      Sadly the liquor boards care more about collecting the yearly licensing fees and making sure taxes are paid. Watching to make sure the laws are being followed is usually left to the police departments.

      They didnt really lie except for when they said that he was asking for money. But they corrected that later.
      They said he was on their property. But they were mistaken and the lawsuit would not work for just that. They did call them. But the responsibility of him ending up in hand cuffs is ultimately all on the officers stupidity.
      He knew he was lieing when he was telling jeff he had to ID. Thats why he didnt sound confident and was mixing up his words. Because his instincts told him that his bullshit wasnt going to fly past jeff. He should have listened to those instincts. But cops are slimy little liars.

      At which point, They can only Stop, and speak to a person, We on the other hand, are under no obligation to answer any of their questions, and have a RIGHT TO REMAIN SILENT. They can perhaps Detain Them.🤔
      Which THEY DO All the time regardless, even though it really is AN ILLEGAL DETAINMENT, and if the Officer is sued, the civilian would win a settlement, but it IS ILLEGAL for an Officer to put a Citizen in cuffs without a lawful reason, Yet They do it ALL THE TIME, BECAUSE OF THEIR HUGE EGOS🤢🥴🙄

      A large share, are out on the streets, impaired on Drugs, and/or alcohol🤔 it’s become an epidemic today?

      Feelings based policing. Every court case will become a precedent, every reoccurrence will become a stinging rebuke, followed by firings and eventually the local PD will be placed under supervision. Qualified immunity will get stripped and once the first lawsuit manages to get to their pensions, it’s going to get interesting

    Watching this video, AFTER watching the internal affairs interviews after the PD realized this cop clearly violated Jeff’s civil rights, was interesting. As expected, rather than admit he violated Jeff’s rights out of ignorance of the law and plain laziness, Officer Gault and the union thug assisting him rolled out the typical excuses, including the “he baited us” argument, which is nothing short of embarrassing. I guess expecting the police to follow the law and do their job professionally and ethically is “baiting”. Rather than express remorse or regret for overstepping his authority and violating Jeff’s rights, Gault had the audacity to claim “ he is one the most professional officers in this department”. Wow, what arrogance and hubris and incompetence.
    Hopefully Gault learned his lesson and will do better………..but I seriously doubt it.

      The detention in cuffs, etc., was because the second cop believed Jeff HAD TO ID. That's it.....he got side tracked by his belief and ego, both of which are misplaced. Guarantee Jeff would have gone to jail without that CCW. And the cops & city facing a legal enima.

    The officer's retelling of events was never consistent with what actually occurred. It's shocking that his testimony in court would be permissible, let alone have any weight. God bless you, Jeff. Keep fighting the good fight. You are making a positive change in this world.

      It is scary, even the first cop couldn't even remember the 5 words on the sign. He said his "God bless America sign" and the bar ding bat said "or whatever he was spouting." They didn't do any investigation first. Also, the way the cop retold the story made it seem like Jeff was making a threat "He said he had a firearm in his pocket.". When in reality he only said that after the incompetent false memory cop moved to pat him down and ask if anything will poke him in his pockets......... That cop is dangerous.

      I've wondered many times how challenging it must be for prosecutors when their entire case relies only on testimony of a cop. With all these thousands of videos showing cops as habitual liars will eventually mean that some fraction of the jury pool won't trust the cop's testimony. All it takes is 1 out of 12 with that view and conviction is impossible.

Provides all the evidence on video for any future stripping of Qualified Immunity and a lawsuit against the city. It was in fact an arrest, they handcuffed him and moved him off the scene. The store employee narrowly sidestepped a lawsuit as well.

    11:56...The cop told Jeff, he was being detained "for the identification of you, which is an investigation that they started". The cop will change his story that Jeff was detained for "pan handling", but the video recording clearly shows that the cop detained Jeff, just to get Jeff's identification. CHECKMATE! Jeff wins.

    The first cop had already investigated, and based on what the bar owner said, there had not been a crime committed. So the first cop calls the second cop, perhaps because the second cop is more senior to him, or maybe because he is more aggressive, or smarter than the first cop ( ok, maybe not smarter, but more “coy” ). So the first cop fails to relay all of what he had been told to second cop. That right there should be the end of qualified immunity. He did this knowingly.

      It is amazing how the first officer was basically taking his orders from the business owner. What we see here is a common goal with the police (get people to move along to end the call) and they use common tactics to get this. Intimating arrest and harassment until they get their way. And “the ride” is being used as harassment. Make up a charge that doesn’t apply and has no elements to the situation but creates a penalty for not allowing them to violate rights.

    At the end, in the car, on the phone, he tries to frame it as if he hadn't already detainted you and gone hands on at the point you revealed your CCW. He's trying to make it seem like you said you were armed and that's why they took action... But he still made it clear he'd carried out zero investigation prior to holding you as guilty. The phone call made by the public to 911 is not evidence of anything, it's just a way to measure the required response in terms of number of units, speed, level of risk justifiable in the process of getting there. Once on scene the investigation begins.

      What is really funny is that you think if the cops had arrived and beaten or killed him that there would be no liability for the bar owner and employees. If this was in UK, that wouldn't even have to happen, just calling them to generate a public record with your name on it could be enough for a Liable claim.
      Oh! and if there is an emergency (inside the bar), you press the emergency alarm button and let ADT take care of it. That is why I pay them.

      You have that right if one of my employees called the cops without telling me the reason why they be fired. My business could be Jeopardy of being sued and I could not live with myself. If that person was shot, tased and arrested for doing nothing illegal.

