  • In the (nearly) nine years I've been working as a full time artist, I've been amazed by the inappropriate things people will say to me. In this video I share three of those things.

    I heard a great comeback to that comment for #3, "well if someone robes your house, you shouldn't be angry, you should take it as a compliment, I mean they really like your stuff."

    If some one asked me for a commission where they only wanted a print I would say “sure! But, there is a fee for the creative process.” The fee would be my hourly rate plus the cost of the print. That way if the original didn’t sell I wouldn’t be out any money. 😂 The nerve of some people!

    The worst question I get is when someone offers an insulting lowball price for a painting that sells for thousands. The really insulting ones usually follow my polite refusal with an observation about how much the materials cost me. I would rather GIVE the painting to a deserving cause than accept such an offer!

      The cost of materials is irrelevant. Anyone can buy art supplies, but can they make art the way you do? They cannot. Only you can. Have a great day!

    So true! A co-worker asked me to draw her dog. I said sure, but it would cost you. She said, no, it's just a sketch, not a full painting. I said yeah, so it won't cost AS much. She never asked me again. Haha.

      I have experienced all of these issues and I feel exactly the same way. Other questions I notice people feel free to ask is How much do you earn in a year and what do you normally do for work!
      But a suggestion in response to people who use/steal your artwork - I would mention, actually that's my intellectual property and as much as I appreciate that someone likes my work, that is my lively hood and use of any of my artwork without permission is legally theft because of the intellectual property attached to my work. Each and every mark I make is copyright and you're currently in breach of the law. So will you please cease using my work immediately.

    A possible comparison to your artwork being stolen could be: Think of a time when (or imagine that) you worked on a project at your job and put in countless hours, days, weeks, months ect. using skills and experience you have developed over many years, and then having a coworker or supervisor take credit for everything you solely did on that project, stealing it right from under you, as if it was their own, with no mention that it was all you, and then them profiting on it, as far as recognition, a promotion, a raise, or a bonus. There would be little recourse for you to set the record straight or make things right. As well as, if you speak up about it and instead of others saying “yeah, that’s so wrong!”, they said “well, you should take it as a complement”, I bet you’d feel differently about it!

    I`ve been an artist for over thirty years now, and I´ve heard them all. At some point I realized that there was one thing that put me in a weak position: if I started justifying myself, explaining things, trying to get people to understand my point of view, it made me look weak and insecure. So I decided to communicate my conditions only. If I´m asked for a commission I tell them what that would cost. Nothing more. If somebody starts to question the price, I know, that he or she ist NOT the sort of customer I want. The customers I want, are people who see my profession as valuable as it is. People who question that or try to take advantage of me are NOT nice people. So I don`t have to be nice to them or make them like me. Over time that kind of people either avoided me or respected me for my firm attitude.

    Hi Ellen - good information like always. I’ve seen a couple of your vids on copyright infringement and recommend them to all. On your first point….. maybe an answer to the ridiculous requests goes something like this: “Sure I’ll create an original and you can decide to purchase only prints, but the minimum order quantity is X (maybe 200??)” I bet they don’t purchase, and they just might get the point!

    People can just be straight up baffling sometimes! I have said before, if you think this cartoon is a “simple drawing”, then YOU do it. That way you have what you want for free. Nobody takes me up on the challenge though.

    Prior to starting my art career 6 years ago, I worked as a legal assistant for an intellectual property attorney in Indianapolis. We remained friends, and I keep him on speed dial. A simple cease and desist letter from him usually does the trick. I can no longer be nice about it - it's our livelihood - how we pay our bills and feed our families. They even go so far to insinuate that my art is not serious because I specialize in folk and expressionism ... Seriously? Those precious (repeat) clients who do appreciate and collect my art beg to differ.

    On a positive switcheroo, I have had people see my preliminary sketches for works and offer to buy them for a surprising amount. Relatives often will ask for something I've done for Inktober or something, and often I'll swap something for them. I just got a few hand-tied fishing flies from a friend for a small ink drawing.

      Ah yes - nice slant.
      As an artist I am learning to embrace the business process - which can also be creative and fun - though requires a level of assertiveness.
      I did a pencil sketch of a group of guys chatting in a coffee shop - while I waited for a meeting.
      One of them saw what I was doing and wanted to buy the sketch.
      It was unexpected so I said he could have it if he paid for the breakfast for the meeting I was going to have.

    Wow, I’ve never heard of that before (people asking a commissioned print) ...it would’ve been funny if it wasn’t so ridiculous. No one would ever think to ask plumber if they can redo piping in the whole house, yet only pay for the changing the faucet😂🙈 Artist is a profession just like any other job and deserves same level of respect.

