Fans need to stop making Fan Games, and just create Fan Mods which are easier to slip under the radar and under fair-use... if there isn't a game to mod. Create a "spiritual successor" / clone game with your own assets... then create a reskin mod for it. Steamworkshop is great for that. Minecraft has the Pixelmon mod, its highly rated in the community, lets players play Pokemon in Minecraft.
Also, my opinion as to why Nintendo randomly stomps on fanmade things was always because they had bad experiences with allowing others to handle their works, so they just don't trust anyone. Look at before the Mario Movie we don't really talk about and then afterwards. Now, look if any of the companies mentioned in the video that do encourage others to create whatever they want. They have a huge difference.
Something that is worth pointing out is that most fangames that got DMCA'd were projects that *(coincidentally)* were similar to something Nintendo was planning to announce in the near-future. _Now somebody needs to make a F-Zero fangame, and if they don't take it down _*_we'll know that the franchise is dead for sure_*
@@christonadams9046 honestly the safest thing for Nintendo to do would be to never release Mother 3 overseas and leave the fan translation. We've had the fan translation for so long now (and it's a damn good translation) that whatever localazation changes the team decides to make would be met with huge backlash from its fans, or alternatively if they don't change enough then SJWs will surely find things to cry about in the game, leading to controversy either way.

@Horizonshot there are good mario/ Nintendo fanworks out there! The most recent example is the super Mario 64 pc port (yes I tried it and it was awesome!). I just don't like that Nintendo is going after a lot of fan projects, while Sega being pretty chill about it. Nintendo even went after dreams creations, while Sega didn't bother at all. I still played a few mario official games on wii and fan games and I enjoyed them, but yeah I don't like Nintendo's attitude towards the fan projects.

What sucks is that Nintendo has so many cool properties they never use but the minute a fan makes a passion project (that they usually don't profit of) about one of those properties they get taken down immediately.
Crazy that Nintendo would want people to pay money for their games and pay their employees rather than having their IP freely distributed because that's what it's about, right? It's either let other people sell all your stuff and pocket the money or give away all your stuff for free seems like. Nothing unreasonable about that.

I am so sick of people using the "Sega makes bad games, so their acceptance of fan games doesn't count" argument whenever someone brings up Sega in this topic. Regardless of how bad Sega games are today, it's still proof that game companies can coincide with fanworks, with positive results. They aren't losing their copyrights, or anything like that. Nintendo and other companies can easily do the same thing, as long as the fanworks don't resemble ideas of their own.
First of all. Who would say sega makes bad games ? I mean there are other ips such as yakuza series, sakura wars, super monkey ball, puyo puyo tetris and the persona series. So sega just makes least good quality games unless if people are talking about sonic games. Then there's two divisions team who are incharge of the games development

Also, Nintendo was never the only company. Naughty Dog, Capcom, and Square Enix made take-downs that are just as bad as the ones from Nintendo or even worse. At least Nintendo won't attack you for calling them out. I just wish they could actually listen to the criticism, which would actually help them. Same with other companies.

One thing we left out of the video: Nintendo once purchased the rights to a pair of "films for grown ups" (we were going to call them) to stop them from ever being released again.
I think because it’s not really a substitute for any official Nintendo games they probably are a bit more lenient on those. So long as Nintendo aren’t making porn games it doesn’t really matter if others are.

This reminds me of a "recent" (I think 2-3 years ago) take down from Capcom for a remake of Resident Evil 2 made by an Italian group. There is actually a very good ending, because Capcom thanked them for their support by credited them in their RE2 Remake, plus the team could "remake the remake" by turning it into an original videogame (Daymare1998) with the moral support of Capcom and a more practice support from Paul Haddad, the original voice actor of Leon Kennedy from RE2 (who recently passed away). But, what's important is why they did that. And the reason is pretty simple: They were working on an actual Resident Evil 2 Remake. What I think is that Nintendo basically takes down fangames that got somewhat famous in the recent days, especially if they're an obstacle to projects very similar to what they're developing. I'm not saying they're working an a Mario 64 for PC, I really doubt this. In this case they're probably just defending their IP. But there some examples like the Super Metroid remake and the Mario Battle Royale one that got down also because Nintendo was planning to release something similar.
But then they also go out of their way to ban fan projects from awards and the like which just smacks of pettiness. They are downright callous to their fans while Capcom supported them despite the copyright claim.

