Right? The guy with the badge and the gun is afraid of a person because "I don't know how you phone works." If they felt he was a danger, it would have escalated almost immediately. The fact that they just sat there and argued about his phone shows they wanted HIM to escalate the situation by using stress techniques. It's disgusting that so many officers do that to people just wanting to stay safe.
The only resistance here is the cops. They stopped someone that told them no, which for them is out of the ordinary. So they resisted common sense, training and policy. Stop resisting.

My thoughts exactly. When they go on with the "I'm recording too" spiel is when it's even more important for you to record. They always say it in a way to try to intimidate whoever they are interacting with. It's also quite interesting how a lot of the footage they are "recording" somehow goes missing if a lawsuit is filed or a foia request is given.

Also, the cops recording is not for the public benefit otherwise there will not be the option to be able to turn it off. Only six months of training and they know everything about going from tyrant, judge, jury and sometimes even the executioners. Always record the cops.
That was weird. First he says that the guy has to stop filming him. He says he is concerned that the guy is calling other people. Then he asks the driver if he may take the passenger’s phone. Wait a minute, I thought you said I had to stop filming because you said so. Why are you asking her? Then he says he is afraid that they might be live streaming. I thought he was afraid they were calling people. Which is it? This fucking guy was just making it all up as he went.

Not necessarily. Perhaps some (if not many) of these officers may have aspirations to become undercover officers, and these officers would be exposed. What these officers should have done is just let them film them. It's not like "bad guys" are checking EVERY SINGLE video on UA-cam to see if this person is an officer (how would that even be possible, with millions of videos?).

Its because shit might happen and some streaming apps/sites have auto record to a cloud type storage. Even if they get the phone the video is in the cloud. Same with the philando castille the girlfriend was streaming it so the video was on the cloud already.
Honestly, I’d encourage it. Why give them the potential opportunity to delete the video or corrupt the device it was taken on if something were to go horribly wrong?
Phil Allison In public (on roads, sidewalks, publicly viewable areas), recording others whether for personal use or to broadcast is protected by law. The Supreme Court has ruled on this - folks do not have a reasonable expectation of privacy in public. Folks who are working in the public service, especially police officers, should also be aware of this and that they are in no way exempt from it - anyone can record and broadcast police officers in public. Police may request or order that bystanders remain a certain distance from a scene and those individuals should comply within reason (officers cannot use this as an excuse to escape unprofessional or illegal behavior being documented on camera). Subjects in detained or in custody, whether receiving medical care or not, so long as they are in the view from public areas, are also lawful subjects of visual and audio recording and broadcast. There are some departments and areas with laws against this, but those laws need to be struck down, precedent set by the Supreme Court has shown them to be unconstitutional.
@Phil Allison - Livestreaming and automatic uploading to cloud storage can protect a driver's or passenger's legitimate interests to a degree that just recording to the recording device can not. The recording device may be confiscated, destroyed, damaged, the device or file may fail, etc. Please cite a federal case that suggests that driver's or passengers cannot livestream a traffic stop because of concerns for officer safety (or for any other reason for that matter). Obviously, the discussion between a police officer and the motorist they detain is not a private conversation. It's an official contact between an agent of the government and the motorist, anything the motorist says can be used against them in court, to justify an arrest, to justify searches and seizures, to extend detention, to investigate offenses other than the one(s) for which they were initially detained, etc. And many law enforcement officers all around the country use body cams to record their interactions with suspects. The officers don't own the body cams, the government does. And the officers aren't recording home movies. 😂 While your looking for the livestreaming exception, can you also find the case law that allows video recording but not audio recording during a traffic stop? Obviously, the people being detained have a legitimate interest in recording the audio, just as they do the video.