    One of my pet peeves is being asked to do a project totally unrelated to my body of work.
    There seems to be a tendency for people to assume that when you’re an artist you do every form of art.
    I’m a sculptor but I get asked to design logos, paint murals, sketch portraits etc...
    I guess all of my sculptures give the impression that I do those things lol?? 😆🤦‍♂️🤷‍♂️

      Yes to THAT! I am asked that only on occasion - though I have to say, asking me to work in oils when I specialize in ink is not as bad as asking a sculptor to design a logo....at least I'm still holding a paintbrush! 😂

      @@EllenBrennemanStudio You specialize in ink? I'm not an artist of any sort, but I happen to be interested in ink painting. I'm thinking of trying it out (as a hobby).
      Do you use only brushes or pens too? Apart from ink, do you do other forms of art?

      @@keegimujaltold1454 I worked on a series exclusively in acrylic and india inks for about 5 years. I used a brush and a spray bottle of water to move the inks around.
      Now that my series has come to a close I'm exploring everything from PanPastels to watercolor :)

    Glad to see I'm not alone. On the idea of art donations for exposure. I have chosen to do this, but it is always my choice and is very limited, 1-2 paintings per year at the very most. The fact is, I have never gotten any business from that sort of exposure. When people are surprised that I don't crave all that "exposure" I tell them that I can't eat exposure but I can certainly die from it. I love your videos Ellen, I always look forward to the next one. Cheers!

    OMG! I can't believe the Goof Balls out there!🤣😂 Yes please spend 10 plus hours on an original artwork that I am too cheap to buy just so I can have a $20 print. O' by the way; can you give me a %50 discount on that print?

    With #3 the analogy that came to my mind, although maybe a little extreme, was... Like if someone says to a woman victim of a rape " well you should feel complemented they did it cause they find you attractive and sexy"

    Hey Ellen
    I find your videos to be not so rambling reflections on important topics. I liked this one too.
    Yes - people or so often just horrible - One thing I am learning is that if I am going to do this well I am going to have learn to access my outrage more readily.
    I had someone take picture of my artwork at a market just the other day.
    I had not thought it through so - I just watched - it was so unexpected.
    JMW Turner used to throw people out of his gallery if they tried to sketch any of his paintings. He would watch people through a spy hole and bounce into the gallery through a hidden door. And - by the way - he was an example of an artist who became quite wealthy.
    It is after all business!
    If it happens again I have resolved to step in front of the person and ask them not to take pictures.
    AND
    if they want to know why I will say "I am selling more than an image here and you are taking away with your a chunk of valuable intellectual property."
    And if they can't accept that I will say "you are stealing from me"
    That is the plan.

    to appreciate the hard work, people can promote the artist, spread the word and help them reach their audience/customers instead of stealing and making money out of others hard work. it's disgusting!!

    Earlier in my career way before social media, I got hit with #2 quite often. I was very active with my local art league and people would come by my studio asking for donations to various local charities and they were always saying that its "for the exposure" or "developing collectors of your work". The last time I did this, I donated two small pieces and got the spiel I mentioned and they promised to tell me who bought the work in their charity auction and for how much. Afterward, they became very evasive when I asked for the who and how much or did the work even sell? In spite of being persistent, never got the answer to what happened to the work. Of course, there were no new collectors resulting from the exposure. My feeling was that the work probably didn't sell as I've had that experience a time or two at charity auctions in which I was present and got the work back at auction end. I felt like I threw away two of my good pieces because I wasn't going to submit something like I was cleaning out my closet.
    What finished me on donating work was for an event with the art league that I had a role in getting off the ground we called "reverse raffle". A photographer whose studio was down the hall from me got one of my paintings at the event and told me at length how much it meant to him and his wife to have it. Two days later, he tells me he sold the painting for several times the cost of the 75 dollar raffle ticket and that the buyer wants to come to my studio and "trade up". At no point did money for the sale of the work ever enter my hands. I was shocked at who was encouraging me to do this and I said no to all of them. My response to anyone who approached me after that to donate work was to politely say no. I thanked them for thinking of me but declined to submit anything.

      Oh, Patrick - that is awful! I'm also amazed that the man told you he sold it for well over the cost - talk about insensitive! Although I suppose it's good you found this out since there was a lesson for you there....but still!

