No he just plays stupid. Cos as he has proven, stubborn and stupid always wins. They did, all was there and yet he got away with a half win, a slap on the wrist and as he sees it: A huge PR win. After all this not Karl was the big gaming whoop everyone was writing about and by WINNING A SETTLEMENT Billy not only got scott free but also proven to himself and his djmb grupies has was right. Now he will get tons of support back from illicit people, a champion of unlaw if you will. He won more than he could and probably actually did hope for.
As did you kids, after all, they got the chockolate in the end and you wont toss them out from home from it. That and a lesson at lying and stealing since no dire consequence will happen to invalidate it. Nothing worth losing chockolate over. Hell in the end you probably laughed and made pictures which if anything is a form of praise, which ends us with this rapther apt analogy.
Billy got the chockolate, the painless lesson, affirmation and the fame amongst his "peers". The point of all this was to stop him in the future, not empower.

Putting aside the fact that Billy had to accept TG's settlement instead of pursuing HIS OWN LAWSUIT to the end - which clearly makes him the loser, as he didn't get what he set out to sue for- this is not about Karl's lawsuit, Karl's lawsuit is till ongoing, as you could hear YOURSELF at the end of this particular video.

Remember being a kid, thinking that adults had their shit together? Now we’re grown up and find that these adults are involved in lawsuits centered around cheating at video games. I don’t think people are taking the time to step back and look at how surreal and stupid this really is.

The lawyer for TG dropped the ball on this. He got caught sending texts to witnesses so got slapped by the judge for witness intimidation. That one misstep was all Billy's team needed to have the leverage to push for a settlement.

It's an essential way that narcissists like him maintain their damaged and warped sense of self.

Without this story, he's nothing, and he knows it. So he clings to it with all his strength.
Narcissism is a terrible affliction. It poisons everyone it touches. And Billy lives an absolutely miserable existence of self loathing, and he needs this fiction not to feel good exactly, but to not feel completely awful about himself.
Narcissists are created by extreme abuse in childhood. So Billy is a victim in all this too (not that it makes a difference or excuses the horrible behavior he exhibits now).

Honestly Karl, I love your content, but don't try to present this as something it's not. This is a W for Billy. The vast majority of people are not gonna recognize the nuance of how his scores were "reinstated" and he has more than enough to make it look to the uninformed observer like his lies were true, and the uninformed observer is exactly who he has always tried to pander to. It's already being reported widely that "his scores were reinstated" when that isn't what happened.
The person who benefits most here is Billy, and the people hurt the most are the people who could've used a TG win as leverage in court in their own frivolous suits from Billy. Do not pretend otherwise.

Do you want to see something funny? Rewatch Karls video about Dream cheating after seeing this. And you will realize that entire Karls argument for Dream not intentionaly cheating can be boiled into "I can not belive that someone would do all this intentionaly and then tried to shift the blame and therefore I believe that they did not do it intentionaly".
Which is pretty much like this video where he can not belive that Billy could have won and therefore in his mind it is settled as not win for Billy no matter all the circumstances that says otherwise.
It's a bit dishonest to neglect to mention that TG's lawyer did a big no-no, committing contempt of court by inappropriately contacting some of Billy's witnesses. This was no doubt a big factor in the decision to ultimately settle. You've sung his praise a lot about how smart he is, but this was a very, very dumb move, and it ruined their case.
Here's the thing - it's very clear that neither Billy nor TG has the money to continue this farce. Both wanted a way out. And I don't blame TG. Would _you_ want to spend hundreds of thousands of Billy Fckin' Mitchell? You would not.
Billy lost. Totally. And Jobst is going to kick his azz in Oz as well.
The only way Billy could have won was a jury verdict or TG admitting he was right. Did either of those things happen?

