    Agreed CC. Also apparently requesting your C file opens you up too. VA said i was dead at first after i submitted my C file Foia request, then they said oh our bad your not dead but we also reviewed your adjustment disorder with depressed mood 70 %, back injury 20%, bilateral nerve damage LE 10 each and OSA 50 % while we thought you were dead and are keeping it the same. Praise god i documented my continued inuries and issues. Then they didnt give me my foia response pdf as a downloadbld claims pdf and didnt send me my c file. I just had to re request it smh VBA.

    I'm 70% for PTSD, 20% for my ankle. Total 80% service connected. Should I file a secondary for depression? My sleep issues, memory issues, concentration, anger & irritability are well documented in my VA file.
    I never knew about secondaries until I found your channel.

      Depression falls under mental health - is combined with your PTSD, will be denied - don't open your claim to be reviewed...

      As the other guy said, don't open up anything like insomnia or depression. You're already rated. Focus on secondary's if you have them. If you have sleep apnea, you want to link that to PTSD. You'll need a current diagnosis and nexus.

      Ok, I’m looking for clarification here. Mental health 30%. Arthritic lumbar 40% max. Can I still claim Sommatic Symptoms Disorder?

    TBI really sucks, I live with it after my in service injury. Most of the doctors in the VA don't fully understand it. The VA system will work against you and use your TBI to help them further water your injury down. Common for a person with TBI to say I am ok. If you have a TBI get some help when filing.

      Exactly. TBI & PTSD are both rated separately. The VA will try to give one rating.

      I suffered 2 concussions while in service, one while in Desert Storm. Have always had headaches since my time in service. Lol and behold I survived a massive Hemoragic Stroke in 2017. I survived it but with short term memory loss. I know these are medically related 😢. I am rated for PTSD from my time in the Gulf. I am going to file for depression as a secondary to PTSD.

    Question for everyone because I can't seem to get a good answer.... I saw several deaths including a suicide while I was in. I didn't seek any help because I felt I could get a grip on my own and I was terrified of being taken off of my deployment or thought of as not being able to handle myself. I was good for nearly 12 years. I had some symptoms, but they would subside very quickly and it wasn't effecting my home/work life enough to make a real impact. Last summer, my grandmother passed and my grandfather couldn't take it and took his own life. I found his body. Not only did that rock me, but it brought those deaths up from service and made them extremely difficult to think about as well. I'm getting good help from my local VA and am on the road to better. My question is...1. Does this make me "deserving" of service connection. I don't want to take a piece of the pie away from you if it wasn't something I rate. 2. Since I didn't seek help while in, and severe PTSD symptoms only popped up after EAS, would it even be possible to establish service connection?

      You could get ptsd for that. Do you have documentation that all that happened? If you don’t, you could write a lay statement and submit that with your VA claim for PTSD

    I just hit the 100 club for Hep c something you don't talk about much, getting back pay from 2003. I also have 30 for Chronic diarrhea along with 20 for tinnitus & still have 7 secondary claims related to Hep c.

    CC, the VA requested a check up for my back 2 years ago and they lowered it from 50% down to 20%, stating that my back has gotten better according to my medical records. I appealed it and disagreed with them stating that I had MRI’s and X-Rays from the VA showing my back has clearly gotten worse over the past 20 years. They denied it again and closed my case. I also had my back rating for over 15 years. Any advice?

    Question: Submitted 3 claims June 29th,2023. One for dependency. One for TDIU. One for PACT Act condition COPD. The TDIU is the only claim with activity showing. The last activity was on 12/29/2023. It states that it is waiting for 13 days (7 days now) for a concurrent EP.. Everything is completed. C&P Exam, PFT, CXray done and returned to VA. I went to an accredited VSO (I did everything I just wanted him to look and see where the progress of the claims were) he informed me that it was all there in the computer that he could see it. Yesterday he told me that the COPD claim was raged at 0% - but when I speak to the VA they are telling me all three claims are open and that no rating has been awarded. So, I'm totally confused. Today when I spoke with the VA Rep - he asked for confirmation of my address/email/banking information. and said that the concurrent ep is they are waiting for the rating on the copd claim. Can anyone make heads or tails out of what I just said??

    The VA rated me at 💯 for PTSD with Unspecified Depressive Disorder to include TBI, and VERTIGO. They didn't break them up and the VSO that put the claim in said to just leave it alone

    Just had a c&p for sleep apnea and I had my orthopedic disabilities re-evaluated, I also receive benefits for PTSD, should I be expecting a reevaluation for mental health too or not?

    Quick question, I got my C&P exam results back for my back. I have two range of motion degrees, one that was the results of the goniometer the day of the exam and one that was “estimated ROM on worse day” which ROM degree are they going to use for my rating? And I dispute if they choose the higher one?

