    I’m so confused, $57/hr she could afford to live basically anywhere. She could find somewhere to go with that pay. She also said she moved there to mitigate the commute issues, so I’m still confused. No, the landlord shouldn’t go in her room, but she’s overreacting. A 1 bedroom apartment would cost her $2500 in Menlo Park (near Stanford) if she's lucky. And she still has to take care of the mortgage and bills at her home in Sacramento. That $57 an hour would be stretched real thin if she doesn't have any help.

    • @OhHeyItsShan
      @OhHeyItsShan 3 роки тому +31

      @@froi916 $57 an hour. So let's say she works 9 hours - that means she earns $513 per day. Let's assume she works 5 days a week (Mon-Fri) that means in 1 week she gets $2,565. In 4 weeks (1 Month) she would earn $10,260. If she wanted to live in Menlo Park she could easily afford it AND she would have $7,500 still left to pay her mortgage and bills in her old home. Even if she set aside $2,500 for bills/mortgage in her old home, she would still have $5,000 left from her monthly $10,000. So nothing she says makes sense because she had more money than needed. Remember in the healthcare industry the hours can be much longer, so her days may be 10/12 hours long and perhaps she might have to work on weekends. So $10,260 a month would be the MINIMUM she would earn. If she can't get her s**t together for $10,000 a month then there's no helping her at all.

      Just because she didn’t broadcast her trauma on national tv doesn’t mean she doesn’t have any that was triggered by him entering her space without her consent. Clearly she has an issue with men, she specifically asked if any would be in the home. The landlord said only his wife and women tenants would be there and he would give her 24 hours notice before entering her room. He did none of this. It doesn’t matter how silly this seems to you and the judge. An agreement is an agreement and he broke it. She was extremely biased in this case. I have seen her stick to words written in a lease and she didn’t with this one because she (and you) think she’s being dramatic. Shame on you. I hope you don’t call yourself a feminist. She may not have been entitled to $10k and her job loss is her fault, but he violated the lease. Period.

    The whole thing people seem to be forgetting is this was a roommate situation. Not an apartment or a house where the landlord was inviting himself in without cause. He lived there. Yes, i agree he should not have entered her room under any circumstances but when you rent rooms out to people, people tend to get comfortable like if it was a family and forget that some people have real issues. She entered his room to put money on his table, he probably just didn't even think about if she would feel different. But to end the lease over it and lose her job. No. She could've sent him an email letting him know how she really did not appreciate him entering the room and ask him not to do it again. And if he did then take action. She over did it and I'm betting it's how she operates in her daily life. Just sad she would allow this to hinder a good job. She needs some help.

      With regard to the landlord entering her room, her responses in her emails to him were understated, and the judge took that into consideration. She was citing all kinds of "reasons" for her move when it appeared she wanted to bail on the lease because he retracted on renting the whole house to her. In other words, it appeared somewhat retaliatory. However I will say that landlords -- or heads of households -- frequently feel as if they do have the right to enter a renter's room, and in his case, it was extremely passive aggressive. In other words, he used this so-called innocent reason to enter her room in order to legitimize "snooping" ... This is something that many people who rent rooms do unfortunately.

    • @DavidKen878
      @DavidKen878 3 роки тому +32

      @@whale6144 Thats assuming. Keep in mind, she was renting a ROOM in his HOUSE. He doesn't need a reason to enter her room when he can just do it when she's not there and she would never know. No one wants their landlord coming into their home when they're not there. We all get that. What we (myself and Judge Milian) don't get is why she's acting like he committed some heinous act, as if he walked in on her naked? All he did was leave a receipt. Since it's her living situation, she's right to feel any way about it as she please. But crying and shouting he violated her just because she left her big girl panties laying around and he saw them, is not something to shout "I was violated" over.

    1: He had no right to enter the room he rented to her without proper notice. Does that 1 time violate the lease in such a way where it's a breach? I would say yes if she would of left that day and notified him that day that she is leaving because of this reason but she didn't do that. With that said it is not a breach of the lease but def a violation to consider for future violations.
    2: Her job let her go May 10th. She notified him April 19th that she will be leaving in May. Even though this is presumptuous, I believe her job gave her 2 weeks notice of termination because it wasn't working out. Also consider this is very close to the 90 day period most jobs give you to see if you are a good fit. This also would explain why, with that salary or 57/h she didn't find another place (motel, hotel, ect) to live. I don't know what her rent was but if her security deposit was $1250 then her rent should be around there.
    I think the judge made a reasonable ruling.

    The plaintiff was upset that she couldn’t rent the entire house and used that as an excuse to break the lease.. I wouldn’t have liked someone going in my room either. The defendant could’ve sent a text acknowledging the amount received or simply taped the receipt in an envelope on the outside door or slid under like the judge said..

    I think the real reason she got pissed, wasn't because he was in there, but rather she didn't have enough time to air out her room from the cigarettes. He got after her for the smoking, and then she had a temper tantrum, and created this whole fiasco.

      Under the law there is a difference between a material breach versus an immaterial breach. A minor violation of a contract often doesn't void the contract, but a major one does. If one party, the plaintiff here, commits a material breach based on the immaterial breach of the defendant, then plaintiff will be found to have actually violated the contract (lease). Who determines if it is material or not? The finder of fact, often in cases like this it would be a judge, or in this case an arbitrator.

    Judge Milian read thru all her dramatic bs and story. She's clearly a drama queen. Douglass knew it was about to be a good case because he said he love it at the beginning. She wanted the money she missed out on for not taking proper measures to secure her bag and needed to take it out in someone and it happened to be the landlord. I don't know what lawyer she consulted with but she should sue them next for taking her money and making her think she had a case 😂
