It was like who do you think you are looking through my things?? I will show you. She then went and got the gun and nonchalantly walked into the kitchen with the gun behind her back. She did not look like she was “possessed” or in the throws of psychosis. She then used her mom’s phone to text her stepdad like she was her and waited for him to arrive…all the while showing off her handiwork to her friends. When her stepdad arrives and she shoots him, she is screaming because she failed to execute him as well. She knew that her plan to kill him too was gone and she had to now create a ruse to try and deflect from the cold blooded murder and attempted murder she just committed…that is in my most humble opinion. I just hope that the jury gets it right and convicts her as everyone seems to have forgotten about the real victim in all of this…Ashley Smiley. Her grandparents and stepdad seem to have forgotten that fact seeing their actions in the courtroom.

She did not expect Carly to have killed her mom. She did not believe there was a dead body until she saw it.
And how do you expect a teenager to deal with that situation? it’s a very rare teenager who is mentally prepared to deal with being alone with a person who has a gun and who just blew their own mother’s face away. She would’ve been in shock. She would’ve been terrified. She would’ve been confused. She would not have known what to do.

He is also in complete denial that the little girl he helps to raise his capable of such a horrific act, therefore, in his mind, it must have been a psychotic break.

The defense is trying to pull a fast one with their psychiatric expert. Here’s why:
    1. Saying he wont offer his opinion or draw conclusions because that’s “not his role”might just be the stupidest thing I’ve heard from an expert witness on the stand. Using his expertise to form opinions and make findings is literally the exact job of an expert witness. Even if one can’t determine something, that’s a conclusion! It’s not a juries’ job to form those conclusions because they aren’t experts. The juries’ job is to consider all evidence and testimony and weight it out in terms of the charges.
    2. Defense was admonished by the judge for not producing a psychiatric expert within a reasonable period of time. Essentially, they could not find an expert to say that Carly was NGRI.
    3. The best the defense could do was find this guy who is feigning reverence for the role of the jury to cover the fact that he CANNOT and WILL NOT say on the stand, that Carly is NGRI.
    4. He did a four hour interview and reviewed some records, this is subpar at best. We have many well designed and standardized tools to assess whether someone is faking, diminishing, being defensive, even lying to themselves about mental health symptoms! He didn’t use a single one?
    5. People who have auditory hallucinations, tend not to describe them as “voice in my head” but describe actual auditory hallucinations or as delusions where they believe the government, witches, aliens, etc are inserting or controlling thoughts. An internal dialogue in someone’s head is simply that. It’s common for people with depression or anxiety to experience their internal dialogue as very intrusive, but it’s not a hallucination.
    6. He’s throwing out tons of random information that has no bearing on anything and only serves to confuse the jury. I just about lost it when he started going on about fugue states.
    7. Even if we all agree Carly has all these diagnoses and is psychotic, unless this was completely controlling her at the time of the murder, then she’s not NGRI. It’s beyond telling that he won’t attest to this on the stand.
PS - people get diagnosed with personality disorders all the time.

It is laughable that defence counsel can buy experts like this to tell them what they want to hear. Thank goodness the prosecutor set a few things straight. Dr expert will hopefully be questioning his own ideas about dissociative memory loss now.

Bottom line it was not OK for what she did. So many of us want parents like that, who treat us good and not like crap! She was lucky! It's like *Sydney* Or *Ambuser Turd*
No! She was wrong. Carly Looked in her room saw her mother looking around turned around and walked back to the other side of the house and got the pistol Came back and did what she did It's Terribly sad what she did!! 😔🙏🏼

She told her friend that “ I just put 3 in my mom, and I have three for my stepdad when he gets home”. She knew what she was doing 100% of the time. I hope she stays in Prison for the rest of her life. RIP Ashley 😢💔🙏

As a doctor who knows about research, I think that the person testifying about the state of mind of the defendant (the Psychiatrist) is not a credible witness. There is no literature that will neither suggest nor back the notion that a person that hides presumptive bad actions does not know the difference between right or wrong. What he says is ridiculous! Fortunately for the criminal prosecution, we have the conceptual and empirical frameworks of Consciousness' of Guilt. "As an axe leaves its mark in the speechless tree, so an evil deed leaves its mark in the evil doer's consciousness" (Wigmore, 1923 cited in Hutchins & Slesinger, 1929).

I just posted a similar comment on yesterday's video on this trial. This is common in the American south and it drives me nuts. They have very different meanings. So many of them say whenever when the proper word, given the context, is when. A lot of Floridians, and those from the Carolinas, etc., do this as well. It's a southern thing. The cops testiying yesterday did it throughout their testimony. Today, I'm annoyed by the way this defense attorney pronounces "Carly" but it's not wrong, of course, it's just her accent.

I used to litigate criminal defense cases. I have empathy for the defense team, because we do what we do because we have a passion for law. We either fight tooth and nail for their innocence, or if the circumstances doesn't allow that, we fight for a proportional sentence for the offense. This defense team seems without fight in some ways. That's why I have empathy, because it is clear their hands were pretty much tied from the get go with the information presented. It would seem they had a job to defend a girl that voices a defense poorly thought through, who, herself, is not adamant that her defense version + takes center stage. What a crappy set of facts to defend.
