As a non-American the fact that you can just file a lawsuit in whichever state gives you the best headstart is baffling
Well you can certainly file the lawsuit, but like he says in the video you typically won’t get very far before being issued a dismissal if neither party has any connection to the state.
Generally speaking the purpose of our specific jurisdiction system is actually to ensure that people only have to defend themselves in states where they have purposefully availed themselves of the benefits and privileges of local state law. This can happen through conducting buisness, advertising, etc.
Only the rich would be able to casually do something like this
Yeah it's odd to me as an American that our different judicial areas have different rules. So on some states you can't do something but in others you can on a federal level depending on what that judicial area said

the thing is, Musk has the money to pay lawyers to be on retainer 24/7, meaning their only job is to be on-call, and file whatever he wants, whenever he wants
to that extent, it costs him nothing to file these frivolous lawsuits, because he's already paying for the representation

I've been going with Xwitter, mostly just as a way of mocking the whole thing.

I really want it to be called The Company Formerly Known As Twitter. We only had to do that for about five years before Prince changed his name back.
I tend to use Xitter, with the Chinese pronunciation of x as sh.
Even pre-Musk, Twitter had a serious problem moderating hate speech when it used terms that were offensive outside the US. I saw really vile things said to Australian First Nations people that were dismissed by Twitter mods as not hate speech when the words used would get you kicked out of any Australian pub (we have a high tolerance for swearing, but not for racial slurs).
As an Aussie, totally agree. But now it's worse because many non-racist people have left and the place is a cesspool constantly stirred by elmo

Something I would like to point out as a software engineer. And I think it applies here because we are actually talking about software. When we test software, we don’t test it delicately by not stressing it and treating it with kid gloves. We test software adversarially. We test software under harsh conditions. We test software under conditions where we are trying to make it fail, and it must not. That is what Media Matters is doing here. What they are doing is not organic, but neither is the testing that Twitter’s safety department, if it were to actually exist, should have been doing all along.
And isn't Elon Musk supposed to be some kind of computer programming-type guy? Like, that was supposed to be his only actual, legitimate skill? He's definitely not an engineer, probably thinks that a newton-meter is a device for counting fruit-filled cookies.

The point of the lawsuit is not to win it, it is to cause financial strain to the defendants to make other journalists think twice about reporting something negative about X, fearing they might have to pay legal fees if they do. I think that intention to intimidate should have been mentioned in the video.
And of course pander to a specific audience
In the meantime, there's a newsworthy trial going on and other journalists have good reason to remind people "there's a lawsuit about racist stuff on Twitter" and "Musk is suing the people who found racist posts not the racists who posted it."
The thumbnail says "SLAPP" which stands for "Strategic Lawsuit Against Public Participation" and I think Devin also uses that term in the video too. It's a pretty well known tactic and in some states you can get a case thrown out if you can prove it's a slapp suit. Of course you can usually find a reason to sue in a state that doesn't have anti-slapp laws.

The diver sued Musk, but lost since it's kinda hard to get justice versus someone with billions for lawyers..

It's amazing that people still don't understand that freedom of speech is not freedom from consequence. But in Musk's case it isn't surprising in the least.
And that it only regulates interactions with government, not between private entities. I believe it's because very few people actually read the Constitution. They just go with what trolls on social media claims free speech is about.

How is this related to the current video at all? Feels like the anti-Twitter crowd showed up based on the title and jumped straight to commenting their favorite slogans.
Defamation laws (or "disparagement" here) are limitations on freedom of speech. Musk isn't even on the pro-speech side of this lawsuit.

It comes across as a placeholder name to me. As far as I can tell it is something he latched onto in the 90s when the letter X was quite popular.
I call it "Xitter" (the "x" is pronounced as "sh")
But we can still call them "X-cretions" instead of tweets.
Speaking as a (now retired) software engineer, who has been tasked with investigating tricky issues "escalated to engineering", the methods used by Media Matters to detect and document the issue are entirely proper.
First: If the problem occurs randomly, that is, if its frequency is based on statistics, and especially if the problem is reported with low frequency, then in order to reproduce the problem in a reasonable timeframe, and obtain multiple examples of the problem, of course one runs one's test for the issue over and over, preferably under automation, not by having some unfortunate human poking buttons, and one repeats the test as rapidly as is feasible.
Second: One sets up the test using the reported conditions under which the problem occurs. One does not, should not, try any settings whatsoever. This is why we ask users what they did before they observed the problem...so that we can reproduce the conditions. One does not ignore the reported conditions, try something else, then say to the user, sorry, works 4 me... Note that the "user" here is the advertiser, not some random X user looking at their feed. The issue here is not how often does some user who never does anything but look for cat videos encounter a non-cat post with toxic content. It is, does the advertiser encounter the problem, yes or no? Does the advertiser have their ads shown on toxic posts. Of course one must examine toxic posts to reproduce the conditions.
Elon Musk is the sort of client who probably pays more for his lawyer's therapy bills than he does their attorney's fees.

