My ex boss had this happen,even after the police told the HOA it was illegal,then used a torch to cut the boot off. We spent the next couple of days cutting boots off the neighbor's cars. If a boot popped up,we cut it off. We collected the remains and dropped some on the HOA presidents lawn and some on the lawn of the self appointed "parking enforcement officer". They called the cops and said we destroyed their property and the cops said that since they were already told that booting cars was illegal,people can remove them anyway they can.I miss that miserable old bastard boss.He always was good for a laugh.

Glad I don't live in america and we don't have to deal with that type of shit. The only regulations we have in France depends entirely on two things: -The city (as in the mayor and the cultural image (we'll get to that later). -The district you're in (you can't build a 4 floor house if your district only allow 2 floor houses, once again because of the city). And that's it, the only limitation you have are basically practical more than anything, no one bitching about the colors of your walls, your flowers, where you park your car (as long as it doesn't bother anyone) etc... In my street, just in my street, my neighboor on my left has his painted in a lime green and the one of my right has his painted in some kind of red-ish orange and no one care but them, it's their problem.
And even that isn't legal for them to do. Blocking a side walk is a pretty cheap parking violation (police come and write you a ticket). Otherwise it's YOUR property. I wonder how much that boot is worth for scrap metal....

HOA is nothing more than the landlord for the house that you purchased. It's literally the worst of both worlds, you still have to go through all the hassle of buying a home and being responsible for it AND all the hassle of living under the rules of someone else and abide by strict regulations of how you live in your home.

i had a little event occur with my HOA a few years back. im a certified welder and have a welding truck which i use for work. i always parked it in my driveway. this went just fine for over 4 years. suddenly we have this new parking enforcement company. i got my truck booted ,i went to the office as i had peremission to park in my driveway. the company refused and i paid 85 bucks. i began parking the truck in the garage. well i was doing some work in the backyard and the front garage door was open. i was floored to find my truck booted inside mydamn garage. i went to the office and im pissed ok. they refused saying that no one wants to see that truck. now i might add that my truck was beautiful. new paint chrome everything and always clean. before i left the office i said i will not pay. i was then told that i should enjoy my time off as im not going to work. how stupid that guy was is astounding. i have extensive metal working tools and i took my cutting torch out cut that damn thing off .i drove to the enforcment office and booted the bosses car but i welded it together.no key was opening that one. well guess what people i was never bothered again. they underestimated my level of contempt and revenge.
I cannot tell you how many times I bumped heads with my previous HOA. It almost made living in my home oppressive. They had me remove rocks that were placed at the bottom all around my outside fence even THOUGH the original builders designed it that way. They never said a word about it until I moved in with my family. I spent 2 hours carrying those heavy rocks one by one. Then a couple months later they said I had to cut the bushes of my small tree outside where they were starting to impede people walking on the side way and cars on the street. It wasn't that long and I was walking right under them just fine, but I thought fair enough. So I cut them, about 3 feet above my head and I'm 6 ft. And on the street same, about 6 ft above my SUV. They sent letters again saying I had to cut it shorter. AND I had to fix a golf ball sized hole in my white fence. I swear I saw red after those letters. I patched the hole with White tape. Took an Axe and chopped the tree down, loaded it in my truck and dumped it. They sent an angry letter with a fine for chopping the tree and I called them and played dumb. Asking I thought THEY did that? And they continued to accuse me of chopping the tree to which I kept stating I did not and thought it was HOA so I thought nothing of it. And I got very defensive and said if you think I chopped it down then show me a video of me chopping it down, otherwise I'm calling the cops for harassment. They withdrew the fine and never sent me a letter again. Long grass. Weeds. Even painted parts of my house different color. Never said shit after that about anything. Lol

If you own a home before the establishment of a HOA You can use a Grandfather-Clause to your advantage. Ex: My grandmother had a small vegetable garden in her front yard for almost 27 years, Then a HOA was established in 2007 and tried to enforce their rules and standards. Eventually removing the garden without permission after my grandmother’s refusal over the course of 8 months. After a long legal battle and an undisclosed legal settlement, My grandmother at age 96 still has a vegetable garden. The end.
It’s a shame she had to go into a legal battle, but good for her. There are some decent HOA, but there are some that refuse to follow or understand their own rules and clauses. I’ve also seen some bad things get grandfathered in as well due to the negligence of the boards.

