I would have never assumed that those photos were of the documents scattered around because that's how Trump left them, but now that he's going out of his way to deny that I just have to assume he absolutely did.

Exactly. It was an evidence photo, where they stage documents to photograph for evidence. The only person who claimed an issue with it was trump himself! I imagine he was again just trying to create a conspiratorial talking point to distract his blind sheep from the real issue at hand here. He knows his followers well. Show them a shiny ball with the word “fraud” painted on it, and they run after it.
He probably didn't keep them like that. As Devin said that photo is common practice to show what they were taking. They were probably in that box with the magazines. However, the intermingling of his personal stuff and the docs is akin to what you're describing anyway.

Rn, the House would look at it and potentially see issue, but this current Senate still has the same problem this Judge does-Being still loyal to Trump more than the people, that is-so the Senate couldn’t impeach her w/o being in trouble with Trump/his supporters, which would mean poor re-election results for Republicans in Congress because they’d be ‘RINOs’ like Liz Cheney in the eyes of the voters they desperately want to vote for them in November. After November if the Senate doesn’t flip I think their responses will largely depend on how far the investigation has come and what poll numbers are on it. If Trump support wanes so will many Senators, if not, they’ll stick by what’ll get them re-elected. If the Senate flips, then Dems control Congress and they’ll probably have a lot of things they wanna do speedily, so I think it’d just be a matter of priority and how prioritized impeaching this judge would be if she stepped over that line. If I had stolen dozens of Top Secret/SCI documents, I don't think that I would have been able to hold onto them for a year and a half and then pick my own judge to handle the case once they were finally recovered.

It's not damage to reputation, that was merely an assumption, it's because it would prevent him from running and as a consequence they have to assuage the possibility of it being a political attack, rather than a conventional breach of law.

I find it disconcerting that his presentation is very one-sided and that he does not explain all sides with equal fervor. This would be fine if he were clear about his biased approach but the fact that he is not indicates that he is dishonest and not interested in imparting truth to his viewers.

The fact that we are now witnessing a former president arguing that the DOJ planted documents in his home during a raid, but he kept those documents secure before the raid even happened and he had declassified these documents before they ever reached Mar-a-Lago, but he still needs a third party to review the illegally planted evidence that he declassified and took good care of before they were planted because it would hurt his reputation, and all of that is being taken as a serious legal debate right now shows why this country is so screwed.
The fun part comes after the indictments. Trump is going to pick some defenses. Then the DOJ is going to ask about the times he claimed something that contradicted those defenses. Especially if Trump keeps his current legal team

As a former records office supervisor, a room with a lock is not enough for documents that need special protection. That room had to be certified to a level of being a vault - surrounding walls, floor and ceiling made of concrete or cinder blocks. I hope that basement room came close to that level.
I work at a school and even we have a vault built to state specification for the storage of state tests and the likes. Walls have to be X feet, door needs to be made of Y material and weigh Z pounds, etc.

The sad part is the DOJ laid those documents out like that to take the picture, that isn't how they were found. That is the stupidity of the Trump org, they claim they never left it like that...but evidence is laid out and photographed where it is found, so it was most likely in front of the time magazine portion of the box that they were found in. They photo the evidence then put it in a box, then take it away. The lunacy of the Trump's is he is clean, and we have seen pictures of inside his office and it tells a different story anyways. But the fact they claim they didn't leave them out like that is confirming they had them, or admission of guilt.
The special master appointment is ludicrous. Their argument is if a suspect is rich or famous enough, they should have special privileges in criminal trials that a layman can't assert. Guy working at dollar general cant say he needs a special master or his reputation could be ruined, by any celebrity or corporate exec can say it and cite this case. It's disgusting they're creating a new way for the justice system to benefit the wealthy.

It’s literally nothing new to have someone go in and check whether or not something was done correctly. A normal person wouldn’t be raided for official documents…. If someone normal was in that type of government position and was accused of taking certain documents they too would probably send someone in to see those papers. I mean what happened to innocent until proven guilty. Don’t say that Trump is obviously guilty because of the documents he had in his posession. The debate at hand is whether or not they are classified or declassified.

@@decrulez Nothing in her emails were marked classified, which is a little better than Trump's flagrant disregard for security, but various pieces of information that should have been properly marked and should have never been sent on an unclassified system. Unfortunately, lazy people in the state department did the wrong thing (and should probably be held responsible too) and essentially reproduced classified information from memory when drafting emails on unclassified systems. If this were contained to government servers, it would have been identified as a "spillage" incident and cleaned up with audits confirming that none of the classified information was compromised, but because Clinton was super special, she had her own special server that all of her unclassified work email got forwarded to. Those sorts of clean-ups and audits weren't possible to the same degree as if it were contained to a government system... which is why she should have never had her own mail server to begin with. I'll put it this way... if a soldier, marine, sailor or airman did what Clinton did, they'd have received a dishonorable discharge at best, jail time at worst. But because Clinton is a powerful and rich politician, she got essentially a smack on the wrist and got told "don't do that again." Saying she deserves jail time is mostly hyperbole on my part, but she does deserve significant consequences/repercussions that send a clear message that our politicians are not above the law. Unfortunately, my cynical opinion on this whole Trump situation is that, like Clinton, he's going to get a slap on the wrist at most because he is a rich and powerful politician.
As a non-native English speaker; since the beginning for this year. I've learn so many new English words and terms I never knew existed. Words like, affadavit , plaintiff, subpoena, and Special Master. To my mind Trump is screwing around with the justice system in America, and he should not be allowed to.