I hope Media Matters asks for EVERYTHING about the finances, user numbers, and advertising in discovery. I have a feeling it will be very embarrassing for him. Well, he doesn’t have the capacity to see it as embarrassing. He will blame everyone else.

The issue is that Media Matters, most likely will pay a hefty fine. I do have a law degree and I do practice under the supervisor of my senior coworkers, but defamation and assassination of character and attacking one's livelihood happens literally all the time. I'm in civil cases usually, one of these day I plan to move onto criminal/federal, but liability cases are so frequent and it has been proven that Media Matters, did ran a sting operation to give the appearance that most advertisers had their ads next to racist, sexist and etc posts and ideologies. Which is technically illegal. I can personally go make a bunch of accounts on twitter/X and spammed your feed stating that "you hate grandmas and are planning on killing every one and stuff" without authenticity backing it up with raw & unedited facts. You would see me in court saying that I "cancelled" you and you cannot make a single cent on your legitimate business because I "killed" it off thus ending your livelihood.
Besides, the crap I have been seeing on Facebook/Instagram/Tiktok are far more problematic and quite troubling. Now I don't care for Elon, but the man has a case where either Media Matter will have to pay incredible large amount of fees, for potential lose earnings for both the company and shareholders, and possible declare bankruptcy

@@Faded.VisualsI'm not quite sure you read what they did but their claim wasn't that this is everywhere but that it happens - Musk's response was to admit it does happen but only in contrived circumstances. Companies started to cancel contracts for advertising where, as stated in the video, a single instance of it happening broke the standards they expected, contrived or otherwise.
Because Musk admitted that this is possible under twitter's rules all Media matters are responsible for is highlighting this truth.
That isn't to saw Musk's expensive lawyers won't be able to draw something out of it or drive up legal fees such that they go bankrupt but from an initial legal point of view the case should be thrown out.
It's hilarious to say "We define hate speech more narrowly now - and "Hate speech impressions are way down" at the same time. No shit, if you stop counting racial slurs and nazi imagery as hate speech your numbers will go down.

They redefined it because people who are apparently allowed to say certain slurs were getting banned for using them.

They did add some anti-republican phrases to that list and started to ban journalists who reported on the changes and questioned the decision. That was Musk's whole idea of "free speech".

What X lawyers are saying is that Media Matters just did a simple software stress test using some predefined variables to see if the expected results happened and they did occur. I thought space karen was a software genius, this is literally software testing 101.
I know! I laughed at this whole thing. It's a basic software stress test, and they failed. Twitter/X should be doing this DAILY.
Considering he nominated and elected himself to run engineering at Twitter you’d think he’d be familiar with stuff like this.
What does that say about the advertisers? Did they ALL completely fail to do their own stress test? Or did they just decide advertising next to some of these things didn't hurt the bottom line enough to care?

But how would that work? You can't penalise people for bringing cases to court or threatening legal action. That's a real slippery slope. People with ligitimate legal standing could be threatened by a anti slapp law, which would be the height of irony.

If you'd like to know how a federal anti-SLAPP law might work, I'd first recommend checking out how they work in the many states that have them. Those would be a good starting point.

Free speech and freedom of expression. Targeting an individual on the grounds of their beliefs can get you in a lot of trouble legally, but it's also just a moral quandary. Quoting from popular religious books could actually be perceived as hate speech. This'll probably take hundreds of years of squabbling and meandering about in the courts and communal conversations before it gets figured out by the masses.

Not only does the First Amendment only prevent government (not private) censorship, but it's actually the main law protecting platforms' right to take down speech they disagree with so that they aren't compelled to support it. The US also has no law against hate speech.
Of course, you could say that morally it's good for Twitter to promote free expression even if legally they don't have to, but that's a separate matter.

So here's my thing about this, and I hope any court of law would come to the same conclusion: if I buy a phone, and through a series of easily replicable button presses, I overload the battery and turn it into a potential explosive device. In that situation, regardless of who is legally at fault for the explosion, the phone company will still be legally required to recall that phone model and fix the problem once it is made clear that it is a problem with the phone model itself, not some kind of individual device flaw.
Just because you have to go through a convoluted series of actions to expose a problem doesn't mean that problem doesn't exist. As dumb as he is, Elly-boy knows that. I'm guessing the only reason he doesn't take the much easier approach of fixing how ads work on his site is because he likes it the way it is.
And a journalist should be able to report on the issue.
I was trained in dealing with safety calls when I worked for a phone manufacturer so I can confirm it's absolutely treated this way by the company. It *did not matter* if the customer created a safety issue by misusing a device. If there was any possibility that the phone could cause harm we had to investigate it and make sure the public wasn't at risk. I don't live in the US so I don't know what the law there says about it, but the company (which is based in California) sure as hell agreed.
If Musk had simply made efforts to address the issue, then he would have avoided the advertiser fallout. But nope, he literally told them to go f@$# themselves in a public way, and is using the court system as a weapon. Literally the opposite of what a reasonable rational person would do.

