The Preliminary investigation is required for cases where the penalty prescribed by law is at least four (4) years, two (2) months and one (1) day without regard to the fine. So it is true that the violation of an ordinance requires no preliminary investigation not only because it is a summary procedure but also the penalty prescribed does not qualify with the required penalty requiring preliminary investigation as per Rule 112 Sec. 1 of the Rules of Court.
