  • Do you TEACH stuff on UA-cam? If so, you probably want include copyright material in your UA-cam videos -- but what about copyright strikes? In this video, I give you the solution for avoiding copyright strikes and lawsuits. It’s Fair Use for UA-cam, specifically for educational or “how to” videos on UA-cam. Fair Use on UA-cam can be pretty complicated, but in this video I break it down for you and answer the question, “What is Fair Use?” UA-cam “how to” video creators want Fair Use explained, and so this video is designed to do just that! I take you slowly through Fair Use law and explain how UA-cam Fair Use is different than on other social media platforms. You see, Fair Use on UA-cam is a part of copyright law.       Ian Corzine Hi Ian, it really seems best to avoid this whole problem of ALL copyright infringement permanently by linking the video of another creator in the “description” section of my video so I don’t have to worry about this in the first place.That way I can show the other creators entire video & comment on whatever I want or am I missing something?

    Fair use is a law and should be useful, but these companies rather false copyright strike, even for a little edit and the use of a video or audio clip

    This was a brilliant video Ian! I loved the editing, it felt different this time! Super well done. The tips were really great. I tend not to use a LOT of other people's stuff (photos etc), and I use only free music from either the UA-cam audio library or from another source that specifically states the music is free.
    I absolutely loved the transformer sound effect lol, that was so unexpected haha!
    Jeven is awesome by the way, nice clip!
    I learned a lot from this, it gives me some great ideas to really try to enhance my own videos and feeling confident that I'm doing it correctly!
    I think this is one of your best videos to date Ian! Amazing vid!!! 😀👊

    So I've read a video policy of a particular game that says we are free to publish their content on UA-cam.
    Also says: "We ask you to remember that the use of our content in your videos and streams has to be non-commercial - meaning you can neither charge users to view your work nor sell or license it to others in exchange for any kind of payment. You can, however, become a part of the UA-cam or Twitch partner programs and monetize your videos or streams featuring the content of our games"
    So my question is, Can I use the music from that game as a background music to create a How to video that's completely unrelated to their game? Can I monetize that video? Will this be a breach to their policy?

      Hey Khinshodova! Thanks for watching. No, that would not be a Fair Use. You can't use a song for entertainment -- i.e., because it's cool. You can only use a short portion of it, if you're critiquing, commenting, educating, or news reporting about that particular clip.

    When you used that example of Philip de Franco talking about EU copyright directive draft article 13 (now enacted as Article 17), I felt like I had to look up whether EU legislation is in fact copyrighted; I knew that works of the US federal government are not copyrightable, but some state governments do copyright their own works, and although I read that many national governments make their own works non-copyrightable, I wasn't sure about whether that applied to the EU.
    It turns out that publications from Eur-Lex (including both legislation and legislative proposals in the EU) *are* copyrighted, but under conditions very similar to a CC-BY license, as described in Commission Decision 2011/833/EU (OJ L 330, 14.12.2011, p. 39); this means that your example was precisely on-point.
    I also tried to find who wrote the *Illustrierte Kronen-Zeitung* article "Die Katastrophe von Sarajewo" to determine its copyright status, but as long as any known authors died at least 70 years before the start of the year in which that video about the Great War was made, it would have fallen into the public domain by then (I later realized that you already knew as much); better examples might be the many uses of newspaper clippings in videos by The Gaming Historian, all of which are far too recent to have fallen out of copyright.
    FWIW, the video in question does not cite the newspaper itself, and your link is incorrect; this is the correct one (first video on the channel): ua-cam.com/video/6FgaL0xIazk/v-deo.html

    Thanks Ian, I do have a question or two. When does a body of work become public domain or can the current Copyright holder renew said works? If so are there different expiration dates depending on the type of media or are they all the same across the board? As for the video game streaming, although I don't do this myself, I've found more than enough situations to answer most of the questions I've had in the Games/Developers EULA which they are more than happy to provide in numerous areas, actually, one is usually included with the gaming software. One last one on the earlier topics you discussed. I was not aware that you can use someone's tutorial videos, as long as you use them as you've stated with the proper commentary, to have them fall under Fair Use, but I would think that if anything it would be morally wrong. I know that morals have nothing to do with probably 75% of the content on UA-cam and I would be very upset if I took the time to create a really kick-ass tutorial video only to find out that someone else has taken my hard work and just layed down a new audio track to suit their needs, just an observation. Thanks again and hope you can throw your experience at this one for me.

    straightforward and well said, Ian! Thank you. but what about those who get random videos from YT channels( not from C. commons bec. they are limited), then edits, get short clips 3-5 sec., adds photos from free sites/own intro/outro/narration/YT music/puts fair use policy in the description...I've seen a lot of big channels doing this...like conspiracy/top 10 channels...hope you read this, keep safe!

