Peterborough landlord dealing with "nightmare" tenant who stopped paying rent

  • One Peterborough landlord says she's at her wit's end while dealing with a "nightmare" tenant situation who stopped paying rent in Sept. 2023.
    Lorinda Seward attempted to remove her current tenant from their home, but the tenant quickly filed a stay of eviction.
    Since then, the house has allegedly been occupied by an unknown amount of strangers, which Seward says had made renting the second section of the house impossible.
    As they await to sit before the landlord-tenant board they look to the community for support. Tricia Mason has their story.

    So if i dont pay my mortgage 1 month bank will take my keys away and here we go no rent for 10month and no law?

      The bank will not take away your property for a month or two of nonpayment. Good communication with your bank can also have a positive result if you default for a month or two.

      @@s_hart For years the private sector has fought to keep housing stock low to inflate property value.... and now citizen scammers and just following the private sectors lead.
      This is the problem with normalized corporate corruption. It creates destabilization in the markets & rewards only a few.

Laws are created to respond to social immorality. Lots of social immorality going on with private developers.....

    Im an excellent tenant. Respectful, prompt to pay , quiet and i even garden. People like this make it so hard for people like me. Im on disability, its very hard.

      Ironic, when all levels of gov have failed to build proper housing to support our population growth, and private developers and landlords have been given the keys to the kingdom for over 40 yrs. It appears you support " the rules for thee but not for me" philosophy while our country has been robbed blind by corporate interest.

      Yes, it has turned a lot of people off in being a landlord. This is what is causing the housing crises.
      My Mom lives in a house close to the University, she won't rent out her basement suite because she doesn't want to go through the hassle of deadbeat tenants.

      A business decision was made not to build new housing for all the population growth for 40 yrs,
      Corporate interest (private developers) have lobbied the gov to keep it this way, but other corporate interest wants more immigration for business expansion.
      Our economic system has caused this problem, non of the economists take accountability. It's obvious Canadian citizens are being taken advantage of by corporate interest/ corruption.

If you don’t pay rent for 3 months cops should be able to sort it out or the landlord should be able to lock them out. Tenants should not have the right to get court order against landlord for eviction when they have not paid their rent.

      I am sorry that you chose to be a landlord & you took a risk, I am also sorry that other fellow landlords have created 0% housing crisis. While BLOCKING REZONING.
      They block a SOLUTION to the 0% rental vacancy, then complain when tenants hurt them back. Perhaps your narcissism prevents you from understanding the humanity in this.

The Tennant featured in this story not only refused to pay rent but also made the situation bad for the other unit to be rentable. That’s two houses lot of decent people would love too have and now this landlord is going to remove two units from rental market. In fact these Tennant should be exposed so that other landlords can avoid renting houses to these thieves.

    Ontario needs to start a official tenant registery where your name is listed with rental history like they do with credit at Equifax and Transunion. You print the report show a prospective landlord. The bad tenants will be revealed on this registry.

    As a former small scale Ontario landlord, here is my warning to people in Canada thinking about renting out a space in their house or buying a 2nd property: IT WILL BE ONE OF THE BIGGEST MISTAKES OF YOUR LIFE, DO NOT EVEN RENT A DOOGHOUSE TO A DOG IN THIS COUNTRY.....Rent theft is now legal in the country. At any time, your tenant(s) could simply chose to cease paying rent, then it will take you who knows how long to evict them. Then you have to pay contractors to fix your property. Dealing wth other people's mental illnessess, addictions like gambling-drugs-alchol etc will be your new existence. The current Ontario Government destroyed the current landlord board, but the ego of our failed Premier won't allow him to admit that laying the entire in person local housing tribunal staff to switch to online hearings only has sowed such chaos the system is crumbling. Find another way for a 2nd income...you have been warned.

The whole point is the plan 2030 where the government will own everything like in socialism and the peasants own nothing and will be happy!

      Sounds like you rented to whoever waved money at you first. Did you set any standards like renting only to someone employed for minimum 2 years, check background, references. Most landlords don't and that's where they get themselves in trouble renting to misfits of society

      @@s_hart Got manipulated by friend who I worked with for 15 yrs. But I met plenty of people in the industry like realtors & property managers who had similar issues. Generally, about 20% of tenants are bad tenants, maybe more. A realtor who did property management informed me at one point one third of his tenants were in arrears. I was very careful for years, made a mistake which I have to take blame for...I know a guy who had a great tenant; Government manager, clean, paid on time etc. Guy moves out on short notice. The landlord never checked the unit the day he left. The guy left his bi-polar girlfriend behind. She had been living there long enough to establish tenancy. Took him 2 yrs, and over 40,000 dollars to evict her. Renting is very dangerous in this country. It needs to be kept in the hands of deep pocketed companies with legal staff on hand.