There's more moving parts in modern government than our constitutions framework is capable of addressing. We have so much corruption because nobody could have foreseen just how many new pieces with new weaknesses would be built. We're decades overdue for a total review of the constitution and our core legal framework as a whole. There are too many bad actors in law, too many places for them to hide, and too many ways for them to gain footholds and abuse their powers.
It is not broken, it functions exactly as intended, for the rich, by the rich and of the rich. That is why justice is for sale at a very high price. You get arrested without warrants, never get to see the evidence or interview witnesses, and never get your day in court because you will be all but forced to accept a plea deal whether you did the crime or not. Oh, and it helps them that they have now made practically everything illegal and can stack 20 different charges for one offense. And can set bail at such ridiculous high amounts like a million dollars or more, for people who never made more than $15 per hour in their life. If it were actual justice you could go into a courtroom and argue your own case because the laws would be simple and fair, it should be up to the state to PROVE your guilt to a jury of your peers. Instead it is up to the poor to prove their innocence to cops and courts who do not even look at you as an individual. MONEY = RIGHTS. POVERTY = PRIVILEGES that can be revoked without notice.

Unless there were some communications that I'm not aware of, it seems like this judge has been having ex parte communications with the Trump team. The main thing that comes to mind is that after the first filing she asked for clarifications, but then after a few days she just spontaneously issued her."inclined to approve" statement without receiving anything from the Trump team. As I recall there was one or two other things she did without having any filing from the either of the parties.

Trump almost completely picked people from the court supplied from a list of Federalist Society members, who are ultra-conservative partisans who want to see all the progress of the Warren Court overturned. Conservatives are packing the courts with partisans for EXACTLY this reason - because it means that nothing they do will ever be held accountable. This judge was picked by Trump and his rich corporate cronies for exactly this purpose. She knew what she was going to do for him the moment she was appointed - no additional communique necessary.

No, it’s 100% standard practice for defendants in multiple proceedings to request all cases be brought before the same court, particularly if that court has General Jurisdiction over the defendant. It makes mounting a defense far cheaper and more effective, as all documents and appearances will be in one place instead of all over the country, and any reasonable defendant would make the same request (and generally they are accepted)

And did it again (go to Fort Pierce) for this Search Warrant case (filed in West Palm Beach). That's not standard practice. That's blatant gaming, rigging and cheating.

Placing a man under the authority of an individual he placed in power is fundamentally a conflict of interest. There exists no realistic means to clear the judge of any debts, real or perceived, to the defendant.

As someone with a Top Secret/SCI security clearance, I'm immensely frustrated by this entire situation. I cannot begin to describe how sensitive the information in TS/SCI documents is, and how damaging to the United States it could be if such information is leaked to foreign actors, and we KNOW for a fact that Mar-A-Lago frequently hosts foreign persons of interest who may not have good intentions towards the US. In my particular case, the TS/SCI information that I handled contained information on how to strike critical targets with long-range missiles, including flight paths and trajectory information that could be used to defeat such attacks by simply placing anti-air batteries in the right locations; that is an EXCEPTIONALLY mild example of the information such documents contain. The President can't simply declare a document declassified, and the fact that ANYONE believes him when he says that is concerning! Why do people simply believe whatever this man says, no matter how outrageous? The declassification process needs to be followed to the letter if a document is to be declassified; the President can REQUEST declassification, and even has very broad authority to do so, but that is only the START to the process. Declassifying a document requires it to be reviewed, redacted of potentially damaging information, expunged of its classification markings, and other critical administrative steps. Unless and until those steps happen, THE DOCUMENT REMAINS CLASSIFIED. Furthermore, it is NOT within the President's authority to remove, retain, or disseminate documents concerning the US nuclear weapons program; such documents are not actually "classified", at least not in the normal manner. They are basically NEVER "declassified" and instead follow a completely separate procedure that is NOT under the purview of the President when being released from protective measures. If ANY OTHER government official, including former Presidents, were in this situation they would likely already be in prison and many of the very same people who support Trump would be calling for their heads. Just imagine if President Obama had behaved in this manner! They would be calling for an execution at dawn!
I am concerned that this was allowed to happen. Many of us have always known Trump is untrustworthy. How did he get that much stuff into unsecure locations? Aren't there procedures in place to prevent that? Or was the problem that the people responsible for those procedures were loyal to him? I feel like this should be bigger than just him. A single elected dumbass should never be able to singlehandedly ruin our and our allies' national security.
Unfortunately, the precedent was already set in 2016 with the Email scandal. Classified documents were stored in a private residence, and even worse, with internet access on a server. Anyone here claiming "Orange Man Bad", while still not screaming about the email server is showing bias. BOTH are serious situations, and BOTH should be held accountable. You can't jail trump without jailing the darling of glass ceilings Hillary. It's already been decided, and the same people that defended her and her actions, gave Trump the ability to get away with it. You did this to yourselves. I also have Top Secret/SCI clearance (since inactive) and have seen just how careless many people are with information. It's nothing new, but it is still dangerous.

