- Bernell Benn was charged with second-degree murder over a dispute in a local convenient store that left one man dead in 2012. Today I will be reacting to a clip of him telling his side of the story from inside jail.

mace is for sure a weapon, there is more legal precedent across the country. there was a security guard in Denver who shot and killed a right wing protestor who had slapped him and sprayed him with bear mace, charges dropped. basically you just need to prove they acted with aggression and not in self defense.
Nah. Public carry needs to be a outlawed, and an automatic life sentance.
If they are for protection, keep then in the home; or a sports event.

So let me explain further that that means your comment with 30 likes is a steaming pile of uninformed bs. Par for the course for the internet. BUT you can and should do better.
For those who didn't check the link the article seems to indicate he was in jail for at least two years. Charges were reduced in 2013 and the article is 2015. Anyway, there were two trials and both ended in mistrials. It was mentioned the majority of the jury thought he was guilty BUT it must be unanimous. The DA dropped the charges believing a 3rd trial would result in the same outcome. That's all that's in the link AND it indicates things more than likely didn't go down as he describes. He was NOT found not guilty, much less innocent.

Dang, he still spent 2yrs in jail. Two trials went to mistrial as they couldn't reach a UD. A majority of the jurors found him guilty, but they needed a unanimous decision.
The prosecutor put this guy through hell for exercising his right to defend himself. He was shot at first. It was a miscarriage of justice to prosecute him.
such bs if someone defending themselves get jail time like that. I mean the dude pepper sprayed him, there had to have been footage in the pharmacy, also, the other dude HAD A GUN in his HAND right? I mean that is obvious self defense if you ask me, if you look at footage and you can see. Nah, not cool. The judge and prosecution should pay some for that, and all law enforcement involved, in some way, be more accountable, should not have to fear defendig yourself. I fear defending myself thinking what if I go to prison, think think think, for me, I cannot seem to think that much mostly, so i freeze. So I let them kill me? I mean bullcrap self defense is plain in a lot of cases, if it is, it should be done and over within a week.

The Norfolk Commonwealth's Attorney's statement said they decided to drop the charges after two jury trials held in the case ended in mistrials.
In each trial, the jury was unable to reach a unanimous verdict. Both juries indicated that the majority of jurors wanted to convict, but a unanimous decision is required.

I watched this guy last nite....crazzy.... didn't believe him at first few minutes, but he really has his story together and I'm glad it went his way, it easily could have not.
Also another cat where they wanted to frame hin literally by not providing the existing video footage. ..luckily like here they eventually got justice - they didn't say how much time both wasted on defense.
It's so beyond me that in 2023 they are willing to try and frame people to serve decades man, and knowing there's material evidence saying otherwise (related to that other vid - same channel)

My uncle jus killed a guy recently that broke in his house maced him and started beating him up telling him to give him all his money. Didn’t even go to jail for it or nothing. Shit was crazy

@@scottyelder8351 right he was pretty tore up about it but it was him or the other guy he told me the full story and he got lucky the guy was fighting him for the gun and he's a skrwany old man and said the guy had the gun turned in his hand pointed at his own head with his own finger on the trigger the gun didn't fire he got it away from the guy and put one in his neck. The saddest part is that crook was well known for robbing elderly ppl like that and the cops and drs at the emergency room were going back and forth from his room treating his maceface and bumps and lumps and they started high giving him and telling him good shit and all kinds of stuff. But I guess play stupid games win stupid prizes... I tell him it was either you or him and would you rather be dead and him still on the streets doing it to other ppl? When he waved his hand, that WAS the "stopping point" the cops are trying to get him to admit aggression, if he changes his answers they gottem....and thats what their digging for.....but he's holding steady. Good for him.
You can see in his eyes that he’s reliving it all, his descriptions paint a clear picture & u can even see he’s even questioning himself at times when he’s asked certain questions. I feel bad for him but this is what we have concealed carry permits for, all states should be stand your ground but for whatever reason most are not. I hope he can find peace & healing from what happened, he clearly did not want any of that to happen.
i sat in jail for an attempted murder charge for 3 months before they dropped the charges. i had a job and got off drugs before i went in. then i got out and got back on drugs .

There’s insurance for if you ever do have to shoot someone to protect yourself. Where they bail you out and have attorneys to work your case etc. I’ve heard it described as “legally shooting someone insurance”. If you illegally shoot someone though, you’re on your own

At first I wasn't believing him either, but as he explained everything I began seeing the pain in his eye's and he was definitely being honest and I believe he was scared for his life. The pain in his eye's was genuine and he didn't miss a beat describing the situation.

@MrMancreatedgod Gotta give me some reason's of why you feel that way. Can't just say he is! I've seen many who could have been a salesman in real life and on the internet and after watching the video and back story of it all I believe him. Even in the video you can see the guy attack him first and yes you see him come at the attacker and shoot which is normal in a stressful situation especially when partially blind and feared for you're life gonna try too stop said attacker at all cost. I feel the attacker didn't expect him too also have a gun and immediately tried too back away while firing when he pushed and shoot back at the guy. That's what I got from the actual store video and his story. So let me know you're take on the situation if it's not how I see it. I'm not arguing or fighting just wanna hear your side about it because this was obviously a tough case.

They were both fighting over a place in line which they didn't care about because they both jumped out of line to fight.
I watched the surveillance footage on UA-cam of him gunning down that guy. He was clearly in the wrong of murdering him but got away with it. He was walking around in circles talking on the phone clearly not standing in line waiting. Thinking that no one would come up and stand there is ignorance. The guy he shot clearly came up not thinking no one was in line. Bernell in the footage was clearly looking like he was going to walk down the aisle on the phone when the guy walks up. So obviously the guy walked up not knowing that someone was in line. Bernell then walks up and tells him he was in line first. The guy then tells him no you weren't there was no one there. Right then and there Bernell should have took his lick and let the man go. Bernell wasn't in line he was walking way away from the line in circles. The man he shot was in the wrong though for macing him but it does look like Bernell was trying to be the aggressor. Walking in front of the man by the counter before he got maced. This is where we need audio evidence and the cashier to be a witness on what they were saying to each other. I think Bernell was being aggressive. The guy only maced him twice. Clearly in the video you can see that Bernell still has his vision. The guy didn't mace him good enough. You can see him and the guy walking down the aisle together. The man who maced him should have let it be but his machoness got the best of him. He was probably just going to mace him again and didn't have a gun. You can see in the footage that Bernell could see because he began chasing the man down the aisle and then shot him a couple of times. The guy was running not shooting back at Bernell. Bernell wasn't feeling his way down the aisle he was running after the man. At the very end of the footage you can clearly see that Bernell still had his vision. He threw his gun, kicked it and then picked it up. If you can't see how can you see to run after someone, aim and shoot. Then pick up your gun off of the floor afterwards. He was twisting the truth to get away with murder which he did. Bernell should have squashed who was in line first because he clearly wasn't in line. He should have let him go and take his lick. The guy shouldn't have maced him but what was said to make him do that we will never know. There was no audio or witnesses so he got away with it only because the other guy was stupid and kept pursuing Bernell down the aisle which he shouldn't have. Now a man is dead because one wouldn't back down and the other thought he was more dominant.
