      No one in North America accepts that the landlord knocks on his door and asks him to leave. The landlord must follow the legal procedure. If the landlord has the right to repossess the home, he may have to pay compensation to cover the expenses of the move. But in most of the cases, the real reason is to replace the tenant with a tenant as a result of the rise in rents, inflation and the housing crisis during the past two years.

And if you had seen the post and/or heard what is said in the video, you should see that I am following the law... I am going through the LTB. My bigger complain is not the tenant, but the LTB. If you still don't understand what the news clip is about, kindly stay quite.

    This behaviour doesn’t just hurt landlords, it hurts other tenants as well. This is the main reason that so many landlords now ask for 4, 5 even 6 months worth of rent up front!

      Unfortunately, the problem is not bad tenants or landlords. There will always be ones. The problem is that the authorities let it happen and do little to resolve it quickly enough to not affect both groups. That is why both groups are trying to protect themselves from situations like this to happen. But it is a landlord market now, so they get to choose.

    Any tenant who fails to pay their rent and continues to occupy should be immediately evicted and arrested by the police for theft/trespass. It's no different from overstaying in a hotel and not paying.

      @@katnisseverdeen4ever please help me understand the difference. Either way, someone gets something for nothing, and someone else bears the cost without having consented to do so. I fully appreciate the necessity of shelter, but that does not entitle anyone to force others to pay its price. If a landlord could rent a suite for $2,000/month, and you refuse to leave and refuse to pay, you ARE stealing $2,000/month from the landlord. It may not look like that because there is no physical exchange of goods or cash, but that doesn't alter the reality.

      @@mikeybohunicky2696 The flaw (logical and legal) in the "opportunity cost" argument is the failure to recognize that the only one who gets to decide whether or not to incur an opportunity cost is the one with the opportunity. No one else has any right to impose any decision one way or another (which is what the squatters are doing).
      A lot of people seem to think that if a choice in their favour exists, no other choice is legitimate or acceptable. This lack of understanding and respect for others is the source of a great deal of unnecessary conflict and animosity. It's a misappropriation of power/authority (basically, it's behaving either like a spoiled brat or bully).

    When you don’t pay rent for a long time and are ultimately evicted it should literally be next to impossible to rent anywhere else. Maybe then people will be more cautious and stop taking advantage of homeowners. This has gotten completely out of hand. I feel so bad for these owners.

      I think it should be an arrest offense and become the problem of the police and courts with in 30 days of missed rent as it's a-kin to theft and the offenders have two options; Option 1 - should include jail time with immediate eviction. Children to foster care. Option 2 - Government hotel that requires community service to pay "rent".

      It's absolutely criminal for owner thinking they can put the mortgage and property tax and get extra back out of renters that's the whole problem to begin with this is the end result of that so no compassion from Me I've been saveing up for a house since 2008 only for it to be always out of reach but the housing market will crash eventually with these unsustainable prices

      So what happens if all landlords stop renting out their properties. Will it help you buy a house? No. Will it help people find a place to live by renting it? No, quite the opposite, in fact. It is supply and demand. If you feel it is unfair for you to pay someone else's mortgage, you are welcome not to. You see, it is your choice after all.
      The reason behind why they rented their property out should not be justification for illegal actions towards them.
      I wish you to find your own place someday, though.

Why do you think they did not follow the right procedure?? It is really appalling when someone does not hide his intention to break the law then thinks he is right?

The response was to the person who literally said that he had no sympathy for the landlord who WAS trying to do it legally, and whose tenants were definitely abusing the system. There are bad landlords and bad tenants. The problem here is that both exploit loopholes in the law, in this case the loophole is caused by the government not being able (not willing?) to resolve these cases in a timely manner.

    Unfortunate - but true. This has happened to me! Sad part is that the authorities and the public representatives have their eyes and ears closed. Not all tenants are bad tenants, but there is a growing number of such rotten apples that are using the LTB delays to their (unfair) advantage. I believe in law, but "Justice Delayed is Justice Denied". Even if the LTB gets the tenants evicted in a year or so, could LTB ever compensate me, my family, and many more other such families like ours, for all the financial, physical and emotional stress we go through.
    I may be right, or wrong. Similarly the tenant might be right, or wrong. I am not asking LTB for favors. I am asking for my right to get a hearing. And why should I, or anybody else for that matter, should suffer for the inefficiency of LTB???

