  • Episode seven of STAYAWAKE is here!! (EARLY!!!!)
This one is my current favourite, I had a lot of fun making this! I really hope you all enjoy.
    For further information on KAI:
    www.theglobeandmail.com/canad...
    NOTES:
The spelling of Kais last name "Mcgillivary" seemed to change in almost every article that I read about KAI. However - I decided to stick with "Mcgillivary" instead of "Mcgillvary" due to an interview with Kai's father that I found during my research. This article also spelt Kai's fathers last name as "McGillivary".
I will definitely do an update on this case if more information surfaces! :)

I know lots of people who live Kai's lifestyle and for young men to be taken advantage of by older, wealthy men is unfortunately not rare. I believe Kai. I hope he gets an appeal one day but it's clear he does have a conduct disorder that not only leads to his transient lifestyle but also leads to him being unable to really have a fair trial, as the judge and jury view his "outbursts" as attitude when he's really being genuine. Poor guy.

My father is in his 70s and is still going strong. I’d say most elderly people, assuming they are still in good shape and without health issues, are only about 10% or so weaker than they were in their 40s-50s. How long did the Trial last? What did the Jury know. What did they see? If the jury says something wrong or "Possible" the judge should sentence fair. To be honest. This is the type of guy that might be a danger to society. Young, free spirit but might be a serious danger to society and to show sympathy to your point is he's that Nuts he should be in a mental not criminal situation. This is why I hate mandatory minimums and put in in for life stuff. If they're nuts , if nothing else antipsychotic or something that makes you drool. But i'd rather get hanged or firing squad Torture and getting revenge took the place justice If I think someone should rot, id put em down easy. I don't like seeing illness or suffering. So when you put someone away it's not punishment. its pertinence i hope we learn empathy again soon. for the good, bad and ugly. just like a lemon when you get a kar. sometimes Death is lesser than promoting suffering and revenged instead of justice ⚖ IDK he might not need 1st degree murder but This guy hit me in too many spots. almost like a film. too insane to say it would happen. He's sick people are dead. but I say too many mentally ill are sent to prison and it's not the proper way. Justise would to protect the public but a mental disease is the same as anything else. He's wired wrong. a danger. A risk. Was it fair IDK. but he's the type that people dont realize or understand Pieces of shit and people with disease. also , we dont wanna let mass murderers get off on "im wired wrong" blame genetics" no simple answer i hope you enjoyed reading. Id take a death sentence no worries to not suffer in a hole full of sosiopaths and ill people. just thoughts, not answer :-)

In both instances he claims the guys either brought up the subject of getting w/ a young boy, or supposedly abused him. Personally I see a pattern. Maybe he was abused as a child and he engages in acts that cause him rage afterwards, this has happened many times w/ young men who turn on the "john" after the drugs wear off and shame sets in. I don't know any drugs that cause a man to suck 🐓. Anyhow, listen to his voice when he talks of hacking that guy in the head, then look how savagely he beat up the old man...something is wrong with him, yeah he seems cool asf, but he has a dark side...no doubt.
That was not self defense at that point, he was not being abused when he brutally beat that old man to a bloody pulp, he could have called the cops, maybe beat him up a bit, no that was not self defense. He prob figured he could get away with it since he became sorta famous for attacking the other guy (why not call the cops and prove there was semen on his face? He could have sued the fck outta that man.
The jury saw way more than either of us, but we do KNOW what he did to that man...again, not self defense and if in the right why not call the cops afterwards like he went on social media (creating a defense). Funny, this young guy was in two brutal attacks/homicide, that we know of, what has the 70 something man ever been accused of? Seems a bit odd to start drugging people at such an advanced aged w/ no history (not saying impossible, looking at the two, Kai seems the violent mentally ill one, sorry I know you're fond of him...as were people charmed by Ted Bundy and didn't believe he committed the crimes he did either (at first, at least)...and Bundy seemed completely normal...
edit: BTW his own parents say he had behavioral problems for years...and lies about being abused www.nj.com/news/2013/05/mysterious_hitchhiker_from_can.html

If someone invites you to their house because they want to have sex with you...that's neither grooming nor an excuse to hurt them in any way.

It seems that the elderly murder victim, being an attorney himself, had many powerful friends within the legal system that Kai's trial was held in. This is alleged to be the motive for certain pieces of evidence, including swabs of the old man's genitals which, had they been investigated and admitted into court at trial, would have shown some mitigation as to Kai's story. It is also suspicious that he was held a very very long time - years in fact - before his trial was held. Just sayin.

    • @Sinsteel
      @Sinsteel Рік тому +16

Right, because his powerful friends wanted an innocent man convicted, why? He was a respected lawyer so obviously he had friends in the legal community, and clearly they would want to see justice done.
Even if Kai's story were true, rape isn't an excuse for murder, and as far as I can tell we're just impugning a victim who isn't suspected of rape. Old gay guys invite young men down on their luck into their homes. That's not a new story. I don't believe for a second that Kai was naive enough with all his time on the street and the road that he didn't know why a rich, single older man invited him to stay. I'm not judging him - lots of young guys turn tricks for cash - but let's not pretend he had NO IDEA what was going on.
Stop making excuses, you don't violently and comprehensively beat to death an old man over a period of some time, in a homophobic rage after waking up, and even if you did, that's called murder. If he raped you, it's still murder, but there's no indication of rape other than Kai's self-serving excuse after he's murdered the man. Did they have sex? Probably. Why else would this older, established gay lawyer have invited an unstable, homeless drug abuser into his home if it wasn't some kind of prostitution arrangement?