    I have had my art stolen multiple times and I've had my art vandalized multiple times. I totally know how you feel! People just don't get it. I've been an artist for 30+ years and honestly, I've gotten to the point where I ignore people who make stupid comments. They are trying to help, but they have no idea what they're saying. As far as the commission for a print, I've also had people ask me for that. I just don't do commissions, period. It's not worth it. It's stressful and I hate being told what to create. One of the things I've been told multiple times that really gets me is when people tell me, "It must be nice to be an artist and just paint all day." Um, no, this is a business! I spend 50-80% of my time on business tasks. I WISH I painted all day! Thank you for this video. It is helpful to know I'm not the only one!

    Copyright answer; You can ask them there names, were they live, send a bill. Otherwise there is Pictoright. This is a worldwide organisation they do this for you. There income is, I thought 25%, what they get from what they do for you. That is a possibility. In our country I know an artist, she asked all copy paintings back and burn them. Also with the newspaper to know this. When she Camry back from holiday, she saw a shop for furniture, they sold printed (China) copies from her work. She did this ask all paintings and burn them.

    I worked extremely hard on a difficult position of a self portrait. The painting is beautiful. The first thing is I thought it was much bigger then that. 45 dollars will not get you a large painting. The client was about to give me 5 dollars less. Until they say my face.

    I was hurtful to an art theif. Kept on commenting that a liar, a theif and a fraud. Not just on the post she stole from me, but the other 5 she stole from different artists on instagram. I got my supporters to bash her too. I said she wasn’t going to get away with it. I was so harsh they deleted all their posts.

    I have had someone use my art just as there instagram thumbnail. I mentioned to a friend that it was annoying and I got the comment, well that is how it is when you put things out there. Those kind of responses don't help. But I normally don't say anything back, I just realize some people will never understand.

    The rudest thing that I get pissed off by is "DrAwInG WeIrD CaRtOoNs AgAin?" like bro, first off, everyone has their own interests and who are you to say that. Artists work hard for their pieces. Second, it's not a cartoon it's anime.

    I'm not out there enough to have had these questions or statements made. However my previous profession was in mental health and part of my role was assisting people to rephrase things so as to get their needs met.
    The two that stand out is the compliment for stolen art.
    I think you put it quite well. Putting it into that particular persons context is the most powerful tool you have.
    With the donate your art b.s.. that is marketing psychology at work. Appealing to the "ego" or the "dream" of being discovered. It is nasty, manipulative tactics coming from a purely single minded objective. To get what they want. If you want to put them back in their place but in a polite way you have to reverse the psychology.
    "Oh I do wish I was in a position to help it sounds like a very good cause. Unfortunately though I have a bit on my plate at the moment being a sole trader and the heart of the business I would not be able to give your piece the time or attention it deserves. As for existing art I'm afraid there are not any pieces available at the moment. I do wish you luck with your fundraising though."

    I sell a lot of prints and other items with my original artwork printed on them, I have had people ask me for “custom prints” soooooo many times! It’s crazy. I do pet portraits and have even had people ask me to make prints with pictures of their pets without them purchasing the original!

      UGH! I just cannot get over this. I see it as a perfect opportunity to educate people but all too often, they aren't interested in learning about the process; they just want what they want :(

    I'm an artist and hesitate to post on internet due to stories I hear about works being copied and sold. I also make cards. I can relate to some of your experiences and feel bad. Some people do not understand or appreciate, let alone respect. Good idea to send legal documentation to cease and desist.

    Thank you so much for sharing! I have been watching your old videos from 2017 and they are still so relevant. Sometimes when I hear questions like that i start to think... Is it something wrong with me or with those people?? Because I could never ask such insensitive question. Personally most common for me is a comment from people "Ooh, you price yourself" with that look on their face. People that dont do art dont really think how much it really costs and how much time it takes to create something. They are too used to cheap, mass production :(

    Thank you for your videos, I am learning a lot.I have been an artist for a long time, but the business and money part of it has always been my weak point. I can relate to this particular video. When I was years ago at the 'One of a kind show', my work was copied after the show and when I brought my stained glass pieces in the Art shop, I saw them copied so well I could not tell the difference. Later, one of my most expensive and most popular pieces was stolen from the nursing home I worked at, and the management did not even respond to my e-mail about it. I had people say the same thing they said to you: it is a compliment, someone likes your work. I was also very angry, and walked out of the gallery shop saying they will never keep up with me, as I will always have new ideas. The woman was making money off my work, and I was struggling as a single Mom of 2. After one of your videos, I did the reverse image on Google, and found the photo of my stolen piece (blue boot lamp) used in an article named 'Cindarella man'. Thank you so much for the videos

