HOAs are important if you want the neighborhood to be nice for a long time. A HOA saved me, the HOA sued the Propane company because they were raising prices and threatening anyone who tried to get a different provider in our neighborhood. Also my neighbor tried to get his whole front yard turned into concrete which would ruin the value of his home and mine. Also my other neighbor kept parking his cars in a way that it was blocking my driveway there was no town rule, but there was an HOA rule. We asked nicely for him to stop when he didn’t, the ones blocking the driveway were towed. So please think before you make dumb comments. Also you have the right to not live in an HOA it’s called don’t live in one.

Why do you think local/state governments want HOAs so badly? It's about regimented control and limitations on individuality. That trend is what has lead us to where we are now.

the case was dismissed. andy lipka and his attorney filed for petition to dismiss. likely the hoa backed down and cancelled the fines after all the press coverage and outrage that people were having over it.
I own a 40 year old car and a 29 year old truck & a 20 year old truck. Two of my vehicles have faded patinas but they are excellent mechanically with rebuilt engines and transmissions. Nobody has the right to tell me I have to get rid of my vehicles just because the neighbors don't like the faded paint jobs.
As someone who likes older cars way more than newer ones, just know that this HOA fucking sucks and everyone else thinks your truck is way cooler than anything made today
Update: he easily won in court, the HOA then proceeded to ban him from "all use of any and all of the common facilities for a period of one (1) year" for no other reason than they were salty they couldn't kick him out of his home

I live in a HOA and they decided to redo our public pool and splash pad. However, there really was no need to, and when they did they made the splash pad a lot smaller and less fun for kids. The HOA got displeased with how it turned out so they redid the splash pad again! What a waste of money. P.s- splash pad still bad to this day.

I was building a patio for a customer years back, is HOA said patios and decks could only he a certain square footage and could not extend beyond 15 feet front the house's fondation, that left them with very little room for their furniture and grill. Since there was no restrictions on landscaping I placed two large patio slabs just off the main patio so he had a place for his grill, his HOA rep was NOT happy buy couldn't find any infraction that covered his gripe, but he never forgot. A couple of weeks later I was a few houses down and the guy walks over and told me he received a HOA citation for not having a over on his grill. Turns out he cooked a couple of steaks and left the grill to cool down before putting the cover back on, it started raining so he left it to early the next morning to covered it. The only way to even SEE the grill is to actually walk behind the row of houses through the 10 foot wide area the builder had to leave beyond the 15 toot lot envelope, the only people that go back there besides the home owners are the lawn cutting crews...and apparently the anal retentive nightmare of a HOA nazi out on a rainy night looking for revenge. BTW the guy took his citation to the full board, explained what happened and got the violation overturned.

Bought into an HOA, I had a Chevy Blazer that didn't fit in the garage. They had a "no trucks parked in the drive way" rule. They took me to court over it. I won by pulling out the registration that categorized it as a station wagon.
Awesome. Many states register even 1/2 ton full sized pickups, like any 1500 series, with the same plates thats any passenger car can get. If the HOA wants to go play rotten like that, that means that probably 95% of the vehicles in that neighborhood have to park inside, with the trend of everyone needing an SUV. Are they trucks, or are they cars? A little of both, really.
You have to check what the registration indicated... mine was marked as "SW", which in Florida was "Station Wagon". Their lawyer asked me why I didn't tell the HOA it was designated a "station wagon", in front of the judge. I told him they never asked and frankly it wasn't my job to educate them... that was HIS job. The judge laughed.

I once lived in a neighborhood that had a HOA. One rule was no utility trailers allowed to be parked on the driveway. I had one I kept stored under my deck in my back yard. I used it one day and when I was finished I parked it in my driveway intending to put it back under the deck the next morning. The next morning I had a letter from the HOA in my mailbox already with a picture of my utility trailer parked in my driveway. A note was with it explaining I was in violation BLAH BLAH BLAH and had something like 2 weeks to rectify the situation. So I let the trailer sit there up until the very last day I had to "rectify the situation" and THEN I moved it back under the deck in the back yard rather than moving it the very next morning after having used it. Reminds me of that quote: "Don't hate the player. Hate the game." And reminds me of an old Charlie Sheen quote: "Winning!" 🤣🍻

Communists/socialists want everyone equal with order no one can be different this includes house color, garden setup, type of roofs, property maintenance all have to be the same... fascists are based on hierarchy level. One government (HOA) picks who should do what. In theory it would pick houses to look great and other to look horrible creating a hierarchy. But both communists and fascists have absolute control. There is a flip-side to this; if you have no HOA, and someone moves in and decides to never mow their lawn, par dilapidated cars and busted appliances all over the yard, be loud, obnoxious and let their house fall into a state of extreme disrepair, it's a bigger battle to get anything done about it and how it can tank your property value and make it impossible to sell. There is a reason HOAs are formed, the big issue is gross overreach of power. You're damned if you do, damned if you don't. Either way you kind of need decent neighbours all around.

