Drunk Chef Arrested for DWI After Leaving a Party

- On January 9, 2023 around 1:21 AM, Patrolman Scott Macmillan with the Byram Township Police Department observed a 2010 GMC driving in an erratic manner on Route 206 and Route 183. He initiated a traffic stop and made contact with the driver, who was identified as Carrie. Carrie told Patrolman Macmillan that she was a chef and she was heading home from work. Patrolman Macmillan asked her if she had anything to drink, and she admitted to probably consuming 1 beer before operating a motor vehicle. Based on his suspicion of impairment, he called for another officer to come on scene and administer field sobriety exercises.
After the other officer arrived on scene, Carrie was asked to exit he vehicle and perform field sobriety exercises. The first exercise was the Horizontal Gaze Nystagmus (HGN) test. The second exercise was the Walk and Turn test, and Carrie did not touch heel-to-toe on each step and failed to keep her hands at her sides. The final exercise was the One Leg Stand test, and Carrie failed to raise her foot in the proper fashion while nearly falling over.
Based on her erratic driving, her admission to drinking, and her inability to perform the field sobriety exercises adequately, she was placed under arrest for DWI. Patrolman Macmillan transported her to the Byram Township Police Department for processing. Carrie was read Standard Statement for Motor Vehicle Operators and she agreed to submit breath samples, but they were unable to get an adequate sample because she claimed to be sick and she was coughing. She was then asked to consent to a blood draw, but she refused. As a result of her refusal, the officers obtained a warrant to compel a blood draw, and Patrolman Macmillan transported her to Newton Medical Center to obtain a blood sample. Carrie was subsequently transported back to the Byram Township Police Department.
Carrie was issued citations from both Byram Township and Stanhope because they observed violations committed in both jurisdictions. She was eventually released pending court appearances in both the Andover Joint Municipal Court (for Byram Township) and the Stanhope Municipal Court. She was issued the following summonses: Operating under the influence (39:4-50), reckless driving (39:4-96), careless driving (39:4-97 from Byram Township), improper use of high and low headlight beams (39:3-60), and careless driving (39:4-97 from Stanhope)
Court records indicate that on April 19, 2023, Carrie pleaded guilty to operating under the influence and she had to pay a total of $690 in fines, her license was revoked for 4 months, and she had to spend 12 hours at an intoxicated driver resource center while using an ignition interlock device for 3 months. The other citations from Byram Township were dismissed as part of a plea agreement. Carrie also pleaded guilty to careless driving and improper use of high and low headlight beams in the Stanhope Municipal Court and a total of $380 in fines.

The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. I don’t think she learned any lessons from this experience. Her rant at the end was just the icing on the cake. But, I’m glad she got those citations, pled guilty to the charges and paid her fines. The suspended license and interlock device is not BS. Maybe, she’ll learn a lesson.

She only coughs when she remembers to cough. The whole time on the phone with “baby”, she was all better though. When the officer asked if she was on medication for her cold, that reminded her to resume coughing.

When she was just chatting away with the officers there were no cough at all but, yowza in the "blow room" those drawn out coughs sounded a lot like she ran a real risk of p00ping her pants! As well as when ever she was reminded ofc... Isn't it usually a refusal when the officers have to apply for a bl00d warrant, I mean she did refuse?!

I broke a toe once in my twenties. I was teaching high school. I'm in my mid 70's now. I ran my toe against the cap end of the foot of an ironing board and cracked it down the middle. I couldn't even walk the pain was so bad. I saw a doctor, he wiggled the toe to see if it was broken and I almost passed out. He gave me shot of anesthetic, taped the broken toe to the good toe. The pain was so bad I almost threw up. I had to use crutches the for next several days, I couldn't put any weight on it. I will never forget how painful that was. So, she is lying. The policeman sounded almost incredulous when she told him that.
I agree! I broke the same toe twice and you described it perfectly! There's no way her toe was broken. I don't care what a person's pain tolerance is, I believeshe was lying. I could barely get my foot into a slipper without tears.

There is a calculation that they do based on the time the blood was drawn. I was hoping they would post it but safe to assume she was over because she was found guilty in court.

I just realized when she said how embarrassing it is to get arrested. She needs to be grateful that it isn't the way it was when I was growing up. I remember my parents reading daily arrest in our local paper, to see if they knew anybody and what they were arrested for. I guess getting blood drawn cures her cough.