      @@markdonaldson7934 well that's strictly the landlord's fault, they didn't do their due diligence by checking the unit when the tenant left. It's not right the bi-polar gf took over and perhaps there was a second key made without the tenants knowledge but at the end of it all it's the landlord's fault. No one likes to admit to f'ing up but people need to start taking accountability for their own decisions whether they thought it was a good idea at the time or not.

    This system only works when people cooperate. However people are more willing than ever before to take advantage of it. This real estate/housing system needs complete reform because people will not change and only seek to exploit it further.

    I don't really understand how someone can stop paying rent but still get to stay in their place. 10 months? What's the precedent? That's more than enough to get a job and save up for a new place. Who is this helping besides criminals/scammers?

      Agreed, however all levels of gov have failed to provide basic housing for all citizens, but expect tax to be paid. I fail to see the freedom in this country when the middle classes role is to service debt to make the rich richer.
      The social contract is broken & it's all political parties that have ensured this has happened.

      I think you are to the point. The consequence is too little for the perpetrators. If they could be sentenced to jail and left a criminal record, it would be much easier for small landlords to avoid them and leave the supply to decent people who would like a home.

      Landlords abused renters for years when the delay in complaints meant they didn't need to do repairs.
      Not all of them I'm sure but every landlord I had was pretty much just abusing my desperation and ignoring the things I was paying for. This was a big enough problem that canada is full of people like me.
      Landlords can chew on their bad investment. No one needs to care.

    What is our Landlord & Tenant Board doing regarding this ? I won't dare rent my house to renters cuz I don't want any stress on my part if renter stop paying rent. Since the law doesn't protect the small landlord, the more small landlord would be hesitant to sign in renter

      You know if a tentant destroys something significantly you can have a money order issues so they have to pay for the damages.
      Unless those damages are of course just normal wear and tear from using the house.

    As a T myself, I’m for landlords. If a T hasn’t paid 3 consecutive months then they should not have to have a hearing but should get a notice from the board to evict immediately. If the T has paid and the LL is lying then the T should provide the proof and the L get a hefty fine. If it is more complicated only then should a tribunal hearing be scheduled. Not every case needs a hearing. This is the reason it takes so long and the LL is out of pocket. Streamline the process better and be efficient about it!

    Landlord should hire a bouncer… Not legal? So was trespassing… Either way, will sort out by same tenancy board, but at least landlord collect rent while waiting, instead of squatter laughing in your face…

    I'm a renter, this sickens me. Makes it harder for me and my friends to find places. More than 1 month late on rent should equal automatic eviction, you had a month to get caught up or move out.
    It's a breach of contract at best, and more likely should also be looked at as theft, mischief, fraud, and public mischief for falsely or improperly filing a stay of eviction with the tenancy branch.
    ... and in this case, if it's true the original tenant is gone, the one who once HAD a lease... it's time for cops to throw out everyone else for trespassing.

      All levels of gov have failed to build adequate housing for the population.
      This is happened over 40 years... This story is a direct result of citizens not being provided the basics, but are expected to be machines to service the "free market", which depends on gov handouts to function.
      So isn't it ironic the corporate media (paid by corporate lobbyists) never seems to do investigations to find real solutions other than creating division & outrage in society.
      Folks struggling in life (psychologically) then become the villain in the story.
      If our society does not care about our minds & our bodies, why are we concerned with capital interest?
      It's a legit question that deserves to be answered meaningfully.

      I'm from BC, and we have different rules that I think Ontario should look into:
      1. Here, one can only withhold rent with prior approval from the residential tenancy branch.
      2. We have rent control province-wide that caps the increases pegged against inflation, and only one increase is permitted per 12 months, to get an increase above the guideline, there are much higher thresholds for evidence the landlord needs to show.
      3. Our wait times for hearings are much less. Yes, they are still too long, but when I had an issue with a landlord attempting a renoviction, and dragging their feet on repairs they'd started after they did the initial demolition inside of my unit, it was resolved within a month, after waiting a couple weeks for a hearing.

      I lived in Yaletown, and I observed all the "wonderful" personalities Vancouver has attracted with all the money laundering.

    Change the lock!
    She, or her husband made duplicates of the key to give to other people, so if the lock is changed then the key will not work therefore NOBODY can enter except, for the home owner. If a stranger is in the home right now then that is considered as breaking, and entering, and what I said should be illegal, so remove the person then CHANGE THE LOCK IMMEDIATLY!!!

