I'm re-uploading that with the same exact title sometime next week
@@rossmanngroup That won't solve your issue, I'm afraid. People will just think you're behind on the most recent updates, and will pester you to make an updated video. If you're gonna talk about it, you should talk about his _latest_ video instead.
I recently revoked my Roku TV’s internet privileges because of your videos.
Whats funny (or not), is my dad bought a Roku TV, just because he wanted a bigger TV. He's NEVER connected it to the internet (I don't think he knows how), and he just uses the antenna and the RCA jacks for a DVD player. But hey, he's happy so I guess that's what matters. in my opinion as a person of sound mind:
- forced arbitration clauses should not be enforceable
- class action waiver clauses should not be enforceable
they probably aren't... its just perception & inconvenience.
They aren't in the civilised world; it's only a USA thing.
@@quantisedspace7047maybe you have no idea what civil means! Super sorry that Americans refuse to sell our free will off to the British demon army… Guess you’d have to do something about that… Gonna lock me up in prison for talking shit about monopoly enforcer big gov soon? Is that what has already happened over there?
@@quantisedspace7047 the extent of enforceability is limited even in the USA
It has failed in US courts already, as have many other TOS, as have NDAs. Companies put them in there to scare you away from trying to sue or talk, the same as they send "Cease and Desist" letters with empty threats of implied lawsuits that have no chance of even being heard in court.
The legal precedent is, more or less, that because nobody can get a job or use a product without signing these absurdly long, tinyprint contracts with incredibly unfavourable terms that no reasonable person could be expected to read or get a lawyer to look over, they aren't an enforceable contract (and indeed, even enforceable contracts sometimes aren't, if the terms are too onerous).
Edit: Of course, even better is the fact that this can backfire magnificently, since the arbitration has to be paid for by the corporation, not the plaintiffs. It then doesn't even matter how the arbitrators rule, all that matters is you make Roku pay for hundreds of thousands of them, at something like 50k a session.

I hate that “updates” are used for this term. People will mindlessly click this to update, being trained in the fact that updates are important for security. I don’t think 99% of real users read this.
Many many years ago i decided to disable automatic updates on everything.
@@Splarkszter every system update resets that... & "they" seem to bury the option .
@@Splarkszter I disabled automatic updates on my smart TV. And then they turned back on, because they pushed an update that added ads to it. Which of course nobody would opt in to. Ads are, by definition, the thing you don't want to watch.
It's also not obvious to me that accepting the terms after they've already had the breach means the terms apply to class action suits brought because of the breach.
@@Splarkszterthey can just call them mandatory and force you to.
Some software/hardware have updates that don't ask and are mandatory. No opt in, nothing, the software/device just updates itself silently. It's how ppl are getting forced to agree to mandatory arbitration by Roku : they simply have no choice if they don't want an expensive paper-weight taking up space.
The injecting ads via hdmi is actually insane. Idk how anyone is okay with that. And the forced arbitration is even worse. For people who like to own what they buy, and people who care about their rights, the future is looking more and more bleak each month.

Thankfully they've just filed a patent. That doesn't even mean they have the ability to do it yet. For example, Ford filed a patent for self-repossessing cars, but the self dricing technology is probably a decade from being that viable.
Still, the earlier we raise concerns about this, the better.
If it halves the price of a TV, and the ads only play when not playing content, as I understood Louis' video, I can see poor people getting one. But we all know the price won't halve

How does Roku know who agreed to their terms, if a ten year old kid, who just want to watch cartoons, pressed the agree button it's surely not binding.
Same question. Well they might say that as a parent you are responsible for your kid but what if I bought used one and previous owner clicked? I can't be responsible for other adult.
@@test-rj2vllol cute, you want to be able to resell property you own. watch how long that "right" lasts with our new overlords.
My 8 year old girl gets to the tv every day before the rest of us. She will absolutely do this if she hasn't already.
It isnt legally binding. As roku also cannot provide evidence that you agreed or even were able to read the terms of service.
