That's almost always the case. They ID you to run you for warrants to see if they can arrest you even if you're not committing a crime.
So if they didn't get you with what they suspect you... they will get you with a past crime or a active case? Or pat you down?

Its only a crime if a) it happened and b) he is under age.
According to the 4th amendment, and Terry V. Ohio you can be detained for meerly "reasonable suspicion" but it must be able to be articulatable to a judge. In this case I don't see anything the cops are doing wrong but the guy should not have stepped out to talk to the cops. The correct way to handle this would be "do you have a warrant?" then you cannot come inside. And never step outside.
Edit.. the only thing I see the cops do wrong is saying his name is needed for a report.. thats actually not how it works.. nor are you paid to do the officers report for them.
In truth the officers had no suspicion, they had the suspicion of an unreliable source. Hearsay is meaningless.

I thought the cops were going to cry. Not having qualified immunity makes a huge difference. This should happen in every state.
This kid just got his tuition paid for by unsubstantiated evidence and hearsay. Imagine how much alcohol he can afford now that they are paying for it.
An eyewitness is not hearsay. If someone saw him....and reported it...that is an eyewitness, which is acceptable in court.
@@kevinzink9063 Hearsay is a court term. They would have had to provide the witness in court in order to avoid hearsay.
This was a case of not having to I.D., because there was no charges, no criminal act. There was suspicion, but no proof. A witness may CLAIM anything. But without proof, the cops have zero standing.
So, forcing him to I.D. without a crime, or proof of a crime, is actionable because it is a violation of his constitutional rights.
The reason they didn't get a warrant to enter, is because all they had was suspicion.
No judge would have granted it.
Them explaining that they weren't going to pursue getting a warrant, was their way of trying to save face to people who may not be aware that they're going to cost their city a lot of money, because their ego didn't let them walk away.

That officer was literally shaking while talking to the student. I don’t think he was shaking because he was scared; but because he was frustrated. He wanted to go hands on but knew there would be consequences he would have to face at a later date by doing so.

The COP THEMSELVES needs a single articulated fact that THEY know a crime has been committed .. not just HEARSAY .. otherwise just calling the cops and saying whatever you want would end in arrest everytime.
America is moving in that direction. Cops arrest anybody they want to because they will suffer no penalties. Just today, Steve Lehto reported on a Circuit Court ruling that cops can arrest anybody and try to find some infraction or crime later.
I would have said, "I saw your momma sniffing cocaine. Go investigate and harass her."
I may be misunderstanding this cause I’m not a lawyer or anything but from what the video said, they could not arrest him because of the suspicion and they never claimed to. They thought they could arrest him because he was refusing to ID himself and they had in their minds a reasonable suspicion that he was involved in criminal activity. Whether or not a court would actually find that to be the case, I don’t know, but certainly you can’t be arrested just for being suspected of a crime. So no, I don’t think calling the cops and saying whatever you want would result in an arrest every time because if you give them your ID, they have no reason to arrest you. Remember, the fifth amendment specifically protects your right to refuse to answer questions when you have a reasonable belief that answering them may incriminate yourself. Again, I’m not a lawyer, but it seems to me that he believed that giving the cops his ID could not in any way incriminate himself so his refusal to do so would not be protected by the fifth amendment. Please correct me if I said anything wrong.

I would like to see a follow up on this case. When a law student knows more about law then a cop the cops have to worry.
The student made certain that the cop threatened to arrest him if he didn't show ID. The cops should be put on The Brady List and be sued.

It’s amazing when a cop that goes to a police academy for 4-5 maybe 6 months is going to argue with a person that is going to LAW SCHOOL for 4 yrs we’re they study law only and nothing else!
I love that he was forcing them to threaten him with arrest rather than allowing them to continue "asking" which is exactly how they would report it.

I loved the end of this, when the young man granted them an expletive filled goodbye, as they took that walk of shame. Unfortunately for them I get the impression, this college kid will follow up on having his 4th amendment violated, just so they could satisfy their ID addiction. And throughout the gaslighting to the lanyard ID'd dorm staff, the sergeant eluded that the caller was anonymous, which indicates he knew he wouldn't get a warrant, even if he tried. Also saying they weren't going to get a search warrant, apparently in hopes the college could do something he knew wasn't going to happen for him. What came off as absurd was his interpretation that litigation was somehow a threat, when every officer there was literally there to try imposing possible criminal litigation upon the student, and trying to justify their threatening behavior as if it's somehow different. This college kid knew his rights, and the assertion he'd pursue litigation definitely had the sergeant pumping the brakes really hard, and in very short order. But that Addiction to ID's, was too strong, and he had to throw out that threat of arrest, and the possibility of criminal litigation, rather than walk away from this kobiashi maru ( star trek reference) no win scenario. Which was the only way to win. But alas, they even screwed that up.
When they asked if was a threat he should have said "No Its a promise".

One thing I like about these videos is he is always telling you what the actual law is and even lets you read it. Surely, the person that supposedly made the call had to leave a name with the dispatcher. Then there is the other point about that person being an upstanding citizen and trustworthy. So the cops were wrong from the very beginning. Keep up the good work and I hope the young man gets his degree in law and becomes a good lawyer. We certainly need them.