Here in Australia as long as the car is registered they are not allowed to dictate if you you can keep it on your property they can only do it if the car is in non running and unregistered

I lived in an HOA community for a time; there was one guy that literally walked the neighborhood daily looking for violations. It was a neighborhood of good people that kept an eye out for each other. I can assure if anyone saw someone breaking into his house, they would have ignored it.
People who have nothing going on in their lives begin meddling in the lives of others. It's really bad when they do it waving a flag of "good works" when in reality they are nothing more than bored miserable people.
My dad did auto mechanic and auto body. This is only paint wear. This is a classic truck which probably qualifies for historic plates. I dont see any body damage to this vehicle from this clip. Auto damage to me is when your in a car accident and its damaged fenders, mangled car parts, missing car parts and the like. The HOA thinks his truck is an eye sore. If the man is paying his bills and HOA fees, they shouldnt be able to foreclose. It seems the HOA is being greedy, wants more money, and unreasonable. I hope the court and judge see this is a classic truck and its on his property, not the street.
I live in an HOA. I have been here for 15 years. It is a good common sense organization and keep a moderate control over our housing area. Gets after keeping cracks sealed on the roads, keeps drainage ditches clear and has a simple, practical set of rules. A minimalist approach. This HOA is excellent, caring group. No problems here.

I'm not sure on the stats, but probably 4 out of 5 homes these days are under HOAs. Those that aren't may not be affordable or meet many folks' criteria for being able to purchase.
This is sad to see, especially because the truck seems to be mechanically sound too, and not too loud or smoking or anything. It's literally just a classic car in original condition with normal wear.

When your house is part of an HOA, it is legally part of a PUD (Planned Unit Development) and you need a Certificate of Approval by the HOA for both your lender and the county record. I actually turned down a really good bargain on a very beautiful house because it had that little piece of micromanaging government. With the way we have too much government to begin, why would anybody volunteer for more government in a HOA? I guess the house was so affordable because it had a HOA and nobody wanted to bother with that stupidity.

HOAs are a double edged sword. It's like anything. People get very nit picky and personal which is what we have here. I dealt with this in Colorado. As one commenter wrote. "Imagine living in a place where your largest problem is you don't like the paint on your neighbors truck." I live in a HOA residential 55 years old and older. The president of the HOA lives right across the street from, my gardeners come once a week to mow and trim my yard. When they gardeners have finished my yard the president of the HOA will blow all his leaves into the middle of the street, and when the car's zoom by the leaves well blow into my yard. He does this every week right after my gardeners are done with my yard. Our street is the messiest street in the HOA residence.
no one special If you think about it, you are always renting because you have to pay property taxes, too. No such thing as really owning anything in this country. If you don’t pay them, the county will put a lien on your house and eventually seize it.

If you don’t pay the govt, you’ll be out on the street and even jail for being “free”. Relax.

That 65 Ford truck is my favorite truck of all time, it was built with pride, that is more truck than any in that HOA, just goes to show you that these people do not appreciate what America is really about, that truck has more character than any built today, how can it not be appreciated?

It would/could cost over $1,000 to repair. Yet, would that keyed car be subject to the HOA's scrutiny? The covenant's phrasing is very subjective and is probably meant to be that way just for cases like this. Let's hope Mr. Lipkey wins the case.
This is why I live on unrestricted private property. Yes I’m surrounded by HoA property and they HATE me. I lived on my property before the new neighborhood developed. They send me 5-8 offers a year and I always counter with a 7 figure number higher than previous. They haven’t figured it out yet
The HOA that developed near me keeps saying that I need to join the HOA because it would make my life easier. All they want is my 30 acre's if land for more house's. I'm not selling my house or my land. I've been tempted to go ahead and turn it into a NWR since there isn't anything but a small forest on my land.

Here in Maryland HOA's have been stripped of all punitive power. The only thing that they can come after you for is not paying your annual or monthly dues. They can legally slap a lien on your title for that but that's all they can do now. That doesn't stop them from driving around the neighborhood and finding fault and sending you letters to fix this and address that. But you can ignore the letters as I always do and nothing ever comes of it.