    I would compare the third case to someone passionately doing all the hard work, getting a new customer and sealing a deal only to receive a minimum-wage paycheck, with all the credit and year-end bonuses for the deal going to a random colleague of theirs. Or having a book plagiarized and sold to a publishing house. Or organizing an amazing birthday party only for someone else to take all the credit and spend half of the party giving the guests their contact info for future reference in case somebody needs to hire a party-planner one day (isn't it flattering? You're so good at planning parties someone else can get business based on all your hard work! Don't shame them and don't say anything, just stand there happily and bask in all that flattery, why don't you?). Or something else like that.
    I just can't stand comments like that and some of my closest friends are artists, so I got reeeeally carried away.
    The video is amazing, I love that you picked seriously problematic situations and gave your perspective!

    That's kinda frustrating someone wants your work for free then sell it for thousands of bucks.... that's selfish and insulting.

    My experience is somewhat related to this video and at the same time a little outside the sphere. I decided to donate a piece to a local gallery auction to raise funds for the gallery itself. When it came time to attend the auction my particular piece was set a $200. When my piece came up in rotation in the auction near announced the starting bid, you can hear the crickets chirping. I would have originally solved the work for at least $600 but once again as other people have stated in your comments, I was looking at the exposure element versus losing the work to a reduced price. So, nobody wanted the piece for $200. Then the auctioneer dropped to $150. Once again, silence reigned. Finally, the auctioneer with an awkward chuckle brought it down to $100 and the hand went up denoting interest in my art. The moment that gentleman's hand went up his wife slapped him in the shoulder in called out his name exasperatingly and added “not that one!”.
    I knew I was in for potential disappointment when I brought my work in and realized it was hung along other pieces that were very conservative in nature. I tend to do expressive figurative work which in the conservative climate of my city doesn't sell well. But once again…I was hoping the exposure would be beneficial. When the auction fiasco took place I can feel a dark pit develop in my gut at the embarrassment of how little interest people took in my work. This was two years ago and ever since then I sometimes ponder as to where that gentleman's wife put my drawing…local landfill maybe?

    Hi ellen..thanks for extremely useful practical things....seeing your video....i realised that next time someone close to me(friends) ask me to do a painting for them.....i will tell them to donate some money to charity on behalf of my painting...that way I feel my art is given its value and also it goes for charity!

    Hi Ellen. Another good topic! In answer to the 1st one I would say, “that’s what google images is for. Help yourself. Not interested.” The 3rd one, I would watermark everything in your catalog, right across the best parts. And if you were able to get ‘in touch’ with someone who helped themselves to your hard work, I would say, “if you had only taken the time to ask me, we could’ve made a sweet deal.” But since they did not you can now take whatever ‘they’ made out of your work, and spin it any way you want, using any changes they made and then sell it, if it happens to now be good or popular, as your own, because it WAS, and clean up on that deal! 😉
    Seeing how awesome you are, though, I don’t know if you’d want to ‘play’ like that. It’s an option though. A very popular band would do that when a lesser known band would ‘sample’ Their one of their songs and make let’s say a TV or radio commercial with it. This popular group would hang tight until the ‘pilfered’ song got popular and would take it, with ‘their’ changes, remake it and clean up. The ‘borrowers’, perhaps even thinking that They would kindly give the popular group even more popularity never did that more than once.

    I can't really be of any help in the realm of "nice" ways to respond, because I just simply don't do that. I'm assertive, abrasive, and if someone's being ignorant and overtly insensitive about such things, I get mean. Words tend to fly about, such as "commie", "ignorant prick", "entitled ", etc. (and those are the least colorful ones). I haven't robbed anyone to show them a realistic example, lol, but one day the right sort of jerkoff might just come along and need it. ;)

    On the subject of someone stealing another's artwork, it is very uncool. And what is so sad is that, even though you work is "automatically" copyrighted there isn't anything you can do unless you have registered the work with the Library of Congress (I believe that is correct, but check me on that as I just did a quick search on how to apply or register a copyright). I tried to find a pricing list, but yeah, guess you have to go through the application to find that out. One description I found stated $55 for a group listing and $35 for an individual, which individual is how you have to register art, at least that was my understanding, again I looked really quickly.

      It is disheartening, and the search you did yielded me the same results. It has been up to me to monitor and patrol the Internet and handle situations myself; I found that it started breaking my spirit a bit so I quit doing that and now only rely on fellow artists and followers to tell me when they find my work being sold without my permission.

    I could be wrong here but I thought original art is automatically copyright protected. If I saw someone using my art online I would tell them I'm taking legal action. I would also comment on the the person's site that they were stealing my art.

