    What if I’m allergic to lidocaine and I told the surgeon, anesthesiologist, nurses and anyone that would listen and they still gave me lidocaine in the operating room?

      You may want to request your medical records from the surgery as well as the records that show the harm cause by the lidocaine. Present those records to a medical malpractice lawyer in your state and see whether they can assist you with a claim. Most medical malpractice lawyers will provide a free consultation to determine if you have a viable case.

    I got injuried July 2023 PT since, MUA in DEC 2023, More PT, Scoped for Labrum repair (Slap 3 Repair) March 2024, More PT, MMI'D Aug 8th. Rating was Whole Body 6%, ARM/Shoulder 10%. Seems lowballed. Behind my back is bad still, Overhead can go over 20lbs. AL - Workers Comp.

    I'm having this very issue right now... I am the wife. I understand diabetics have amputations. But, my husband's situation progressed because a doctor didn't prescribe antibiotics after his surgery. On May 18th my husband went to a podiatrist because of a foot infection. She sent him to get an mri and didn't prescribe any antibiotics. After the mri the doctor schedule a surgery to remove just the tip of his 2nd toe on the left foot. Surgery was done on June 5th, I believe. After surgery she didn't prescribe any antibiotics still. A week later he went for a checkup and his foot was still swollen and still black. We have all the photos. She said it's not healed yet to remove the stitches. She said to come back next week. The following follow-up visit my husband was in pain and asked her to prescribe an antibiotic. She informed him that she didn't think he needed it but his foot doesn't look like it is healing. She asked him to give it another week. She didn't advise any blood work to look for an infection and still didnt prescribe antibiotics. That was on a Tuesday. By that Friday my husband was so sick and could barely walk. I suggested he go to the urgent care. Which he finally did on that Sunday. That was May 30th I believe. Urgent care did blood work and told my husband to go to the hospital immediately because he has a very bad blood infection. At the hospital he ended up having to have the remainder of his toe removed. Please don't dismiss this simply because he is diabetic. The 2nd surgery could've been prevented if the original doctor would've given him an antibiotic in the first place. Her neglect to give antibiotics caused my husband to have an additional surgery and remove his entire toe when he saw her originally only the first knuckle on the 2nd toe needed to be removed. My husband is in the hospital now with a 3rd surgery. This has been very traumatic for my family. Thanks for listening. I'm in maryland so I know you can't help.

    Greetings, My name is Lois Rolland, and I am reaching out to you regarding a serious concern about my knee replacement revision surgery. During this surgery, it appears that the surgeon may have broken my femur, an incident I was never informed about. I realized this after your firm pointed out discrepancies in the surgery notes. It seems the surgeon broke my femur during the 2022 procedure, and I was not made aware of this complication. Reviewing the consent and disclosure of risks for the surgery, I noted that broken bones were not listed as a potential risk. This omission, coupled with the lack of communication about the injury, leads me to believe that I might have a valid medical malpractice case against the surgeon. I have not previously consulted anyone regarding this issue. However, given the severity of the situation and the potential implications, I understand the urgency of addressing this matter legally. I am aware that the statute of limitations for medical malpractice in Texas is two years, which means I have until around July 12th of this year to take action. Therefore, I am seeking your advice on how to proceed. Could you recommend a medical malpractice attorney in Texas who has experience with cases like mine?     With my ivc filter settlement they decided to settle out of court a year and 1 month, it took 4 months to skip over the clients who skipped on the settlement. So should i now get my settlement next month. I have no leins.

      There is a big difference between (1) telling you what to say and (2) helping you frame a truthful answer. If any lawyer tells a client to be untruthful during testimony, they should be arrested for perjury alongside their dishonest client. But, yes, you are correct...lawyers should always help their clients understand the best way to convey truthful testimony.

      In some situations, yes. We encourage you to contact your elected representative about your concerns. We can only bring successful claims under statutory laws enacted by federal and state governments as well as the common law handed down by Courts. If the law doesn't provide a remedy for a wrong, elected officials need to hear from their constituents and fix the problem.

And its UTMB who im after We did an autopsy for her to see if they were correct. They were not.       UM policies usually cover general damages. However, if you intend on accepting the at-fault driver's liability limits, please consult with an attorney first. The liability carrier will require a release and you must make sure the settlement with the at-fault driver's insurance company does not jeopardize your ability to pursue your UM coverage.