    Sir, I have a channel with 80,000 subscribers. All the videos are copies here. which videos collected from other channels,

    I reached out to UA-cam and asked them about a subject I am interested in...Genealogy. I want to express a certain mood in my research videos by playing a popular song that sets a certain mood. Is vlogging my Genealogy research considered research? Well, the woman said she needed to put me on hold to try to find that answer...but the reality is she was putting me on hold to confirm if my question was more of an "editorially advice" question. She came back on and of course proceeded to shoot down any further questioning because it was considered "Editorial advice". At the end of the day, I learned UA-cam is NOT going to give advice or suggestions on how to use "Fair Use" other than to refer you to the examples already out there on the subject. All the examples of Fair Use stem from precedence set in court case outcomes, that is how all of our laws are established, out of precedence generally. So Ian gave an example on the use of "Fair Use" in Educational videos (the safest of all the examples I might add...hehehe) because that is that is the oldest true and tried "Fair Use" example we have. It goes back to our College/University days when we used examples in our papers and such. Plagiarism, that is where that stems from. Which is all fine and dandy, but that is not really where most people have a question of fair use today. I have found the best tool you can use is a "Copyright - Fair Use Analysis Documentation" on your videos and hopefully by the end you have a fair assessment on whether your videos are really leaning towards "Fair Use" or whether you're just wanting to gain followers on your channel by using someone else's creative content. If you are being COMPLETELY honest with yourself, most of us will land smack in the middle of the analysis and that means it's ambiguous at best, but it's better than nothing.

    Hello, Ian! I appreciate your videos. I have a question and as not being monetized it's a terror trying to contact YT. YT states that you can use "replays of a sports tournament where you explain what a competitor did to fail or suceede" and Movies can also be altered and monetized but when I do commentating on sports videos I get CR and also got a strike today which is very annoying considering I spend about 3-6hours of editing etc per video. It seems between fair use and what youtube states my videos should be fine for monetization and I feel the big guys (in this case the MLB))are just taking advantage of YT not protect us little guys. Could you advise? My idea is to do like news and highlight channel. Thanks for your time!

    Hi there!!! Thanks so much for all your help. I have a question, do you think I can get in trouble if I translate a song as the video is playing? Like for example: I play a video with the song and pause it, and than say what it means in Spanish and so on until the end. I already do it but the way I'm doing it is without music, just specting people to know the song but I don't think it is helping me gain any momentum. Please let me know if I need to talk to you in private and call you or email whatever. I would like to continue doing videos but I need to know more first.

      Hi Alex. This is a hard question. You need to understand Fair Use is not an exact science. It is very subjective and UA-cam is the ultimate police, judge, jury, and executioner. They alone decide what is and isn't acceptable. For you to claim Fair Use, you can only use about 10 secs max of material and you must transform it into something of your own. Adding in music will complicate the matter and possibly get you a copyright claim from the music alone. Here is a thought: maybe make another YT account under a different email, and post your video there. See what happens. That way you won't lose your channel you have built up if YT terminates it. Just a thought. 👊🤔

I am looking to use clips for research and I am only looking to use about 25-35 seconds of each video but I do not intend to market or publish the survey, only the results of the research study.     Good night, I would like to know if this is qualified as fair use, I teach bible very well, supposed I take a video of a pastor like Joyce Myers and react to it, how could I do it without being sued or not infringing copyright.       Hey Reynan. Thanks for watching. Yeah, using a whole song is a "no-no." You may get away with it for a while but eventually, UA-cam Content ID is going to pick it up. I would replace the audio in the Creator's studio.

    Hi, Ian. For those five fair use methods you've mentioned at 3:30, aren't there more fair use methods? Because I thought I heard you say there were eight fair use methods in one of your other videos.

      Haha! Emily, you caught me -- those are the 5 per se methods -- the ones we use most often on UA-cam for teaching. Frankly, Fair Use is both objective and subjective. If I was a judge, I would consider other fair Uses -- like for parody, satire, or government documents along with the Fair Use consideration factors of the purpose and character of your use, the nature of the copyrighted work, the amount and substantiality of the portion taken, and, the effect of the use upon the potential market.

    Hi Ian, thanks alot for your video. It gives me tremendous insight on fair use watching your first three videos. I have got a question on fair use. Will fair use qualify if I have a youtube channel with copyrighted videos with Big substitles (not a normal youtube CC subtitle) which is for educational purpose to learn English (listening and reading skill). I am inspired by watching anothet youtuber doing this. Please provide your insight on this. Thanks alot.

    Thanks for this video Ian. I have a question, what if someone puts up a video me, who doesn't own the video and neither do I, where does that fall under? I was on this program DWTS and I would like to get recognition and views to my channel and not get a copy right strike. From my understanding this person doesn't work for the channel where the program was filmed. This person keeps getting the views and most likely the monetization as well. How can I either get some those earnings or ask them to take these videos down? Is this considered fair use for someone to do what I wrote about, both my side and theirs?

