Cop Arrested in Full Uniform Before Shift

- @Copwatchtv obtained body camera footage from an incident involving a uniformed Albuquerque Police Officer who was on his way to work in his fully marked police unit.
While he was driving to work, according to NM State Police the officer was apparently going well over 100MPH and swerving within lanes of traffic. A New Mexico State Police officer observed these driving behaviors and pulled the APD officer over. The New Mexico State Police officer soon could smell alcohol on the officers person.
APD Officer Jordan Hernandez has been with the department for 3 years and is currently being investigated within his department for this incident and his trial is pending.

May be dept policy to cooperate in all investigations. If he refused, it could possibly mean immediate termination.

To be honest, alcoholism in policing is rampant. You see a lot of s**t , can't talk about it with anyone, your relationships get strained and the shift pattern can screw your sleep and mind up. Not an excuse and dude needs to answer for it, officers gotta get better about getting help for their drinking before something like this happens.

How bad do you have to be? Buddy, this is low down on the "crimes cops do" list. Have you seen how many of these cops get promotions and commendations AFTER committing worse crimes?
The arresting officer should be praised for holding the officer to a higher standard. We need more accountability. This was refreshing to see.

If that is failing a sobriety test, what the heck does passing look like?
There's small things that make this a failure, but with the conditions the test was done in (windy highway, test done in full police gear), I doubt it would be hard to fight in court.
Poor guy… apparently he is afflicted with alcoholism. Sucks.
The 3rd test he began before he was told to begin.
The eyes. The eyes are a dead giveaway. When you follow his finger back and forth your eyes will jump if you are intoxicated on anything. The second he did the eye test the cop was going to jail. He just did the other tests to seal it in court. My uncle got a DUI for weed and on the ticket it even says " Eyes jumping".
I know. Field sobriety tests are completely useless.
This officer is Sgt Toby LaFave, who has 20 years on the job and well over 3k DUI arrests under his belt. He's seen first hand the horror of drunk drivers. Kudos to him, once again.

Good job to the arresting officer for not showing preferential treatment to a cop who is DWI
Almost guaranteed he wouldn't do the same to a superior officer in that department. Maybe he would, but I STRONGLY doubt it. Holy crap.
yeah, that is the point people have failed the FST totally sober. ALWAYS ask for a blood or breath test if you're not drunk. The field test is meant to be failed.
If an officer has already decided that you are under the influence, it doesn't matter how well you perform on the FST's. In this video, the other cop's eyes didn't display nystagmus, he had no trouble following instructions (when he was able to understand them due to the wind), and he did fine on the heel-toe walking. The only test that can clear you in the field is the breathalyzer, or blood draw done after a trip back to the station, booking, and securing a warrant. I suspect this cop submitted to the FSTs in order to gain some extra time for his body to metabolize the alcohol before they force a blood test on him back at the station.
@@abasdarhon nystagmus can be distinct and sustained but not highly visible on body worn camera. I did witness some nystagmus on the video so its not unreasonable to think that the nystagmus was highly visible to the officer in the moment. yeah when I was in the military there were troops who were depressed and alcoholics. Used to try to conceal their intoxication at work. NCOs were trained to look for this. In the military there is no leniency. If you come to work intoxicated once they might send you to counseling but ultimately they start trying to get you out of the military at that point.
@imveryhungry112 no leniency or free councilling? Which is it?
@@jasond869 Both. They will send the troop to "counseling" to get them out of the work place while they begin processing them for discharge. That's usually what happens to these troops. @@_Clayton.Bigsby_ actually yea a lot of people do. This is probably just a nice cop. Why can't that be the case? The cops in my town damn near apologize for arresting you they're so nice. So you really don't know
That state police officer takes no prisoners.
So he shoots people instead?
Except this guy. He took this guy as a prisoner.
Huh??? 🤔🤔🤔
He definitely took this prisoner!😂😂😂😂
I wonder how it would go if he pulled over another State Police Officer....or if this guy was stopped by his own department. Probably a little professional courtesy on the speeding violation and no DUI test
This is NOT how a traffic stop should work. This officer goes full on DUI within seconds of pulling this man over. 6 minutes he’s doing field sobriety tests. Without asking. Ridiculous
At least he was respectful to Trooper. Sad.
Get sober Officer-good luck.
Yeah, I have never seen a drunk police officer act so respectfully. Ever.

It is against the law called weapon under disability being drunk is the disability you can see cops get charged with that all the time on UA-cam videos.

Possession of a firearm while commiting a felony.
@@michaelvasquez9677 Possession of a weapon while committing a felony (which every State in the Union classifies DUIs as) is a crime in every State Some States only consider whether the felony itself was of a violent nature though in making this determination.