    My mother died in result of delay of care and negligence, and, per her death certificate she died of Sever Neuropathic Pain Syndrome which was never treated or addressed during her entire stay 78 days at Strong Memorial Hospital and Rochester Center Rehab. She fell on Nov 7th, 2023, but no broken or fractured bones, however laid in the hospital bed as a paraplegic with severe diabolical pain. She was never told why she could not walk, stand or sit, neither was she ever treated, diagnosed, or tested for symptoms of severe nerve pain-family pleaded for nerve blocker or epidural. Every time she was repositioned, or turned she was in unbearable pain, therefore, the hospital neglected to turn her causing bedsores. The amount of daily pain caused de-conditioning, delirium and dementia-patient did not possess any mental issues upon her admittance on Nov 7th, 2023. She was discharged to rehab with infections from a failed back surgery-again, nerve damage was not diagnosed pre-or post-surgery and pre-paralyzed state as well as post paralyzed state was not attended, and an additional MRI or CT scan was denied. Patient was discharged to another hospital in which they tried to save her life but was unsuccessful. The new doctors and renowned pathologist spoke with family and specifically confirmed delay of care and spinal nerve damage went unaddressed. Case Filed in 7th Judicial Circuit, NY. E2024008716

      Great question. Each state has different laws concerning recoveries for minors. Your state's laws will determine who would qualify to act as a fiduciary for your child's recovery until the age of majority. In many states the settlement has to be approved by a Court.

    My attorney sent for a video to be preserved. Months go by no video which I know they had , because the MOD told me he looked at it! Anyhow, here we are months later after a long treatment and not much recovery, demand sent out and NOTHING . I’m so stressed

      Good for you and your attorney! Take a deep breath...you should be ok. Sometimes attorneys can't force the at-fault party to produce the video until a lawsuit has been filed (it isn't like criminal law where law enforcement can get a search warrant). Civil lawyers usually need a lawsuit to be filed before the Court can force one party to produce something during the discovery process. Corporate defendants often refuse to produce videos without a lawsuit. If the at-fault party destroyed the video after receiving your attorney's letter, he/she/it could be in hot water. Reach out to your attorney so he or she can explain their procedure and thought process for your specific case. Wishing you all the best with your case!

    Monday I clean cut my hand right below my knuckles in the top.. Basically, the top of the palm of your hand. Cut my thumb off and 3 fingers completely in half big knuckles included. The pinky finger was the only one keeping the other three fingers held on. Lucky me they re-attached fingers but thumb was sadly found way too late to reattach. My mother found my thumb the next day which she only looked for once she realized I didn't have my thumb after surgery when the doctor let her know. FREAK ACCIDENT... My hand was cut with a table saw and thumb was missing yet the fire dept showed up and the individual who was supposed to be wrapping my hand and helping stop the bleeding requested to take pictures on his phone the guy took the photo and started to wrap it and then a 2nd fireman asked him to hold up so he could get a photo as well on personal phone so they unwrapped what had been done 2nd fireman took photo then they proceeded wrapping my hand. The chief and 3 other fireman showed up shortly after and stayed on the sidewalk overlooking the guys wrapping me up but were stepped back and talking about their weekends.. Looking back I will never forget their lack of efforts because my thumb was 3 feet from the saw and now my life is changed forever... Fire dep. and Ems didn't even look for it. Not sure which one of the two groups checked the saw, but they basically just looked at the blade and told me they think it may have been mutilated. so search stooped there... IT GETS WORSE. I get loaded into ambulance and they basically take me to the nearest big hospital even though there is only one hand specialist and he cant reattach anything.. I get there and nobody is ready at trauma for us, so we wait 5 mins by the door inside while EMS made sure we were at the right location before being pulled into a room. Once in the room they give me a little pain medicine but it is nothing compared to what I am taking now 5 days post surgery in other words it didn't do shit.... I could tell nobody knew what to do or had a POA. Looking back now I know this hospital couldn't do anything for me that's why they all walked in circles clueless.. The hand doctor gets there decides to undo my bandages and take an Xray... This was excruciating.... Then he comes back and basically says he can't do anything for me there and I need to be taken to a hospital 25 mins downtown that is known to reattach and fix hands. They called the same ambulance to turn around and come back and re wrapped my hand together. Then I waited 20 mins before they arrived and was given very little pain meds for the road. I later found out the doctor had called the specialist who would eventually pull off the miracle on my hand and told him I had all 5 fingers but my thumb was crushed. This was after he had a visual and x ray so yet again the opportunity to find my thumb was lost. On the way there the ambulance hit the highway and decided to turn off lights and sirens while on the highway and cruise to the next hospital. This pisses me off to think about now giving my pain. I finally arrived in good hands and was taken straight back for a 8 hour microscopic reattachment surgery. It took so long a 2nd specialist was requested by my doctor to help. After a very smooth reattachment it was finally addressed that everything went well but I was missing my thumb which is sadly the most important part of your hand. My mom immediately went to look, and she found it immediately around 3 ft from the saw just under the edge of the kayak that was sitting behind the saw in the garage.. She brought it back and it could have been 1000% reattached based on the cuts because it was perfect clean cut: however, at this point it was too late... So I very emotionally watched them take it from my room and throw it away....... Not sure what to do. Going to talk with some attorneys Monday because of how mad I am about those these 3 groups completely fucking up and not looking for my thumb. Am I justified to seek a lawsuit since I can no longer do my construction job at work which loses my family majority of our income or go fishing or use a can opener etc etc etc.. Very frustrated let me know thoughts.