In university when studying for my computer engineering degree, I remember a teacher telling us that anything that is possible to do within the computer program or system you're building will eventually be done, so in order to prevent users from doing things you don't want them to do, you must make it impossible for them to do so. Musk thinks that the equivalent of a "Please don't search for racist stuff" warning message is prevention enough.

The last thing any advertiser wants is a screen shot of their ad next to something they find offensive. That could be sex, violence, religion, politics, Nazis, etc. If you're offering an advertising platform and can't guarantee that won't happen, the advertisers will run away.
But wouldn't that mean that advertisers couldn't advertise on any social media? Even the most strict social media with the best monitoring software and thousands of moderators can't catch every bad comment. There's millions of comments. You are always going to get some that sneak through. It seems like a zero tolerance policy would be unrealistic here.
My personal favorite that I found was an ad for Carnival Cruises on a UA-cam video about the sinking of the Costa Concordia, Costa Cruises being a subsidiary of Carnival.

The handful of individuals and funds that joined Musk to acquire Twitter have seen the value of their investment evaporate. “Musk has made a lot of money for his investors” is irrelevant to this story, because he and his partners are losing billions of dollars of value, and it shows up in financial statements and filings, such as Fidelity taking a write down on their investment. I don’t know if you’re a Musk family member or a Musk worshipper, but you need to find another angle to love.

Not quite. Musk also alleges that Media Matters also sought out and followed the accounts of big advertisers, so that the advertisers' content would show beside the Nazi content. So Musk is stating that it is okay for a Nazi who loves Xfinity to see Nazi content next to Xfinity adds, but is implying that such a thing could never happen. To be fair to Musk, I am pretty sure that even Nazi's wouldn't stoop so low as to liking Xfinity.

Musk attacking Media Matters' free speech, a company that was trying to highlight harmful speech and its effects, in a way specifically designed to avoid laws protecting free speech, to protect a company he bought specifically to "protect free speech", in an effort to protect said company from harmful speech made by the company that was specifically trying to highlight harmful speech on said platform, is so meta it breaks my brain.
The specific complaint was that Media Matters used defective methodology that created results that were worse than what real people would experience in normal use. I don't know if that's true or not, but if it is I think Media Matters needs to be held to account for dishonesty.

@willofdodge1 a deadname is typically used to refer to the birth name of someone who has since chosen a new name. A lot of trans people change their name as part of their transition, but it is not exclusive to that community obviously.
Anyway it is very disrespectful to deliberately call someone by something other than what they want to be called.

Why do people defend and like Musk even after all his insanity? The dude is not nearly as "intelligent" or "genius" as he likes to think he is.
IMO, he is Ego unchecked and he's hoping, craving really, that someone will finally and forcefully say "No" to him.
Because he has money and (apparently) unrestrained success, and people (in the United States especially) have a fetish for success and for ‘hard work’. And because people still largely believe you can make Elon Musk amounts of money on their own with hard work.
I feel sometimes, it's just projection with a dash of denial. I feel these people find him cool and inspiring so put the muskrat on a pedestal. They think one day if they act like him, theyd be successful too, somehow. So they deem all his stupid embarrassing actions as Ws, just to deny the fact he's just a toddler that has ill gotten wealth.

Anyway, I wish I didn't fall for it back when I was in college, it took me a few years to realize how much of a fraud and jackass Muskrat always was.
First of all, Elon Musk only likes free speech when it's things that he agrees with. Second of all, ain't no one is ever going to call Twitter 'X'. Even the news media says "X-formerly Twitter" and never just X. Because X is just a letter of the alphabet! Third of all, I like "space Karen" and will call him that instead, good suggestion.

I opened twitter once, the first image I saw was a real life picture of dead child children. The post had millions of views and It didn't have any warnings or censors. It was in the home page, even tho I only interact with lighthearted memes. Underneath that post was an ad. I didnt click on that ad or think about its contents, I could only think about the horrific image I saw.

@@andrewcoyne4035 Nah, but did he really buy it? like Yes he paid the 44 Billion, but he loaned money (13 billion) from Bank of America, Morgan Stanley and Barclays. So if he cant pay them back when Twitter fails then they will probably take Musks share in Tesla to pay for it. Which means it could result in Musk not only losing Twitter but also Tesla.

They do - but any and every article around the planet that calls it X immediately follows it with "(formerly known as Twitter)", which underscores that absolutely nobody, anywhere, has stopped calling it Twitter. If it survives the next year or 5, Everybody will still be calling it Twitter. Nobody anywhere has changed the blue Tweet symbol on their adverts or advertising.
