- The plaintiff says he brought his van to the defendant’s shop for repairs, but he claims the defendant faked the post-repair inspection. The plaintiff says his tires were in bad shape, but the defendant charged him hundreds, so he’s suing for a refund. The defendant says the plaintiff’s van was 25 years old and he repaired what he could. He claims the plaintiff showed up six months later looking for a refund.

The verdict was fair. The plaintiff should’ve taken the vehicle back immediately or within a reasonable amount of time. A lot can happen in 90 days.. 25yr old vehicle is a time bomb ticking especially when it’s setting up dry rotting..

He seems like a mechanic you would want to have. When you’re super broke you need to just be able to “get by” to pass inspection lol. He knows exactly do it cheaply. I hate mechanics who do extra crap after discussing the only stuff you want done, then charge you for it after it’s all done. Making it nowhere near the discussed price.

plaintiff is CHEAP!!! how long was that van sitting there with those tires on? dry rot?! at the least, should have replaced ALL! of the tires (for his own safety & peace of mind); but like he kept saying, he didn't want to put a lot of money into this van, the Inspector comes across as a decent guy!

Concerning the alignment I have been told the same thing plaintiff is saying, if the car needs balljoints or new tires mechanics won't do the alignment. It won't be aligned no matter what they do if these things aren't fixed first

If Plaintiff knew the tires were bad, he should have bought all new ones.
The only thing the defendant "should" have done is maybe have created a "need to do soon" list for the guy. My first car was a 1986 Ford Escort and the last time I had it inspected (1998 after owning it for only two years) it failed but I was given 2 lists of "defects." One for the failed items and one for the need to fix that was outside the inspection requirements.
I understand why she didn’t entertain the mans lawsuit but now he’s leaving thinking he was still right and the judge “didn’t let him talk” 🙄
I've only sued someone once in my life however I don't think it's smart to tell the JUDGE what's not important/revelant. She was correct in saying don't mansplain me bc he wouldn't have done that to a male judge. Judgement was fair. He didn't call the mechanic immediately so that's on him.

Y'all are in a bubble. The defendant had a completely different demeanor with Doug. This case was a waste of her time. It wasn't the defendant's fault and the plaintiff didn't have to talk down to the judge. He was on the defense and didn't see it as time wasted because he was forced to stand up for himself. Bit if he had stood before a male judge he would have been respectful, as he was with Doug. Just answer the questions and don't treat women like that don't know what you are talking about.

Here in Australia a lot of used cars are sold with barely passable tyres, if you buy a cheap car from a used car lot, you know you need to buy new tyres within a month or 2.

If the mechanic/ manager had missed that much impaired items on the van, foregoing extra revenue for himself because he was - what- lazy?? He would be out of business because of all the consequences and mistakes brought about by his "lazy" habits.
I've seen some pretty stupid cases here, but this one should get a prize. The guy comes in seeking damages and all he can come up with is: he should have told me it needs a lot more work that I am not willing to pay for. What an a-hole.

That’s what mansplaining is-it’s trying to teach a woman her field of expertise and it happens to women like us who reach high levels in our field all the time. I’ve been asked to fetch coffee “because this guy is going to be late” when I was the guest lecturer the men in the room had been waiting for. I will tell my customers about looming problems like that van had, but it's not the mechanic's responsibility. I did a brake job today and informed the customer of a damaged tire that he needs to get replaced because it's damaged. I don't sell or install tires, it's just the right thing to do to protect people.
For a start, stop calling the vehicle "a van", it's a campervan. The Inspector thought the three tires were okay, that's why it passed. If you think the work was faulty, then you go back straightaway, not 3 months later, no sympathy for the plaintiff.
The fact she didn't even bang the gavel down shows how much she felt this was a waste of her time and everyone elses and just left.
Guess the plaintiffs size did not intimidate the judge here.

I understand what the plaintiff was saying . He really wanted a real inspection. The defendant thought he was helping him out by giving him the small things he needed to pass inspection maybe he thought the man was going to sell the van . The plaintiff was saying that he really wanted an inspection and not simply “pass” inspection . The judge came out already bias against this case without even really listening . But the plaintiff did have the van for 3 months so it could’ve gotten worse in that time as well .
If he wanted a real inspection, he wouldnt have walked in saying I didn't want to spend a lot of money

He also was saying you can't do a alinement with dry rotted tires. Alinement is done on the rims, tires have nothing to do with it.

Plaintiff is ungrateful and a fool.
The defendant could have not passed the inspection, and the plaintiff would still would have had to pay for the work and the inspection. Then the plaintiff would have had to find a place to store the van, or drive around hoping he won’t get a ticket.
The inspection is getting a sticker showing that the things on the checklist are functional to the state government. Not listing the problems with the vehicle- which the defendant certainly would have done if requested. And mentioned a lot more.
Problem was the plaintiffs comprehension- the defendant didn’t do anything wrong. In fact what is common is mechanics will overstate work that is not necessary, and charge extra.

The plaintiff didn't have an opportunity to address the defendant's claims before the Judge passed judgement. The plaintiff probably couldn't have, but still, he didn't have that opportunity. The judge's use of the term "mansplain" shows an unwarranted prejudice. Make me wonder why she even took the case at all. Wasting my time.

Judge was against the plaintiff from the start ("mansplain" etc.. I hate it when guys mansplain too, but that was just the plaintiff stating his opinion / rationale for not calling).
In this case, he perhaps needed a more detailed expert evidence, it certainly is feasible to see rotten tyres / breaks which are sufficiently bad that on balance of probabilities, they were sufficiently bad 3 months prior, and should have been flagged as an unsafe vehicle. Next time it won't be a wasted $600, but a car crash because the defendant signed off on an unsafe vehicle.
