I worked in retail loss prevention once and can attest the majority of theft is from employees more so than customers.

During the pandemic there was a shortage of hand sanitizer..they were only allowing 1 family member in to shop..I was waiting in the parking lot and I have dark tinted windows..this Walmart employee carries 2 very large hand sanitizers to her car parked ahead of my car. They also had a sign out front stating Walmart was out of hand sanitizer. Very obvious thievery is within amongst the employees and not shoppers.

Sure, but if you don't like it shop someplace else. If they ask everyone then why not. If you don't agree to be 'searched' before entering a concert, airplane etc then you can be refused service. I think they should do the same, because theft cost us all more. Not just the store.

I showed my receipt at Walmart one night. I had over $200 worth of stuff in my cart. The woman proceeded to scan my items and started comparing the prices on my receipt. I took my receipt out of her hand and told her if she thinks I stole something, call the police. She told me she was doing her job. I told her I didn't have time for their nonsense. I no longer show my receipt and tell them if you think I stole something call the police.

I never stop, I tell them no thanks. I'm not wasting my time so someone can check my receipt.
There are two issues, if I was checked out by an employee, if something was missed, go deal with your employee. If I had to check myself out, then my mistakes are your problem. If Walmart wants to save money by getting free labour out if the customer, then mistakes are a part of that.

Btw the "prices rising due to theft" excuse is BS and a scam. They just use that as an excuse to purposely price gouge, walmart tried to complain about theft last year despite posting record profits. They also have insurance writeoffs for that very reason, the price is never passed onto other customers. It's all a grift and you're all coporate simping NPCs if you actually believe that.

So That’s just not true. The 14th Amendment does not apply to stores open to the public. It applies to the government. BUT there are civil remedies for a tort called different things in different US States, but basically it is akin to kidnapping you. But you must ask yourself whether a lawyer would ever take your case under the circumstances because juries are just not down to punish stores trying to prevent theft. As I already commented, you have no “right” to come in and shop there. You could choose not to shop there, or they can choose to exclude you. Would you rather just try to make a point knowing any lawsuit is an unlikely victory, or would you rather just show the receipt? FWIW my experience is that when I offer mine, they don’t look at my stuff, they just sort of pause and mark the receipt and wish me a good day. I don’t mind that personally.

WalMart policy does not live above the law. Whenever I go to Wally World and they ask to see my receipt, I simply say "No thanks. I'm good.". On 1 occasion the door greeter grabbed my shopping cart. I told this guy that the first thing he should do is take his hand off of my cart and the second thing he should do, is to learn the law before he finds himself eating a bullet. Yes, I carry concealed. They decided to call the local Sheriff's Office and when the deputy arrived (actually 3 of them), the cops checked my concealed carry permit and then told the door greeter that he had no right at all, to even speak to me. Even the deputy sheriffs never asked to see any receipt. Yes, they did tell me that this all could have been avoided, had I simply complied with the worker and showed my receipt, but my life isn't lived to comply with anything that is not written law. Fun fact, when they put their hands on your shopping cart, it is the same as them putting their hands on your physical body and that, is illegal, unless they have active probable cause to believe that you are stealing. They are responsible to prove this probable cause. To this day, I have never shown my receipt to any Wally World door greeter and I have never been arrested or barred from returning to the store. Know your rights. There is no law, in any of our 50 states, that requires you to prove that you DID pay for your merchandise. This only applies to public access retail and grocery stores. If you are in a membership only store, the law is much different. The contract that you sign when buying that membership, has a lot of legal speak and that legal speak states that you are required, upon being asked to provide proof that you actually paid for everything you are removing from that establishment, you agree to do so. Simply tell these door greeters that if they want to see your receipt, they will have to legally detain you. If they do, then they are effectively placing you under arrest and you are not free to continue with your life. If you haven't stolen anything, this is called "false arrest" or "false imprisonment" and you can take home a pretty nice payday. For me personally, I never go into any Wally World, without someone else with me and they know that if I do get stopped, detained or arrested, they will instantly pull out their phone and record the entire event.

So, it is not YOUR shopping cart, it is there’s they lend to you for your convenience. When they grab it, they are not committing a battery the way the person would if they grabbed your body or your clothes or your hat. The issue is more about not posting on your way in that you’re subject to being stopped to produce your receipt, because sure they can stop you and check your receipt before you leave. The law you are thinking about is the 14th amendment that ONLY applies to the state and federal government. The general principle is that it is torturous conduct to prevent a person from moving about. But your remedy is an expensive jury trial, and a low probability of success with a jury. If you do win, what the heck are your damages? Good luck getting a lawyer to take this case and honestly, with your attitude, you would not endear yourself to the jury. After you win your nominal damages, you’re likely to be out the large cost of the lawyer. Better to shop somewhere else if it bugs you that much. They sure could exclude your entry and refuse you your ability to enter to shop there.