      You are correct Francine, all art is copyright protected under law. However, battling a website that is using art illegally is not an easy task. Emails go unanswered, calls unreturned, and legal action for every site that has stolen my work would likely cost 1/3 of my yearly salary; when one shop is shut down, the offenders simply wait a few days or weeks and open up another.
      Commenting on offending websites is a good idea and I encourage that! Sites usually delete my comments but not before at least a few people have seen them.
      Things are slowly beginning to change with the laws, however - it's just very time-consuming and frustrating.

    Great content! What if someone spent hours and money restoring a vintage auto and it was stolen? It's not the same as a piece of art you labored over and put your heart and soul into, but it's worth a lot. I had someone take a piece of my art and use it as their Facebook profile photo with no indication that they hadn't painted it. I was furious! They weren't making any money from it, but still it wasn't theirs to take. I asked her politely to remove it but she would not admit she stole it and then she ignored me. Not as bad as having others make money off of your creativity and hard work though.

    A friend once told me after looking at all my art that she was going to approach me for a commission for a sculpture. I said "yes of course, I'd love that" as I had never had such an offer. Her: "but you can't request more than 30 for it". Me: explains to her how much art generally costs, that it would take months to complete and that 30 wouldn't even cover material cost. Her: "in that case it has to stay a hobby." Let's just say we weren't friends much longer and she also ate for free at my place that day 🤦🏼‍♀️

    This question is off topic, Ellen. I usually sell only orginal artworks, a lot in my local area, but I make prints or cards for a small shop in town. I sometimes worry how people who have bought an original for several hundred react when they see a (small) print of ‘their’ picture for sale for much less. I know the copyright laws. Should I point out with every sale that I might be making prints? What if someone would prefer me not to do that? It doesn’t worry me for works that leave the area or go overseas, but I live in a small place where everyone knows each other!

      I think you should do whatever makes you feel comfortable. I can only speak from my experience and I don’t live in such a close knit community, but personally, I don’t feel the need to let a buyer know that I may make prints of some thing I already retain the copyright to. That being said, you could always add your intention as a disclaimer with any of the other information you send along with an original painting; that way a potential buyer will know without you having to have an awkward conversation about it.

Either I, or a family member has been ill which has prevented me from filming :/ (not COVID, thankfully).     I’m just so taken aback by the painting but they want a print thing. Maybe it’s my bias, but if someone was going to create a physical painting for me, I’d want the painting, even if it costs more?? Like... if you want something cheaper why not go to a digital artist who does a traditional-like style? I guess that’s just my artist bias though. My mind has been blown

    Hi ellen....I am artist and I recently i think i stole a painting....yes I am confessing shamelessly. I mean i painted a picture from pinterest (which is a painting) and did the same in oils....and put up in instagram....hearing.......you i realised what blunder i had done....thanks for enlightening me.....i will put a disclaimer in the comments of insta post.iam new to instagram and also these copy right issues. please comment anyone here...as an artist do we have right to paint a subject which is painted already by someone? can we sell such art? honestly, I posted that in insta just for fun...not for sale. I will not sell it now anyway. This video would have helped so many. You are so subtle in your videos but such powerful impact. thank you again

Yours was an honest mistake and you are not alone - many people are just not aware of these things which is why education is key; thank you for your attempt to make amends by editing your IG post. 😊 👍🏼To answer your question, it is a violation of copyright law to reproduce another artist's work and sell it as his/her own. I'm not exactly sure what you mean by painting a subject - If you mean a character that's been created by another person (such as Micky Mouse, Superman, Baby Yoda, etc), that is also violating copyright law.

    Hi ,Allen. You are too kind to ppl asking you to do a painting of which they intend to buy only a print. It is quite embrrassing to the artist. Tell you what I say: Why not ? You would have to pay for the original too and the print. Please send me 5 million advance,I will call you in eight days so you can pay me the balance 5 million plus for the print size you need. I start the moment the advance is received. How's that ? They won't dare say that again to any artist.

    I would say that having your artwork stolen feels like preparing for your wedding. You get a custom dress made, and spend a lot of effort and money toward making your special day as memorable as possible for yourself and your spouse. When the wedding day comes, your mother in law arrives wearing that same dress, which gets seen by your wedding party before you walk down the aisle. Everyone compliments her on it, though a few people will tell her it is in bad taste for her to have chosen such an inappropriate outfit on a day that isn’t about her. The day is ruined. Years later, all of your wedding photos bear the memory of that and all that hard work you put into it feels irrelevant.
