My husband is Schizophrenic . Before marriage he had this disorder. I always felt cheated.this is a permanent disorde, after marriage I diagnosed that something was wrong and consulted a doctor who told about his disorder,since then he is under medication .Now continuosly my husband's sister is harassing me that because of me he is having disorder and she want to grab all property , as my husband don't understand the process of papers. Sir plz how to move forward in this case that I can get justice in court. My husband is a employee, even lawyer says earning person can't have this disorder. Sir mere Saath exactly same case hua hai farq sirf itna hai ki muje 20 din k baad pata chala jab usko psychotic attack aya aur uske Bhai ko bulane pr Uske purane psychiatrist k pas le Gaya jaha Dr ne bataya she's a known case of schizophrenia since 2 to 3 years. Dusre din admit karaya rehabilitation center mai for 15 days baad mai gharwale uske koi zimedari nhi le rahe the Dr ne bataya ki usko gaon mein uski maa k Pas bhejdo. Waha bhejne k bad I filed annulment of marriage under sec 12 c in family court jiski 3 dates padi ek Mai ladki ayi thi counselling k liye uske baad usne meri family pr 498a kr Diya, DV 12 Kiya hai aur 406 karegi. Is dauran mera nullity k case per supreme se stay le liya hai for ex parte. Guide karo kya karu?

After a days of marriage my wife behavior was not normal her hand was shivering unable to stand properly and sweating from forehead. She had committed she is under going with Psychiatric treatment from last 4.5year she hide this from me because she wanted to marry with me. After I saw her prescription all medicines are belong to schizophrenia.. Could please give me what are proof we need to to give court. To get nullity Decree from court.
As much medical papers as possible to collect can be produced before the court as an evidence.
Sir, I have only wife prescription paper from 2020 to till date will this help for me for to get Decree.
Only prescription wouldn’t be sufficient. Together with the prescription you need some witnesses who can tell about the abnormal behaviour of your wife. You can also meet the Doctor to procure more evidence.

How to prove that disease was before marriage, because wife side family will say everything happened after marriage.
Dates on Medical reports are concrete piece of evidence.
@@TheLawOfLayman but sir patient's side family will not tell/give anything which could prove that disease was before marriage. Even thought their neighbours know little bit, but they will not speak before the judge.I think It's bad luck when someone is cheated by their parents- in-laws. (Whole life of spouse gets wasted by regular visits at mental hospital with the patient). Their children suffer the worst, their childhood become toxic, can't live a respectful life and feels shame everywhere because their fellow mates tease/bully them.
The case which I'm talking it's the wife who is mentally ill, she beats and abuses the whole family. Husband can't do anything because mother/father-in-law threatening the husband that he will end up in jail. (They will initiate many false cases against the husband mainly related to suppression of women like domestic violence, dowry etc).

Hi, my husband was taking treatment for schizophrenia before marriage. He cured and he dint take medicine. I dint know this. 1 year after marriage, again he got the symptoms and started verbal abuse. He took treatment for 2 yrs. Thn his appendix bursted by over dosage of medicine. I am taking care of him from past 4 years. Now again he got schizophrenia symptoms. Now we came to native for treatment to a dr. And i came to know that he was taking treatment from 5 years before marriage. I feel cheated. I want to file divorce. What are the procedure?
You simply file a divorce petition in the Family Court on this ground.

Aap High Court mein Quashing of FIR ke liye ja sakte hain. Agar court ko laga ke aap ke against false 498-A ka case kiya gaya hai to court iss FIR ko quash kar sakta hai.

Thank you sir and Tushar. I am in this position now. My wife was suffering from schizophrenia prior to the wedding and my wife’s parents(assholes) got her married to me. I have recognised it after 30 days from the marriage since here the first night rituals are made after some day from the marriage. Now I file a case asking for divorce and they filed it for maintenance. I hope family court verify all the factors before passing a decree. Thanks again this been very useful,

1) Judicial Separation mein agar koi reasonable excuse hoga to he Court Order pass karta hai. Aap apne Advocate ke through court ko ye bata sakte ho ke aap ke husband without any reasonable excuse aap se separate hona chahte hain aur aap apne husband ke saath he rahna chahte ho.
2) Aap Hindu Marriage Act 1955 ke Sec. 9 ke through District Court me Restitution Of Conjugal Rights ka Petition bhi file kar sakte ho.

Schezophrenia is chemical (dopamine ) imbalance of brain chemicals.it may be genetic,depends on atmosphere at home at workplace or traumatic situation faced by the patients,.may be severe or mild,bagwad Gita may be a therapy,but can't completely cure it,schezophrenics can't work,can't even do daily routine ,medicine is important along with spiritual therapy.

Yes, its possible but its been 20 years of marriage. You have to put forward extremely strong evidence to get the divorce decree. You have to persuade the court, why after 20 years of marriage? Why not at the inception of the marriage?