My original comment: Woah there just a second kiddo. It’s true That SEGA allows fan-made stuff to exist, but be careful what you wish for. SEGA games as of now are pure garbagio, struggling to find an identity for themselves. Take the Sonic games for instance. They keep bringing back pointless characters that add no relevancy to the plot, and struggle to find a good balance between platforming and boost-to-win sections. Not to mention that the enemy AI sucks more than you can suck to the middle of a Tootsie Roll. Do you want that? Do you want Nintendo to fall into corporate failure like SEGA did? Do you wish upon yourself that Nintendo stop making good games such as Mario, Zelda, Splatoon, Xenoblade, Kirby, and much much more? Not much they can do with the hacks themselves, and romhackers have gotten pretty good at skirting around copyright infringement. An IPS patch of Kaizo wouldn't share a single Nintendo asset; but rather a piece of code that rearranges the assets in a copy of Super Mario world. The legal onus is on the player to get a ROM to apply the patch to, the method thereof usually does violate some copyright law. Little to no legal accountability on the hacker's part, all they're sharing is code. A fangame usually does require illegally aquiring Nintendo assets (sprites, music, artwork) or making derivatives without licensing the IP (making a cover song without license is still illegal but artists tend to not go after each other, it's mostly record labels who do), which is a much more solid case. If Nintendo could build an ironclad case against SMW hacks, there is no doubt in my mind they would, no matter how much the community has kept Mario relevant or how much love fans put into the work. It's not even about money they're *currently* not seeing with a fan project; sometimes it's about leaving a good idea that they could ONE DAY make money off floating on the net.
Romhacks often are distributed in patch files which still require original ROMs, meaning there’s nothing Nintendo can legally do to prevent them from release as they don’t technically contain any Nintendo code in distribution.
The strange part is there are people actively making 10s to 100s of thousands a year making merchandise off of unofficially licensed Nintendo properties, but the first whiff of a fan game that makes a fraction of that, if anything at all, gets axed. Just take a gander at the collectible pin hobbyist market.
it isn't about how much money the fan project makes, its about how much it hurts nintendo's profits. collectible pins aren't going to affect nintendo's profits in the slightest, since nintendo doesn't sell collectible pins and nobody in their right mind would buy a pin instead of a nintendo game, they aren't the least bit interchangeable. fan games, _especially_ free or very cheap ones, could definitely be viewed as a cheaper or better alternative to nintendo's actual products, and thus they could actually hurt nintendo's profits.

as i have stated on another comment, the port is not a fangame. it is literally an unauthorized version of the game that was shared around for free and therefore technically a form of piracy and hence illegal.

There's been some floating around. Like from 11 years back. But two have turned into new games that come close if not match F-Zero. The 3D ones at any rate. Check out Super Pilot and Aero GPX if you have time.
It wasn't even Nintendo that really made F-Zero GX, that's probably why they are so hesitant to try and create a new one, because it will never be as good at F-Zero GX made by pretty much SEGA.

The reason is much simpler: Japanese business culture. Old Japanese companies run by old men are notorious for their unwillingness to develop novel ideas, and live off of intellectual property developed during the economy bubble era. They are very protective of their IP because it's all they know and it's all they have. Creating a fan game is like trying to befriend the child of a reclusive helicopter parent: you're just trying to show some love but the parent thinks you're a kidnapper.

But it wasn’t Sony; it was Nintendo, when it screwed Sony over on a hardware partnership (prompting Sony to enter the gaming industry). The PS was spearheaded by a fellow in his early 40’s and spun into an independent, multinational business unit. Japan definitely deserves credit for the PS, but the arrogant, clingy business culture embodied by Nintendo does not.

To me, in my completely honest opinion, the idea of Nintendo shutting down fan games because they feel threatened and that they believe that fan games diminish the dignity of their IPs is absolute bullcrap. The people who are making these said fan games are making them out of love for these said franchises. Why can't the higher-ups at Nintendo understand that?
At least SEGA did respect its fans so no wonder why Sonic The Hedgehog Movie was a success. If Nintendo abandon its arrogance towards fans, then Mario Movie should do better than that.