    It's incredibly hard here in Florida you need to hire a subject matter expert when the doctor has clearly messed up..This protects the doctors.Many Floridians are looking for expert witness are leaving the state to find affordable experts. It's like the system is rigged to protect doctors verses patients.

      Same here in Georgia. Medical malpractice laws in most states make it hard to bring a claim. The only thing we can do is vote against the politicians that protect negligent doctors at the patients' expense.

    It sounds to me like we need legal reform around malpractice. I had something left behind in my body after surgery. We just discovered it and it's possible it's been causing me pain and making my conditions worse, but it seems like I don't have enough in damages for my case to be worth taking Which means there's no way to hold that hospital accountable. Which means they have 0 incentive to do better and put policies in place to prevent this.

      We agree 100%. It should not be so hard to seek recourse against a medical professional. Legislatures need to fix this but they have to stop believing the lies spewed by the malpractice insurance carriers if there is any hope of reform.

    I wish i woul have know about you guys 10 months ago because i hired some clowns that are nothing but liars we had mediation today & i did not want to settle because of their ongoing lies if you will .i decided i want to take it to court.prwying for the best outcome.

    Whenever you approach a lawyer with a potential case the first thing they do is a risk versus reward analysis. They weigh how much time and money will they be risking and what is the likelihood they will win and how big the payoff will be. In America you get as much justice as you can afford and equal justice under law is a grotesque joke. Big corporations and the rich know all this so they know they can screw average people and their lawyers will make sure they get away with it. This is a major factor driving income and wealth inequality in America. And it's the same thing with the political system as well, which is to expected because most politicians are also lawyers.

      Thank you for the comment. We agree 100% with the first sentence. As lawyers, we have to make "business decisions" so we can stay in business. One business decision we make every day is whether to accept a claim or case. And, yes, you are absolutely correct, if the laws we operate under cause the risk to be so great that there is little chance we get paid, the case will be declined. Declining cases is the worst part of the job. There are no two ways about it...when we decline a case, we have to tell a real person with real problems that there may be no recourse in our justice system. That sucks. But losing tens or hundreds of thousands of dollars and hundreds or thousands of hours on a case sucks too. We wish there were a better way. Thank you again for contributing to this conversation.

      It is a sad reality that it takes money to obtain justice in our current system. Expert witness fees are only part of the equation. Simple things like taking a deposition and obtaining the transcript often run $1k or more. Heck...in an injury case, it normally costs several hundred (sometimes thousands) of dollars just to obtain the injured person's medical records and bills that are needed to substantiate a claim.

    Here's a simpler question. I was told by a law office(s) that it would take 24 to 48 hrs for a attorney to get back to me. It's been 3 days. What am i to deduce from this? Do i called them? Which might finger me to be a nuisance or wait patiently. Do they have duty to contact me and let me know they will or won't take my case? Thx for the vid!

      Great question! If a law firm doesn't return your call within 72 hours, you probably want to consider other options. It could be they are too busy to call you back, there is an lack of cohesiveness between their intake department and the attorneys, or a whole host of other things. If you can find a firm that makes you a priority, you will likely be much happier.