But then again, it will not be on roku to sue you, it will be on you to sue them, so that part only comes into play the moment you actually sue them.
That's the rub. If you didn't sign anything, you didn't agree to anything. Just because a button was clicked means nothing.
When I apply for a remote job, they don't give me the option to "agree" and that's it. They also require my signature. Clicking agree is not binding. Someone needs to sue just to sue.
I'm in law school rn and I came so close to opting out of the Roku terms just for the fuck of it (which you could do per the terms, but only by mailing a letter to their corporate address within 30 days) and now I really regret not doing it because-- ahh!! Something about blood and watering the trees.
A Declaration of Independence every 19 years?
Boston Tea Party was 3 years earlier (1773)
The revolution started 1 year earlier (1775)
The Articles of Confederation was 1 year later (1777)
The Constitution was 13 years later. (1789)
@GHOSTSTARSCREAMM
Overall, no, but itll seem like it. Never formatting a harddrive, it will seem like its dying when really its just cluttered and disorganized. But yeah, eventually itll need to be replaced. Either way, its time to clean the harddrive, or get a new one. Because what we have, and what we are being forced to keep is just making everything worse by the day.
I love Jefferson, but all we need is term limits and to cut the Federal bureaucracy by 75% and keep it that way. When the Federal bureaucracy is the republic's largest employer, and even the lowest level bureaucrats are paid better than the national average, the tail is wagging the dog. If Louis can get 100 million subscribers, we can make it happen.

This being a trend has a small silver lining: Exposure. They aren't hiding their lizard-skin anymore, so it's easier to know who's who.
I guess that's a good thing. The more these companies do this, the more people will know.
This has been going on for at least a full decade in the video game industry: microtransactions, DLCs only adding 10% more content for 50% of the base game's price, games being shipped pretty much in a pre-alpha state, servers having a logic seizure or something, etc..
Only now do we see gamers in general being fed up with all but the absolutely most popular games/franchises, with good games getting a bigger slice of the cake on average this year than ripoffs.
But it's taken so long. During that time, several beloved franchises have been destroyed, beloved studios have been bought up, drained of developers and shut down, CEOs, investors, shareholders and executives in general have been gorging on the money the games raked in, and in general the video game industry is in an absolutely miserable state.

So says someone who, if Benjamin Franklin was alive, would be a double first cousin. It was one the worse ruling from the Supreme Court in this past hundred years granting this win-win option to them, and the people increasingly are under the weight more excessive than King George ever had a wet-dream for.
Individuals in the company have the rights of citizens however a collective cannot be considered a citizen.
I own a Roku TV (a gift). I first started noticing the forced ad control when I woke up one morning and found that my background had been changed to some shitty movie's theme. It has randomly happened several times since. It pisses me off to no end. I DESPISE being harassed--no, not "bothered", HARASSED--by ads and "promotions". In 2024 alone, I've had nine different companies suddenly update their ToS to include or expand forced arbitration. If all the businesses are doing this, it is not to the benefit of the consumer.
Perfect time to switch to 100% FOSS software! Avoid proprietary software, and continue the fight for free software, which should never be impacted this way!
Time to move to file a restore the [7th] amendment bill, so forced arbitration cannot be a binding term in the EULA. Edited to correct 6th to 7th amendment is civil I had it backwards even though what they are doing should be criminal.
The 6th amendment is about criminal trials. This is purely civil. "Sixth Amendment:
In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defense."
sadly with the current people in charge on both sides it wont happen at all theyre enjoying fucking us over
Could it be argued that in the Roku and EULA examples this is a coerced signing of a contract? Would that void the arbitration clauses?
@@samuelswayze I can't imagine how anyone could argue that pushing "agree" on the screen of something you already bought means you actually agreed.
@@samuelswayze It should, but so should almost all eula's on software you have to agree to on install vs before purchase. This case is just more blatant. Since this was forced on the user over the internet I see it like any other sort of malware. I'd like to see it prosecuted like ransom ware, same for companies that remote remove features that came with something but allow you to subscribe to get it back. That latter should also be extortion or something similar.