Respectfully, as a 40-year criminal defense attorney now retired, I can say that you exercising your Constitutional rights can not ever possibly provide probable cause to detain and/or search you or your possessions.
    BUT!!
Then your refusal to cooperate as a practical matter could result in them excluding you from entry. They don’t have to invite the world into their store, but currently they do. It’s like the RV’s sleeping overnight. One argument used to be the store is open 24/7 so anyone could hang in their parking lot because the store is open. Obviously, once the spots fill up the store loses customers. Once folks’ trash starts getting strewn about, or folks start bothering others, the store can lose business….so they can change the signs again and notify all who enter that they are subject to being denied entry by the store. The only remedy there like this lady in the video, is to prove they are harassing a “protected class,” but again as a practical matter, it would be really difficult to find a lawyer willing to take the case because that kind of a case is not as likely to be “cost effective” from their point-of-view….

Not stopping does not give a store the probable cause they need. I worked asset protection for Walmart and we were taught that you had to have 3 things in order to stop someone.
    1. You had to witness them select an item.
    2. You have to see them conceal an item.
    3. You have to see them walk past the point of sale without paying for the item(s) (which is typically the door to leave)
And you must have a visual on the individual THE WHOLE TIME after seeing them select and conceal the item. If someone does not have ALL three things, along with constant visual they can and should not stop an individual because that person can file a lawsuit against the store for a wrongful stop.

While it might be against a specific Walmart policy, any employee or agent of the business can legally and lawfully detain someone he/has personal knowledge and reasonable suspicion is shoplifting. The issue here is that they are stopping people with zero reasonable suspicion. Declining a search cannot create a reasonable suspicion to justify the detainment. There is no need to be deputized or be legal peace officers. In *most* states there are specific statutory provisions that allow this.

Correct. You don't have to follow any rules that stores have in place. They are not laws. They can tell you to leave and then you can get charged with trespassing if you don't. If you steel, that is a crime. If you touch someone else, that is a crime. If you break something, that is a crime. If you expose your self in public, that is a crime. Walking away from someone and leaving a store with something you paid for is not a crime. In fact, If they ever put their hands on you and try to stop you from leaving, that is a crime they committed unless they know you just comitted a felony. They can call the police but nothing will happen because you comitted no crime. I always decline because they see me at the register and still stop me. They have no legal authority and can not force you to stop or force you to show them anything. I always tell them no and keep walking as it is my right to not be detained or have unreasonable search and seizure when comiting no crime.

Facts. I had got stopped at the exit to Wal-Mart, and the person at the door asked me for my receipt. I stopped and told her "There is no membership here, so I don't have to show you my receipt", and before I could get the last word out, the woman at the door cut me off said "Ok have a good day bye" in a annoying tone as if she knew I was on to her bullshi..

@gunluvr20 - you are badly mistaken about that. Almost every state authorizes citizen’s arrests, though the particulars vary. Even the federal government in the form of the Supreme Court - way back in 1946 - recognizes citizen’s arrests as valid. The only state that does not recognize a citizen’s arrest as lawful is North Carolina, and even NC allows people to detain a suspect until police arrive.
In most places that recognize citizen’s arrests, resisting a citizen’s arrest is just as illegal as resisting an arrest by law enforcement. In some states a citizen making an arrest has more freedom in how to do so than a cop does - for example, in Kentucky it is illegal for a cop to shoot a felony suspect who is fleeing from arrest, but completely legal for someone making a citizen’s arrest to do so.
Some states, such as Texas, go so far as to authorize citizen’s arrests in the same paragraph of the same statute that authorizes police to make arrests.
Citizen’s arrest has its roots in common law, and the thing to remember about police is they weren’t invented until 1815. The first US city to create a police force was Boston in the 1830s. The US didn’t simply do without courts and law enforcement from 1776 to 1838. Citizen’s arrest is a leftover (but a still perfectly valid leftover) from that time period.

Can't the store say this is our policy and if you don't want to show the receipt, you don't have to shop here? That's what I would do if I was Walmart. Show me your receipt, no banned from the store. "NO SOUP FOR YOU!"

My mom is a Walmart greeter. They are not stopping people because color. My mom is not racist. Jerks who were stealing stuff have called her that, though, an elderly lady who was recovering from cancer and had to work. However, many people try to steal TVs. They don't MAKE you stop, just because they ask to see the receipt. They try to check all receipts, but especially the ones for carts that have large, expensive items. People walk right out with bikes they haven't paid for, then yell the greeters are racist. It's weird to yell to employees with dark skin that they're racist. "May I check your receipt?" Yes or no is fine, not, "racist!" People steal from there many times a day. They don't even try to catch them all. Knowing they'll ask to see your receipt is basically a deterrent, including for kids. If it was actually security, they wouldn't have elderly women who hobble around doing the job.