If a police officer has a body camera and something goes south, should the footage not be available, that's incriminating evidence against the police officer. Or at least it is in a sane justice system. If i were i judge and the police officers actions were on trial and there SHOULD be body camera footage but there isn't then i would slam the hammer on the officer pretty darn quick unless there's contradicting evidence to suggest the opposite.
The cop literally just said to dispatch “he’s recording on his phone”... Later continues to say “I don’t know what your doing with your phone” 😆 theses cops are something else I swear.
When a cop asks me if I know why I was pulled over, I answer, "If you don't know, I'm certainly not going to tell you." If the cop laughs, I engage with them. If the cop doesn't laugh, then I don't say another word.

You can use terms and phrases such as “Sir, at this time you’re behaving suspiciously.” “Sir, I need you to step away from my vehicle and keep your hands where I can see them.” “Sir, don’t be reaching.” “Sir, if you continue to make threatening statements, you’ll be placed under arrest.”
The fact that he gave him a reasonable explanation as to why he was holding his phones should have made the officer go "ok" then go back to finishing the stop.

that's inaccurate. we have no evidence that they would do something unlawful without the camera and more than we have evidence that they wouldn't. it's completely possible that they would have been legally perfect without it. the problem is that if they DID do something unlawful, even by mistake, the courts would likely side with them if there was no camera.

Yep. He's a pussy. I have people who threaten (real threat) to kill me yesterday, and I carry a gun. I'm not nervous when I go out, and I feel very safe because I have a firearm and 35 rounds of ammunition. This cop is a fucking punk for being afraid of a camera. No one this lack of situational awareness should be allowed to be a cop. I really hope they all get fired. Not one cop stood up for their rights. Even when the second cop came on scene and asked what was going on, when the first cop tells him "They are recording me" the second cop should have said "okay, so what? It is their right to do so." @@yu4233 most of us filming have lawyers to help guide us. Cops and security guards mostly don't know about public photography. The paranoia of cops doesn't overwrite your rights.
These cops are forever abusing their power. The moment someone won’t comply (even if what they are asking is illegal) they continue to push because they feel their authority is being challenged. In these police interactions the police never admit they were wrong and just continue to dig themselves deeper and escalate the situation. These are not the police we need protecting our communities.
We need to fund independent psychologists in police departments. These cops have really childlike mentalities. If they don't get what they want, the citizen is either interfering, resisting, or disorderly. As soon as the citizen bends a little, the cop's miniscule ego is satisfied and they back down (sometimes). This is all more reason to video in the first place! It _could_ present a safety concern for the coppers. I've seen a time or two when a situation got very chaotic upon the arrival of screamin banshees with the "We gots our rights" routine and "You only doing this cuz we black". It is part of the job for many cops but still is something to avoid. This cop wasn't _really_ worried about that though. He was just trying to maintain his freedom to say and do as he wanted then control any video evidence of the fact.

Ok so one time i got pulled over for running a stop sign and the cop asked me why i think i got pulled over and i said i think i ran that stop sign in Jersey you get points on your license and have to take driving school. But the cop told me to be careful and gave me a ticket for window tints because i have 5% tints. So he hooked me up depends if you tell them the truth.

10:00 and on. This cop just invented an imaginary app that allows the passenger to simultaneously record AND call people and he invented this imaginary app so he could justify his anger at being recorded. Now *that's* dishonesty.
Funny enough, they recently created an app that does that. From lock screen it will text emergency contacts your location and that your getting pulled over and start recording. Once its ended it will send the recording to your contacts.
Officer: "Do you know why I pulled you over." Me: "Sir, if you can't remember, I'm not going to remind you." Would not recommend: "Is it the body in my trunk?"

Too many cops believe that your rights do not trump their limitless authority. Lately (lately within the last 5 years) policyholders seem very intimidated by camera phones and are quick to say that they are recording as well. But, you have to go through hoops to get it and months of waiting to be told it got “lost”!