Not only giving up your rights to sue, but the more we allow it, the more precedent it will get. Its also affecting contractual law, because it's not allowing you to negotiate the terms, but rather forcing you to agree. And its interfering with consumer protections, because its disabling a product based on terms you didn't agree to at the sale. Its them trying to say "you need to organize a remedy with us, not the court" so they can screw you over whenever you have a complaint because they make the terms of the remedy.
Unless you want the future of owning nothing and living in the pod, you need to start rejecting this on principle instead of "who cares about watch history"?
I don't sign anyting anymore. It's now a Trap. They can't force you to sign a contract. Look for alternatives.. many people will try to convince you today, thats the way to go and you have to deal with it, but for my experience: There is always a way around. always.
You're right, but rebelling against this kind of derivative injustice will ultimately yield nothing on its own. Government is slavery, and that relationship trickles down into everything.
Without unearthing that root, we will find ourselves here again and again. We need to think about *evolution* rather than *revolution* if we want to break the millennia-old cycle.
Thanks for the hdmi video.. I was able to block roku’s software domain in my router and my tv cannot auto update anymore. From now on i will check for changes in the updates and will only allow if it doesnt force features on my tv.
Unfortunately, there is a lot of people who lack even the most basic principles.
Amen to that
And those people own the banks
The whole "When are you going to want to sue them, anyway?" response ages like milk on a summer day, anyway. I remember back in 2012 when I started getting upset about this sort of behavior, the response I usually got was along the lines of "Well I don't see myself ever wanting to sue Blizzard."
About a decade later and a lot of people were shouting and screaming about suing Blizzard, only to discover they'd agreed to a terms of service that forbade it. And all I had to say was "Told you so."
Because of all of this, I told myself the next "TV" I get, I should just get a big screen computer monitor so I don't have to deal with smart TV crap... Cut to the other day I'm browsing electronics, look at monitors, and what do I find? SMART MONITORS.
....
This frustrates me on so many levels. For one thing, now monitors are becoming infected with this crap. For another thing, THE HELL DO YOU MEAN SMART MONITOR??? It's not a smart monitor, it's either a smart TV with the antenna port removed OR it's an all-in-one PC with a shittier OS, shittier specs and no ability to upgrade the hardware plus all the other bullshit that comes with smart TVs.
You can't win unless you go back to using older tech before all these "smart" features were embedded into the hardware. Maybe that's why I keep seeing articles of kids these days playing more retro games instead of modern releases cause they're done with the bullshit and found retro games don't try to nickel and dime you for horse armor.

This is why I miss the simple days back before everything relied so heavily on an internet connection, sometimes you can't even use your device unless you have internet, and it forces you to agree to endless amount of nonsense to use it
There is a second part to the history lesson. Unfortunately part of how the U. S. were founded is also the reason why forced arbitration “works” in the U. S.. Due to history the acceptance of state authorities in the U. S. is much more limited. That’s why the U. S. states have much more power compared to federated states in other countries, that’s why the 2nd amendment exists, that’s why libertarianism plays a much larger role in U. S. politics and society than in other countries. On the contrary, given how e. g. European countries went from autocracies to democracies, there is still a greater consensus in these countries that the state has a monopoly on the legal use of force, which includes not just executive force, but legislative and judicial force. As I said before, in my country’s constitution there is an article that nobody shall be removed from the jurisdiction of their lawful judge. In that context, if the state allowed forced arbitration, it would be not just a violation of our constitutional rights, but also of the monopoly on the legal use of force which says that only the state in form of courts is authorized to dispense justice.
If I had a dollar for every time I've been offered a "free Experian" account because my data was stolen from a major corporation I'd be a goddam millionaire at this point. To be clear...THAT is their solution
Hi Louis, I also can't use Discord without agreeing to their forced arbitration agreement as of 4/16/2024. It's ridiculous that this is a thing and there's nothing we can do about it.