I'm quite hyped about all the new potential series! (Plus, I hope you realize Sega is doing quite well in other industries, like a example- casino industry. to be fair though, Nintendo goes after fan games that would potentially be competition for their official games, which is understandable. Like how they took down that Metroid fan game, to release Samus Returns
If there's anything I ever honestly really dislike about Nintendo, it's this exact thing. They seriously need to learn that we want to be able to give them tributes for their work, and that we are really neither trying to "steal" their copyrighted characters nor are we trying to make our games better than their's. We want to be able to create fan games under fair use policies, and we just want to be able to give something in return for their hard work on shaping the video game industry as we know it. Otherwise, well, if they ever go out of business we may or still may not be able to create fan games because the DMCA may still strike them down. Oh well, I guess only time will tell if they'll ever finally open up or not... P.S. It also doesn't help that us gamers are having to rely on more Indie games because Nintendo is apparently starting to get super greedy with their recent mobile games. I don't see how fan games would threaten their IPs though, Nintendo most of the time makes really good games. They aren't in the same position as Sega where fans can actually make better Sonic games than they can. but I do understand where they're coming from since it's still their IPs in the end.
There would be numerous problems that not only limit potential earnings but cause customer relation nightmares. That doesn't even begin to include how nebulous the legal entanglement that the author would forcibly drag the company into by their own self-inclusion. Do they get to demand royalty payments after the fact as they contributed to the valuation of the intellectual property? It's utter insanity. Complete and utter insanity. There were particular ways that copyright could be lost in years prior such as from lack of renewal or lack of notice, but no longer apply to works currently produced. To tell you the truth; If I actually had the ability to make my own fan games and make them good, I would just forget using someone else's IP and just make my own. A lot of my personal favourite games that came out in the last decade were actually from small teams, sometimes even 1 person, that worked hard on making their own game. Take Gunman Clive and Stardew Valley for example, these games are amazing and definitely worth your time. And on top of that, since it's your own work, you have zero need to worry about any DMCA take downs.

That reminds me... At one point there was a Spyro fangame in development called Myths Awaken, before the guy was told he wasn't allowed to make a Spyro fangame like that. So he complied... by changing the Spyro elements to functionally equivalent original models, _but not the gameplay_ (well, except for a couple new tricks placed on top of Spyro's moveset). Now it's called _Zera_ Myths Awaken, starring an axolotl/manta ray pair. Still isn't finished, but the current beta has three full levels and a hub that counts as a fourth.

Reminds me of the fan game Super Mario RPG: The Starlite Worlds. It had hours and hours of gameplay and was almost as good as a real nintendo game. Nintendo had taken down the original download but some youtuber put up their own download (which let me play the game). I wish Nintendo realized how hard some of these people work on their fangames...

Nintendo is the same company that took away "Metroid" away from Retro Studios because the "Prime" trilogy was overshadowing the rest of the series, and tried to make Metroid Great and Japanese-Developed Again. This is one thing that I believe that Nintendo's former competitor Sega has handled incredibly well. Just look at their flagship series, Sonic The Hedgehog, which has a storied history of positive interactions with the fandom and fan games. Just look at Sonic Mania, essentially a Sonic fan game given a modest budget and official backing, which released to rave reviews! I love Nintendo, but they are so painfully behind the times in many aspects.

Fans need to stop making Fan Games, and just create Fan Mods which are easier to slip under the radar and under fair-use...
if there isn't a game to mod. Create a "spiritual successor" / clone game with your own assets... then create a reskin mod for it. Steamworkshop is great for that.
Minecraft has the Pixelmon mod, its highly rated in the community, lets players play Pokemon in Minecraft.
Also, my opinion as to why Nintendo randomly stomps on fanmade things was always because they had bad experiences with allowing others to handle their works, so they just don't trust anyone. Look at before the Mario Movie we don't really talk about and then afterwards. Now, look if any of the companies mentioned in the video that do encourage others to create whatever they want. They have a huge difference.
Something that is worth pointing out is that most fangames that got DMCA'd were projects that *(coincidentally)* were similar to something Nintendo was planning to announce in the near-future.

We've had the fan translation for so long now (and it's a damn good translation) that whatever localazation changes the team decides to make would be met with huge backlash from its fans, or alternatively if they don't change enough then SJWs will surely find things to cry about in the game, leading to controversy either way.

@Horizonshot there are good mario/ Nintendo fanworks out there! The most recent example is the super Mario 64 pc port (yes I tried it and it was awesome!). I just don't like that Nintendo is going after a lot of fan projects, while Sega being pretty chill about it. Nintendo even went after dreams creations, while Sega didn't bother at all. I still played a few mario official games on wii and fan games and I enjoyed them, but yeah I don't like Nintendo's attitude towards the fan projects.