    I have a solution. usually the electrical, hot water, water, and heating system is in the basement. shut off all utilities to the main floor. and when they get upset and say they are going to file with the rental tenancy board, laugh in their face as they did you.

      The LTB will side with the tenants. Regardless of how frustrating it is, you cannot shut off tenant's utilities. Likely they would issue for tenants to pay the backlog of rent but also reprimand the landlord and make them pay fees for not providing a vital service.

    I was a victim as well. My tenant refused to rent and getting them evicted was so difficult. After we won the case, they still will not move. We eventually had to call a baliff “and” had to hire people to move their stuff out. Ot was a long dragged out process which was extremely expensive. The laws are not out to protect home owners. We can’t go to out bank and say sorry my tenants won’t pay so can we get an extension on our mortgage???? The banks will laugh in our face!!! There are many struggles and sacrifices made to be a home owner that, unfortunately, people don’t talk about.

      May I ask if the LTB requires the tenants to pay all the overdue rent and any other costs associated with them not moving out (for example, the cost for you to stay at an Airbnb or hotel in the meantime, costs to move them out, lawyers, etc) and if they still don't pay, what happens then? Please share as much info as you are comfortable to. TIA

      My tenant was a doctor. I screened their income and credit worthiness etc. They took 12 months to leave and eventually they claimed that they suffered damage. Screening tenants can only do so much even if they make $150,000 a year, they might still end up in LTB. Landlords have no protection from my own experience !

      @@LinhNguyen-gr2wb The LTB ask the tenant to pay the rent owing not the legal cost. The tenant shows they have elderly or kids dependent on them and can’t pay. LTB tells landlord that evicted tenant cannot pay and best of luck for next tenant.

      Homeowners have no protection at all. It is completely favoured towards the tenants. LTB should be scrapped and homeowners should be allowed to evict whoever they want.

    Amazing how these people get places to rent. I've been denied 50 times in 2 years because I'm with a PTSD service dog. No bark, not dirty, super clean, I'm a veteran, and I actually invest time and money into my places I live because I care. Never miss a rent payment in 30 years. lol. We need to fix our broken society before it gets worse.

      If you are trying to rent in Ontario, they cannot deny you for a service dog or even just a pet. You don't have to mention the dog whatsoever, and after you move they can't make you get rid of your dog.

      Fair housing laws do not allow landlords to discriminate against you because of a service dog (At least here in Texas) . I have rentals in Houston if you need a place. Good luck

      I never tell them that I have a pet. Don’t disclose it. They see you with one once your in, that’s not your problem. Legally they can’t ask you this question anyways, so don’t tell them what they shouldn’t be asking you.

    There’s only 1 way out of these situations. Initiate renovations, with all necessary notice, and with and a suggestion to leave site for comfort purposes. They wont comply. Then on construction day, immediately remove all the doors and windows, and claim a mixup on delivery, delaying re install. Then claim damaged on delivery. Then claim missing items that differ from packing slips. Then claim completely wrong window sizes. Then claim new material back order problems. This can go on for weeks. No one will stay. Unfortunately, you’ve had to incur damages and monetary loss. Possibly a bit more to get them out. But they will leave.

      Most jurisdictions prevent that type of practice of “constructive eviction” without the courts permission. Although clever advice, in certain if not most localities in america, whoever does that would potentially face charges. I would imagine the same in Canada

    This is what happens when you have a flawed system with no mechanisms of deterrent in place, either in the form of criminal charges, judicial penalties, or guaranteed prison sentences, for this kind of willful abuse on the part of corrupt tenants.
    Unless and until federal legislation is introduced that would see tenants face the threat of real legal consequences for this kind of rent-free "squatting", this kind of abuse will only continue.

      I don't think it is Federal legislation that is needed, the problem is probably more Provincially and Municipally. Each Province and Municipality has a different need in terms of Rental space. However 4 - 8 months of non payment of rent is ridicules to kick out anyone. I would say if it is a simple non payment issue then the tenant should be removed at longest 30 days. Even then that is a bit much.