A girl I know works for a attorney that specializes in hoa's . Some of the stories she told me were so unbelievable. One that comes to mind is the hoa going after homeowners that worked 2nd shift, and started rules about what time you could start your Vehicle, and no guests or visitors allowed after 10pm, no one was allowed to leave or return home after midnight. That case the president of the hoa and board members were sued and they had to pay out of their own pockets for lost wages and attorney fees!

Thomas Jenkins best regulation is to outlaw them altogether. It should be up to the individual homeowners to maintain values of their property. If they want trash removal, get the city/town/county to do it. that's what most people who don't live in HOAs do and taxes they already pay takes care of the cost. If that's not an option, pay someone to do it. It's not that expensive. Want lawn care? Do it yourself or pay someone to it, also not that expensive. Snow removal? Petition for the state to maintain the road and again, taxes you pay covers that. A lot of people live well and have valuable property without HOAs. Who needs them?
The problem is cities can function similar to HOA's as well. Letters saying we need to trim trees and mow the lawn are understandable as they do present a reasonable risk to the safety of others and their property. But I remember getting a letter from the city saying we needed to paint a board we installed to cover up a gap in the exterior roof. Funnily enough we have a broken window just a few feet down and have never gotten a letter from the city saying it needs to be replaced. Thankfully, there's none of this "lawn must be exclusively this type of grass and well maintained" bullshit.

I used a chordless angle grinder to remove an illegal boot from my vehicle. Threw it in a dumpster. They sent me a letter fining me for the cost of the boot that was destroyed. I returned there letter saying "What Boot? I have never been booted in my life." They had no proof other than a license plate number and took the loss.
I did one better. I picked the boot on my truck then went around collecting the boots on neighbors (asked if I could first, all agreed). I then put them on all the HOA board's cars and welded them together. I haven't seen a boot since. I kept one to test on illegal parking in the city.

They only way I can live as close to the ocean as possible is to live in a place with a HOA. My HOA is mostly non-existent anyway. I can do what I want actually. I pay them $120 per year and the main reason is: my homes value has increased almost $30k since living here and I have yet to do any remodeling. I could sell my home right now and make a great profit. Investing is wise. Try it sometime.

Nicolaj Nielsen: Taxes go to the city, county, state, school district, hospital district, and each one of those government identities are suppose to deliver a service to you. Where HOA do you no services only collect dues, and fines just to make sure you house looks just like your neighbors. You would have to beg them if you want to built a pool in your back yard, or any type of garden, or some kind of play ground equipment, or even a storage shed. Then there is your cable or satellite disc, where or not you may fly a flag, how high is your fence. Do you understand now why HOA are not needed or liked by most people?

I recently had a run in with the local HOA in my somewhat nice neighborhood. They quickly left me alone after I laughed hysterically and obnoxiously over the phone when they tried to tell me I needed to resod my yard with a different type of grass. Although it did take them three separate calls over a months time, needless to say the laughing got more and more obnoxious and grotesque as the calls came. Edit: I should also mention that I signed no contract, and am not technically any part of their little lame-ass wannabe fascist state. Nonetheless I live close enough to where they felt they could tell me what kind of grass goes in the yard of the home I pay taxes on. Fuck.That.Shit.

Sometimes lands can have CCR's on them. While you are not in an HOA there are conditions that must be met. For example by San Diego there is an area where every home must have Spanish tile roofs and be tan stucco exteriors, even the businesses and strip malls. It was a condition placed on the land when it was left to the state I believe so when it was sold every developer and anybody who buys there must maintain. This IS real. It is enforceable. it ios different from an HOA but similar in some respects. I believe HOA's can be disbanded but CCRs cannot be lifted from what I had heard.