      @@iancorzine the videos are of my partner and I on DWST - Chile. There are 2 different people who have uploaded these videos. I was inside a TV station when these were filmed.     Thank you for teaching these things elaboratively! I already subscribed to your channel.
    I like to ask two things if I may,
    1. My channel is near to be monetize and I don't have any copyright claims on any of my videos. Does it mean I'm less likely to get an approval for the partnership with youtube? Im just worried to some of my videos.
    2. I used the video from other content maker for like 2 minutes, BUT their video is muted and has nothing to do with what I am doing. I just teach stuffs about construction like tips and guides while house tour videos are running in my background (70-80% of the video runs with overlay of images for the teaching part means there's a lot of time that the background house tour is sometimes covered).

    I had a channel which disabled for some videos. Which from i earned some money suddenly UA-cam disabled that channel . now i can't accesse in this channel for this reason adsense also disable because i used same email both.now question is can i re-back my channel and earned money which already added in adsense? plz help me by your valuable suggestion.

      So sorry to hear about your channel. I know it can be very frustrating when you put so much work into your channel and then to have it taken down without any warning or reason. 😭 UA-cam has really been cracking down on anything and everything that doesn't abide by their rules and guidelines - AND it seems they are not even giving the creators notice or a chance to correct their mistakes. Lately I have been referring creators to Reddit to see if they can help. Reddit seems to have more knowledge and resources that may be able to help you. Good luck AND thanks for watching. 👊😁

    I have learned so much from your videos. I am not sure if you covered this specific question in a different video, so please forgive me if you have. I am working through your videos. Thank you so so much for teaching this info! Question about Copyright Claims. I made my first critique video, and upon upload, the system realized that my video has copyrighted footage in it. The note from youtube say that it can't be monetized. It also allows me to dispute the claim.
    I am claiming fair use of the video as reaction, critique, and teaching.
    My question is 2 parts: 1) Can I publish the video as is? Will it result in a copyright strike?
    2) Since I am claiming fair use, is it possible to monetize the video? YT says it can't be monetized, but is that just as is? Or does the fact that I am claiming fair use allow me to monetize it as an altered creation?

    I want to do movie reviews full time. Our first review got a copyright claim. I filed and appeal an it was rejected. We transformed the work and made it a commentary. How do I monetize this without getting sued or kicked off? I tried to upload the video review again changing the film but still got a copyright claim?

    These are excellent and extremely helpful videos! I see a lot "cover songs" on UA-cam performed by various vocal groups and singers. I see no attribution or "clearance" language on any of these. Do you have a video talking about this situation. Isn't clearance from the writer or publisher necessary to perform your version of the song? Not talking parody here..I think that's okay. But just plain performance of the song on UA-cam. Thanks for your work on these copyright subjects. Much needed!

    How does a channel of teaching English named as " learn English with TV series" not get a copyright strike for using long portions of movies in their content?
    They transform the content but they don't make it short.

      So true, my UA-cam channel got terminated after 8 years of hard work last year.
      I had 13K subscribers and 2M views which I earned through a long time of hard work which suddenly Japanese companies decided to strike my channel down.

    Can I include short input of celebrity photos (mostly paparazzi photos) to use as commentary/teaching about their fashion for UA-cam and Instagram? I would be commenting directly on the photos during and after the images were input for UA-cam (and within my captions posting them to Instagram).

    So, UA-cam has given me 3 (false claims for THEIR MUSIC LIBRARY), does that mean they can kick me off of UA-cam for sharing my pets, cooking, camping, and life hacks videos when I pay for a subscription to Movavi to edit videos that use music from UA-cam????

    What about fair use for gameplay creators? Sometimes there will be copyrighted music in a game you're playing, that you CAN'T turn off even though you're still commenting on the gameplay in a let'splay series say. Surely this falls under fair use? I think another video about this would be useful.

    Ok, I'm all about fair use, I'm looking for every potential angle I can come at this, but some of the examples were like so weak. So the guy is going to show a video on how to launch and drone, because he can't show you himself how to launch a drone? That is the best example? Ok then...hehehehe. Let me translate that into what is really happening. Let's use some reality based examples that are going on in front of us all over UA-cam. Gamers are vlogging their game experience and they want to use music collages to express their passion in their game, girls are dancing in tiny little dresses to the newest pop songs to get more subscribers because they really don't have any other talent, people are doing all kinds of activities just recording their day to day life to make a channel and using pop music in their videos to gain popularity. That is what is really going on. There is no "training" going on...sorta speak for many tubers. A good example of true training would be a guy showing us how to get the perfect shot with their new DJI pocket 2. But here's the thing, he didn't need to use someone else's video on how to get the perfect shot to show us ...... how to get the perfect shot. You see how silly that sounds? The reality is everyone is just going about their day vlogging and trying to figure out a way to cram a 10 second song of Beyonce in their vlog without getting a copyright strike. That is the reality of it unfortunately.

    You forgot to mention that if you MONETIZE any fair use videos even if your trying to beat around the bush your channel will get a strike or you need to let the original claimed collect the monetization for that video....
