At 23 years old, a bankruptcy attorney almost convinced me that I should file ch13 for $20,000 in debt when I made over $80,000/year. It's incredible how deceitful and convincing attorneys can be when they're trying to make a buck.
They prey on fear. They also don't make money unless you file with them :/ I do want to say there are some honest attorneys out there, and they really do help you figure things out, but it seems like you got stuck with a lemon :( I'm so sorry.
It's this virus that has helped them to hit the panic button because the important things can be swallowed up so file for bankruptcy so debtors can stop coming at you since you are paying it. Whew.

If people can't spend money on their rent or mortgage, they can't buy anything, they're broke. I kind of never really understood it too, if you make 7.25 an hour and you work a regular 5-day, 9-5 job, that's an average of 20/21 days you work, which is 1,370.25. Assuming you pay for 200$ car insurance, 550$ a month for rent (in my area), and 99$ for utilities, you should have around 520$ left in your bank account. Obviously your circumstances will factor into the final cost but even still, that's around 500/400 dollars worth of savings to have. What are people doing with their money?

Bankruptcy is not the end of the world. I felt immediate relief when I filed mine 5 years ago. I learned from my mistakes and I never want to live off credit again. There is no more cause and i admire those who can pay their debts… good to you all

I betcha it was 400% interest yearly and i think she said it was 10k so yearly that would be 40k and weekly 700$ which is insane. I could be wrong but i believe thats why she got scared. High interest rates. Those kill the most. Example: You make a payment of $100. Only $20 goes to the balance if you have a crazy rate. I see one person with 110% for a 100.00 personal loan. It's crazy how banks can put any Ridiculous rate and get away with it. Thier should be a law against this. A maximum of 15%. Not 30, 60, 80,or 100. But they agreed to it

I filed a chapter 13 on 130k in debt.... I was making 100k a year but then I had a horrible pregnancy and I got 10 months behind and couldn't do it... me and the husband combined make about 100k a year. The bankruptcy is taking 700 a week. I'm drowning. Need to pay the bankruptcy off.

Just make sure every payment is made on time, every month. Never late! Then, DON'T get a credit card again. This is the best opportunity you have to work with ONLY cash and save and buy ONLY with cash. It's not the greatest feeling to file for bankruptcy, but a great lesson to learn from. In 3-5 years, depending on which one you were given, you will be free from payments. It's possible to survive after a bankruptcy and move forward. Life goes on. Look forward and don't worry what's been done. It's emotional and devastating, but within 10 years from today you will be in a better place if you learned your lesson and live on cash.
Wonder why they didn't file for Chapter 7 instead of pursuing a Chapter 13 reorganization. I doubt they would have failed the means test which bars some individuals who make too much money from filing for Chapter 7. Seems like they should have filed for Chapter 7 and exempted some of the items they wanted to keep like their home and such.
Next 7 years is beans and rice. Cant buy nothing with credit , all items you want must be paid in full. Just let this be a huge lesson and work on yalls self next 7 years. Look into finding jobs that pay more money

The $1000 isn't an emergency fund. It's just the first step to prove to yourself that you can actually save money. The emergency fund is the 3-6 months of expenses which is different for everyone.

This is obviously bad advice from one of her stupid friends to file bankruptcy. One of them had to be spending big every month, the math doesn't add up. In 2 or 3 years the entire debt before bankruptcy it would be gone.
Their debt was equal to their total income, about 50k. So yeah, it would likely have taken about 3 if they got serious with it, and nothing bad happened to either one.
@ SaulGoodman, the fact that you would only consider a 50k income in this situation tells me that you will continue to be broke and in debt. Most people would automatically assume that they would have plans to increase their income to get out of this mess.

I got a 2nd job and paid off 68k in 17 months by myself, between the two of them they could have gotten this paid off in less than a year.
No way should it 2 people 2-3 years to pay off 50k, they could have done this in a year or less.
@ SaulGoodman, the fact that you would only consider a 50k income in this situation tells me that you will continue to be broke and in debt. Most people would automatically assume that they would have plans to increase their income to get out of this mess.
The car should have been the first thing to go.