Even when "I" called them. Which was literally twice. Once because someone broke into my home, and the other because my ex would not give me back my children. The first, the cop went on and on about weapons I might have because I said I wanted a police report just in case this was more than a 1 time thing... So there was a paper trail. I looked him dead in the face and said ANYTHING can be a weapon if you're motivated enough. Are you threatening me? Did you break into my house? No! OK then. So why are you so aggressive (I hate it when that's said to a black woman) I said because I'm a single mother of two daughters with a domestic violence issue with my ex, who has stalked and harassed me. Because some stranger tried to pick my oldest child up from school, which is less than a block away from here. Because if someone comes in, I'm the last line of defense to protect my children, and if it were anyone else, you wouldn't be asking why a mother is ready to fight for her children. The second time, my ex refused to give me the children, even though he has no legal rights to the second child at all because he refused to sign her birth certificate. So I called the cops. He ran, his mother gave me the girls, and the cop was asking me where he went. When I said I didn't know, he threatened to arrest me for obstruction and was like then your children will go to CPS. I was like, nope, because MY mother is in the car, RIGHT THERE and SHE will take them. Then I asked him how does he look threatening me because I don't know the answer to his question. I was like do you know how stupid you look? I'm supposed to know where he is, when I have been LOCKED OUTSIDE waiting for YOU to get here because he took my children and won't give them back. And somehow I'm supposed to have superman x ray vision and see through walls to tell you where he is. But I see who you're NOT asking. You're NOT asking HIS MOTHER, WHO WAS IN THE HOUSE WITH HIM. Now what sense does THAT make? AND you're threatening ME with arrest and CPS? One of his fellow gang members that was standing there just being the bully back up must have thought about what he said and he kind of like grabbed his shoulder and was like, OK, ma'am we have your info, you can go now... I was ANGRY, I was SCARED, but you know that fight flight and freeze thing? I'm a fighter. But these two incidences showed me I could NEVER trust them, even if I was the one that called them.

Not necessarily. Perhaps some (if not many) of these officers may have aspirations to become undercover officers, and these officers would be exposed. What these officers should have done is just let them film them. The Supreme Court has ruled on this - folks do not have a reasonable expectation of privacy in public. Subjects in detained or in custody, whether receiving medical care or not, so long as they are in the view from public areas, are also lawful subjects of visual and audio recording and broadcast. @Phil Allison - Livestreaming and automatic uploading to cloud storage can protect a driver's or passenger's legitimate interests to a degree that just recording to the recording device can not. The recording device may be confiscated, destroyed, damaged, the device or file may fail, etc. Please cite a federal case that suggests that driver's or passengers cannot livestream a traffic stop because of concerns for officer safety (or for any other reason for that matter).
Obviously, the discussion between a police officer and the motorist they detain is not a private conversation. It's an official contact between an agent of the government and the motorist, anything the motorist says can be used against them in court, to justify an arrest, to justify searches and seizures, to extend detention, to investigate offenses other than the one(s) for which they were initially detained, etc. And many law enforcement officers all around the country use body cams to record their interactions with suspects. The officers don't own the body cams, the government does. And the officers aren't recording home movies. 😂
While your looking for the livestreaming exception, can you also find the case law that allows video recording but not audio recording during a traffic stop? Obviously, the people being detained have a legitimate interest in recording the audio, just as they do the video.

These cops are forever abusing their power. The moment someone won’t comply (even if what they are asking is illegal) they continue to push because they feel their authority is being challenged. In these police interactions the police never admit they were wrong and just continue to dig themselves deeper and escalate the situation. These are not the police we need protecting our communities.
We need to fund independent psychologists in police departments.
These cops have really childlike mentalities. If they don't get what they want, the citizen is either interfering, resisting, or disorderly. As soon as the citizen bends a little, the cop's miniscule ego is satisfied and they back down (sometimes). This is all more reason to video in the first place! It _could_ present a safety concern for the coppers. I've seen a time or two when a situation got very chaotic upon the arrival of screamin banshees with the "We gots our rights" routine and "You only doing this cuz we black". It is part of the job for many cops but still is something to avoid. This cop wasn't _really_ worried about that though. He was just trying to maintain his freedom to say and do as he wanted then control any video evidence of the fact.

