What about online game review videos, is there fair use in that?
So I was just copyright claimed by a random company on one of my videos, it's about the music, thing is I do no damage runs of certain games, this being one of them. Under fair use, does it have to be vocal? Can it be educational and still show just gameplay? I talk during my streams, but for actually videos I prefer to be quiet. What is the best way to go at this point in time?
I've gotten many copyright claims because of the music from the games I play (examples: Let It Die, Kingdom Hearts Final Mix, Until Dawn). Recently one of my videos (Kingdom Hearts Final Mix) got blocked worldwide (first time) because of this. I have the option to mute the parts of my videos that contain that music, but I'd hate to ruin the experience for my viewers. I just don't understand why I can't be allowed to literally promote a game for free, giving their companies more fame and new fans in the process.
I don't even live stream gaming content and I still watched the entire thing lol, your channel is really quality Ian, this is the content that we need in this tricky era of A13, A11 and copyright nervousness on all platforms.

Thanks a lot , Ian. This is very educational. It seems that UA-cam allows people to block or file claims on videos without having to prove ownership of the music in the first place. Anybody can claim to be a copyright holder and file for a dispute or block. I think the best thing is, as you said, best to do gameplay videos of games by companies that specifically allow streaming with an official streaming policy on their website.

For an unmonetized lets play you shouldn't have to do these steps. It should definitely be protected under fair use. If the developer for whatever reason does copyright strike you then youtube should have your back on it because they can prove that you aren't making money off of their work.

I am going to put out funny video game commentary on old games that I am recording and this video helps so that I follow the rules. My question is, do I have to comment every scene I use in a video game to follow fair use or can the scene go on for like 2min and then I comment on something that just happened?

Man this stuff gets complicated. So far the games I stream/ review and play are over 20 years old and don't run into this often. I have had a few from Nintendo before they removed their partner program, but that was it. It is odd that some of these companies are like this as you are providing free advertising... but I can see their point that some might be trashing their product too!

What if the copyright claim is being done by someone who doesn't have the copyright claim? And how do you go about finding out if a compay has the right to make a claim? Especially one that has had a lot of accusations of copyright claim abuse? I love your videos they are very helpful. Thank you for doing them!
Hello! I just started my gaming channel 2 days ago. The first game I'm playing is Fallout 3, and day 1 "ping" content ID copyright claim. I'm like "Crap!" No action needed be taken, however ad revenue is to be taken by the copyright owner. Turns out, the intro has a cinematic scene that has a song playing behind it. That song, as transformative as my goofball commentary might be, compliments the game more than my video. Now I'm far from monetization, but I thought it worth mentioning.
Shoot!! Sorry to hear about your "ping"!! Although YT's algorithms are far from perfect they do pick up on just about everything and the song in the background is a perfect example. Hey Porter! Thanks for watching 👊😃 Yeah, I know -- that's the rub with Fair Use law. You can only do your best. Some gamers do a Twitch live stream and then edit it down to an hour for UA-cam. There is no satisfying answer. When our legislators wrote the Code they did not count on Apex ... 😂

A real question tho is, what if the content I want to cover is something I DON'T like, but is a critical review/satire about the content? I know a lot of this can fall under fair use defense, but at which point should I ask for permission vs. just taking a risk without having the developer get a knowing impression that my intention may be a negative review/ satire/ parody?

I'm kind of confused about some of this...Someone ripped my videos and uploaded them as their own, but I'm not sure I own the copyright because I'm not sure I'm "transforming" it enough. I believe that I am, as each one of my videos takes many many hours to make, but I would love some clarification about this.

Well, for now you can -- BUT in the future the game makers may start making copyright claims on the images. Video game footage is a BIG part of social media and the game makers may decide that they want to be paid for all the videos that are made. To go off what you said could you use commentary over a video game(while talking virtually the entire time) that has a non-commercial use portion in their EULA, and claim fair use if you are commenting upon the content of the game, doing a walkthrough of the game or just doing let's play?
If you
1) do not use music
2) do not feature or display cuts scenes/ spoilers
3) Talk the entire time?