      I’ll explain. Short term tenants fall under inkeepers act. This act allows me to legally kick out any guest for any reason.
      Traditional long term tenants fall under the landlord and tenant act which essentially favours the tenant since you need to file paperwork and wait for a hearing to evict. This process overwhelming favours scumbag tenants.

    This is why I, my elderly Aunt, my elderly mother and my brother all stopped renting rooms or houses -- we all were 'screwed over' by deadbeat tenants. Then people complain there aren't enough rental properties available. Landlords have bills to pay but the laws tilt way, way too far in the deadbeats favor.

      It must be stressful and I can understand it. However, I am sure he wasn't crying when he was receiving the rental income and could afford to go out of the country. His mortgage was being subsidized and he took a risk. I have a friend who experienced someone not paying and it has cost them to get a bailiff. However, the years that they received income has been very beneficial to the wealth they have accumulated.

      @@jawadshuaib I am not saying it is right what these people are doing to this family. However, this homeowner is relying on this income to supplement his mortgage and lifestyle choices. There are risks to investments and this is one of them. My friend experienced the same situation and they handled it legally and professionally. They will write this loss off of their investment property. It will be happening more and more as housing becomes more expensive and scarce.

      @@cavelleardiel that is a fair point. However, the crime here is not greed but rather the failure on the part of the regulators. If we don't raise our voice against injustice, then it will simply continue. Every investment carries risk - but this particular risk can be avoided with laws that are both fair and enforced; this would ultimately benefit the tenants themselves as rents will be reduced only if the investment risk is also reduced.

    This is disgusting! Send out a renovation notice for 2 weeks. Then start removing the windows. Make it uncomfortable for the tenants.

    I’ve rented 2 of my properties with 3 tenants in total
    All with legal contract and credit check background check and reference check
    They all pay on time. So for past several years no issues
    I feel for people with bad Tenants
    Please please do your due diligence when choosing tenants 😊

      I have 2 myself, student rentals though. I can't express this enough. Do your due diligence. Ive had amazing tenant's over the years. The secret is to treat them like family when they ask for assistance. Always be proactive with the property. (Pay the money for landscaping and snow removal) it's just a small amount and it goes a long way. Leave the odd $2 - $3 garbage tag. Trust me, it's the little things

    Tenants are taking advantage of the long waits lists for a hearings at the Ontario Landlord Tenant Board (9-22 months in Ottawa). Tenants not paying rent all this time because they know nothing landlord can do to evict them but wait 9-12 months for a hearing at the Landlord/Tenant Board. Ppl that own the property having to let ppl live in their own home rent free for for all that time is insane & criminal. Tenants that receive social assistance are collecting shelter costs from government assistance while not paying any rent. So it's their landlords (often small landlords) footing the bill in the tens of thousands and all tax payers footing the bill for the shelter portion they collect from social assistance that the delinquent tenants are just pocketing. People are going to start taking matters into their own hands cuz they can't wait a year for a eviction hearing hearing.

    The more they document this and post videos and articles on it, people repost on social media, there will be more and more of these "professional tenants" that know they can totally take advantage of landlords and have provincial regulations/bylaws and a whole tenancy board protecting and encouraging this behaviour. Amazing isn't it!

      @@CrooKdLetterJ there just needs better laws in place for both sides. If I don't pay my mortgage, I get foreclosed. If a tenant doesn't pay, then you have provincial regulations and a tenancy board backing up a tenant. My tenant is behind $8500 and counting while I wait to hear from the tenancy board. I gave her a lot of compassion as she has two kids, didn't want to kid them out to the street initially, worked out a plan, and ultimately, she gives me back the middle finger back. On my rentals, I never increase rent, I allow pets but I think I'm done. It's almost criminal how tenants treat me back, I wish I can send you photos. I wanted to be a fair landlord from day 1, but at this point, I'm done. I'm a nobody, I'm one small landlord that is going to be out of the market and that'll give room for a bad one to enter. And no, we barely get cashflow, sometimes rent doesn't even cover the mortgage. But anyway, be nice if everyone treated everyone with the respect they deserve

    i know a couple people this happened to and they eventually just sold the house. How are the home owners suppose to pay the electricity and water for both themselves and the tenants if they don't pay their share. My uncle had to unfortunately sell his properties just so he can be rid of the problem. These tenants are shameless and should be kicked out. This system is awful and the government needs to be held accountable, this cannot continue to go on.