I could see how a HOA might work... If by some magical chance the right people were involved. But to go and just farm it out to some officious little company makes no sense to me at all.
I lived in one that was decent. The fees were low, amenities were decent, and was ran locally by elected officials. The neighborhood was very large and comprised a significant portion of the city with sub-neighborhoods all combined into a large complex. They had public newsletters with updates on meetings, and information was all freely accessible. The problem is with HOA management companies who operate like the one in the video: a dictatorship. HOAs must be democratized, with knowledge that they have a job to make EVERYONE as happy as possible, know that there are a LOT of crazy people out there.
Do exactly what my friend in Texas did when going to the HOA office building. Tell the "lady" that she calls the HOA owner to respond NOW or every building that the HOA uses as offices and every employee that lives in the HOA that works for it will also somehow mysteriously have a home "accident" the next day unless they fix their problems. He had had it with the 12+ problems in the past month from them and then made it their problem. Weirdly; two hours later, all the problems were solved, all employees of the HOA were gone, and the whole community had no more problems. Nice when you play on their rules and they don't like it.

HOAs drive away a lot of prospective customers with their restrictive rules. And the funny thing is... during a recession, HOA properties *drop* massively. This is because the HOA often strikes down bylaws to boost slumping sales..., while those who fear “anarchy” when that happens will often sell. It’s a very similar concept to blockbusting in the 50s and 60s. An HOA makes things look good.. and makes certain people feel good.... that’s it. Just like that one carat diamond on the HOA presidents hand that’s worth only 50% of its appraised value because they only people who are going to buy it are pawn shops, jewellers, and private citizens who definitely aren’t paying full value.

The last time An HOA tried this on me, I cut it off and then threw it through the front door window of their office, and then sued them for my lost time, harassment, and fraud. The HOA is no longer in business, they went bankrupt from all of the home owner lawsuits that were filed along with mine. I won.

Hoa gets reported again. Hoa also trespasses and performs illegal search of property and blocking owner's driveway. Owner goes to his towing truck, hoa skidaddles out before owner tows away hoa's vehicles. Hoa places lien on house. Owner takes them to court and wins (hoa has to pay owner's attorney fees plus damages). Hoa places lien on house again. Owner takes them to court again winning. multiple cease orders for hoa to cut their crap. Is a story i read on reddit long ago. I paraphrased it a lot. It may not be very accurate i left out a lot of legal jargon and a lot of the story.

One time I was in the Pennsylvania mountains. I was lost and found myself in a remote little village. They had cars up on blocks. Washing Machines on the porch, little gardens, sheds, and working on cars in the yard. I felt like I was in God's country.
Some folks will put old coaches and washing machines in the front of their homes and leave trash and broken cars around the yard, simply don't maintain their homes. If you don't want to live near those folks you can CHOOSE to live in an HOA community, where EVERYONE in the community signs the same contract (which defines the rules) voluntarily. This protects the home values in the community and those homes generally cost more because they are cleaner and better looking neighborhoods. The community members vote in the leadership of the association. But people in general don't want to be called out when they do break the rules they agreed to abide by.

Booting a vehicle unless you are law enforcement is illegal in most jurisdictions. The city or county would have had to grant this Home Owners Assc. an exception in most cases. Seems to me you have a more serious problem if your government is giving away your property rights without any agreement.

I hate HOAs, I had a flats boat in my drive way which is a down hill drive way and 75' from the road. I get a letter in the mail for the HOA saying they are going to fine me $250 a day for every day it sits in my drive way because it's a danger to other drivers... man I hate them with a passion.

You will be served a notice that you are being sued in small claims court. You will end up paying several hundred dollars. If you don't pay, they will slap a lien on you that will affect your credit rating and then they will go to court and seize your bank account or your paycheck.
Except when you sign a contract saying otherwise. Gated communities specifically claim ownership of public roads through the HOA. That's why you have to have to hire a lawyer to create an HOA. It isn't something easy to do. It involves a lot of legal work.

My ex boss had this happen,even after the police told the HOA it was illegal,then used a torch to cut the boot off. We spent the next couple of days cutting boots off the neighbor's cars. If a boot popped up,we cut it off. We collected the remains and dropped some on the HOA presidents lawn and some on the lawn of the self appointed "parking enforcement officer". They called the cops and said we destroyed their property and the cops said that since they were already told that booting cars was illegal,people can remove them anyway they can.I miss that miserable old bastard boss.He always was good for a laugh.

