  • The plaintiff says the defendant is her cousin, and said she always tried to help her since she had a rough life. She’s suing her for car damages and defamation. The defendant says she was in foster care and claims her cousin didn’t care about her. She’s countersuing for car payments, repairs, and plates.

For her to even admit that she had paid on time everytime BUT that one time she was in the hospital? Pathetic. To kick someone while they’re already down …. To wait until someone is on their death bed or in chronic pain to take something back because of a broken window which she stated she would get fixed ? Not to mention the fact she had paid on time everytime up until the point she was hospitalized…… this is a family member that wanted to appear helpful taking advantage of someone whom was already vulnerable and weakened. This is sad , and it’s even more sad that ppl can’t see through this for what it is.

      She took the car back because her mom was driving it. I’m sure her mom drove it more than once. She needs to direct that energy to her mom that abandon her and left her in foster care.

      Remember the cousin/aunt said it was her daughter’s car that “supposedly” had some issues anyway. So it was in her driveway. I feel that the cousin/aunt used her(defendant)..knowing repairs was needed plus still had a loan on the car. That’s why the defendant only had to pay half of the car note, got her own insurance. Plus it take maybe 2weeks if that depending by state to get plates. You only get temp tags first. Man...this case was all the way messed up. The defendant’s mom & the plaintiff had some issues point blank. How ironic she take the car when she find out her mother was driving it? Some families can be so messy. Smh 🤷🏾‍♀️

      This is crazy but it's okay because if you call yourself helping somebody and you knew she was in the hospital and the mother had the kids and it was no food in the house and she want her to come they get the car as he had proof that she was getting ready to fix the windshield cuz somebody busted windshield that cousin don't understand she going to be paid for that that's evilness that's wicked that's wickedness

    I genuinely feel bad for the defendant. Having a chronic illness and still taking care of children is extremely hard. She needed that car and I feel the cousin (Aunt) could have been a little more understanding. I think whatever dislike she has for the defendant’s mother was projected on the defendant instead. I hope God blesses her with a car and gives her healing from her illness. 🙏🏾❤️

      Let's be very clear. She has not only one child, but three. After that first one she should have learned. You need to make sure you have a car before you have children.. you have a baby and no transportation. If the baby gets sick, how are you going to get them to the hospital? Yes, the cousin/aunt was wrong, but it's her responsibility to make sure she has transportation for her children.

    I think the cousin/auntie just wanted the car back. The defendant made the first two payments with no problem, and was hospitalized when it was time for the 3rd payment. If you needed the money that bad, why not call or visit her in the hospital and let her know; not just take the car. The plaintiff never stated that she asked for the money, only that she saw the windows were broken and took the keys.

    I’m not sure what Judge Mathis was on with this one. I understand the reasoning behind the legal and financial ruling, but unless they edited out something that the defendant said, I don’t understand why he was so disrespectful to her and her mother?
    He was clearly biased, so that kept him from understanding the point the defendant was making about her cousin/aunt. He read her as ungrateful when she was just trying to point out that the aunt’s testimony was facetious. You’ll notice that the defendant brought up the story about the family leaving her in foster care as a direct response to the aunt saying that she had always been there for her. To me, it actually seems as though the defendant said this to show that the aunt was not being completely truthful. She wasn’t trying to absolve her mother; she was trying to show what she believes to be her aunt’s true character.
    And, by her own admission that she went to visit her niece in the hospital to inquire about and retrieve the car, the plaintiff actually validated the defendant’s opinion of her character. Because if she cared so much and was “always there for” the defendant, the aunt would have inquired about the defendant’s kids and perhaps offered some assistance which (interestingly enough) would have alleviated the need for the defendant to ask her mom to go get groceries for her kids.
    This case was sad, Judge Mathis was biased and triggered, and overall I’m just disgusted at the disrespectful, aggressive, and abusive way the defendant and her mom were handled in this court room (by the same Judge who told a woman to give her abuser another chance because he was a black man 😒). The defendant and her mother deserved better than to be berated and degraded by an angry black man on such a large platform.
    I’m wishing both the defendant and her mother blessings, peace, and prosperity because that’s what they deserve.