      100% horrible . But your uncle is no saint . Owning more than one property to create wealth is apart of the problem as well. Homes are to live in and should not become a way to become rich like so many people in Ontario have done and ultimately screwed the housing / rental market. Thievery is just as bad as greed.     if someone doesn't pay the rent, it should be considered transpass and should be treated as such. As they transpass on someone's private property without agreement from the owner. Maybe it's time for people to group together and start a class action against the government for the major delay and their loss during that period of time. Especially when the government already announced they will handled rent increase cases first to favor major corporations landlords. Private citizens are getting ignored by the government if no action is taken...

    Not to sound cynical or too inhuman here, but if there are such long backlogs at the landlord and tenant board, I think it’s justified that small landlords take the law into their own hands in some cases. Hire some security, kick the tenants out, and tell them to apply to the board to have their case heard. Knowing how long it will take to have their case heard, I’m sure that some of these problem tenants would move on. At any rate, stories like these are not going to help the rental supply.

      Hire someone to watch the place and when the deadbeat tenant and family go out of the house, immediately haul their stuff away and change all the locks. Then hire a crew to stage the house to look like you're renovating and when the deadbeat tenant returns and calls the cops, play dumb and act like you don't know them. Cops will tell said deadbeat tenant it's a civil matter and file a complaint with the court. 🤣🤣🤣🤣🤣

    It's heartbreaking and tragic. So many families are working hard and suffering. Their lives and their children's formative years turning into stressful years. And why because they worked hard, owned house, abided laws to have a safe life and home for their kids and themselves, only to fall trap into the injustice of the system. It's really time for change of such laws and government need to take action to compensate for the loss of their money, time , and mental torture.

    I have a great tenant. I am fortunate. Some of my friends, no so much. The Tenancy Branch in BC is one sided. Disgusting what goes on. And they wonder why there are less rental properties.

    being a landlord in Canada is like throwing money out the window, if you tenants dont pay, average wait time for a hearing is over two years. Most delinquent tenants usually disappear after they live in your property for free for two years and you have no way to find them. its just too easy not to pay rent and walk away, i really dont know why some renters are paying their rents..this is why fewer and fewer people want to be landlords which makes the rent go up for honest law abiding tenants.

      even if you get a judgment. they just won't pay that. (my parents tried to have a few rentals at the end of 80s/early 90s - out of 3 rentals 2 of them didn't pay simultaneously and my parents narrowly avoided being able to keep the house we lived in).
      I know some of the tenants are in a position they can't control - like losing their job. in the current market people are in a position where they have very little savings to help them if a situation like this happens.
      given this : i too wonder like the above poster: why isn't there an epidemic of renters who just stop paying? (its very tempting. especially when you consider that would give you the means to afford a better life - like saving up for a downpayment on a house. or getting another car. )

    This is partially a result of Canada's housing crisis. The government says there's a housing shortage but is still targeting record high immigration. Expect more of these problems.

    There should be some kind of registry for people who were evicted due to nonpayment of rent so prospective landlords won't rent to them. Scammers should be exposed. They should only be removed from the list after they have paid money owed in full.

      They were trusted to enter and then scammed. It seems the local authority would physically remove them from the house but it doesn't always happen as that, that easy. It should be attempted, and if it didn't occur, there might be some movers, a moving company that comes in, loads up the stuff and takes it to a storage unit or to a friend of theirs and drops it off there, a change of locks and an advance notification to them before they get to the house while they are at work or elsewhere that they need to go to their friends house, to get their belongings as they have been moved and no longer reside there. It is possible to work through it without being rude or inappropriate when it is. If it isn't, that's criminal. Hopefully it works out, the family can have a happy home. 🏠

      @@dumpsterfire295 If you are in a rental agreement with another individual the proper process should be followed to break the agreement if it is broken or the terms are violated. If there is sufficient notice given, it is clear to the point of obvious, there are things that can be done without legal consequence. It would seem as though the best thing to do is to have the tenant move their own belongings yet that is not always possible. If the landlord moved their stuff to the basement or moved it to their friends house they might try to argue burglary but they are not standing on secure foundation, as they haven't paid the rent, so much so, the camera crew evidence supports the delinquency. It would seem any court, will understand. Typically the authority will allow an eviction, but it's not always so easy to say that or to have it happen.