I think that this man was swallowed alive by trauma, passion, drugs, and fame. The clip you pointed out where he accidentally said "i was driving..." and his general demeanor shows me that he prides himself on being a story teller, and he has lived because of it. I think that his pride, his fear, his illness, and his potential addiction issues lead him down a path that he no longer had control over. It's hard to fake that sort of consistent affection. And the outbursts of emotion; and the lack of control afterwards; and HAVING to control the storyline; shows me a traumatized man that learned traumatizing behaviour.

The Caleb McGillvary I know is a sincere, sweet, and friendly man who enjoys spreading love and light in this world despite the difficulties and hardships he has lived through. I absolutely believe he acted only in self defense when Joseph Galfy drugged and assaulted him. I have heard the audio interrogation where Kai learned for the first time that Galfy died of the injuries he sustained as Kai fought him off and left the house as soon as he could. He did not even know until that moment that Galfy had died. Kai has no motivation or desire to harm anyone, and his actions that night were only to get himself free of that monster’s assault.

As a gay man, I know(and experienced similar)the underbelly of that story since it’s a consistent theme/sexual pleasure to seduce the “simple” str8 guy after making him feel comfortable with you……. Think about it, why would a wealthy, never-married man in his 70’s take home an str8 young man he met in time square? Yes, Kai was naïve and honestly thought the guy was a friendly “cool dude”…… and was then drugged…… an excellent “straight” example is Bill Cosby and the multitude of women he did the same thing to…… there has always been the fantasy(and thousands of porn movies) within the gay community of “gay4pay” or hooking up with a “young, rough around the edges” straight guy……. And unfortunately, Kai was not only an unknowing victim but is his entire life was ruined by a forced sexual conquest by a closeted gay man in his 70s……. It hurts and pisses me off every time I see a UA-cam vid on this story!

I am from outside the US (not contaminated by this guy's popular times on the media) I can see it is clearly someone who had sex with a men and later by morning he felt ashamed and regretful and then he got aggressive on the older guy. They probably got drunk and had drugs, but definitely not forced. This history of feeling regretful about sex after alcohol and drugs and then getting agressive is kind of a classic. Then you get this guys temperament and attitude and it is pretty clear. Not naive at all in my opinion.

There was a bunch of shady shit about the people in charge of that area being real close to the guy Kai killed, and framing it in a way that made him seem guilty. Idk, I think he's innocent of murder but guilty of manslaughter personally. Waking up and beating someone to death, even if they drugged/and or/ raped you when they are so old ...its hard to claim self defense at that point, but I think the 56 years is way overkill. He should have turned himself in and gotten a blood test the second he got out of the old mans house to determine the kind of drugs in his system, would have set up a much better defense for him.

@yummy medic this happened in the city where I live and from what I recall he didn't actually chop in to the man with the hatchet, but more like hit him with the blunt end just to get the guy to let go of the woman he had ahold of. He didn't have serious injuries.

I’ve been thinking about how much our genes dictate who we become in life. Environment, early relationships and experiences all work to turn certain genes on or off. Kai’s case made me think about how possibly, if only a few things in his early environment were tweaked, while he was developing, maybe he could have gone on to really become someone. Maybe his wild personality could have been channeled into a creative pursuit, like music. I can see his personality traits making him a good rock star, in an alternate timeline. This is a sad example of how awry things can go when you combine certain strong genetic predispositions with exactly the wrong kind of environment, so that the traits that would balance out the more extreme ones don’t get turned on, or never get channeled correctly so that they lead to a chaotic and detached adult

The part where he replays what he says about him being the driver could be interpreted like that but it could also just be a stoner explaining that he was in a car, I being a stoner saying that I’m driving when I’m actually just a passenger if that makes sense.
Like if I was to explain a situation like that I’d probably slip up and say something like “I was driving or we were driving”
Not sure if that really makes sense but I don’t think it can just be interpreted in one way

Thanks for this video, there was always speculation that Kai attacked Jeff Mcbride for no reason, grabbing the steering wheel out of view of eyewitnesses and causing the vehicle to crash, injuring and pinning a man against a truck, Jeff attempted to escape the car by running towards some women for help, Kai then smashed him with an axe into the head, the damage done caused a brain injury to Jeff, which did not stand good for him as he was inadequately able to defend himself against kai's false accusations and the media also went against him, other eyewitnesses at the scene state that kai was also swinging his axe towards them as they approached him, however there is no doubt that Kai later murdered and mutilated Joseph in cold blood, the guy in all likelihood was a psycho hitch hiker, the only real shame is that he did not get his axe out to play on Jimmy Kimmels head
