I'm a veteran and seeing someone innocently remind people that there are homeless veterans makes me feel good. It doesn't matter if you own the sidewalk or not, every roadway has a pedestrian right of way easement, that permits people to walk there, even if there is no sidewalk. It's usually a predetermined distance from the center of the road, varying by state, county, or municipality.

One is public and the other is implied public. You can be on private property that is implied to be accessible, like a parking lot for a store, but they can ask you to leave. In this instance, he is on an established public sidewalk directly next to a public road. I would find it highly likely that the city is the one that pays and maintains that sidewalk, but even if there isn't one, there are easement laws in most states, especially for an area like this with shops and parks that should be navigable for a pedestrian

I'm a veteran and seeing someone innocently remind people that there are homeless veterans makes me feel good. It doesn't matter if you own the sidewalk or not, every roadway has a pedestrian right of way easement, that permits people to walk there, even if there is no sidewalk. It's usually a predetermined distance from the center of the road, varying by state, county, or municipality.
The restaurant wants to use the sidewalk for their commerce, and got offended when someone was using it for freedom of expression.
Exactly. It could be 100% private (bet it's not) but with that footpath there it's clearly open for public access.
@@getahanddown I'm confused. Can't people be trespassed off private property regardless of if it's open to the public? Like Walmart for instance - it's open the public but they can trespass whomever they wish from their property. I'd think the same would apply for private sidewalks open to the public?

a private business can not trespass anyone from the sidewalk. though some cops allow it.
@@jasras5003 There is a difference between a sidewalk and say a private parking lot or the walkway in front of a store that is completely on private property. One is public and the other is implied public. You can be on private property that is implied to be accessible, like a parking lot for a store, but they can ask you to leave. In this instance, he is on an established public sidewalk directly next to a public road. I would find it highly likely that the city is the one that pays and maintains that sidewalk, but even if there isn't one, there are easement laws in most states, especially for an area like this with shops and parks that should be navigable for a pedestrian
In all of these hundreds of audits, this was the first time I have ever seen a cop actually use a survey. I had come to think they were to stupid to use a cell phone. Good for her.
One cop using a tool doesn't exonerate the rest from being ignorant idiots. Hell, the same stupid cop told the man he doesn't panhandle, then tried to bark statues at Jeff about something she knew he wasn't doing.

I love your work. I think sometimes, (not all times warrant it), but when you are back in those areas, to re-visit with the info from dispatch or BWC video info and point out to the caller that we know they lied. That goes a long way in exposing these "good citizens that just want you to move along".

When the cops knew that he was within his rights to stand on a public sidewalk, they move to plan B with the parking meter crap. Unbelievable what some LEOs will do to keep from looking like idiots. If they only worked half as hard to uphold the rights they took an oath to protect as they do looking for a way to circumvent them. The restaurant manager should have been required to express why Jeff did not have the right to stand there instead of Jeff explaining why he did.
