I wanted to give you all a little update on the Charlie Tan case: I am now in contact with Charlie through the inmate messaging system and he was very thankful for the coverage on his case and all the supportive comments coming through. He is doing some amazing things already in incarceration and has some big goals to impact victims of domestic violence in the future. We are brainstorming ways we can work together. He is the sweetest guy and I am just so heartbroken by his situation. Hopefully we can work together in the future and try to make an impact. Thank you everyone for all the kind words and support, I have messaged him several of your comments and i'm sure it means a lot to know people are thinking of him on the outside...

Thanks Kendall. From your video, i believe he’s a brave hero to his mother for doing what he did. I’m not a domestic abuse survivor.
If there’s any support we can give him, anyone we can contact to get an appeal, please let us know. (I don’t live in America so don’t know the process).
20 years is absolutely ridiculous. I would understand a lighter sentence, but this is crazy. There should be something similar to battered wife syndrome but for the children who witness their horrific parents growing up

18 DV calls and police did nothing. A common theme among DV victims. Just tragic

    • @smm855
      @smm855 2 роки тому +82

That's why I feel like after a certain number of DV calls it shouldn't be even an option for the two individuals to live together anymore. Like: "Oh you hit strike 5 of the DV calls? Guess you two have to find different housing! Nope, don't care if you don't want to press charges! We might not charge one of you for assault, but now neither of your are legally allowed to occupy the same space. I see you have children, well I guess if you want dual custody you'll have to do a kid swap at the local courthouse as the two of you are too dangerous to be anywhere near each other." On an additional note, I think if you have more than one spouse/partner that reports you for domestic abuse, you get to go to jail. At that point, you've proven you're a danger to others.

Agreed. They used the weapons charges' punishment as a stand in for murder punishment which is super unethical imo. Sure, make him serve time for the weapons charges but it was his first offense and there were mitigating circumstances. He cooperated and plead guilty, why did they throw the book at him?
Idk if he was just trying to do the right thing (by pleading guilty) and didn't actually get a plea deal, but if he had a lawyer during this time they should be fiiiiiiiired and disbarred. Still, it's incredibly bad form by the judges and DA. I'd accept somewhere between 5-10 years but closer to 5 or less if served concurrently. And then never being allowed to own weapons again and probation for however many years. This 20 year sentence is just a waste of taxpayer money

My comment may not be popular but i don’t think it was the police fault. It’s the laws that protect abusers that are at fault.
If she called 18 times but then defends him 18 times when the cops come, what do the police have against him? What can the police legally do?
we did get the specifics of one incidence & the mom defended him, coerced of course, but defended him nonetheless which is extremely common in DA. The police may have had their hands tied depending on the laws in their jurisdiction and what evidence they could get.
It’s unfortunate how their relationship affected their children so much.

However, he committed premeditated murder. There are laws in this country, which were clearly broken. While it would have been better for the dad to go to jail forever, there was no chance of that happening since the mom lied to police every time and refused to press charges.
So it's not really fair to say that she wasn't protected. What were police suppose to do? Take her against her will? That's unfortunately the only way she would have left. All I can say is even though I do think it was pre-meditated, I’m Asian-American and I feel so much sympathy for Charlie, his brother, and his mother. Domestic violence, divorce, family troubles, mental health, or things of that nature are so hard to talk about because they’re incredibly stigmatized. From my experience, in the Asian community, divorce is not only stigmatized, but almost is seen as selfish. It seems like there’s the mindset of, oh I worked so hard for this marriage and we share so much of our lives together, I have to tough it out and be the selfless one. There’s almost no consideration of having a second chance at love or a second marriage. You have to just keep working hard to make it work even if it’s abusive which is incredibly sad and toxic.

Charlie committed premeditated murder, involving hours of driving to get to the house, weapon acquisition, collusion and cover ups including living with a body in the study for several days, and an escape attempt to China by way of Canada. This is truly insidious and psychopathic -if he’s supposedly meant to be “normal” and “a victim of his circumstances”. There is no actual or implied self-defence in this story, as the killing was done execution-style.

It's alarming that we have people deciding fates when they don't even know what a mistrial means. She said instead of being a decision by a "jury of peers" it came down to a judge's decision... the mistrial was due to the judge not making a decision and going on the basis of a "hung jury". If the jury could have come to a decision there wouldn't have been a mistrial. If the judge would have made a decision of guilt or lack of then it would have been based on a judge's decision...

The judge can’t make that decision in a jury trial. A trial where the judge alone decides the verdict is called a “bench” trial and such decisions are made before the proceeding begin with both prosecution and the defense agreeing to it. I absolutely agree with you that it was unjust and he should never have been convicted

    • @morgan4574

I think when the mistrial happened due to hung jury, the judge felt that a new trial (without any new evidence) would have resulted in another hung jury. Why do it over again when the results will be the same, was their justification. Of course they didn't know for sure but they made the determination. A lot of prosecutors and defense teams do switch up a lot of tactics and such learning from the first trial so there's a good chance that it wouldn't have been a hung jury the second time but the judge felt like there would be

it sucks that the kids have to be put in a place of having to protect and rescue their abused mothers. abusers rarely change but it's never too late for a victim to escape. ladies plot, plan, find resources, hide any clues, take your time planning all the details and in the meantime live your life like nothing has changed. you can do this, you have to because he won't stop abusing you and no one can rescue you either, don't let that responsibility fall onto your kids because its not fair to them.