Law students don’t appear in court rooms, only lawyers. And you don’t refuse to ID as a lawyer in a court room - to the contrary, you state your name and bar number for the record.

Really we shouldn't have to hire attorneys to interpret the law to us they should be written in a way that the average high school graduate can comprehend as it used to be.

For sure 1 semester in law school is much more law training than any cop is required to have.
Joel gave those tyrants so many chances to both do the right thing and avoid a lawsuit, and they just didn't get it. He got REALLY pissed the moment the cop acted under color of law with the threat of arrest (even though he has easy grounds for a lawsuit now). And you can tell he's a kind person too, even thanking the other cop for being professional, trying his best to help them do things lawfully, and only swearing at the tyrant who violated his rights.

It has to be very specific and reliable information given to police to count as RAS . Very rare would that ever give RAS because people aren't reliable. Karen's call all the time for nothing .
Weeeeeellll there is a few parts that go into it. They investigate the tip, but no RAS is given from that. If the tip leads to you meeting a slurring kid who smells like beer, then you'd have some RAS. These cops ran into a kid wide awake and in perfect sober condition claiming he was study...in a dorm room. They had nothing.

If you talk to the police, you need to be careful. The police said, "someone saw you talking beer into your room." The student later said to a friend that showed up, "Some one said they saw me me take a case of beer into the room." Would have happened if the police spoke up and said, " we did not say case of beer, we said beer."?
I also think he should not have stepped out of his room.
Made a couple mistakes like announcing his age, and the officer did say case of beer later on so im not sure that part mattered.

He's a law student. There is always the possibility that they had someone call on them just to see if the police would do exactly what they did. I mean there could be some over zealous Dudley do right on the floor, or an ex girlfriend just trying to get even.
In the end it does not matter. The kid was 100% right. His ID does not prove he does or does not have alcohol in his room, and the piggies have no right to search, and thus have no right to demand ID.

The greatest was when the kid said his age and called him out and the cop said don’t be like that. That shit said it all 😂😂😂😂😂
This makes me think of a time when my sister worked at a gas station and a customer came in drunk off her ass. They called the cops on her and were told that because they(the cops) didn't see this woman driving themselves, that they couldn't do anything. Yet in this case, someone supposedly saw this guy with a case of beer, and they come investigate.
I don't think we got the full story. This was university police, so very likely on university grounds in university housing which likely has strict rules against alcohol that could potentially get you kicked out of housing and even expelled. And students probably sign away many of their Constitutional rights in the housing agreement. So, I'd say this student was lucky the cops were so nice and backed down. They were probably well within their rights to search the room even if it was an anonymous tip.

It was all about putting his name in the crime data base. Had nothing to do with a crime, we all seen that after they didn't pursue the matter right after he got the ID. Tax funding time comes around they need to have more crime gets more money. All over the country this is what law enforcement does, absolutely pathetic at the expense of innocent people.

Being old enough to go to a university but not being able to drink alcohol sounds crazy to a non American. In the UK if you are underage they will just confiscate your alcohol, they would never ask you if they can search your room.

Listening to the video the cop said he needed his ID for the officers REPORT. The law doesn't require anyone to provide ID for a report.
The law requires it for a crime that they can prove.
"Here's the deal" the inevitable precursor to "I am about to attempt to violate your rights".
He did a good job in the first half but lost the plot in the second half. Never state that you are setting up litigation, never use profanity or derogatory terms, be polite and cordial, and clear in your intent. That goes a long way if and when it goes to court.

Without qualified immunity they actually try to do due diligence and look things up. We all need that.
Funny how if you are legally detained you have the right to have an attorney present during questioning but if you refuse to answer questions without an attorney they get very upset.
I only heard the cop say "with alcohol". Later the dude said "a case of beer". Maybe that was mentioned and I didn't catch it. Alcohol was mentioned a couple of times but I don't remember beer being mentioned until the college kid said it.
Am I siding with the cops? No. He's a college kid. Let him have his case of beer! You know the old saying: "You only college once!"

He said beer, later the other officer said case of beer. Alcohol means different things to different people. To me, I'd have said there's no liquor in my room. That doesn't mean I have alcohol, that just means I enjoy spirit over beer. Whether I'm of age doesn't matter if I have no alcohol.

for a law student that doesn't answer questions, he sure did talk to the cops an awful lot. he even gave up his age at one point before giving up his license. hopefully this will teach him to actually plead the 5th and not say _anything_ .
I never understand why the people in these videos talk so much. I suppose it's awkward and tense, so the natural inclination is to avoid silence and staring.
I'm just waiting for the video where the citizen says, "You know I don't have to ID. You know it! You're just waiting for me to do something stupid so you can put me in cuffs." And then they shut up and stay shut up.

If they don’t know who he is, how do they know he is a minor or who to engage in the first place?

When he sues you, I hope that he gets enough to cover at least half of the student loans that he’s had to take out in order to become a lawyer. Can you imagine if a law student can wipe the floor with them as bad as this kid dead can you imagine what a season attorney will do in court.. I can’t wait.