      Yes, contacting a firm that would make me priority would be great. Easier said than done. Maybe you can use your powerful vids to focus on the finding of a firm. How are we to know how much effort to put into this seroius problem of finding a lawyer? How do we know what catastrophic is? How many law firms do we contact? Do we just keep searching until the statute of limitations runs or when we've contact every attorney in the state, in the country or what. My case is that I'll lose 10 years of life do to my medical injury. My estate will lose $700,000 at todays money when I died in 10 yrs, not mention the constant problems I live with. Some firms advertise we take catastrophic cases. This is warning to me they want only very very serious injuries like brain damage & women's issues. I don't contact them. Most medical malpractice advertisements are really "accident" lawyers. We spend to much time worrying about our condition AND add to this trying to find an attorney making contact after contact with, in my case, no curiosity response to add insult to injury. Part of what I'm getting at is the idea of getting justice is an illusion created by government and attorney advertisment. Please, give me "Fair Hearing". I've seen so many seemingly trivial lawsuits on TV news those of us with medical malpractice injuries seemingly should have a right to get justice. My point in all this blathering is to help people see what a serious problem it is to get representation and to try and get video lawyers to help us examine our case's. Lofty I idea I'm sure.       We are sorry that you are having such a hard time. The truth is that most states have passed laws making it very difficult to successfully bring a medical malpractice claim. In our opinion, medical malpractice cases are almost always slugfests that drag on through years of discovery, expert depositions, lengthy trials, and appeals. Most medical malpractice law firms work on a contingency fee basis (meaning they only get paid if they win) and the firm advances at least six figures of case expenses to get a case to trial, not to mention the thousands on man hours a single medical malpractice case takes. If the case is lost, it can be financial ruin for many law firms (any their clients). All of these factors force firms to be very selective about the cases they accept. And, yes, this leaves too many people without effective representation. It is a very sad reality but it is a reality that will only be changed if states change their laws to remove the procedural and financial barriers that make it exceedingly difficult for victims to bring and pursue malpractice claims. We have to decline medical malpractices too often. We wish that were not so.

    You've explained you have to have catastrophic injuries. Explain catastrophic damage. Why do we see so many trivial law suites in the news and medical patients can't get legal protection! Highly suspicious. My problem is my PC doctor caused my kidneys & bladder to be blown up do to a extremly enlarged prostate. Both od which fail to detect and send me to a specialist. CKD cuts my life expectancy 10 yrs. Which means, in its simplist form, my estate will loose $700,000 because of this, not to mention the pain experienced during the whole confounding process. I found a doctor/lawyer in Veags. He heard my case. He said it was a good case, but he couldn't take it because he's not licensed in Arizona. I can't find a doctor/lawyer in Arizona. I've contacted your 800 number lawyer. They said the case is not for us. I've contacted 2 in Arizona, "injury lawyers", that say they do medical malpractice. I explained most everything they needed in detail, i have records, timeline, dates PC doctor failing to refer me to a specialist, kidney doctor causing life long damage to my kidneys by ordering me to drink 96 oz of water a day. It blew up my kidneys and bladder causing irreparable damage. Unbelievably we can't get proptection from negligent doctors. Thx for the vid.

    Surgeon installed wrong size femur stem into thigh bone during hip replacement and yet no lawyer will take my case it’s basically like trying to get a police to testify against a police crazy how they gone get away with it

    I was not working due to an industry strike then had my car totaled. The strike ended but I couldn’t go back to work since I had no car and the insurance company has been acting in bad faith for the past 6 months. Can I get lost wages added to the lawsuit I’m looking to file now since I’ve missed 6 job opportunities because of this delay in settling the claim? I see a lot of information regarding lost wages due to injury but nothing due to lack of transportation. Public transportation isn’t a realistic option since it’s roughly a 1 1/2 hour commute with a personal vehicle and almost 4 hours with public transportation. Plus I need a car to get to and from meetings during the workday.

    My mom almost died after a kidney stone surgery. She went to the doctor twice while recovering at home with complaints. They gave her pain killer and antibiotics and sent her home. Within 12 hours she was in critical condition and had 6 blood transfusions. 3 more surgeries. She is afraid to go home now. I’m ready to fight this. We listened and trusted this doctor.where did that get her… help