I know ppl who told me when they went into the system and their family took them in, they would only do it to get the money from the state. These kids get verbally/mentally abused, made fun of by their “caretakers”, their state money getting used for everything else BUT them, some of them even become “Cinderellas” to these ppls kids! Then they are tossed out the day the turn 18 because the money stops coming in! Judge Mathis is so judgmental for someone that’s went to jail multiple times and is was a criminal, he should’ve let this lady say her experience! And I’m on the defendant’s side in this case!

    The aunt did her wrong. She knew she was in the hospital and she was making payments and had told her she was getting the window fixed. She wasn’t even using the car. SMH Bless her heart.

      Phyllis and the Bible does say honor thy parents and things will go well with you the rest of your life. This girl was doing just that. True they hat the mom was negligent. But this daughter now trying to take care of all this kids and not make the mistake her mother did. I still feel and I know judge Mathis had yo go by the law, but he has helped others with rehab from drugs. He can make his judgement and then he could have walked it back and he personnaly could have helped this this young woman. As woman we know we have been through those struggles. I know the mother was not always there for her, but there is redemption for everyone, and it seems to me she is on track in her wrong doing and now trying to help her daughter. It's sad and almost shamful the aunt had to take this action at a critical time like this when this young girl needed help the most. I respect judge Mathis alot, but right now I feel like he owes me an apology. the laws of the land aren't the only laws there is. There's the laws of God too.

      One thing I would say is, there was stipulations to her getting the car, so for her to not tell her cousin about the windshield and her mother blaming everybody for her faults in life and now her daughter is agreeing with her shows they want handouts from family because they believed no one was there when the mother lost custody.

    I understand Daranesha feelings. It's crazy how they let them go to foster care and they was 12 and it's was only two. But at the end of the day they don't owe you nothing! Your mom had no business going to jail when you got kids depending on her for their survival. Plus where the father put blame on him. Whatever the family do is extra not regulated.

      Yes and its sometimes easier to blame someone els for for your hard times than face the truth. I can sure relate, unfortunately. The mother will always be ok in her eyes but the ones that did help get the blame.

There are so many things the cousin could’ve done. Her payments were on time and she was maintaining the car. She ended up in the hospital during the time she was going to get it fixed.     "Been there, done that." Only my outcome with two nieces was totally different. When they went into foster care, due to their mother's untimely death and an MIA daddy, my family and I got them out of the system ASAP and from that point, my own mother, etc. raised them to adult-hood. Today, both are accomplished women and productive in society. That is all that we ever wanted--to love them and give them the same opportunities that we were given. Dysfunctional families, with family support, guidance and love CAN be broken. I absolutely "feel" for those that never received that chance.

    Life doesn't always deal us comfortable or easily manageable situations that afford us nice feelings about the people around us. The kindness and understanding of other people is a great thing, but at the end of the day, we each have to be responsible for ourselves and can't fault others for doing the same. In the big picture here there is no loss of life or limb, just a hard lesson learned, IMO.

    Honestly, I think that the niece has some entitlement issues and is ungrateful. 1) The aunt does not owe her anything. She allowed the niece to use her car, which she was still paying for. The niece received the car for 1/2 what the aunt's monthly payment was and was required to keep it maintained. It was the niece's responsibility to let the aunt know that the car had been damaged and that she was going to get it fixed. 2) The niece still doesn't get that she was driving that car for her and her children's benefit. If you can hop in and drive, you can take care of it. So, if that care broke down at mile 2, either get it fixed or take it back to the aunt (especially considering that she knew that it had been unused for a while). 3) No one took anything from her and her kids. The niece used the car. She would have been on that bus for those two months if it was not for the aunt. 4) The aunt showed way more restraint than me. I would have knocked her teeth in if she would have cursed me like that.

      That aunt played her! Gave her a car she knew needed work and once all that was fixed and that girl made two months of payments she came and took it at first chance she got, during a time when she was down in the hospital.

    In the beginning, I thought the defendant was taking advantage of the Plaintiff. In the end, I felt like the plaintiff intentionally took advantage of the defendant. She knew she was in the hospital and she wanted the car back because she knew it was fixed. There was no breach in the contract, except by her. She said it herself, the car was just sitting there at her house. This proves that she knew the car was messed up before she lent it to her cousin. As soon as she knew it was fixed and her cousin was in the hospital, she swooped in to take it back and used the defense of "breach of contract" when really she just knew she could actually use the vehicle. You will never get ahead in life trying to tear someone down, especially your own family.
