But to be clear when I was in a wreck not drunk driving the car in front of me didn't have working brake lights they made me pay the tickets that I received since I hit someone from behind and they made me pay the difference from what was still owed on my car to what they totaled it at and I had to pay the increase for my insurance that went up

Depends on the questions. They can't ask anything about what they're investigating, but for ID and other matters, sure. Also, they don't have to read you your rights if they're not going to ask you anything. That can happen if they witnessed the crime.