The only regulations we have in France depends entirely on two things:
-The city (as in the mayor and the cultural image (we'll get to that later).
-The district you're in (you can't build a 4 floor house if your district only allow 2 floor houses, once again because of the city).
And that's it, the only limitation you have are basically practical more than anything, no one bitching about the colors of your walls, your flowers, where you park your car (as long as it doesn't bother anyone) etc...

i had a little event occur with my HOA a few years back. im a certified welder and have a welding truck which i use for work. i always parked it in my driveway. this went just fine for over 4 years. suddenly we have this new parking enforcement company. i got my truck booted ,i went to the office as i had peremission to park in my driveway. the company refused and i paid 85 bucks. i began parking the truck in the garage.
well i was doing some work in the backyard and the front garage door was open.
i was floored to find my truck booted inside mydamn garage. i went to the office and im pissed ok. they refused saying that no one wants to see that truck. now i might add that my truck was beautiful. new paint chrome everything and always clean.
before i left the office i said i will not pay. i was then told that i should enjoy my time off as im not going to work. how stupid that guy was is astounding. i have extensive metal working tools and i took my cutting torch out cut that damn thing off .i drove to the enforcment office and booted the bosses car but i welded it together.no key was opening that one.

I cannot tell you how many times I bumped heads with my previous HOA. It almost made living in my home oppressive.
They had me remove rocks that were placed at the bottom all around my outside fence even THOUGH the original builders designed it that way.
They never said a word about it until I moved in with my family.
I spent 2 hours carrying those heavy rocks one by one.
Then a couple months later they said I had to cut the bushes of my small tree outside where they were starting to impede people walking on the side way and cars on the street. It wasn't that long and I was walking right under them just fine, but I thought fair enough. So I cut them, about 3 feet above my head and I'm 6 ft. And on the street same, about 6 ft above my SUV.
They sent letters again saying I had to cut it shorter. AND I had to fix a golf ball sized hole in my white fence.
I swear I saw red after those letters. I patched the hole with White tape. Took an Axe and chopped the tree down, loaded it in my truck and dumped it.
They sent an angry letter with a fine for chopping the tree and I called them and played dumb. Asking I thought THEY did that? And they continued to accuse me of chopping the tree to which I kept stating I did not and thought it was HOA so I thought nothing of it. And I got very defensive and said if you think I chopped it down then show me a video of me chopping it down, otherwise I'm calling the cops for harassment. They withdrew the fine and never sent me a letter again. Long grass. Weeds. Even painted parts of my house different color. Never said shit after that about anything. Lol

You can use a Grandfather-Clause to your advantage.
Ex: My grandmother had a small vegetable garden in her front yard for almost 27 years, Then a HOA was established in 2007 and tried to enforce their rules and standards.
Eventually removing the garden without permission after my grandmother’s refusal over the course of 8 months.
After a long legal battle and an undisclosed legal settlement, My grandmother at age 96 still has a vegetable garden.

It’s a shame she had to go into a legal battle, but good for her. There are some decent HOA, but there are some that refuse to follow or understand their own rules and clauses. I’ve also seen some bad things get grandfathered in as well due to the negligence of the boards.

A girl I know works for a attorney that specializes in hoa's . Some of the stories she told me were so unbelievable. One that comes to mind is the hoa going after homeowners that worked 2nd shift, and started rules about what time you could start your Vehicle, and no guests or visitors allowed after 10pm, no one was allowed to leave or return home after midnight. That case the president of the hoa and board members were sued and they had to pay out of their own pockets for lost wages and attorney fees!

Thomas Jenkins best regulation is to outlaw them altogether. It should be up to the individual homeowners to maintain values of their property. If they want trash removal, get the city/town/county to do it. that's what most people who don't live in HOAs do and taxes they already pay takes care of the cost. If that's not an option, pay someone to do it. It's not that expensive.
Want lawn care? Do it yourself or pay someone to it, also not that expensive.
Snow removal? Petition for the state to maintain the road and again, taxes you pay covers that.
A lot of people live well and have valuable property without HOAs. Who needs them?

The problem is cities can function similar to HOA's as well. Letters saying we need to trim trees and mow the lawn are understandable as they do present a reasonable risk to the safety of others and their property. But I remember getting a letter from the city saying we needed to paint a board we installed to cover up a gap in the exterior roof. Funnily enough we have a broken window just a few feet down and have never gotten a letter from the city saying it needs to be replaced.
Thankfully, there's none of this "lawn must be exclusively this type of grass and well maintained" bullshit.