      Another reason to get rid of ford the next election
      He drastically cut back staffing leaving tenants and landlords in a mess
      Landlords are now leaving units empty or screening out tenants with low paying jobs
      Tenants with low incomes know they are facing deacrimination in housing because if these situations
      It's hurting everyone
      It also makes neighbourhoods less safe
      Tenants are now subletting and over crowding rental units and landlords can't get them out
      There is no clear process for eviction of these guests

    A number of years ago I was talking to a landlord that owned multiple properties and the issue of these problem tenants came up. He said any landlord that knows what they are doing always visits their property during a rent dispute with two large, well muscled friends with them.

    neighbor rented his house out got first and last months and nothing for 2 years he ended up having to pay the delinquent tenant $10000 cash to move out so he could sell the property before he lost it to the bank ...I would never rent in todays Canada

    If the legal tenant has moved out, doesn't that make the others trespassers? Shouldn't the police be able to remove them for that reason?

    The tenant has left, so how is it possible that these other unknown people are occupying the premises? The lease has been broken, (tenant having left) are any of these other people's names on the lease? If no, they are trespassing, change the locks and don't allow them entry. Pay to have their possessions put in storage for 30 days, if they don't pay for them after that let the storage company deal with that and I assure you they will.

      Have a reliable friend sign the lease to rent. And then move them in. Show police the signed agreement....the other has to leave....simple as that!

    This is a double edged sword. You have tenants who don't pay and you have bad landlords who want to evict tenants just to bring in more tenants who will pay the current "market rate". I had a landlord with whom I had a great relationship. I kept the place immaculate and always paid on time. I had been there nine years. He wanted more money and used the "I'm moving in" excuse and wanted me to leave on New Years Eve, over the Christmas Holiday. He was Muslim so did not celebrate and I have two children who do. I took him to the Landlord Tenant Board and managed to get an extension to April (only because the hearing was set for March) but all he had to claim was he is moving in. During this time I kept paying rent. I had to move out but kept an eye on him as I had friends in this building. He had a sister move in and rented out after the first year was up. While at the LTB hearing, EVERY case before me was scammer tenant who did not pay their rent for months. There were no evictions handed out. The judge just had them promise to pay and they were let off.

    If tenant was visually seen moving out with uhaul and belongings then the tenant friends are trespassing. Simple as that.
    Turn off the water. Turn off the power. Take the door off and get them out. Take matters into your own hands.

    The Ford Government and LTB is encouraging and supporting tenants like this and the so called housing crisis will never be solved. Being a small landlord in Ontario is the biggest mistake I‘ve ever made in my life.

    "She doesn't live here anymore" . Change the locks and take possession, am I missing something here? I only rent to family and that isn't always as smooth as you may think.

      right now the "tenants" have more rights than she does. She can be criminally charged if taking back possession of her own property at this point. Squatters like this figure out the game pretty quick. Watch a few youtube videos, talk to other squatters, figure out exactly how to phrase the legal (garbage) paperwork, and take advantage of the up to a year and half backlog

      To add I lost in the amount of 35 thousand in total and I still have to pay land taxes and heat the water and hydro and gas and mortgage and repair all the damages too it not funny anymore the government failing the small landlord's for that matter all landlord's one piece advice don't sign a lease rent you home as rooms. If they don't pay kick there but out after the first month missed.

    8000 condos for sale in the GTA right now. Investors (landlords) will not buy them as cash flows will be negative, or even with no mortgage especially since the regs/law is skewed heavily towards renters or non-paying renters!

    It is even worse in BC the RTB is 100% on tenants side. I had tenants who stopped paying rent for over 3 months, I did all the proper steps to serve them papers etc on time with the right process, it led to a hearing with the RTB, where all they did was talk to the mediator about their 6 month old "new born" for 20 minutes. We only had 30 minutes and lots of ground to cover in the hearing, to which they had arrived 10 minutes late. When I politely interupted, due to being at work and having booked only an hout off, and asked if we could tend to the matter at hand, the mediator said she didnt like my tone and found for the tenants and I had to pay them another $3,600. This coupled with the $12k in damages they did moving out left me broke. In BC you cant even appeal. I thought the mediator would be a law student or something but later found out they are just people who go down to he Hire Canada job board. Zero qualifications. The only peace of mind I had was that these people named their kid Seven or Sleven or something stoopid like that. When he grows up it will be my justice...LoL

      @@kanwalinjapan from what I understood at the time is that you cannot appeal the decision with the RTB. You could write the Director a letter but all he might do is review the case, but not even communicate with you his/her findings, and they definitely would not over rule or change the ruling, no matter how wrong it was. This was 12 years ago. I have since heard of a case where the landlord appealed to the BC Supreme Court, but this took 5 or 6 years and about a $100k in costs. I have also in one case been the tenant in the RTB hearing and the mediator didn't even give the landlord a chance to speak, and was rude to him. I felt embarrassed for the landlord. All I can tell you is that the RTB in BC is very lopsided and 100% on the side of the tenant. It is what made me not want to rent anymore - way too dangerous. If you get the wrong tenant in your suite it could cause you to default on your mortgage or go bankrupt. If the tenant damages the property and you have to get contractors in to do a repair, you are in a whole other world of pain, especially if you also have to deal with a strata council that has "approved" contractors, then you can expect to pay 3 times more on top of the 3 times more the trades people in BC already charge. We had a roofing company quote $250,000 to what amounted to replacing about 6 shingles and running some sealant on our roof. It is crazy.