I have an excellent dash cam. An get a body cam so if they yank you out of the vehicle, you can record what they do OUTSIDE of your vehicle.
Got any product recommendations for the hidden one? I have been unable to find a hidden dash cam that can face the passenger window.

Ok so one time i got pulled over for running a stop sign and the cop asked me why i think i got pulled over and i said i think i ran that stop sign in Jersey you get points on your license and have to take driving school. But the cop told me to be careful and gave me a ticket for window tints because i have 5% tints. So he hooked me up depends if you tell them the truth.

10:00 and on. This cop just invented an imaginary app that allows the passenger to simultaneously record AND call people and he invented this imaginary app so he could justify his anger at being recorded. Now *that's* dishonesty.
Funny enough, they recently created an app that does that. From lock screen it will text emergency contacts your location and that your getting pulled over and start recording. Once its ended it will send the recording to your contacts.

Too many cops believe that your rights do not trump their limitless authority. And merely exercising your rights is an affront to that authority, and therefore makes you at best suspicious, at worst dangerous.

It’s almost impossible sometimes. I’ve heard of people having to get a lawyer and sue just to get the EDITED version! Always record them. They love to create their own narrative. This is why that state burned

Police body cams have a tendency to " malfunction ".
They only release the footage when it favors them.
So what if he is calling someone, maybe he's talking to his lawyer! Even if he did call someone, hurry and get the stop over before they can arrive!
Or call 10 cars of them as backup and still give the ticket or whatever. It's unnerving to do that but atleast get the traffic stop over.

Asia brown Unfortunately girl you will learn that they will get you back for “showing out” / stopping the status quo. Especially black cops, they have to try twice as hard to fit in with the white majority counterparts and that is why they are so complacent and support mistreatment of citizens especially the ones that look like them.
Example: Friendly fire, no/slow support response when you call for immediate back up, alienation at work, false complaints against you etc

They are afraid their corruption will be exposed to the world! Lately (lately within the last 5 years) policyholders seem very intimidated by camera phones and are quick to say that they are recording as well. But, you have to go through hoops to get it and months of waiting to be told it got “lost”!
In over 50 years I've never ONCE ever met a cop that was sincerely concerned about my wellbeing. Cops are always a bad experience.

Which was literally twice. Once because someone broke into my home, and the other because my ex would not give me back my children. The first, the cop went on and on about weapons I might have because I said I wanted a police report just in case this was more than a 1 time thing... So there was a paper trail. I looked him dead in the face and said ANYTHING can be a weapon if you're motivated enough.

I said because I'm a single mother of two daughters with a domestic violence issue with my ex, who has stalked and harassed me. Because some stranger tried to pick my oldest child up from school, which is less than a block away from here. Because if someone comes in, I'm the last line of defense to protect my children, and if it were anyone else, you wouldn't be asking why a mother is ready to fight for her children.
The second time, my ex refused to give me the children, even though he has no legal rights to the second child at all because he refused to sign her birth certificate. So I called the cops. He ran, his mother gave me the girls, and the cop was asking me where he went. When I said I didn't know, he threatened to arrest me for obstruction and was like then your children will go to CPS. I was like, nope, because MY mother is in the car, RIGHT THERE and SHE will take them.
Then I asked him how does he look threatening me because I don't know the answer to his question. I was like do you know how stupid you look? I'm supposed to know where he is, when I have been LOCKED OUTSIDE waiting for YOU to get here because he took my children and won't give them back. And somehow I'm supposed to have superman x ray vision and see through walls to tell you where he is.
But I see who you're NOT asking. You're NOT asking HIS MOTHER, WHO WAS IN THE HOUSE WITH HIM.
Now what sense does THAT make?
AND you're threatening ME with arrest and CPS? One of his fellow gang members that was standing there just being the bully back up must have thought about what he said and he kind of like grabbed his shoulder and was like, OK, ma'am we have your info, you can go now...
I was ANGRY, I was SCARED, but you know that fight flight and freeze thing? I'm a fighter. But these two incidences showed me I could NEVER trust them, even if I was the one that called them.