However, it also doesn't set a precedent in any way that has anything at all to do with Trump's exfiltration of both classified material and documents pertaining to the nuclear weapons program. What you have brought up here is a "whataboutism". You are literally saying "What about Clinton's email server!" What about it? It's a completely separate matter. I believe that the FBI made a mistake in not pursuing Clinton's use of a private email server further, but that mistake does NOT preclude them from taking law enforcement action against Trump. It has been upheld time and time again in courtrooms at every level that law enforcement does NOT have to perfectly prosecute every alleged crime to be able to continue to prosecute future crimes. Worth mentioning: powerful people get away with high-profile crimes all the time, which isn't right. That doesn't mean that we as a nation have forfeited our right to prosecute people who commit crimes in the future.

In various circumstances it's possible for counsel to discuss things with a judge, but it can't legally be deliberated on if it must be decided in court since the other party must have opportunity to argue against it if they object. The fact that the 41g was granted despite not technically being filed and they barely argued anything and she gave Trump what he wanted is rather suspicious.
Worse than that. Donnie Dimwit was already told by the original Magistrate Judge that no special master was needed as there was already a taint team in place performing all the needed reviews. So because he was told no, Donnie Dimwit went judge shopping for a judge that would kiss his aspirations. And he found one he appointed that was very recently installed, like between election day and inauguration day 2020-2021. And she was willing to toss aside that appointment for her master Donnie Dimwit.

There absolutely SHOULD be a law that prohibits a judge to have any involvement in a criminal case involving a former president who appointed them or tbh any politician who was involved in the process. Whether they voted for or against. Because BOTH of those cases create a baias. In the former, it's the gratitude for the position, and could lead-like in this case- to ruling in favour and in latter it could be resentment and could lead to a ruling against. This thing is as corrupt as it can get.
But who decides & where do you draw the line? If the Judge wasn't appointed by but voted for Trump, is that not bias? There's a million things like that which seem like they should be bias, but they apparently aren't. Like in the Chauvin trial, one of the jurors was a BLM activist, went to rallies to defund the police & such. Does that not have a bias against the accused? A lot of things seem like they should be obvious bias, but many legal experts agree that it's not *shrugs*. This is sorta the same. The Judge isn't beholden to Trump, Trump can't fire her. But yeah, common sense would definitely expect some allegiance to him.

But yeah, in this context, I agree with the "best we can do" notion - human beings are inherently biased and inherently imperfect. It’s unethical for this judge not to recuse herself from Trump’s lawsuit requesting a “special master”. The DOJ says, “fine. Pick a Special Master.” That means DOJ has plenty of evidence to arrest Trump anytime now. Because the special master has no authority. Can’t make law. Can’t define law. Can’t say anything that will make a difference, Trump is sweating. He’s seen at Maralago moving boxes onto airplane to Washington DC. This is how dumb he is. Accused of mishandling documents and takes boxes of documents into airplane (did he dump them at sea?) He is really panicked to be moving boxes in plain sight.

The one thing that teump also can't seem to do is have any lawyer he wants. He's been bailed on by tons of lawyers, and has had to rely on some pretty shitty counsel for much of the past two years. Lots of lawyers seem to think that he's not worth the money and/or they will join the list of lawyers that temp has refused to pay.
To play devil's advocate, you don't have the capacity to do a lot of this stuff. I'm willing to bet you haven't handled a single classified document, much less hundreds of them. You'd have to go looking for them, and access them illegally. Trump had pretty free access to them as part of his job. The issue was that he was keeping them after he should have turned them back over. If he had just done that, no one would have batted much of an eyebrow. Also, did he get to pick his judge? Don't think that's how that works, and if it is, it's probably something anyone bringing something like this to the court can do. The personally appointed part is fair, though.
I seem to remember a news story quite recently [ in summer 2022 ] about a sweet talking young lady who pretended to be a young member of the prestigious Rothschild family easily gained entry to the Mar A Lago property. She even posed for a photo with Trump on a part of the golf course. So much for difficult entry into the country club!
He has standing if the documents are his own. For instance, he has standing to sue over the return of his medical and financial records. That doesn't mean he has a good argument or a chance of winning, but he does have standing.

