First, because the incident is minor, there is little damage. I don't agree, however the Supreme Court has decided that minor detentions, including jail and body search, are inconsequential. (But then I don't know of any SC Justice that has been arrested and spent the night in jail after spreading their cheeks)
Second, a lawyer is going to cost a minimum of $10,000 and probably closer to $50,000 or more to sue the police. The award is most likely to be less than the legal fees. Very few lawyers would volunteer for something that will cost them money.

I'm surprised it's not called out more as well!!
I remember 1 specific video a cop who of course was on a power trip escalated a minor traffic offense to threatening to blow a man's head off. He was ordering him to exit the car the guy was justifiably scared with a gun to his head so was asking for a supervisor. The cop threatened to "blast him, light him up, blow his head off" while giving conflicting orders he said "get out the car or I'm gonna shoot." Then also said is response to the man saying he's gonna get out "no you not you move 1 bit I'm gonna blast you!" I felt like this is a tactic used and not to say they use against blacks and only use I'm only gonna bring up his race because every single time 1 of us is killed by cops no matter how unjustified it was there are certain people who ALWAYS use the "if he would've followed commands it wouldn't have happened." And I feel certain that both them and his PD would've sided with him had he decided to kill him because he had a *cover all* so to speak, no matter what the man did he "disobeyed" the officer is what the bootlickers would say even though the situation was rigged.

Violating people's rights all over and on camera... it's not a mistake so much as these guys legitimately do not know the laws they are hired to enforce. There's so much ego involved in most of these interactions too it's clear that they are trained to put the individual's rights last on their list of concerns. That's just unsat. Look up the easement laws in your city, town, or state. This guy is just giving bad information. Most measurements are in writing, by the city or state and usually read something like "where no sidewalk exists, an easement shall be allowed measuring" so many feet from the center of the roadway straight across. So if the easement is 30 ft from the center of the road, and its 20 feet from the center of the road to the edge or curb of the road, you can be no more than 10 feet onto the property. This is also why most businesses and homes ARE NOT allowed to build a fence right up on the edge of the property.

Ive always heard that there was a law there had to be an easement. And that you always had 1st ammendment rights on public property. I think the ata guy missed some case and statutory law.

ATA just said there isn’t a standard measurement. Most states are within the same amount of feet but some aren’t. You are correct that looking up your specific state is the only way to know definitively.

1 Step next to the road "Trespassing".
If it was like that companies would sue every mf that crosses their property.

On all Right of Ways, there is a designated width. Often, the road is centered in the RoW and the RoW is sized so that it is larger than the road itself. Seldom is there a RoW perfectly sized such that the boundary of the adjoining properties is at the back of curb. However, the RoW is hard to identify without experience doing so or in cases such as this where the only indicator would really be locating the boundary markers. Edit: Without markings to deter trespassers at the property line, there is little to identify where we would go from walking in the RoW to walking on their property.

Usually only after the road has expanded to the point of eminent domain issues. This road clearly hasn't been expanded.

"Independent journalist" goes to the middle of nowhere to "film" some chickens or some such bullshit and wait for the cops to arrest him so he can sue and maybe make some money. Disgusting.

Cops are agents of property owners. That's always been their primary function from the very beginning. Even when the owned property was human beings.