This reminds me of a "recent" (I think 2-3 years ago) take down from Capcom for a remake of Resident Evil 2 made by an Italian group. There is actually a very good ending, because Capcom thanked them for their support by credited them in their RE2 Remake, plus the team could "remake the remake" by turning it into an original videogame (Daymare1998) with the moral support of Capcom and a more practice support from Paul Haddad, the original voice actor of Leon Kennedy from RE2 (who recently passed away).
But, what's important is why they did that. And the reason is pretty simple: They were working on an actual Resident Evil 2 Remake.
What I think is that Nintendo basically takes down fangames that got somewhat famous in the recent days, especially if they're an obstacle to projects very similar to what they're developing.
I'm not saying they're working an a Mario 64 for PC, I really doubt this. In this case they're probably just defending their IP. But there some examples like the Super Metroid remake and the Mario Battle Royale one that got down also because Nintendo was planning to release something similar.
Well I guess that is another reason on the pile we probably won't get a courtbound game. The incredible animations will need to suffice.

My original comment: Woah there just a second kiddo. It’s true That SEGA allows fan-made stuff to exist, but be careful what you wish for. SEGA games as of now are pure garbagio, struggling to find an identity for themselves. Take the Sonic games for instance. They keep bringing back pointless characters that add no relevancy to the plot, and struggle to find a good balance between platforming and boost-to-win sections. Not to mention that the enemy AI sucks more than you can suck to the middle of a Tootsie Roll. Do you want that? Do you want Nintendo to fall into corporate failure like SEGA did? Do you wish that our lord and savior: Masahiro Sakurai ditch the highly requested characters for Smash, such as Dante, Geno, that one Arms character, Sans UNDERTALE, Waluigi, and so much more just for another generic Fire Emblem character? I mean, not to say Byleth’s inclusion was bad or anything, but look at the roster. *8* Fire Emblem Characters. That’s on par with the Mario cast, which doesn’t include Donkey Kong, Yoshi, and Wario by the way. Heck, Sakurai had the balls to add a freaking Piranha Plant to Smash, showing that he can make literally anything possible. What I’m saying is: Be careful what you wish for. theres 100s of nintendo mario games already released and more importantly... each ROM stays with the same style as the official release if i showed you a rom next to the real game chances are you may mistake the ROM for being real (well the less crazy ones) nintendo only really copystrikes when they feel threatened so to them they already have 100s of official games made by veteran level designers what will some ROMs made by amatuers really do?
It's doubtful that fans could hurt sales by making the likes of Kaizo Mario.
Not much they can do with the hacks themselves, and romhackers have gotten pretty good at skirting around copyright infringement. An IPS patch of Kaizo wouldn't share a single Nintendo asset; but rather a piece of code that rearranges the assets in a copy of Super Mario world. The legal onus is on the player to get a ROM to apply the patch to, the method thereof usually does violate some copyright law. Little to no legal accountability on the hacker's part, all they're sharing is code.
A fangame usually does require illegally aquiring Nintendo assets (sprites, music, artwork) or making derivatives without licensing the IP (making a cover song without license is still illegal but artists tend to not go after each other, it's mostly record labels who do), which is a much more solid case. If Nintendo could build an ironclad case against SMW hacks, there is no doubt in my mind they would, no matter how much the community has kept Mario relevant or how much love fans put into the work. It's not even about money they're *currently* not seeing with a fan project; sometimes it's about leaving a good idea that they could ONE DAY make money off floating on the net.
Romhacks often are distributed in patch files which still require original ROMs, meaning there’s nothing Nintendo can legally do to prevent them from release as they don’t technically contain any Nintendo code in distribution.
I assume it's because it's hard to make money from rom hacks.
The strange part is there are people actively making 10s to 100s of thousands a year making merchandise off of unofficially licensed Nintendo properties, but the first whiff of a fan game that makes a fraction of that, if anything at all, gets axed. Just take a gander at the collectible pin hobbyist market.
it isn't about how much money the fan project makes, its about how much it hurts nintendo's profits. collectible pins aren't going to affect nintendo's profits in the slightest, since nintendo doesn't sell collectible pins and nobody in their right mind would buy a pin instead of a nintendo game, they aren't the least bit interchangeable. fan games, _especially_ free or very cheap ones, could definitely be viewed as a cheaper or better alternative to nintendo's actual products, and thus they could actually hurt nintendo's profits.

There's been some floating around. Like from 11 years back. But two have turned into new games that come close if not match F-Zero. The 3D ones at any rate. Check out Super Pilot and Aero GPX if you have time.
It wasn't even Nintendo that really made F-Zero GX, that's probably why they are so hesitant to try and create a new one, because it will never be as good at F-Zero GX made by pretty much SEGA.

The reason is much simpler: Japanese business culture. Old Japanese companies run by old men are notorious for their unwillingness to develop novel ideas, and live off of intellectual property developed during the economy bubble era. They are very protective of their IP because it's all they know and it's all they have. Creating a fan game is like trying to befriend the child of a reclusive helicopter parent: you're just trying to show some love but the parent thinks you're a kidnapper.