But the master has to have the highest level of clearance to look at the files in the first place or they can not look at anything at all. Then Trump can say it would take another 90 days. So when 2024 comes around Trump runs for re-election and wins and becomes POTUS all over again. This is because Trump knows he need the protection of the Office of the President of the United States. This will keep Trump's rump out of prison for 4 years or more. Then say after Trump leaves office in 2028 a republican becomes POTUS and then can pardon Trump for every single federal crime Trump committed.

Well...figuratively any other human being, considering the very same thing happened with Hillary Clinton in 2016 and they ruled even though the classified documents were almost certainly accessed on her server by foreign and enemy agents, they couldn't find that she had any intent to distribute them so was not indicted under criminal law.

The DOJ needs to dot every single i and cross every single T in this case, to establish a strong precedent in this case, and the judge ruling in trump's favour in this part of things to delay long enough to get past the primary.. it's going to be a long time before anyone sees a trial this large, but when they do it's going to be bigger than watergate.
It's remarkably generous of you not to address the actual qualifications of this judge in the first place, which are also a pretty major point of concern. This is an attorney whose own submission of documents after her nomination are incredibly damning (in brief, where a qualified nominee would have...well, anything of note in the public record, she has absolutely nothing, which indicates that her utter and complete failure to comprehend even the most basic aspects of the laws she's supposed to be ruling on could be the result of legitimate incompetence), so going out of their way to put this matter before her looks really, really fishy. It's also worth noting, I think, that the judge here basically served as Trump's lawyer. The response he submitted was incoherent and included none of the determinant arguments that the judge actually ruled on. If I'm Cannon, I don't want this to go to the appellate court. I don't want anything to make me look any worse than I already do. All it takes is one unlikely break in the midterms and the prospects of my impeachment improve dramatically, and I don't need the appellate court schooling me on how completely inept I am at my job after I've already become a laughingstock - on Legal Twitter if nowhere else. If ever there was a case of dangerous, gross incompetence on the part of a jurist, it's Cannon, and she really should be trying to keep her head down right now. I hope that she's smart enough to strike a deal the DOJ can live with, because otherwise...yikes. To be fair, you can say the exact same words about our VP, who was an AG, and now obviously the VP. To be fair to the judge, I would also be inclined to appoint a Special Master in that situation (scratch that, make that two - one to yell at Trump's lawyers to make their documents look actually legible, and one to confer with the FBI and make sure they've dotted all their i's and crossed all their t's), but as another commenter pointed out in a different thread, at least wait for actual motions and documents to arrive before handing out extraordinary circumstance measures as there's some suspicion that Judge Cannon may have been having ex parte conversation with the Trump legal team given how she's changed what she's saying so quickly. I'm also not a lawyer but I do appreciate the value of giving the appearance of fairness. The way she's going about literally everything else seems strange though.

@doof goobins No, it shows that Trump co-mingled personal documents with classified documents. Or did you honestly expect the FBI to go through every article on site (which isn't possible given the sensitive nature of the documents)? If they did you'd be here complaining about that instead. Trump took documents he shouldn't have, he told the court that he had in fact returned all documents, refused to turn over documents when asked again, and also co-mingled classified documents with his personal articles. There's no standing to say what the FBI did was overboard. In fact they have been far too lenient on him, any normal person would already be in Jail.
The judge also granted an injunction that was not requested. To get an injunction they should have to show they are likely to win on the merits and they would suffer irreparable harm, which of course they didn’t because they didn’t even request it. Judge Cannon was essentially working as Trump’s lawyer.
That has to be illegal, right? It's unethical that a "judge" can act so far outside the scope of their actual job and the law, while others nod along parroting "She has decreed it, so mote it be!".

After that it goes to the supreme court, which is also dominated by trump-appointees and conservatives. Wait a second the lawyer searched for secret documents when she did not have top secret clearance. So she just admitted to attempting access to top secret documents without clearance. Being a lawyer, or judge, or special master does not grant one the security clearance to see secret documents.
Euh, not necessarily. (Top) secret documents are labelled as such on the cover, which allows to to see a document is (top) secret without seeing its actual contents. That's how you know you're not supposed to be reading it if you don't have clearance.
Yes it actually does in specific circumstances. This same point came up during the Hillary Emails controversy. A couple of her lawyers who sifted through her emails did not have clearances. DOJ came out and said it was fine.

