- The plaintiff says he brought his iPhone to the defendant’s shop for repair, but it stopped working again a day later. He claims the defendant wanted another $100 to fix it, so he’s suing for his money back. The defendant claims the plaintiff came back seven months later with a damaged phone complaining that the phone didn’t work. He says he owes nothing.

It's lack of knowledge of the devices on both sides. If the receipt is correct that the device was a 6+, rather than a 6s like the old guy said, then it was probably "touch disease" meaning the touch IC was going bad.
6S doesn't have the same touch IC setup so you can't blame touch disease and it was probably a faulty part or a main board issue...which, yes, you can replace motherboards lol

it should matter but sometimes it doesn't. I brought evidence to court when I was fighting my mortgage company, I had physical proof that I paid my mortgage for the months they claimed I didn'.t Judge sided with the crooked bank. You'd be surprised. I'll go to my grave always wondering how in the hell that happened. I did win against them n another issue but for the mortgage payments, I had copies of the checks with their endorsement on the back of the checks showing they cashed all the payments, judge didn't care. unfortunately a true story. Curt, he's justified in wanting his money back because the phone wasn't fixed even if he doesn't use it to fix the phone. He didn't get the satisfaction of his contract with the repair tech.

@@TechX1320 phone is damaged is a common excuse to not refund. My mother had a camera that the catch that kept the batteries in was broken, she put it in for warranty repair, they came back saying water damage. The camera worked fine. I then realised that that was a common excuse to not repair under warranty as you can't really prove otherwise. So when I had a situation with a phone with that excuse, I called their bluff and wanted the phone back for independent testing. Well they conveniently lost the phone and still didn't want to replace or refund, but upon threatening to take it further, I got my refund. You need to be aware of the common excuses before hand and get proof. You shouldn't have to, but you do.

Defendant is full of crap! “It wouldn’t work and then not work.” NONSENSE! I’ve taken my phone for repairs, picked the phone up, it worked for a few hours, and then it stopped working again.
That's usually faulty parts. My repair shop has a warranty for lifetime, as long as you don't drop and crack the screen again. What the old guy was experiencing, if the receipt is to be believed with it being a 6 plus, rather than it being a 6S like you said, it was probably touched disease where the touch IC starts to fail after a few years.
Some repair shops use some really crappy parts. Like, I would trust eBay parts more than some of the parts these shops use. Especially a mall kiosk. Never go to a monkey ask, never go to a place that you don't really recognize the name of, always look at business reviews, hell ask if you can watch

With this particular IPhone model, this problem is known as “ touch disease “ It was a design flaw. Apple never took responsibility for the problem.
Touch Disease was in iph6 and 6plus. The chip was reinforced in the 6S and 6Splus, so they didn’t have it. Touch disease was very easy to diagnose for a technician that takes the time examine to phone. I have over 20 years of repair experience. I hate repair kiosks in the malls, they take shortcuts and then blame the customer for not realizing they screwed up their phone before they pay them.

I always thought the receipts were heat printed not ink. If you put the around something hot they get dark. I worked retail for years and replaced plenty of receipt paper, never had to put ink in anything. 🤷🏾♀️ who knws anyways I always make a copy of the serious receipts cause I knw they will eventually fade.

Doug was so stupid at the end... the question he asked the plaintiff didn't make any sense (he was sueing because they he paid for a service he didn't get) and secondly - he kept saying the defendant brought the whole neighbourhood, which is offensive - it was his FAMILY!

If you are dealing with a business with lousy record keeping, YOU keep the records. Keep every communication. Follow up conversations with email or text. Take a picture of yourself at the shop so there is a timestamp. And usually if there is a dispute and you show them all the records you kept, they'll either believe you or stop trying to swindle you.

The guy's question at 12:25 doesn't make sense. He paid $130.67 to repair his old phone. They didn't repair his old phone (long term) so he sued for the money. Because the phone is still broken, he went and bought a new phone. He now can attribute the $130.67 he paid the repair shop to fix his old phone (but didn't) to the price of the new phone he just bought. The guy asking the question (I forgot his name) thinks the plaintiff is going to go and get his old phone fixed while having the new phone in his other pocket.
I’m glad he sent in the evidence and won. Neither of them were believable in court though. I’m really surprised she gave the plaintiff a week to send in evidence. At most she’s taking a quick recess to let them try to get something, but not a week to get evidence. I can’t count many times I’ve heard her say ‘this is your day in court’…‘you knew you were coming here today’… ‘I need to here more than flapping gums’ That’s all this case was.
yes but some things are obvious that you need and some not so much. Judge Judy is the same. sometimes she will give a recess, if it not so obvious that it was something you needed.

Don't know what set the judge off on this one. The guy took his phone to a kiosk in a mall for repair. The phone started working after the repair. A month+ later and he wants his money back? And he does it sneakily by contesting the cc charge? Her "I've owned phones!" nonsense was ridiculous as well. It's like when people say that they "went to school" before trying to tell a teacher how to do the job. From a legal standpoint, this case should have been simple. The receipt clearly stated "No refunds, no exchanges, no warranty." The plaintiff signed that receipt. The judge acknowledged seeing that policy on the original receipt. He doesn't NEED records with that policy on the receipt. Her verdict was dead wrong.
Plaintiff wants to to become whole I get him and it’s the principal you can’t keep operating bad business stealing folks hard earned cash.

Defendant does bad business , and gives really bad customer service. No one will go back there, or recommend them, rather earn bad reputation. They will be going out of business, if they haven’t already.
I used to repair phones, and even if what the defendant claims is true, they should have made it clear to the customer beforehand that he will be taking chances on repairing, instead of replacing the phone for a another one- then they wouldn’t have gotten a dissatisfied customer. Even selling a used one to the plaintiff would have been better.
Best practice for sellers - just give the money back, and you won’t have to deal with disputing customers. Just consider it as a business loss .

Having worked in a repair shop the defendant really came in with ego and not logic. When we did repairs we remembered what we did and for who. Also not many repair places work for free. If we looked at your phone there was a charge. If we repaired it and showed you it working there was a charge and warranty. However if someone came back weeks later and complained of the same issue but there was physical damage then the warranty would be void.

If you own a iPhone6s, pleeeease do not take it to a “We fix iPhones” store. I have a friend who had iPhone problems They took it to the Apple Store. The cost of the repair is similar to a neighborhood shop. The difference is it is still working, without having to go back and get it re repaired.
Apple phones are rubbish. Theyre all about gimmicks. Not sure about newer ones now but older ones up to about 6 at least, can't expand memory, look at the glass the wrong way it shatters, doesn't do much more than an android, in many cases less. Yes there is face time but so what, there is messenger which essentially does the same. Yet the iPhone then costs 10 times more than an android all for gimmicks and being trendy.

Not specifically true, iPhone 6 was plagued with an issue known as "touch disease" and it was caused by improper board design on apples fault, In this scenario i'd have done the exact same in regards to the repair. There was no way of knowing that phone was going to then have a board level fault as it was working after the repair had been done.
The fault occurred again in the end users hands and without looking into the repair aspect she has very arrogantly decided against him, If she could actually diagnose a phone she'd realise noones exactly at fault here
@@ryanon252 if he brought it in because it wasn't working and asked for it to be fixed. They replaced the screen the screen wasn't the issue. And most times with frozen screens a hard reset will put it working again for a little bit.

He wanted his money back for the faulty repair... He ended up buying a new phone because his old phone was broken and he had to pay for a faulty repair. How is it just that he has to pay for a repair that didn't work? Ridiculous.