There was an HOA here in Florida that had a golf course inside of it. The owner of the golf course died, and his son inherited it. He immediately closed it down, and was going to turn it into a water park, because he hated golf and everything about it. The hoa blocked him from doing this, so now the golf course is closed, the residents that "paid" to live on a golf course are salty, and last i heard, he was trying to get section 8 high-rise apartments built on the land😅

I owned a home that had an HOA for about 20 years. I hated it. I wasn't allowed to hang my clothes in my back yard. My son visited from out of state. He has a motorcycle and stayed with us for two weeks. We was told the motorcycle wasn't allowed in the driveway. My AC broke down in the middle of a Texas hot summer but we'd have to wait for a few weeks for a part to be delivered so we bought an in window AC.. we was told it needed to be removed. We sold that house last year and moved. I told my realtor absolutely NO HOA when looking for a new house.. I would never have one ever again.
The HOA will lose. The remedy would be suing them for punitive damages with their frivolous lawsuit. That truck sits proud in that vet's driveway. Semper Fi.

A HOA saved me, the HOA sued the Propane company because they were raising prices and threatening anyone who tried to get a different provider in our neighborhood. Also my neighbor tried to get his whole front yard turned into concrete which would ruin the value of his home and mine. Also my other neighbor kept parking his cars in a way that it was blocking my driveway there was no town rule, but there was an HOA rule. We asked nicely for him to stop when he didn’t, the ones blocking the driveway were towed. So please think before you make dumb comments. Also you have the right to not live in an HOA it’s called don’t live in one.

I own a 40 year old car and a 29 year old truck & a 20 year old truck. Two of my vehicles have faded patinas but they are excellent mechanically with rebuilt engines and transmissions. Nobody has the right to tell me I have to get rid of my vehicles just because the neighbors don't like the faded paint jobs.

I live in a HOA and they decided to redo our public pool and splash pad. However, there really was no need to, and when they did they made the splash pad a lot smaller and less fun for kids. The HOA got displeased with how it turned out so they redid the splash pad again! What a waste of money. P.s- splash pad still bad to this day.

I was building a patio for a customer years back, is HOA said patios and decks could only he a certain square footage and could not extend beyond 15 feet front the house's fondation, that left them with very little room for their furniture and grill. Since there was no restrictions on landscaping I placed two large patio slabs just off the main patio so he had a place for his grill, his HOA rep was NOT happy buy couldn't find any infraction that covered his gripe, but he never forgot. A couple of weeks later I was a few houses down and the guy walks over and told me he received a HOA citation for not having a over on his grill. Turns out he cooked a couple of steaks and left the grill to cool down before putting the cover back on, it started raining so he left it to early the next morning to covered it. The only way to even SEE the grill is to actually walk behind the row of houses through the 10 foot wide area the builder had to leave beyond the 15 toot lot envelope, the only people that go back there besides the home owners are the lawn cutting crews...and apparently the anal retentive nightmare of a HOA nazi out on a rainy night looking for revenge.
BTW the guy took his citation to the full board, explained what happened and got the violation overturned.

Bought into an HOA, I had a Chevy Blazer that didn't fit in the garage. They had a "no trucks parked in the drive way" rule. They took me to court over it. I won by pulling out the registration that categorized it as a station wagon.

Awesome. Many states register even 1/2 ton full sized pickups, like any 1500 series, with the same plates thats any passenger car can get. If the HOA wants to go play rotten like that, that means that probably 95% of the vehicles in that neighborhood have to park inside, with the trend of everyone needing an SUV. Are they trucks, or are they cars? A little of both, really.
You have to check what the registration indicated... mine was marked as "SW", which in Florida was "Station Wagon". Their lawyer asked me why I didn't tell the HOA it was designated a "station wagon", in front of the judge. I told him they never asked and frankly it wasn't my job to educate them... that was HIS job. The judge laughed.

I once lived in a neighborhood that had a HOA. One rule was no utility trailers allowed to be parked on the driveway. I had one I kept stored under my deck in my back yard. I used it one day and when I was finished I parked it in my driveway intending to put it back under the deck the next morning. The next morning I had a letter from the HOA in my mailbox already with a picture of my utility trailer parked in my driveway. A note was with it explaining I was in violation BLAH BLAH BLAH and had something like 2 weeks to rectify the situation. So I let the trailer sit there up until the very last day I had to "rectify the situation" and THEN I moved it back under the deck in the back yard rather than moving it the very next morning after having used it. Reminds me of that quote: "Don't hate the player. Hate the game." And reminds me of an old Charlie Sheen quote: "Winning!" 🤣🍻

There is a flip-side to this; if you have no HOA, and someone moves in and decides to never mow their lawn, par dilapidated cars and busted appliances all over the yard, be loud, obnoxious and let their house fall into a state of extreme disrepair, it's a bigger battle to get anything done about it and how it can tank your property value and make it impossible to sell. There is a reason HOAs are formed, the big issue is gross overreach of power. You're damned if you do, damned if you don't. Either way you kind of need decent neighbours all around.