No, it’s not. Special Masters are standard procedure in cases where there’s contention regarding what the government is specifically looking for and what they found. That Trump is a political leader absolutely warrants additional scrutiny on the government; when DeSantis becomes president would you have the same view if his FBI raided AOC’s home? Even if justifiable on face, in a democratic society it’s especially important that any investigation with a hint of political manipulation is conducted fairly and transparently

There is no mystery to as why it wasn't filed with the original judge. Trump's camp went JUDGE SHOPPING. That is not a made up term, it is something that actually happens in the law arena. When a client needs a lighter or some other provision in their sentencing, their lawyers go "judge shopping" for a judge that would be more conducive/favorable to lean their client's way.
The DOJ also went Judge shopping for the judge who signed on the search warrant. So both sides are guilty. And it is always like that, we humans tend to go to the people who are likely to agree with us. That's just fact🤷🏾♂️

It could be seen as a way to protect Trump by bypassing a lower court in order to get a presiding judge that may be partial in favor of him. Trump also previously sought her as presiding judge over the RICO case.
In that interview Trump also called the documents on the floor “confidential”. Isn’t that at least somewhat of an admission that those documents weren’t declassified?
@@dtsyt82 It is a classification level, but it is also used outside of government by businessmen to cover dodgy business practises, and by individuals to indicate that a document contains sensitive personal information. In my experience, the Confidential classification is only used in applications that involve the handling of people's personal information, such as medical records. Anything held by the executive branch would be either unclassified, or classified higher than confidential. Source: I worked in Government and had Secret clearance.

In the UK, this judge would have to recuse herself from the case due to her relationship with 45, and in the UK politicans dont even get to appoint judges... A judge should never be allowed to rule on a case involving the person who appointed them to the bench, period. Including things like executive orders, its a clear conflict of interest.

Question: Why isn't the 11th District in DC snatching this from Cannon? If the law spells out that this case is in their court, why are they letting someone else muck around with it? I thought judges were very prickly about this. Its one of the reasons shopping your case to find a favorable judge happens in only a set number of instances and if unsuccessful you now have a pissed off judge hearing your case.
All Trump appointed judges should be pulled, reviewed and evaluated to determine if they are actually suitable to be in that position, and then reinstated if they are or removed. Clearly some of his judges are loyal To him, not the US or the law.

It is 100% standard procedure to appoint independent reviewers in cases where there the government isn’t initially sure what they are looking for in a search. It happens all the time, and is an essential aspect for maintaining the value of search warrants in a functioning democratic Justice system. That it happens to benefit someone you don’t like is no basis to criticize that system; we need it to protect the people you do like as well.
Considering Trump appointed her after he lost the election and the senate confirmed her and they made a new case just to move it to her court, and she's one of the most unqualified judges out there...

Exactly. It was an evidence photo, where they stage documents to photograph for evidence. The only person who claimed an issue with it was trump himself! After November if the Senate doesn’t flip I think their responses will largely depend on how far the investigation has come and what poll numbers are on it. If Trump support wanes so will many Senators, if not, they’ll stick by what’ll get them re-elected.
If the Senate flips, then Dems control Congress and they’ll probably have a lot of things they wanna do speedily, so I think it’d just be a matter of priority and how prioritized impeaching this judge would be if she stepped over that line.

The fact that we are now witnessing a former president arguing that the DOJ planted documents in his home during a raid, but he kept those documents secure before the raid even happened and he had declassified these documents before they ever reached Mar-a-Lago, but he still needs a third party to review the illegally planted evidence that he declassified and took good care of before they were planted because it would hurt his reputation, and all of that is being taken as a serious legal debate right now shows why this country is so screwed.
The fun part comes after the indictments. Trump is going to pick some defenses. Then the DOJ is going to ask about the times he claimed something that contradicted those defenses.

As a former records office supervisor, a room with a lock is not enough for documents that need special protection. That room had to be certified to a level of being a vault - surrounding walls, floor and ceiling made of concrete or cinder blocks. I hope that basement room came close to that level.

The sad part is the DOJ laid those documents out like that to take the picture, that isn't how they were found. That is the stupidity of the Trump org, they claim they never left it like that...but evidence is laid out and photographed where it is found, so it was most likely in front of the time magazine portion of the box that they were found in. They photo the evidence then put it in a box, then take it away. The lunacy of the Trump's is he is clean, and we have seen pictures of inside his office and it tells a different story anyways. But the fact they claim they didn't leave them out like that is confirming they had them, or admission of guilt.

