Bless up!
Oh and to answer your question at the end of your video:
Ye I have a brand, a logo, and I'm trying to do some apparel for it.
He has videos on them I can bet
Hey Adam, thank you so much for all that you do. I really appreciate the help you provide us with. I'm sorry to bother you but I just have a couple of questions for you. This has a little bit to do with your video but not entirely. I am currently recording my own music and I am not completely sure as to what are the next steps after I am done recording my songs. I know that once they're finished I could copyright them in the government website. I can copyright either 1 song or a whole cd. After I do that.. I heard that I can sign up with companies like cdbaby (if I'm correct) and that way I can start getting some money from anyone listening to my songs or downloading them or things like that. (Again, I'm not 100% on this info, I'm sure you have a lot more experience on the subject than I do). Could you please tell me if I am correct or what info I am missing? Another question, right now I am just going by my own name but what if I wanted to change my name to an artist name... do I have to trademark that name before I copyright the songs or can the songs be modified to a different name after I already submitted all my information to the government website with my real name? Do I need to pay extra fees in order to do so? This may be a dumb question lol. What if I wanted to just continue to use my real name... should I trademark my name in the music business or something like that? I apologize for the long message. Thank you in advance for any help you send my way. God bless.
lmfao the burp.. thanks for the info!
excellent thanks
I enjoyed your teaching
Thanks!
Need to hear this😄..
Hey Adam!
I've been searching your channel for information about copyrighting songs, and whether or not to create an LLC prior to releasing music. Do you have any videos about this or any additional advice on this?
Thanks!
thank you
Thank you
Very helpful information
My fiance and I #ThrillzRadio (Thrillz Radio) were watching this and it incited is on bigger prospectives and angle thank you for pointing out that door that made us notice the others
#Subscribe
Had a chick basically cop my whole name and aesthetic. I wasnt taking music too seriously at the time but it's still kind of a kick in the nards because I was putting out music for 2 years prior. So now its time to rebrand and lock it down.
Thank rob iv learn so much from you man I'm from Houston Texas iv been building my brands from the time I left high school in 2000 I'd love you help
Thanks man!!! :D
Very helpful 👌🏾👌🏾
Thank you.
SO, i'm doing something and the name is highly important to me with the way it's spelled, particularly symbols. There's two variances I do. I plan to launch strictly digitally, specially given the pandemic, and build from there. I can't disclose too much more than that because it's one of those special projects. I feel like I'm saying too much as it is but I overthink things. I'm wondering if, since marketing will be involved, if I should trademark the name I'm doing, both spellings of it, to reassure I don't lose it, specially since someone uses the regular spelling of the stage name I have, even though inactive and across the world from me, nothing similar at all between us other than being artists. Thanks for the informative video.
Can you trademark a phrase like
"back that thing up" so no one else can use it
I’m pushing a business as well as music
Thanks for the info Adam Ivy.
I have a stage name and band name that I have built an identity and brand around. If someone were to swipe those, it would completly change the bands image. Should I still worry about not legally claiming them, until after I get bigger?
Your voice at 0:27 sounded like some crazy alien drum roll lmao