This is disappointing. I can understand why Twin Galaxies didn't want to spend even more money by going to court, but it's a shame Silly won't be shown for who he is. I've already seen people saying they both must have been in the wrong for this settlement to happen, and that's terrible to hear :(.
Exactly, for a claim as spurious as Billy's anything less than a complete and utter defeat is a victory. At the end of the day he got everything he wanted, his scores back up on the site and for Twin Galaxies to stop calling him a cheater openly.
It's not simply that they didn't want to spend any more money, it's that their lawyer David Tashroudian (who Karl had previously praised) engaged in potential witness tampering, and they settled to appease the judge.
They both were, TG years ago for having any association with BM.
To be honest, I do hear you. On paper it really does seem like Billy got away with a relative slap on the wrist but I think in actuality the complete circus of his lawsuit has cemented him a legacy more enduring than any high score, being the absolute laughing stock of the video game industry. In future people won't be thinking about Billy's high score, they'll be thinking this pathetic man in his twilight years wasted thousands of hours of time and money trying to convince the world he didn't cheat and all he got for it, was a acknowledged statement from an expert whom also has exposed themselves as a laughing stock in their industry.
The end result is such a pathetic gain on Billy's part for the amount of hours and time that went into it, I can't help but smile.

@@zerg9523Probably to TG’s lawyers contacting the other side’s witnesses with messages that could be construed as threats (threat in this instance can just be something like “we might sue you for defamation” - still considered a form of witness intimidation) which they had been ordered not to do and was considered contempt, and was a huge setback to the defense’s case
Always love the videos Karl but I think you may need to change the title to something a little misleading. Billy Mitchell technically did not 'lose' this lawsuit although the outcome is pretty negative for him. A settlement is much different as it does not confirm a verdict for either side meaning BM can still claim that he did not cheat.
i really dont know if its all that bad for Billy: his records got reinstated on the Twin Galaxies website, so he is now seen as the record holder again. it pretty much sounds like he got what he wanted

Anyone who has a clue know it means someone backed down, usually for money but sometimes to save face. In many cases the settlement details remain confidential.
While I get why they'd settle, it's also frustrating because it's basically the best possible outcome for Billy
The best he could realistically get is not anywhere close to the best he actually wanted. No reason to spend more time and money to come to the same result.
Yeah, no offense to Karl but he is saving a bit of face here honestly, that expert testimony would likely raise doubt in a jurry making the outcome less of a slamdunk.
I mean it is far fetched for anybody that is informed about emulation and video artifacting that the points of failure mentioned by the expert testimony would result in a one to one output that maps to an emulation loading screen, but I can get how from leagal perspective there is sufficient doubt dealing with people that are not necessarily as informed. I suppose it is possible that one or any combination of those issues could, but it seems astronomically improbable...lol...like that time a cosmic ray caused a bit flip in a speedrun type of odds. Speaking of which I am surprised that expert did not throw that in there too for good measure since he went for every other hail marry under the sun.
Also I am skeptical that this is not the result Silly Bitchell wanted. He will get to puff his chest and strut around like it's victory without having to face any definitive accountability.
But at least Karl and Bitchell's case is still ongoing, so hopefully we will get a more satisfying sense of justice from those results.

Maybe you should look again. There was no "reinstatements." Twin Galaxies just added a "historical database" to show that Billy held those records at some point. TG still says he doesn't hold those records anymore, and is still banned from leaderboards. So if you want to be sad at someone, be sad at that article for spreading misinformation.
Yes, as somebody who has worked on MAME for 25 years it's weird to see this outcome, because it was an easy homerun for Twin Galaxies, but in this case, Billy 'won'
There is no doubt at all that the recordings were not from a PCB. I can't say they were from MAME, because if you were to code your own emulator it is highly likely you'd make the same mistakes we made, but they're simply not something an original PCB could output, not even with a 1/1billion hardware glitch that just happened to coincide with the exact frames in question.
As I've said before, the people fighting against Billy often seem as bad as Billy himself, and with this take, Karl is putting himself in the same group. I suspect it's because he's preparing his audience for the same kind of settlement, which he will declare as a win. This was an undeserved win for Billy, even if it was meaningless historical records (I'm willing to bet Twin Galaxies aren't allowed to drop those records from their site now)

@@Razer5542 They did so because their lawyer, David "Tash" Tashroudian, attempted to bypass the discovery process and contacted witnesses directly, in an effort to dig up more dirt on Billy and have him sanctioned.
This backfired, and the judge threatened to recommend Tash for disbarment. He was forced to issue an apology for his misconduct, and days later, he settled the case with Billy.
In short, Tash got greedy, and torpedoed his own case.