The special master appointment is ludicrous. Their argument is if a suspect is rich or famous enough, they should have special privileges in criminal trials that a layman can't assert. @@decrulez Nothing in her emails were marked classified, which is a little better than Trump's flagrant disregard for security, but various pieces of information that should have been properly marked and should have never been sent on an unclassified system. Unfortunately, lazy people in the state department did the wrong thing (and should probably be held responsible too) and essentially reproduced classified information from memory when drafting emails on unclassified systems. If this were contained to government servers, it would have been identified as a "spillage" incident and cleaned up with audits confirming that none of the classified information was compromised, but because Clinton was super special, she had her own special server that all of her unclassified work email got forwarded to. Those sorts of clean-ups and audits weren't possible to the same degree as if it were contained to a government system... which is why she should have never had her own mail server to begin with.
I'll put it this way... if a soldier, marine, sailor or airman did what Clinton did, they'd have received a dishonorable discharge at best, jail time at worst. But because Clinton is a powerful and rich politician, she got essentially a smack on the wrist and got told "don't do that again."
Saying she deserves jail time is mostly hyperbole on my part, but she does deserve significant consequences/repercussions that send a clear message that our politicians are not above the law. Unfortunately, my cynical opinion on this whole Trump situation is that, like Clinton, he's going to get a slap on the wrist at most because he is a rich and powerful politician.

There's more moving parts in modern government than our constitutions framework is capable of addressing. We have so much corruption because nobody could have foreseen just how many new pieces with new weaknesses would be built. We're decades overdue for a total review of the constitution and our core legal framework as a whole. There are too many bad actors in law, too many places for them to hide, and too many ways for them to gain footholds and abuse their powers.
It is not broken, it functions exactly as intended, for the rich, by the rich and of the rich. That is why justice is for sale at a very high price. You get arrested without warrants, never get to see the evidence or interview witnesses, and never get your day in court because you will be all but forced to accept a plea deal whether you did the crime or not. Oh, and it helps them that they have now made practically everything illegal and can stack 20 different charges for one offense. And can set bail at such ridiculous high amounts like a million dollars or more, for people who never made more than $15 per hour in their life. If it were actual justice you could go into a courtroom and argue your own case because the laws would be simple and fair, it should be up to the state to PROVE your guilt to a jury of your peers. Instead it is up to the poor to prove their innocence to cops and courts who do not even look at you as an individual. MONEY = RIGHTS. POVERTY = PRIVILEGES that can be revoked without notice.

Unless there were some communications that I'm not aware of, it seems like this judge has been having ex parte communications with the Trump team. The main thing that comes to mind is that after the first filing she asked for clarifications, but then after a few days she just spontaneously issued her."inclined to approve" statement without receiving anything from the Trump team. As I recall there was one or two other things she did without having any filing from the either of the parties.

This is entirely likely. Trump almost completely picked people from the court supplied from a list of Federalist Society members, who are ultra-conservative partisans who want to see all the progress of the Warren Court overturned.
Conservatives are packing the courts with partisans for EXACTLY this reason - because it means that nothing they do will ever be held accountable. This judge was picked by Trump and his rich corporate cronies for exactly this purpose. She knew what she was going to do for him the moment she was appointed - no additional communique necessary.

No, it’s 100% standard practice for defendants in multiple proceedings to request all cases be brought before the same court, particularly if that court has General Jurisdiction over the defendant. It makes mounting a defense far cheaper and more effective, as all documents and appearances will be in one place instead of all over the country, and any reasonable defendant would make the same request (and generally they are accepted)

Placing a man under the authority of an individual he placed in power is fundamentally a conflict of interest. As someone with a Top Secret/SCI security clearance, I'm immensely frustrated by this entire situation.
I cannot begin to describe how sensitive the information in TS/SCI documents is, and how damaging to the United States it could be if such information is leaked to foreign actors, and we KNOW for a fact that Mar-A-Lago frequently hosts foreign persons of interest who may not have good intentions towards the US. In my particular case, the TS/SCI information that I handled contained information on how to strike critical targets with long-range missiles, including flight paths and trajectory information that could be used to defeat such attacks by simply placing anti-air batteries in the right locations; that is an EXCEPTIONALLY mild example of the information such documents contain.
The President can't simply declare a document declassified, and the fact that ANYONE believes him when he says that is concerning! Why do people simply believe whatever this man says, no matter how outrageous? The declassification process needs to be followed to the letter if a document is to be declassified; the President can REQUEST declassification, and even has very broad authority to do so, but that is only the START to the process. Declassifying a document requires it to be reviewed, redacted of potentially damaging information, expunged of its classification markings, and other critical administrative steps. Unless and until those steps happen, THE DOCUMENT REMAINS CLASSIFIED.
Furthermore, it is NOT within the President's authority to remove, retain, or disseminate documents concerning the US nuclear weapons program; such documents are not actually "classified", at least not in the normal manner. They are basically NEVER "declassified" and instead follow a completely separate procedure that is NOT under the purview of the President when being released from protective measures.
If ANY OTHER government official, including former Presidents, were in this situation they would likely already be in prison and many of the very same people who support Trump would be calling for their heads. Just imagine if President Obama had behaved in this manner! They would be calling for an execution at dawn!