I used a chordless angle grinder to remove an illegal boot from my vehicle. Threw it in a dumpster. They sent me a letter fining me for the cost of the boot that was destroyed. I returned there letter saying "What Boot? I have never been booted in my life." They had no proof other than a license plate number and took the loss.

They only way I can live as close to the ocean as possible is to live in a place with a HOA. My HOA is mostly non-existent anyway. I can do what I want actually. I pay them $120 per year and the main reason is: my homes value has increased almost $30k since living here and I have yet to do any remodeling. I could sell my home right now and make a great profit. Investing is wise. Try it sometime.

You can always choose not to move into an HOA home or not to get internet from a shitty provider, etc. but the point is that it's essentially an ultimatum where whatever you pick it's going to be just as bad. it's not as simple as choosing to boycott a watch a movie or something, choosing a home is something that affects many aspects of your livelihood and it's not something that most people have many options in.

Where HOA do you no services only collect dues, and fines just to make sure you house looks just like your neighbors. You would have to beg them if you want to built a pool in your back yard, or any type of garden, or some kind of play ground equipment, or even a storage shed. Then there is your cable or satellite disc, where or not you may fly a flag, how high is your fence. Do you understand now why HOA are not needed or liked by most people?

I recently had a run in with the local HOA in my somewhat nice neighborhood.
They quickly left me alone after I laughed hysterically and obnoxiously over the phone when they tried to tell me I needed to resod my yard with a different type of grass.
Although it did take them three separate calls over a months time, needless to say the laughing got more and more obnoxious and grotesque as the calls came.
Edit: I should also mention that I signed no contract, and am not technically any part of their little lame-ass wannabe fascist state. Nonetheless I live close enough to where they felt they could tell me what kind of grass goes in the yard of the home I pay taxes on.

Sometimes lands can have CCR's on them. While you are not in an HOA there are conditions that must be met. For example by San Diego there is an area where every home must have Spanish tile roofs and be tan stucco exteriors, even the businesses and strip malls. It was a condition placed on the land when it was left to the state I believe so when it was sold every developer and anybody who buys there must maintain. This IS real. It is enforceable. it ios different from an HOA but similar in some respects. I believe HOA's can be disbanded but CCRs cannot be lifted from what I had heard.

The neighborhood was very large and comprised a significant portion of the city with sub-neighborhoods all combined into a large complex. They had public newsletters with updates on meetings, and information was all freely accessible.
The problem is with HOA management companies who operate like the one in the video: a dictatorship. HOAs must be democratized, with knowledge that they have a job to make EVERYONE as happy as possible, know that there are a LOT of crazy people out there.

Do exactly what my friend in Texas did when going to the HOA office building. Tell the "lady" that she calls the HOA owner to respond NOW or every building that the HOA uses as offices and every employee that lives in the HOA that works for it will also somehow mysteriously have a home "accident" the next day unless they fix their problems. He had had it with the 12+ problems in the past month from them and then made it their problem. Weirdly; two hours later, all the problems were solved, all employees of the HOA were gone, and the whole community had no more problems. Nice when you play on their rules and they don't like it.

The last time An HOA tried this on me, I cut it off and then threw it through the front door window of their office, and then sued them for my lost time, harassment, and fraud. The HOA is no longer in business, they went bankrupt from all of the home owner lawsuits that were filed along with mine. I won.

Owner takes them to court and wins (hoa has to pay owner's attorney fees plus damages). Hoa places lien on house again. Shit, if anybody booted my truck or cars or my boat & snowmobile trailers on my property I'd do the same as you...I'd grab the hypertherm & cut it off...but I'm not in an hoa neighberhood. Some perspective is in order man...they're getting what they're paying for, so it's their problem.

When I am house-hunting, my first question for the real estate agent is: "Is this property infected with an HOA?" If yes, I walk. Simple as that.