To me, in my completely honest opinion, the idea of Nintendo shutting down fan games because they feel threatened and that they believe that fan games diminish the dignity of their IPs is absolute bullcrap. The people who are making these said fan games are making them out of love for these said franchises. Why can't the higher-ups at Nintendo understand that?

If there's anything I ever honestly really dislike about Nintendo, it's this exact thing.
They seriously need to learn that we want to be able to give them tributes for their work, and that we are really neither trying to "steal" their copyrighted characters nor are we trying to make our games better than their's.
We want to be able to create fan games under fair use policies, and we just want to be able to give something in return for their hard work on shaping the video game industry as we know it.
Otherwise, well, if they ever go out of business we may or still may not be able to create fan games because the DMCA may still strike them down. Oh well, I guess only time will tell if they'll ever finally open up or not...
P.S. It also doesn't help that us gamers are having to rely on more Indie games because Nintendo is apparently starting to get super greedy with their recent mobile games. (Looking at you two, Dr. Mario World and Mario Kart World Tour...)

I don't see how fan games would threaten their IPs though, Nintendo most of the time makes really good games. They aren't in the same position as Sega where fans can actually make better Sonic games than they can. but I do understand where they're coming from since it's still their IPs in the end.
There would be numerous problems that not only limit potential earnings but cause customer relation nightmares. That doesn't even begin to include how nebulous the legal entanglement that the author would forcibly drag the company into by their own self-inclusion. Do they get to demand royalty payments after the fact as they contributed to the valuation of the intellectual property? It's utter insanity. Complete and utter insanity. Just look to the Witcher series and the author's dispute with CD Projekt Red as an example as to how insane you'd have to be to even humour the notion!
In the eyes of the law, if you do not defend and protect the trademark or copyright you own... you can lose the rights to it, and it becomes public domain.

There were particular ways that copyright could be lost in years prior such as from lack of renewal or lack of notice, but no longer apply to works currently produced. that would have taken away attention from Nintendo's official version of that game since they remade Metroid 2 (I thinkthat was the one) as Samus Returns. So shutting down a project that would've directly influenced the sales of their newest release makes sense
Fan games are uncreative for using other's IP's instead of creating their own stuff and it shouldn't be rewarded.

To tell you the truth; If I actually had the ability to make my own fan games and make them good, I would just forget using someone else's IP and just make my own. A lot of my personal favourite games that came out in the last decade were actually from small teams, sometimes even 1 person, that worked hard on making their own game.
Take Gunman Clive and Stardew Valley for example, these games are amazing and definitely worth your time. And on top of that, since it's your own work, you have zero need to worry about any DMCA take downs.

That reminds me... At one point there was a Spyro fangame in development called Myths Awaken, before the guy was told he wasn't allowed to make a Spyro fangame like that. So he complied... by changing the Spyro elements to functionally equivalent original models, _but not the gameplay_ (well, except for a couple new tricks placed on top of Spyro's moveset). Now it's called _Zera_ Myths Awaken, starring an axolotl/manta ray pair. Still isn't finished, but the current beta has three full levels and a hub that counts as a fourth.

Just to note, Sega hasn't always been above giving out C&Ds. Nintendo may be notorious for it, but Sega actually shut down a Streets of Rage fan remake back in 2011.

Reminds me of the fan game Super Mario RPG: The Starlite Worlds. It had hours and hours of gameplay and was almost as good as a real nintendo game. Nintendo had taken down the original download but some youtuber put up their own download (which let me play the game). I wish Nintendo realized how hard some of these people work on their fangames...
Yeah I remember that, it had so much work put into it with the timed attacks and just overall content. Thankfully I got it before that happened but yeah, at least they didn't take down the other one by the same team

Nintendo is the same company that took away "Metroid" away from Retro Studios because the "Prime" trilogy was overshadowing the rest of the series, and tried to make Metroid Great and Japanese-Developed Again. That failed hard, and now a decade later, they've been forced to give Metroid back to Retro Studios. Justice is served.

I remember the days of Project Pokemon and Pokémon Brick Bronze on Roblox. They were good games, and they got taken down. For Roblox, they were a gem.

This is one thing that I believe that Nintendo's former competitor Sega has handled incredibly well. Just look at their flagship series, Sonic The Hedgehog, which has a storied history of positive interactions with the fandom and fan games. Just look at Sonic Mania, essentially a Sonic fan game given a modest budget and official backing, which released to rave reviews! I love Nintendo, but they are so painfully behind the times in many aspects.