I am concerned that this was allowed to happen. Many of us have always known Trump is untrustworthy. How did he get that much stuff into unsecure locations? Aren't there procedures in place to prevent that? Or was the problem that the people responsible for those procedures were loyal to him? I feel like this should be bigger than just him. A single elected dumbass should never be able to singlehandedly ruin our and our allies' national security.
Unfortunately, the precedent was already set in 2016 with the Email scandal. Classified documents were stored in a private residence, and even worse, with internet access on a server. Anyone here claiming "Orange Man Bad", while still not screaming about the email server is showing bias. BOTH are serious situations, and BOTH should be held accountable. You can't jail trump without jailing the darling of glass ceilings Hillary. It's already been decided, and the same people that defended her and her actions, gave Trump the ability to get away with it. You did this to yourselves.

What you have brought up here is a "whataboutism". You are literally saying "What about Clinton's email server!" What about it? It's a completely separate matter.
I believe that the FBI made a mistake in not pursuing Clinton's use of a private email server further, but that mistake does NOT preclude them from taking law enforcement action against Trump. It has been upheld time and time again in courtrooms at every level that law enforcement does NOT have to perfectly prosecute every alleged crime to be able to continue to prosecute future crimes.
Worth mentioning: powerful people get away with high-profile crimes all the time, which isn't right. That doesn't mean that we as a nation have forfeited our right to prosecute people who commit crimes in the future.

In various circumstances it's possible for counsel to discuss things with a judge, but it can't legally be deliberated on if it must be decided in court since the other party must have opportunity to argue against it if they object.
The fact that the 41g was granted despite not technically being filed and they barely argued anything and she gave Trump what he wanted is rather suspicious.

There absolutely SHOULD be a law that prohibits a judge to have any involvement in a criminal case involving a former president who appointed them or tbh any politician who was involved in the process. Whether they voted for or against. Because BOTH of those cases create a baias. In the former, it's the gratitude for the position, and could lead-like in this case- to ruling in favour and in latter it could be resentment and could lead to a ruling against. This thing is as corrupt as it can get.

It’s unethical for this judge not to recuse herself from Trump’s lawsuit requesting a “special master”. The DOJ says, “fine. Pick a Special Master.” That means DOJ has plenty of evidence to arrest Trump anytime now. Because the special master has no authority. Can’t make law. Can’t define law. Can’t say anything that will make a difference, Trump is sweating. He’s seen at Maralago moving boxes onto airplane to Washington DC. This is how dumb he is. Accused of mishandling documents and takes boxes of documents into airplane (did he dump them at sea?) He is really panicked to be moving boxes in plain sight.

If I, as a working class citizen, did 1% of what Drumpf did here, I would be in Guantanamo right now. I wouldn't be able to stall the FBI/DOJ, or pay for any lawyer/team that i want, or handpick the judge I want that I personally appointed.
The one thing that teump also can't seem to do is have any lawyer he wants.
He's been bailed on by tons of lawyers, and has had to rely on some pretty shitty counsel for much of the past two years. Lots of lawyers seem to think that he's not worth the money and/or they will join the list of lawyers that temp has refused to pay.
To play devil's advocate, you don't have the capacity to do a lot of this stuff. I'm willing to bet you haven't handled a single classified document, much less hundreds of them. You'd have to go looking for them, and access them illegally. Trump had pretty free access to them as part of his job. The issue was that he was keeping them after he should have turned them back over. If he had just done that, no one would have batted much of an eyebrow.
Also, did he get to pick his judge? Don't think that's how that works, and if it is, it's probably something anyone bringing something like this to the court can do. The personally appointed part is fair, though.
I seem to remember a news story quite recently [ in summer 2022 ] about a sweet talking young lady who pretended to be a young member of the prestigious Rothschild family easily gained entry to the Mar A Lago property. She even posed for a photo with Trump on a part of the golf course.

