    All these folks commenting and complaining about time…I feel you. Mines been going on for over 4 years and I fell 25 feet broke a bunch of bones and had surgery to be able to use my arm again…just gotta have patience…let your attorney’s take care of you. In the meantime I’m getting closer and closer to becoming aggravated with the amount of pain I continue to live with as it gets worse every year…😢

    What are your thoughts on this scenario, the Dealership that owned the vehicle that the at fault driver was driving has retained an attorney to defend the at fault driver in a lawsuit that has been ongoing since 2018 is it commonly accepted that the auto dealership retains legal council for at fault drivers of a vehicle they own in Florida?

      It wouldn't surprise us to see a dealership retain an attorney for the at-fault driver if the driver's negligence can be imputed to the dealership (or if the dealership's insurance policy is written in a way to cover the at-fault driver).

    I was in a auto accident 2-26-23 a lawyer called me at the hospital and i was injured bad I was in backseat if a van a car turned in front of use he had no insurance n was driving on a suspended license the car I was in had insurance the lawyer I have dose not ever call me he doesn’t send me anything in the mail so should I be looking for another lawyer my back was fractured in three places n I have a herniated disk in my neck please help n tell me what I should do thank you kindly Maureen Harkins

      We are sorry to hear about your wreck Maureen. Your lawyer should be keeping you up to date on your case status. If he/she is not, we normally suggest demanding a face to face meeting with him or her so you can clearly explain your expectations regarding the frequency of case updates. That will usually fix the problem. If that doesn't work, request a copy of your file from the lawyer and that will let you know whether he/she has been working on your case. If you can't get a face-to-face meeting or a copy of your file, it probably time to find a new lawyer.

    When you have a third party case, and workers comp gets reimbursed for medical cost, what percent gots to the client for attorney fees since Workmen’s Comp. did not pay for an attorney

      It will depend on the contract you have with your attorney. Most contingency fees are based off of the gross amount of the third party recovery.

    What happens when you can not get in touch with your accident and injury lawyer while receiving therapy. Accident was on May 8th. Have talked to him only 3 times. Left vms emails everything

      If the lawyer is not returning your phone calls, we usually suggest that you insist on a face to face meeting with your attorney so you can try to work it out before taking the next step of firing him or her. During the meeting, let the attorney know what you expect concerning updates/communication.

    Do I need to call the insurance company if my lawyer refuse to give me updates on my case?

      If your lawyer doesn't return calls and refuses to update you, it is probably better to find a different lawyer and let the new lawyer deal with the insurer.

    I sent my demand letter and gave them 30 days to respond. what happened if they ignored my letter

      If your settlement demand letter was ignored by the insurer, you will need to work with your attorney to get a lawsuit filed before the statute of limitations expires for your claim.

      Nothing that why u never send a demand letter if your not ready to take further action it will make you look weak it's better to call the adjuster and ask can we talk about resolving this matter.

      Possibly. This is definitely a situation where you should consult with a lawyer in your particular state because trip and fall laws vary greatly from state to state. In most states, you can recover for aggravation of a pre-existing condition, assuming you can prove negligence on the part of the home owner or property manager.

    How you can evaluate your future medical bills and lost income?

      In most cases, your medical providers will need to provide you with an estimate of the cost of future care that is reasonable and necessary to address your injuries. Lost income will need to be documented with paystubs, time slips, and anything else you have to prove the lost income (this is always tough because of the variety of ways that people earn income). The most important thing is to have documents to back up your claim for lost income.

      Thank you for the question. Litigation loans are a necessary evil in some cases. When someone is in a situation where they can't work in order to pay their necessary living expenses, a litigation loan may be the only option short of settling the case for less than it it worth. If you are in this situation, we are sorry. It is definitely a tough spot to be in but make sure you bring it to your lawyer's attention so you can figure out a plan of action that meets your specific needs.

    Stay in touch? what a JOKE!! Every time I called my lawyer for a follow up I was met with indignation and impatience. They do not want to HEAR from you until they call to ask the same questions they asked 3 years ago. Additionally, I have been assigned 7-8 different lawyers and a dozen paralegals over the past 4 years. All I get is ATTITUDE from "overworked" paralegals. Very disheartening and disappointing. They new lawyers I was assigned didn't even know who I was. I had to complain to the head partner who apologized after he listened to the ass chewing I got from his angry paralegal who was having a bad day. Yea, if you really want to get bummed out, just TRY to keep in touch with your lawyer and follow up on your case. Every follow up called I had a new one. After 4 years of this just wait for their semi annual call (to find out who I am.) One of these lawyers scheduled a deposition, left the firm, and no one ever called to tell me it was cancelled. Just left me hanging like a fool. Thanks a lot.

    If my case is in California and a lawyer is already retained, is getting a second opinion ideal? Injury happened 12/20 and the court hearing is this week Friday…is it too late for a second opinion?

      If you already have a lawyer and a hearing is coming up in 3 days, it is probably better to stick with the lawyer you have. A different lawyer would have a difficult time getting up to speed on your case in just a few days. If you have specific concerns about your upcoming hearing, we recommend bringing them to your current lawyer's attention as soon as possible.

      If liability is solid and liability insurance is available, you might be able to obtain a decent settlement.

    I fell 8months pregnant in a hole in the street getting out my car. And fractured my foot and had to have surgery. I want to take it to trail now because they offer they giving is it enough for the pain and suffering I was caused as how it effected my life and still is !     The driver that hit me was processed for DUI at over twice the legal limit. Will that increase the value of my case?

      It should. In most states, a DUI opens the door for a punitive damages claim (i.e. damages to punish the wrongdoer). Punitive damages are in addition to other damages that are meant to compensate you like medical bills, lost wages, pain and suffering, etc. At a minimum, a jury is less likely to have any sympathy for the at-fault driver.

    Look I had an oven door fall messed my shoulder cuff. . Well I was being screamed at ignored bout getting my paperwork my injury paperwork they didn’t wanna do it . Plus I had EEOC involved towards company so that’s why they were rid to me . Well finally I found the nurse she did paperwork and no where did I put oven door fell ?? I forgot about that . Caused I was injured and still doing my job . I did go second option they gave me off 7 days . I was really injured . Well knaw is a lost cause. Cause nowhere on paperwork I put door fell . Dammit I have it but in the other doctors paperwork later . Wow wow . I did hire Attorney got my shoulder fixed and knaw after all these years they look at the paperwork. I’m stewed

      There is a big difference between (1) telling you what to say and (2) helping you frame a truthful answer. If any lawyer tells a client to be untruthful during testimony, they should be arrested for perjury alongside their dishonest client. But, yes, you are correct...lawyers should always help their clients understand the best way to convey truthful testimony.