I live in an HOA. I have been here for 15 years. It is a good common sense organization and keep a moderate control over our housing area. Gets after keeping cracks sealed on the roads, keeps drainage ditches clear and has a simple, practical set of rules. A minimalist approach. This HOA is excellent, caring group. No problems here.

If I am on the jury In this particular case, the term "moderately severe body damage" doesn't come even close to including the condition of his truck. Lipka is not the one violating the HOA rules.
I'm not sure on the stats, but probably 4 out of 5 homes these days are under HOAs. Those that aren't may not be affordable or meet many folks' criteria for being able to purchase.
This is sad to see, especially because the truck seems to be mechanically sound too, and not too loud or smoking or anything. It's literally just a classic car in original condition with normal wear.

When your house is part of an HOA, it is legally part of a PUD (Planned Unit Development) and you need a Certificate of Approval by the HOA for both your lender and the county record. HOAs are a double edged sword. It's like anything. People get very nit picky and personal which is what we have here. I dealt with this in Colorado. As one commenter wrote. "Imagine living in a place where your largest problem is you don't like the paint on your neighbors truck." I live in a HOA residential 55 years old and older. The president of the HOA lives right across the street from, my gardeners come once a week to mow and trim my yard. When they gardeners have finished my yard the president of the HOA will blow all his leaves into the middle of the street, and when the car's zoom by the leaves well blow into my yard. He does this every week right after my gardeners are done with my yard. Our street is the messiest street in the HOA residence.
Anyone who "buys" in an HOA isn't buying, they're renting under duress and paying taxes on it.

I'm with you but, you know some people will think a scratch is "moderately" severe. Most of us would freak if someone took a key to the side of our brand new car. It would/could cost over $1,000 to repair. Yet, would that keyed car be subject to the HOA's scrutiny? The covenant's phrasing is very subjective and is probably meant to be that way just for cases like this.

Christian Clue sorry if i offended you; my points are that we should remain sensitive to community standards and parking a beat up non restored truck with fading paint and ghetto rims in the driveway is testing and challenging neighbors. I have been on 4 HOA boards and would definitely supported towing this eye sore away.
Christian Clue you’re still ignoring my points after 3 attempts: park in the garage, trashy rims and bad paint are non conforming and aesthetically problematic, remain sensitive to neighbors. I could drive a greater visual albatross than that old truck and because I care about my neighbors and use the garage it wouldn’t matter. Final comment on a really obvious point.

There was an HOA here in Florida that had a golf course inside of it. The owner of the golf course died, and his son inherited it. He immediately closed it down, and was going to turn it into a water park, because he hated golf and everything about it. The hoa blocked him from doing this, so now the golf course is closed, the residents that "paid" to live on a golf course are salty, and last i heard, he was trying to get section 8 high-rise apartments built on the land😅
And this is why I told my realtor "absolutely no HOA homes" when we were searching last year.
Imagine paying for a mortgage and then getting told how to live in your home. Ridiculous.

@@atranfanatic i have a 72 chevy 1/2 ton, 2wd, long bed. ocher and white with the wood trim. no HOA but the township has hassled me about it. ironically, it's the vehicle i have that i get the most offers to buy. i believe in freedom, i don't mind my neighbors business and i expect the same. they do many things i don't like, annoy the crap out of me and i disagree with, but that's freedom isn't it. we all do things others don't like.
My brother served in Korea during that war in and around 1950. The emblem on the side of that truck is the arm patch he wore. It's the 45th division out of Okla.
my grandfather served in korea and we are from Oklahoma so there is a chance our family served together.

I owned a home that had an HOA for about 20 years. I hated it. I wasn't allowed to hang my clothes in my back yard. My son visited from out of state. He has a motorcycle and stayed with us for two weeks. We was told the motorcycle wasn't allowed in the driveway. My AC broke down in the middle of a Texas hot summer but we'd have to wait for a few weeks for a part to be delivered so we bought an in window AC.. we was told it needed to be removed. We sold that house last year and moved. I told my realtor absolutely NO HOA when looking for a new house.. I would never have one ever again.

@@davis.fourohfour That's not how an HOA works. It's a part of your deed that you sign when you buy the property. If you bought the property without an HOA, a newly formed HOA can't force themselves onto your existing deed. You can join if you want to, but they can't force you to.

They're not so easy to avoid. In the Houston area ALL the suburbs are governed by HOAs. There's no escaping it but to live unreasonably far.

only way to do that is farmland with a house and land to grow food on that is not too expensive to maintain if you can find it