The image of Louis with a a musket and tricorn hat is seared into my memory now.
Roku turned into Fuku.
Seems Discord just jumped on this forcing arbitration agreement train. I just got a notice in the mobile app...
I'm glad someone is out there bringing this stuff to light. This one of the many reasons I'm not buying smart TVs. I buy old TVs that don't have any software in them. I have computers to hook to them via HDMI and watch what ever I want. Also, my computers are running Linux one, or two, that have Windows 10 or 7. I worked in the computer field for over 15 years, So I saw this coming. The phones are already becoming an issue. My phone is an old Moto z4. But some day I will have to get something newer, and I dread it. I'm really starting to hate tech for this reason.
You and SomeOrdinaryGamer are great for talking about this bullshit and bringing it to peoples attention that are ignorant or just not able to read and understand the T&C. Keep it up Louis!
Discord updated their agreement there was no disagree button.
i fired roku for this. now off to another slightly-less-poor option. you are what you eat.
My old Roku boxes that I haven't used in years, now have a date with my sledgehammer. Thank you for the stress relief Louis!
Hi Louis! Great content again, and like your better lighting👍🏼
They are likely breaking some law... But there's no police to pull them over and ticket them.
it is not breaking the law if you agree to it... you can bet they are right on the line though.
@@InzidenzPanik im from the era of unregulated internet with "beepy" modems "build your own or do without" & can verify that regulated does = bad. .. i would gladly swap my fast "regulated" internet for a slow unregulated internet any day of the week.
@@donavonlarney what I mean is that the "agreement" is likely not enforceable, and not within the bounds of current contract laws, etc. But, it has to get to court to get to that point of it being ruled as not legal..... so yeah.
@@TRYtoHELPyou i know what you mean... & even if it is "legal" & they get a ruling in their favour .. they could still be breaking the law but to get to actual law you would be so out of pocket it would be completely impractical .. which they are banking on... there is a difference between "legal" & "law"/common law... of which they breach everyday with our "permission"
There are, you just need money to access them. They're called attorneys and welp, they're really, really expensive.
Discord is now doing this as well, forced Arbitration, dude you gotta cover it.
The thing about Discord's TOS is that, if you can't resolve your dispute with them after 60 days from the time you start working with them, you can take them to court then. At least, that's how I interpreted it. It's hard to tell though, since they use such complex language in their TOS document.
Frankly speaking i appreciate you covering these topics as it shows how corporate greed and exploitation is so vile that the consumer's data is being stolen as a direct result of their shit. Keep up the amazing work.
Please keep teaching us, Louis. You're a hero.
Glad I live in Europe. Any change of contract needs to be agreed by both parties, so next to a yes button is a no button. And they CANNOT alter services that you signed up for. And any contract has to be available in the same format to opt out as the method you opted in with, and at LEAST as easy.
Ya, because the EU doesn't have it's own corruption..
Land of the Free??
EU is just as corrupt.
@@darkzap10 Free to screw the customer!!!!
This is why Piracy is not just okay but necessary.
Personal property rights need to be reenforced. No organization acts like you have a right to anything, not your own time, not your own money, not your own property, not your own privacy. Whether it's the government or some shady company, none of them are respecting you or your property. We own next to nothing now, not your house, not your car, not your phone nor computer, and you barely still own yourself. Private property of the individual means next to nothing, and that must be fixed.
My man lol bringing things to light! Keep up the content !
same with the games you buy but still have to download?... if you don't hold it you do not own it... "own nothing & be happy".. yeah right.
My Roku is an attachment to my TV. Right now and probably forever it's a screen saver that will be disconnected if Roku continues with this policy. I only got it because Crunchyroll, Daily Wire, and HBO Max weren't available on my TV. That's not the case anymore. Removing it will be an easy thing.
Or get a real Mini-PC :)
@@Splarkszter With Linux installed to it to keep control on your own.
On forced arbitration...