      The liability lies with law enforcement. The business has absolutely no liability for New Smyrna police misinterpreting the laws or ordinances.
      The police are the only liable party PERIOD. It is their responsibility to govern laws equally to business owners and civilians.

      According to Florida ccw law, there is no need to disclose your weapon or your ccw license to a police officer unless directly asked about them. In which you must disclose both on demand to police.
      Now it gets weird, did the police have a valid reason to make contact with Jeff?
      Apparently not, if he was turned loose., the investigation. This was a false report by the establishment, therefore this issue is why the establishment didn’t get cited.
      Personally I hope he sues the crap out of that bar and the individual manager.

      @@Nayr747 Because that's what they were trained to do. Police aren't trained to write honest, accurate reports or give accurate information to their superiors. They're trained to write reports and give testimony that will secure a conviction at trial. That means they can't stray TOO far from the facts (especially if cameras are running), but they will definitely spin every little thing they can in whatever way looks best for them and worst for the person they're accusing.

    This highlights one of the biggest disconnects in LEOs and the general public, a “call” DOES NOT EQUAL A CRIME!! Change it just a little, “he’s making my waitress uncomfortable”, “what’s he doing?”, “he’s eating meat, she hates meat, he needs to stop eating meat where she can see it”, yaaa anyone think they’d act the same way for that call??

      All the cops have when they get "a call", is an unsupported allegation. Their job is to investigate and determine whether the facts (i.e. evidence) indicate whether a crime has/has not been committed.

All these disturbing the peace calls on here with auditors, it’s ALWAYS the callers and the cops who are disorderly and disturbing the peace, my other fav is the interference lie, guy 30’ away with a camera and they cry interference, but at same time there’s 50 cameras live right up on them every Friday and Saturday they’re happy to talk to!! Make that Make Sense?? 🤷🏼‍♂️

    Illegal detention. Just because they’re doing an investigation doesn’t mean there is RAS of a crime. They can investigate all they want, but there better be reasonable articulable suspicion of a crime. An employee uncomfortable is not a crime.

      No, it's not. They're investigating the "crime" of panhandling, which they articulated to him because of the call to dispatch. Just because it was a lie doesn't mean it wasn't RAS.

      They should have had that talk with the guy outside and with the proprietor BEFORE deciding to put someone in handcuffs and force them across the street. It's clear Jeff wasn't going to attack anyone or flee the scene, so there was no need for all that. They could have done that whole conversation with him standing right there, and it would've been a picture perfect investigation.
      But cops don't want to actually INVESTIGATE anything. They want to hem people up. They don't get promoted for investigating properly and determining no crime was committed. They get promoted for arrests and convictions. So that's all they want out of any interaction.

      @@ajm5007 Did you watch the video? They did. One officer talked to Jeff twice and the manager inside before getting another officer involved. Jeff was only handcuffed because he asked to be. The officers were still wrong, and the manager was a lying jerk, but they investigated before and after the detention.

    If Jeff was assaulted by someone the cops would say that "We were not here to see the incident." We will investigate if someone else said you are asking for money. That doesn't seem right. The manager is so ignorant he doesn't know where his property line is. Manager is an idiot. It is all about feelings, "My employee is uncomfortable coming out here."

    Everything this cop did was illegal. He violated this mans rights during the entire incident. How can a sworn officer be that ignorant of the law with all the resources available to him. Its seems this county has a major problem with violating people's rights by many of their sworn officers.

      He doesnt care.
      He is never held accountable, ever.
      If you had a child (you might idk) imagine that kid messing up really bad. Like stealing your car and crashing it or smoking dang meth kinda messed up.
      Now imagine when you caught that child. That you gave him the option of choosing his severity of punishment. From nothing happens and just go do whatever it is you do. To being jailed for the crime you committed.
      Even put yourself in the kids position in this example if it makes it easier.
      What would you choose? What do you think the child would choose?
      Okay im assuming you would choose "pass go and collect $200"
      Do you think you/the child. Would change their behavior to the better or that they would do anything. Including murder because they know there arent consequences?
      Now imagine if you decided the kids fate and you chose the middle of the road punishment. Losing their job or in jail for a month. Yet a private organization of your friends (the fraternal order of police) sues you and forces you to give the kid all the snacks and release him. Or give him back his job even.
      Do you think you or that child would act like a normal person? Or do you think that kid would become an evil unaccountable snake biting anything he wants just for fun?
      Yeah, if people dont see this as a problem that will 100% get much worse.
      Then its the people that make those decisions that are the problem as well as the unaccountable cops.

      He just detained him, not arrested him. And he obviously needs Jeff not to run off during the investigation. They haven't ID'd him yet and may need to if they determine he actually broke the law. Because they realized the manager was lying, he let Jeff go.

    How is being completely overly respectful being and asshole? Jeff is "the" most respectful auditor that i have even watched. I challenge anyone to show me someone that fights for our rights who is more respectful than Jeff. He keeps his cool even when being abused by mean spirited bullies that wear a shiny star on their costume that makes them believe they have the legal and moral right to mistreat others. Thank you Jeff for what you do and especially how you do it.

    This is beyond civil rights violation. What business is it for the police officer to divulge that the guy is armed to the bar guy? Then he's got the ID out waiving it in front of the bar guy. Quite possible the bar guy could see his name address, date of birth and anything else on it including stated medical conditions. HIPPA violation. Get a good lawyer and take them to the cleaners.