Karl, all the respect in the world, but THIS is not a loss for that piece of work even by a long shot. This is a giant loss for everyone who might "disagree" with Mitchell. He proved that he can subdue and pressure you to conform somewhat, and IT'S ALL HE NEEDED. It will be enough for him to go another 10-15 years talking about how he proved Twin Galaxies wrong, refering to "being reinstated on twin galaxy website" and using other half-truths as he did for past 30 years. He lost NOTHING.
I agree that he'll try and twist it that way, but I think what's different this time is that millions and millions of people who are in to gaming now know who this guy is and that he's a total fraud.
I think he use to get by on being somewhat anonymous, so he could easily bullshit and say he was the Donkey Kong WR holder and no one would really be sure so they'd take his word on it, but I feel like that isn't really going to work as well for him going forward. He's too infamous now.

While court systems do have their issues, this is a case of the lawyers and attorneys just doing bad at their job. Court systems aren't an automated process; they are by their nature, needed to be processed through human interaction. Those human interactions need to follow various rules for a myriad of reasons, most of which are inherently for ethical purposes.
This is not a case of the court system fucking up, this is just the case of human error, which is unfortunately an inevitability. As an example, actual Cases of courts being at fault for the legal issues are upfront costs and financial bullying which yes, Billy is guilty of. This video leaves out one of the most important points: TG’s lawyer bungled the case and was on the hook for misconduct (improper communication with a witness or some such ), and that had much to do with the out of court settlement. This info should NOT have been left out.

I get that trials are expensive and the outcome is never absolutely guaranteed regardless of a case's strengths, but both sides had already invested so much money and years of time to reach this point. So I don't believe weeks of actual trial would make much of a dent in the total litigation cost, all things considered. This still feels more of a win for Billy than Twin Galaxies, caving into his claims and experts by publicly acknowledging them, leaving room for doubt that the VHS tapes are from MAME, is unfortunate.

A trial is the same lawyers active all hours, plus a judge, plus various other functionaries plus the cost of the room itself. Trials are made expensive to discourage unnecessary trials because judges are limited and they have a golf swing to improve and/or a lot of port to get through. Seriously though, although a trial would have been entertaining for us, it would probably be depriving a more important case of timely resolution.

If you actually go to Twin Galaxies' main site you won't see Billy Mitchell's DK scores listed anywhere, for example, because they don't count due to TG's updated rules. All Billy got out of this was an acknowledgement that "Sure, they once existed", but otherwise his scores still don't count.

That was absolutely a win for Mitchell. Even if Mitchell's records are in a "throwback" section on TG's website and not officially recognized by them, they are still there and Mitchell is going to use that as proof that he didn't cheat on everyone gullible enough to believe his lies. Wow. I know that's usually the way things go with corporations, but still, it's incredibly disappointing to hear. they had Billy by the throat. They would have trounced him in court.
This isn't even a settlement. Billy had to give up literally nothing and admit nothing and nothing happened to him while TG had to give him an entry in their historical website. Having such an insane amount of evidence against Mitchell to have him caught on fraud, lying under oath and all that jazz is nothing but a crushing, embarassing defeat to withdraw now. Cuz as you said, there's nothing to stop him from continuing. Karl purposely didn't give us all the facts. Twin Galaxies' lawyer, David Tashroudian, contacted two of Mitchell's witnesses outside of official court proceedings, which is considered legal misconduct and is probably the reason they settled.
Of course, Tashroudian asked the court to impose sanctions on Billy for allegedly lying while evidence was being gathered (as Jobst has covered). Crucially, ARS Technica reports: "A hearing on both Mitchell and Tashroudian's alleged actions was scheduled for later this week; Tashroudian could still face referral to the State Bar for his misconduct." So, there you have it. I'm no legal expert, but it sounds like Twin Galaxies' lawyer screwed up and put them in a position where they had to settle, and/or he wanted to cover his own ass.
I understand Karl not wanting to throw Twin Galaxies' lawyer under the bus, and perhaps it's in Karl's best interest not to. But that's the part he left out. Also, Billy already tweeted that his scores have been reinstated. He's treating it like a victory.