    Meanwhile when I rented my apt on Don Mills and Lawrence yrs ago the owner/landlord was also lawyer and they had a 7 ft goon that accompanied him to talk to negligent renters in the building and they would "convince" the tenant to move out by the end of the month and they would owe nothing if they did so. Never saw a cop called on them or any backlash. Try that as a homeowner, 8-12 months should be a crime and put on a list everyone can access online for deadbeats.

    There is way more to this story that Mrs Seward is not saying. A person can’t live in a place when locks where changed. The rent payment was offered and refused by Mrs Seward. There was vital services cut off to force people out, there was thief of personal things, even when there was a order from the LTB. There was a request of review, if the LTB felt there is no reason for this review they would have never made it. Then here we are yet again the same thing is happening with the locks. The tenant has been doing things right by going to the LTB, the only thing wrong is the rent. This is less then half of the things that Mrs Seward has done.

    Anyone wondering why people are leaving Canada and not wanting to move to Canada.. This is why as small businesses like being landlord is not supported by the government or welcome even. Loosing 16 months of rent is no joke.. Not to mention the high rate of vehicle theft.. Ontario has being ruined.Rules should be simple no rent paid instant eviction authorization to police, the tenant can go to court later if they think it was ok to not pay rent on time.Try doing that to your phone provider they will cut off your line instantly for failure to pay monthly bill. The politicians and leaders should be ashamed of themselves who are in charge of the provinces well being..

    So, the tenant moved out, no longer responsible to pay rent since the date of moving out. Whoever is inside, are not tenants and that is the issue, not the previous tenant with exception of any months she didn’t pay while living there.

    You all think this is news? I had tenants who wanted to THROW ME OUT OF THE HOUSE!!! This country is freak'n strange!! They wanted the entire house so I billed them them down payment amount of $70K, then moving forward, I would bill them the MONTHLY MORTGAGE AMOUNT, ALL THE TAXES, ALL THE BILLS and ALL THE UPKEEP. That shut them up for a month or two, then of course came the "boot" to the "head" and an eviction notice.

    Just change the locks. Take possession of the place if you need to. I don't see any legal barriers to rent to another occupant. Take your losses and move on. This homeowner is lucky the former tenant moved out instead of squatting.
    What she can do is lower the rent substantially and then raise it to market rate as part of a legal housing contract once she gets the place fixed up. I understand that will be a big leap of faith, but it she rents it to somebody she knows and trusts it will be for the better.
    Otherwise, she will have to fix the place in order to command market rent. Unfortunately this stuff happens to both sides! Hopefully she will find a respectful and responsible renter.

    If they just made it a chargeable offence to withhold rent like this, or even better automatic evictions after 90 days, then these problems wouldn’t happen, landlords would be way more likely to rent out to people instead of having such strict testing, overall just much better, also this whole civil matter/LTB needs to be abolished, it is a single reason why this system has spiralled out of control, landlords should be able to use the police to evict people

    In UK right weeks in arrears is a reasonable excuse for eviction. Tenancy Agreements are rarely read by tenants. They should have it read to them before occupation and asked to sign to the Agreement which illustrates they comprehend the two-way contract. A contract is a legal document. It's there for both sides to take issue in line with the signed Agreement. Simple.

    Keep your title handy to prove you are the owner…stop paying all utilities if you are. Open the door with a locksmith, and turn it into a sports bar…organize all big strong teams ready to come with you to party day and night or your seedy friends to party and play loud music day and night…eventually the 3/p leaves. You may want to supply a few beverages. Be ready to change locks when they uninvited start leaving. Check getting rid of non paying tenants in US.

    Canadian laws presently allow tenants to not pay rent, trash the property, refuse to leave, even have the police called on you. BUT if the landlord physically tries to remove you, enters the house and changes the locks or throws all your belonging to the curb, the landlord will face criminal charges. Landlords are left to depend on a broken LTB to rectify the situation before the bank forecloses. Then you will see how quickly squatters are physically removed from a foreclosure.
    Bright side, Trudeau will spend billions and billions *if* he gets re-elected to not only bankrupt Canadians, but to fund committees to look at ways to meet housing build targets. Like the billions he spent already that has lead to ZERO homes and according to his housing minister, it was never meant to actually fund home builds...
