The control tower got him to taxi back to the hangers and got a sheriff's deputy to meet him there, where he was arrested for drunk flying. _One hour_ after the arrest, he blew a 0.23 BAC (the legal limit for flying is 0.04). Not quite as bad as 0.36, but could have been worse given how much more damage a plane can do compared to a car.
You would be surprised how common that is. We had a commercial jet pilot pulled over on the runway in a 737 at our local airport who blew a .2 something. He was taxiing all over the place and tower made up a mechanical reason for him to abort takeoff because they suspected him of being drunk.

To be fair, if you're ever in trouble with the cops for any reason, it's always smart to call a lawyer. However, you should also make it clear you're exercising your right to remain silent (and explicitly say as such), which might not get you out of trouble, but it can at least make it less likely that your situation will get worse.

Being drunk on a plane or in an airport is not a crime, but if you're so drunk that you get kicked off your plane, then you can't stay in the airport. It's an automatic trespass, and if you resist while being escorted out, _then_ it's a crime. Even after being within the secured area for airports, that is still public areas. The whole area is considered in public. Unlike if you went into a regular bar, where that whole area is enclosed. I think the whole issue about the airport situation is even though you went through security and are now on the other side of those gates you still have to hold yourself accordingly right. You were told by the barkeep to tone it down a bit, then again to stop bothering other patrons, then warned that if you don’t stop they’re gonna call police and escort you out. Would you still be like “But we’re not intoxicated in public?” Or would you be like “Oooo someone’s getting arrested for being rowdy!” Just because you made it passed the security gates and are waiting for your flight doesn’t just waive the fact that you are still in the public eye. Minus some of the designated restrictions Airport terminals, the whole building, is considered public property and not private property. Being drunk on a plane or in an airport is not a crime, but if you're so drunk that you get kicked off your plane, then you can't stay in the airport. It's an automatic trespass, and if you resist while being escorted out, _then_ it's a crime. If you cooperate, then you can come back after a certain number of hours or sobering up, whichever comes later.

I think the whole issue about the airport situation is even though you went through security and are now on the other side of those gates you still have to hold yourself accordingly right. Let’s say that you at the bar of the airport and you’re being a bit too rowdy. You were told by the barkeep to tone it down a bit, then again to stop bothering other patrons, then warned that if you don’t stop they’re gonna call police and escort you out. Would you still be like “But we’re not intoxicated in public?” Or would you be like “Oooo someone’s getting arrested for being rowdy!” Just because you made it passed the security gates and are waiting for your flight doesn’t just waive the fact that you are still in the public eye. Minus some of the designated restrictions Airport terminals, the whole building, is considered public property and not private property. Thousands upon thousands of people walk in and out whether it’s this country or that country or this airport to that airport.