The American court system is crap. The way you have to pay for your lawyer whether you win or lose means that big corpos or really rich people can just do what they want to people not rich enough to wage a legal battle.
a lot of the time, the losing side does end up having to pay for both lawyers, but its a risk.
Because winning does not guarantee this, and you might lose the case.
So even though a good % of the time only the loser pays in the end, people don't want to risk it (and you need funds up front to make that gamble)

I have to admit when I first read that press release I assumed he was being reinstated not that a "wayback" was being added to the website and got angry at that so thank you for the clarification.
You know what, I'm going to come out with it: I agree with Karl. This is not, in any meaningful sense, a win for Billy.
TG still have him banned from their main leaderboard for cheating, and he has now accepted that state of affairs as part of a legal settlement. Billy Mitchell's letter to TG demanded that they "retract their statement" that he cheated, which they emphatically did not do.. Yes Billy is on a leaderboard but, if I understand the situation correctly, that leaderboard by definition pays no heed to whether the player is later found to have cheated. For example, we could find out tomorrow, conclusively, beyond all possible doubt, that Hank S Chien's 1,138,600 was cheated, with Hank himself agreeing with that conclusion, and Hank would remain on the same leaderboard as Billy. Being on the leaderboard Billy is on, therefore, says nothing whatsoever about the legitimacy of his scores.
What Billy gets is to say the exact words "they reinstated my scores". However, he does not get to say "the court ruled that I didn't cheat" because he accepted a settlement in which he explicitly remains banned for cheating. He has, moreover, actively failed to defend his position that TG's claims that he cheated were defamatory.
This protects his ego. Slightly. That is, however, literally all it does.

@@nickfifteen He didn't lose, they reached a settlement that benefited only Billy. It doesn't matter if his scores were re-implemented in an "archive", they're still back up on Twin Galaxies in one form, and the archive was made entirely to host the fraudulent scores.
It sucks, but sometimes the bad guys win. In this case, looking objectively at how both sides made out, Billy got the better end of the deal and TG was forced to bend at the knee to accommodate him.

You failed to mention how Twin Galaxies lawyers got emotional and went overboard in court, profusely apologizing to the Judge, and that Billy was threatening to report him to the board. That certainly played a factor in the settlement. As much as I want him to lose this wasn't a loss. He got what he wanted. He can pull up that site and board and show it and 9/10 people aren't going to care its an archive.

Lol, Twin Galaxy didn't settle because it would cost them "hundreds of thousands of dollars." They settled because their lawyers committed a crime. You should know better and be more objective.

The lawyer for twin galaxies, the one you praised in earlier videos, turned out to be an incompetent buffoon and this somehow allowed Billy to get away with settling. As much as I want to see Silly Bitchell lose, this is definitely not the loss we were hoping for.
No. The lawyer just saved his client a lot of money, stress and time. Twin Galaxies still continue with their position of having the scores removed. The lawyers job is to get the best result for their client, and not to try to destroy the opposition.
As I said, look at Twin Galaxies position. No trial expense, no stress. And no need to put the times back. Billy is still banned. That's a win.

They settled because Tash wanted to dodge punishment and TG were worried because they'd angered the judge. They had a slam dunk case and had every chance of getting Mitchell to pay their legal fees, and then Tash threw it all in the dumpster for no reason.

Reason is that the Donkey Kong board components are very old and aging and subject to irregular operations.
Mitchell hired an electronic engineer to testify to this effect. But, any engineer will tell you the the same thing.
These are low grade consumer level components using IPC standard construction..not military or NASA certified parts.
Leaky caps, aged solder joints, thermal damaged chips, decomposing PCB...
Not to mention, these gaming units were never designed to operate in today's environment of WiFi, Bluetooth, cellphones, and GPS signals.

All the internet archive proves is that at one point he had scores on a leaderboard (something that is factually true). It doesn’t actually support the claim he didn’t cheat.

Yes, he's banned from the present day scoreboard but not everybody follows all of the drama. To an interested party just looking at old high scores it would appear that Billy's scores were legit along with all the other people.

Definitely agree with all the commenters saying that the title is wrong and that this is more of a win for Billy than a loss.
The only way this could've possibly gone better for Billy is if the scores were reinstated to the main site, and even that doesn't matter since Billy himself is framing it that way, and there's nothing on the archive site that points out that he cheated.

While this is the best outcome for Billy realistically, he's definitely still pissed because this trial essentially proved he cheated. Billy didn't gain anything but more documented evidence of his cheating.

In all honesty, Billy won more than he lost, and Twin Galaxies lost more than they won. It is a sad outcome since it leaves everyone in a position that they can continue claiming whatever they were claiming before and during the process.