Thereby it is secure for everyone involved. It is a process though and it can be frustrating, from what I've heard in other experiences.

    Cut off the utilities! Start renovations. Change the LOCKS.! Put EVERYTHING INTO A Locked STORAGE CONTAINER. ( if they want their possessions, you have leverage to negotiate. ) & They won't get anything out of sueing you. Fight fire with fire! The law is not protecting people anymore.

    Is there an insurance product that will protect landlords in this situation? Can the renter be required to purchase an insurance contract up front, payable to the landlord in the event of default? That shifts the financial risk to an insurance company whose entire purpose is to manage that risk.

      I'm a landlord and I always use the official Ontario contract, I make sure our leases are 100% legal. There is a section near the end where it gives the tenant an option to opt in or out for standard home insurance, but there's no insurance on the contract related to defaulting payments. I'm not even sure who would offer that kid of service, maybe that should be looked into?!

      @@JCooK2007 some insurance companies have default rent payment combined on their personal insurance products. So if someone gets sick or looses their job, there is $$ to help them pay rent. But most people who are responsible enough to pay for personal life and critical illness insurance, get their money right in the first place.

    It's important to do a through background check before renting out your rental property or sublease your home to anybody. While it's sad to see this homeowner going through the hoops to get his non-paying tenant evicted, the story doesn't tell us if he did a background check (credit/eviction/criminal) on the non-paying tenant. The laws should change in favor of the homeowner if the tenant illegally lives in the rental property or subleased property.

      A "good" tenant, especially if that tenant is experienced and rents for most of his/her life, will know how the system works and be able to exploit it. They can turn into a bad tenant real quick. And references can be faked.
      It's best just to hold onto your houses and keep them empty. Those tenants can deal with the high rents and lack of available housing. 🤷‍♂️

In the US, you need a tenant with good credit score of 625 and above with monthly income three times the monthly rent, and no criminal, bankruptcy, and eviction records. The background report will help make in decision-making. You can also check with the previous landlord of the prospective tenant to see how he behaved with them from the standpoint of maintenance requests, etc.

      I used to have something called an AR that fixed tenant issues very quickly. Just knowing it was in the truck solved one issue.

      No this is not insane. The police cannot be a judge. They can only enforce the law. The police cannot kick somebody out without a court order. The problem is not with the police the problem is with the Ontario government who is underfunding the court system and the residential l tenancy board

    How come a bank can evict a person from their home if they don't pay 3 months of their mortgage, but this is allowed to happen?

      The bank can do that cause you are technically owning the home on borrowed money. Anytime you take a mortgage it's a loan from the bank and that is why they assess your homes value, in case they need to foreclose you and resale. It's harder as a landlord because the tenant isn't really borrowing money from you. The landlord is the one holding the liability (which is a mortgage).

    baffles me how many people side with tenants who refuse to pay their rent. how is it any different then stealing? if you go buy a new car and decide 6 months into a 5 year car loan your just gonna stop paying it, you can be sure the tow company will show up and take it away from you. how do people think you can stop paying your agreed and signed in contract rent and just stay there for nothing. if i stop paying my mortgage they will foreclose the home am i right? or have i been missing something all my life, wish i knew i could refuse to pay my bills years ago while still keeping all of my stuff with no consequences ide probably have joined in. the system has failed and once the tenant stops paying it should no longer be a civil manor and become a criminal manor where the police can force them out, not wait nearly a year for some tribunal board to do it while your stuck living in your car. It's a miracle nobody has been very seriously injured or worst trying to get away with this stuff i can't imagine the rage these people must feel losing everything you worked for while some stranger takes advantage of you.

    A former tenant whom I treated with nothing but respect and did everything by the book to ensure their rights, ended up threatening to sue me for a bunch of things I never did. Failing that he seems hell bent on trying to defame me on social media and spreading my information online. I can't tell if he's has mental issues or this was his attempt to extort me. He left on his own, but now I am traumatized and I refuse to rent out my place ever again. The media seemed to be out to get landlords for a long time and I'm glad there's some coverage of how awful some tenants can be.

