Hello po judge, goodmorning, i was one of your listener.
" Hot pursuit topic" Scenario
The crime of robbery was comitted at 3:00 pm of December 25,2018, the suspect was voluntarily surrendered before the barangay at 7:30 pm of December 26,20218, then the arresting police officers went beforw the barangay and arrested the suspect. The inquest proceeding was conducted on December 27,2018 At 8:00 in the morning,
The respondent waive his right to preliminary investigation and not having sign a waiver pursuant to Article 125 of the RPC.
The information was filed before the RTC- OCC. The accused did not file a motion for re investigation to contest the illegality of his arrest.
On January 7,2019, accused posted bail. Before Arraignment, accused failed to file a motion for reinvestigation. Trial in on going ang the prosecution has rested his case.
7 months later, August 2019, accused filed administrative case before the NAPOLCOM for conduct unbecoming of a police officer and gross incomptence against the arresting police officers.
Two years after, the decision of the NAPOLCOM finding the police officers guilty of illegal arrest and meted the penalty of one rank demotion.
Is the decision of the NAPOLCOM CORRECT?
para akin opinion, bakit hindi nag file si respondent ng motion to dismiss in the prosecutor for the ground of arrest illegality instead of suing the police officer, case may dismiss in lieu of technicalities