From someone living outside the US I find this absolute outrageous, what is the HOA even for? This is a classic example that power corrupts.
One time I was in the Pennsylvania mountains. I was lost and found myself in a remote little village. They had cars up on blocks. Washing Machines on the porch,
little gardens, sheds, and working on cars in the yard.
I felt like I was in God's country.
Some folks will put old coaches and washing machines in the front of their homes and leave trash and broken cars around the yard, simply don't maintain their homes. If you don't want to live near those folks you can CHOOSE to live in an HOA community, where EVERYONE in the community signs the same contract (which defines the rules) voluntarily. This protects the home values in the community and those homes generally cost more because they are cleaner and better looking neighborhoods. The community members vote in the leadership of the association. But people in general don't want to be called out when they do break the rules they agreed to abide by.
@@nightdipper5178there are already city ordinances against people leaving trash in their front yard. You can call the city/county they will be fined and forced to clean up. You don't need to pay another bunch of people to bully your neighbors into not being slobs. Your taxes cover that.
Here in Canada HOAs are not popular because we already know or rights and what our taxes cover. Most Americans that have spoken to seem to not have a good understanding as to what the government is supposed to be doing for the taxes that you were paying.
My friends from Texas keep saying they don't want the government in their business. And all I can tell them is you're already paying them to do that. How are you ok with them just not doing anything with your money!

In the US a city can tell an individual to clean up their yard, and the order can be ignored for years. In an HOA you would be fined each month for the washing machine out front, secured by the equity in your condo, condo can be sold for unpaid fines. The city wouldn't concern itself with a washing machine in a yard unless there was a city official living next door to it.

It is time to force jail time on all private entities that take the law into their own hands, even those that have a business name attached. If one person can get into trouble with the law for doing it, all must share the same liability. The CEO of Hoamco should receive at least a year in jail for each offense his company committed.

Booting someone's car in front of their own home most likely won't work for you when that person can just pull out their angle grinder and get it right off.

Booting a vehicle unless you are law enforcement is illegal in most jurisdictions. The city or county would have had to grant this Home Owners Assc. an exception in most cases. Seems to me you have a more serious problem if your government is giving away your property rights without any agreement.
Well done, swift and effective investigative journalism. HOA corporations have a tendency to be predatory with their enforcement in places, not just keeping the properties in proper, maintained order and not letting people farm rusted cars on their lawn.
I hate HOAs, I had a flats boat in my drive way which is a down hill drive way and 75' from the road. I get a letter in the mail for the HOA saying they are going to fine me $250 a day for every day it sits in my drive way because it's a danger to other drivers... man I hate them with a passion.
Then don't put up with it and move to a non-HOA area.
or better yet call the police and have them tell the fuckers off that their laws dont override city and state laws and if they continue to harass you then take their asses to court and they will find out real quick that they cant push you around

nightshadow actually, they do. When you buy a home in an hoa neighborhood...you sign an hoa membership contract at the time you close on the home. That's why I really don't feel much sympathy for people bitching when they were dumb enough to buy there in the first place.

You will be served a notice that you are being sued in small claims court. You will end up paying several hundred dollars. If you don't pay, they will slap a lien on you that will affect your credit rating and then they will go to court and seize your bank account or your paycheck.
You sign a contract stating you adhere to the HOA, which means this isn't illegal.

Except when you sign a contract saying otherwise. Gated communities specifically claim ownership of public roads through the HOA. That's why you have to have to hire a lawyer to create an HOA. It isn't something easy to do. It involves a lot of legal work.

Before stating "you will get arrested", know that some states have enacted castle doctrines which allow for force, including firearms, to be used to defend yourself, someone else, AND PROPERTY. It all depends on where you live. Here in east tn, people wouldn't put up with that crap for one minute.

Simple solution if you have a spare tire is just jack the trailer up and replace the tire . Then take the tire and boot into you garage and work on it in your spare time. As a blacksmith that is some good metal to work with. I wonder how many knifes I could make out of a Boot ? You know them boots can be expensive to replace. Once they attach it to my car it belong to me.
Most boots have metal disks that cover the lugnuts so you cannot take the tire off the car...

I would get a grinder and pass out fliers at every door for boot removal services for 1 dollar then collect all of their boots and sell them for scrap metal . I provide a needed servuice make alot of money and put the crooked HOA out of business with their security friends .