    😮 I had no idea you could get away with this!!! That’s crazy. I think I’d be shitting bricks if I was in their shoes and couldn’t afford my next months rent!!! (Just one months rent and here they are WAY behind!). I’d be terrified of just getting an eviction notice and then thinking OMG I’m going to be out in the streets! 🤯😳 These people seem to KNOW just what they’re doing!!! I think these kinds of people should be fined or jailed. It’s like stealing! It is stealing. 💯🙌

      I think the tenants are "professionals" at it at this point. Actions like this can absolutely devastate the tenant's credit score.
      Don't do this unless you don't plan on staying in Canada long term.

    There should be a law that states if you reach X months in arrears on your rent then it’s an automatic eviction. Not that even that will do anything; a neighbour was evicted for harassing his landlord and other tenants, being violent, threatening other tenants etc. but he hasn’t left the building almost 5 months later STILL because the cops won’t enforce the eviction.

      Cops can't inforce civil stuff, this kind of things or family matter come under civil. This person can use paid Sheriff to put these people out and their stuff on the street and when violence get involved police will, sheriff are special constable and sworn officers of the court

    And this why you have a rental housing problem. As a landlord for over 30 years recommend never rent and get out. It is now august 2024. Legalization of marijuana and 67% capital gains reporting anything over 250,000. First 250,000 50%. No in person court cases which is worse, judge does not get to see bad tenants in person and can judge their character. Also, can't get back rentals for grandchildren or non immediate family who are not your spouse or children. Don't think you can pass your rental property to family. Etc.

    It's really sad to see. In my country, some landlords take laws into their hands by removing parts of the roof to force the tenants out.

    This happened to my friend here in Abbotsford BC. Tenant didn’t pay rent for 5 months knowing eviction notice will take time. Then tenant suddenly decided to leave and with no known address, notice to recover money is hard to serve.
    And then ppl wonder why it’s difficult to find place on rent. Because of this kind of behaviour.

    It happen to a home owner in lawless michigan this year too, who rented out a house on a lake just for the summer to some crazy folks who stopped paying rent.. 5 times he had to go to court to get them out 😯

    No way . Go upstairs in YOUR house and remove every single door upstairs including the front and bring all your family members, friends to constantly be upstairs. Take the doors off the hinges.. Start putting trash everywhere upstairs. Do NOT let them be comfortable in your own home. Get your family and friends to help you. Keep your own family downstairs safe until then but since the courts won't do crap you do it. You have to find family members and friends that are willing to help you for a long time by moving in and sleeping in the rooms , etc until these INTRUDERS get sick and tired. Board up all the windows upstairs if you have to. Play loud music upstairs loud enough it won't wake your kids up down in basement. Unbelievable

    These stories make me so upset. I'm all for protections for tenants from bad landlords but this is just not fair... there has to be balance in this. I'm no expert and do not know the solution but these stories are heart breaking.

    Who wants to be a landlord ? No backup, nobody really cares if you have a bad tenant. Yet if you can't pay your mortgage, or your property, water, and income taxes, you'll get a very quick response !

      Refusal to leave almost never happens. It’s incredibly rare. If it happens, I’ll call the police and have them remove them. At that point , they are trespassing

    It happened to us during pandemic.. the tenant lived free from January 2020 until she got evicted in May 2021.. it took us 6 months to get court date.. and we can’t collect the payment, the house was left broken, filthy and full of junks..
    the law is definitely broken…

      It's not their job to understand who is right or who is wrong. Unless there is a decision from LTD, they will not do anything

    Total eviction time from start to finish is about 1 month which includes the 10 day notice to quit here in northeastern Pennsylvania, Philadelphia can take 3 months or more, it depends on your location in Pennsylvania

    This is horrible and unacceptable. My husband and I are tenants in a beautiful townhouse. We treat it like our own. Our landlord requests post dated cheques for a year until the next lease renewal. This is fair and this should be the norm. Post dated cheques or they don't live there. Plus a signed contract, background check and employment check and references. I know some homeowners are desperate to get tenants in so they can have an income, but it's worth the extra step to really screen these potential tenants and get post dated cheques.