Fledgling Lawyer: "Is that legal?"
US Supreme Court: "I will make it legal."
The Supreme Court needs to declare these EULA, "I Agree" agreements to be invalid---as they are made under duress. That will put an end to this crap!
My Roku TV has never had WiFi privileges. All it's gotten since I bought it is 120 V and HDMI inputs.
Try giving it 240V and see what happens :D
(hint: the garage might have one)
And this is why I am going to get rid of my TCL roku TV from 2020 for a Gen 1 Samsung odyssey ark.
I had to look it up and I see that it's a curved screen. Can you hang them on a wall?
@@bikeny Yeah, if you have a VESA 200x200 mount.
Samsung products break so quickly, I'd recommend against it.
@@kunka592 OK.
Saw where Discord did this tonight.
Unfortunately, I clicked through because I just woke up but these companies are getting ballsy.
If only there was a way to mail your products back to the company and have the recipient pay for shipping costs as a way to show our displeasure in changing the terms after sale
You can set it to store mode and use it offline
What are u gonna do offline tho😭😭😭
@@supamalleo64 use the HDMI with a Chromecast or proper streaming device, the ones built into the tv are awful
this is why i factory reset my roku tv and denied it any internet access. the only streaming service i bother to use is amazon prime which i can use just fine through the browser on the media center PC hooked up to the TV. so now i just have it denied internet, and set to auto to the HDMI port the PC is on when TV is powered on.
we need a class action law suit against this behavior got to be illegal in some way!!!!!!!!!!!!!!!!!!!!
you shouldnt be using prime you should be pirating instead.
@@marcusbullock630 well when you find a pirating option to get physical things that provides free shipping let me know. prime video is just automatically part of the prime membership. Amazon and Walmart put almost everything out of business around here so alot of things i have to order from Amazon.
if prime video has something i wanna watch ill watch it. if not ill torrent it.
Getting a youtube advertisement for a John Deere retailer (VanWall) before watching a Louis Rossman video is really just adding duel to the fire for me.
Its bigger than the companies and where you took this video in the 2nd half is exactly the point. I emailed you abot 4 hours ago. Same name. I sincerely hope to see you there!
...But First....You've got to get MAD!!
That scene was going through my mind, too lol...
Great film! Thankfully this is actually more focused and constructive in comparison
Does anyone understand why some people defend bullshit like this? I'm genuinely curious.
When Peloton pulled their BS a few years ago making their products unusable if you don't buy a subscription I woke up. I buy NOTHING if it only works if it's temporarily licensed. Gleim Aviation is now pulling this BS. You can pay hundreds of dollars for their learning material, but the audio media portions are only good for a year. I contacted them about it asked why anyone would enter such a deal when you can go to other sources for the same thing and own it. No response. They seem to be trying to get on the same train of taking advantage of customers. Louis is correct, shut this practice down.
The Rantmann goes Revolutionary. A platter of patriotic offerings in our face and down our throats. A short-served content bar today. Thick, satisfying, and fresh as ever. Great spread.
The FAIR Act prohibits mandatory arbitration agreements for employment, consumer, antitrust, or civil rights disputes. The FAIR Act also protects the rights of individuals and small businesses to participate in joint, class, or collective actions related to such disputes.
also through contract law, any unlawful thing in a contract makes the contract void. so forcing people to sign to agree would make the contract itself void. it's an unlawful contract due to the FAIR act violated.
for those who dont know. to hold businesses accountable u want a court system, NOT arbitrations which generally are rigged and business try to use them to get out of legal accountability.
ups(the brown trucks transportation company) actually also did this on their applications for package handler in ontairo california. in order to proceed with the job application you had to sign the agreement. there was no disagree option.

Louis Rossmann for president 2024!
A friend wanted to replace the current, perfectly operational TV with cable signal for a "smart" option. I said to that person "do not" especially if it's a Roku. Refrain for these vile options.
Every point, Louis, that you have pointed out is true. Love you. Especially your non-wokness