      I have the same issue as you. For my active and passive measurement using the goniometer the doctor said I bent forward 60° then she estimated the repetitive I believe it was called that was 40° and then the flare up she said it’s at 20°. I did many Google searches to determine how they would evaluate the flareup of 20° meaning is that what I will be rated on or will I be rated on the 60° active and passive range of motion for my back? Everything I found on these UA-cam lawyer sites Said the VA is supposed to rate me on the flareup one because that impacts or creates functional loss and they have to take that into consideration for the rating. I found that on several lawyer websites enough to convince me so I stopped searching if they don’t rate me where I feel, I deserve meaning the 20° one I will do a higher level review and point out that they are required to take into account functional loss and in my case that is a range of motion of 20° and hopefully they would in my favor. If not, I will appeal for the exact same thing that they are not recognizing my functional lossand evaluating me on the 20° like I believe they’re required to do. Hope this helps you a little bit or at least shows you. You are not alone because it’s driving me crazy. I’ve been waiting since August 21, 2023.

      Here's the best synopsis I could find on this: "Lower Back Pain and Flare-Ups:
      A flare-up is defined as a sudden and temporary increase in symptoms. Flare-ups are typically recurrent, but unpredictable and arise without warning. The abrupt escalation in symptoms, including pain and loss of mobility, can sometimes result in complete incapacitation as described above. If you are service-connected for low back pain, the presence of flare-ups could impact your disability rating. Specifically, a higher rating may be awarded when there is additional loss or limitation of motion due to pain during flare-ups. For example, a veteran is granted service connection for a low back condition and receives a 10 percent disability rating. On most days, the veteran is unable to bend forward more than 60 degrees. However, when experiencing a flare-up, the veteran is unable to bend more than 30 degrees. Therefore, during the flare-up, the veteran’s low back condition becomes much more disabling than 10 percent. As such, VA should assign a disability rating in accordance with this additional loss."

    I got out in 2009
    After years of inner debate and struggle thinking I’m ok. Someone out there really needs it more than me…. Is it even worth it to make a claim today?
    Tinnitus, hearing loss, service related lower body injuries, still hate the world. Is there a consultant or a consulting group I should contact?

    I filed a claim for PAD -Peripheral arterial disease.. It is listed in the Federal Register-schedule for rating disabilities 7114. I have all of the documentation, letters for my cardiologist and my vascular surgeon. It was denied because it isn't in my medical records. It is not a young man's disease. I get 60-% for Ischemic Heart disease. It was denied. Should I appeal? I use the local DAV and they are great.,

    I’m at 70% now for PTSD and feel there are several parts of the 100% rating criteria that apply to me. I’ve had 70% since 2013 and not sure if I should go for an increase. I’ve been seeing only VA docs and my current treatment doc at the VA did a test with me to determine the severity of my condition and rated it as severe PTSD. My concern is getting my rating reduced. I only have PTSD and Tinnitus as my condition the VA approved me for. What’s your thoughts on this? Is it worth the risk? Thanks for being a resource for us veterans who feel intimidated by the VA.

    I have a service connected shoulder dislocation of my dominant arm, and I got 20% from shoulder strain. Since then, I have had two more shoulder dislocations. If I were to make a claim for this, would my 20% for shoulder strain go up? Or would there be an entirely new rating for recurring shoulder dislocation, as well as having my 20% for shoulder strain?

    I'm sure I'm missing something here. 70% tbi, 30% migranes, 20% back plus other things. I don't have anything to appeal so attorneys won't help to get to 100%. I'm waiting for my results for my secondary claim for knees. I think i should have been rated 100% a long time ago. What do i need to get to 100? What am i missing? Should i submit a secondary claim for depression? Anxiety? I'm already on several meds, pain/discomfort all the time, no social life and don't like being around others. Can't work anymore either. Got denied for ptsd but as stated above, got 70% for a tbi. I'm at 90% total. My brain is fried man.

    I'm confused because I see different answers all the time. Can I have ptsd, major depressive disorder, and/or somatic symptom disorder, or are they all lumped together

      You can have all of them but you will have one rating for all of your mental health conditions

    My dad was exposed to Agent Orange and had prostate cancer cancer. He had his prostate removed and underwent radiation. Would he qualify for SMC? He’s no 100 percent but not Permanent and Total.

    If VA “doesn’t want you to know”, then why does VA have a public knowledge base; why do they make the CFR freely available; why does VA make your c-File (eFolder) available; why does VA tell you in the decision letter how you rate a higher decision? C’mon CC, be honest about VA, not sensational.

      I get what you're saying, but you do have to do some serious digging. It's not classified, but you won't find it laying around. And that C file? 6 month wait. I know first hand.

      My final period on AD was in 2012, and I put my claims last year because nobody talked to me about what conditions to claim. I was so ignorant about the process that I thought only combat related injuries were compensable so I never filed for anything until Jan of 2023. Look how many years I missed in payments just because of the lack of knowledge I had and because I had no VA related orientation during my out processing.

      I had a total of 5 C&P exams over the course of 2 years. Each one being no more than 10 pages each and all claims had been closed for at least 8 months or longer. It took them a year to put my C-file together and then it was another 2 months after they supposedly sent it, before I finally received it.
      Why would they turn something so simple into such a long, drawn out process?

      The VA has a hard job, I don’t know why CC calls the VA the enemy - they’re paying him at the 100% rate which I can understand. He’s not 100% The VA has to weed through fraudulent claims.
      CC has a job and also collecting at 100%