WoW! This APD cop was so compliant and polite, this encounter should be used to train other police officers. He never once tried to use his position or asked to turn off the camera. His attitude and demeanor is definitely a plus in his favor. The only thing left on this traffic stop is the sniffer dog!
What used to train them how to act when pulled over drunk driving?
This IS currently used in training officers for when they're drunk and get pulled over by a superior officer

Bro this is absolute BS. My girlfriend is a cop and she's like 99% certain that the Hernandez cop isn't impaired at ALL. He's just NERVOUS AF cuz he's a newer officer who got caught driving like a maniac without lights or sirens. He's not slurring his speech WHATSOEVER. The OTHER VERY important thing she points out is that the Trooper (arresting officer) is SUPER high energy and speedy, almost like he is on coke. If you listen to his speech he can't even say words correctly. He's starting the next word before he even completes the first word. Guy is a joke, on some huge power trip because he was mad that Hernandez didn't notice he was being pulled over right away... Not exactly something cops are used to have happening lol.
It's actually very disturbing that this cop would essentially pull people over and destroy their lives by giving them a DUI while he's literally doing the same thing
I agree. He'll do this to a wrong fellow cop and lose his gun/badge.
@mattb9054 Most cops that drink on duty don't issue DUI's. The majority of DUI's are given by 10% of officers. There are many officers with 10+ years of service, and never given a DUI.
Support our cops. This poor officer was stopped by a communist traitor trooper
Cops aren't destroying anyone's life. Don't defend people who drive under the influence...
Destroying their lives? They’re doing that to themselves.
And he had a "bloody knife" that was supposed to be in evidence in his squad since the week prior. That's 1 crime that can't be prosecuted with the weapon.
I was thinking what the heck. It sounds like that guy has been having problems before today. I hate to see anyone lose their job but in this case they really don't have much choice. He tried to hide being drunk but he didn't.
I had to 'rewind' that part. Couldn't believe he was stating that fact too! Wonder if he got reprimanded too?
Ohhhhhh my lord have mercy no. Wth!!!
Plenty of crimes can be prosecuted without the weapon
@ronathongreenwood3799 Of course goes without saying. Also goes without saying the weapon adds to a successful prosecution ESPECIALLY IF IT HAS FINGERPRINTS AND/OR TOUCH DNA. Duh.
Lmfao bro was STALLING 😂😂😂
This cop is a fool. Why did he consent to a sobriety test.
Imagine people driving by thinking "Well that's a weird place to do training." 😂
why would it be weird to train exactly where the real thing is gonna happen??
Actually not weird. Realistic training on the side of the highway.
@@jasonzwack8342 well for a host of reasons. First would be public perception of law enforcement. "Why is that cop in uniform and a patrol car being made to take fst's?" A lot of the public already has a bad enough view of law enforcement. That certainly wouldn't help. Then there's the safety factor. The side of the road is an extremely dangerous place. Especially now with everyone messing with their phones and not looking out the windshield. Lots of people veering off the road way more than ever before. But I understand what you're saying. Real life scenario training is often quite valuable. I just don't think it would be good to train an officer on fst stuff on the side of a road is all.

The first time I've ever watched a cop ignore the thin blue line. I'm impressed.
The one he stopped seems like a good person who made a mistake. The state trooper sounds like a manipulator who ruins decent ppl's lives to advance his career. A predator
I think someone called in about him.. And the fact that just goes along with everything indicates that he knows that he's above the legal limit.
That's why he refused to blow. That's incriminating in itself.
I was thinking the same thing. Any innocent cop would be furious to be accused of that. This guy was hoping being nice would make it go away...plus not blowing gives it away too.
@@msjanzzee no its not moron, you do in fact have the basic constitutional right to not incriminate yourself.

Let's not forget he was committing criminal offenses in the possession of a firearm.
Never ever take those field sobriety tests. No matter how you perform they're going to say you failed.
A cop holding another cop accountable... Very surprising but refreshing to see.
Officer who was pulled over as an absolute idiot. As someone who arrest others and tells people all day, what their rights are he doesn’t even exercise them himself.
You think cops know what our rights are? 😂😂😂
When you sign up to be a cop you actually do sign some rights away. Like mandatory drug and alcohol testing, refusing is cause for suspension or termination.
HAHAHAHHAAHHAHA this has got to be the FUNNIEST COMMENT EVER!!! OMG I HOPE you are being sarcastic. If you really think cops Inform people of their rights??? That would mean they know what Rights are..... Litterally the whole reason cops exist is to take your RIGHTS away. Three major points. 1) He was wearing his service weapon while intoxicated. (Huge mistake). 2). At the end of the vid he tells his Sgt. that the knife in his front seat was from a previous call 'last week'. So, he failed to log evidence. 3). States he was logging into his computer while driving. Which is the same as texting and driving. He is NOT qualified to enforce the law.
AMEN!!!!
I am surprised that more people didn't catch those...
He was also wearing a shirt with his partners name on it, with the excuse that it fits better than his own one. You have to wonder if he was wearing it so that when people spot him doing dodgy things they report the wrong name (his partners name instead of his own name).
I thought maybe they would stand there and refuse to give each other their names and badge numbers.
“My name is right here”

If that was a civilian, armed while DUI...they would also charge you with negligent use of a weapon, maybe more.
That is correct.
Totally depends on the prosecutor, I’ve seen it both ways with everyone.
So, he compromised material evidence by NOT tagging and logging it. He needs to be fired for the DUI and not being a smart person.