It's remarkably generous of you not to address the actual qualifications of this judge in the first place, which are also a pretty major point of concern. This is an attorney whose own submission of documents after her nomination are incredibly damning (in brief, where a qualified nominee would have...well, anything of note in the public record, she has absolutely nothing, which indicates that her utter and complete failure to comprehend even the most basic aspects of the laws she's supposed to be ruling on could be the result of legitimate incompetence), so going out of their way to put this matter before her looks really, really fishy.
It's also worth noting, I think, that the judge here basically served as Trump's lawyer. The response he submitted was incoherent and included none of the determinant arguments that the judge actually ruled on.
If I'm Cannon, I don't want this to go to the appellate court. I don't want anything to make me look any worse than I already do. All it takes is one unlikely break in the midterms and the prospects of my impeachment improve dramatically, and I don't need the appellate court schooling me on how completely inept I am at my job after I've already become a laughingstock - on Legal Twitter if nowhere else. If ever there was a case of dangerous, gross incompetence on the part of a jurist, it's Cannon, and she really should be trying to keep her head down right now. I hope that she's smart enough to strike a deal the DOJ can live with, because otherwise...yikes. She's a young woman and this is potentially her entire career on the line when she's got a whole lot of life left in front of her. I know that I would be sweating bullets in her position.
To be fair, you can say the exact same words about our VP, who was an AG, and now obviously the VP.
Unfortunately when it comes to the executive branch appointments they're VERY political, and it's not terribly uncommon that the person isn't realistically qualified, but more-so that they tow the party line. The Judicial branch *should* be exempt from that, as it's supposedly apolitical, but in reality? Not quite.
Imagine betting your entire career on Trump, after seeing what happened to everyone else that has hitched their wagon to him. It costs NOTHING for her to NOT take the case, yet she’s chosen to put jump headfirst into the pool.
To be fair to the judge, I would also be inclined to appoint a Special Master in that situation (scratch that, make that two - one to yell at Trump's lawyers to make their documents look actually legible, and one to confer with the FBI and make sure they've dotted all their i's and crossed all their t's), but as another commenter pointed out in a different thread, at least wait for actual motions and documents to arrive before handing out extraordinary circumstance measures as there's some suspicion that Judge Cannon may have been having ex parte conversation with the Trump legal team given how she's changed what she's saying so quickly.
I'm also not a lawyer but I do appreciate the value of giving the appearance of fairness. The way she's going about literally everything else seems strange though.

@doof goobins No, it shows that Trump co-mingled personal documents with classified documents. Or did you honestly expect the FBI to go through every article on site (which isn't possible given the sensitive nature of the documents)? If they did you'd be here complaining about that instead.
Trump took documents he shouldn't have, he told the court that he had in fact returned all documents, refused to turn over documents when asked again, and also co-mingled classified documents with his personal articles. There's no standing to say what the FBI did was overboard. In fact they have been far too lenient on him, any normal person would already be in Jail.
I didn't even consider that his saying he kept them in a much neater fashion is a contradiction of the FBI planting claim, good catch.
The judge also granted an injunction that was not requested. To get an injunction they should have to show they are likely to win on the merits and they would suffer irreparable harm, which of course they didn’t because they didn’t even request it. Judge Cannon was essentially working as Trump’s lawyer.
That has to be illegal, right? It's unethical that a "judge" can act so far outside the scope of their actual job and the law, while others nod along parroting "She has decreed it, so mote it be!".

After that it goes to the supreme court, which is also dominated by trump-appointees and conservatives. Yes it actually does in specific circumstances. This same point came up during the Hillary Emails controversy. A couple of her lawyers who sifted through her emails did not have clearances. DOJ came out and said it was fine.

That Trump is a political leader absolutely warrants additional scrutiny on the government; when DeSantis becomes president would you have the same view if his FBI raided AOC’s home? Even if justifiable on face, in a democratic society it’s especially important that any investigation with a hint of political manipulation is conducted fairly and transparently

I don't know if you will see this message. I assume not. But I just wanted to take a minute to give you my sincere thanks for such great material. This is pretty historic stuff and I appreciate how you keep us up to date on it.
There is no mystery to as why it wasn't filed with the original judge. Trump's camp went JUDGE SHOPPING. That is not a made up term, it is something that actually happens in the law arena. When a client needs a lighter or some other provision in their sentencing, their lawyers go "judge shopping" for a judge that would be more conducive/favorable to lean their client's way.
And this is the second time he went shopping for this judge. He filed a civil suit last spring and tried to get her.
The DOJ also went Judge shopping for the judge who signed on the search warrant.
So both sides are guilty.
And it is always like that, we humans tend to go to the people who are likely to agree with us. That's just fact🤷🏾♂️

It could be seen as a way to protect Trump by bypassing a lower court in order to get a presiding judge that may be partial in favor of him. Trump also previously sought her as presiding judge over the RICO case.
In that interview Trump also called the documents on the floor “confidential”. Isn’t that at least somewhat of an admission that those documents weren’t declassified?

A judge should never be allowed to rule on a case involving the person who appointed them to the bench, period. Including things like executive orders, its a clear conflict of interest.
People say the FPOTUS acts like a king, when he gets his lawyers to say he's above the law. But as much as kings and queens have abused their power in the past, there were usually laws of some sort that they were expected to follow, even when they were seen as appointed by God.

Question: Why isn't the 11th District in DC snatching this from Cannon? If the law spells out that this case is in their court, why are they letting someone else muck around with it? I thought judges were very prickly about this. It is 100% standard procedure to appoint independent reviewers in cases where there the government isn’t initially sure what they are looking for in a search. It happens all the time, and is an essential aspect for maintaining the value of search warrants in a functioning democratic Justice system. That it happens to benefit someone you don’t like is no basis to criticize that system; we need it to protect the people you do like as well.
Considering Trump appointed her after he lost the election and the senate confirmed her and they made a new case just to move it to her court, and she's one of the most unqualified judges out there...
