I think I am messed up, but I will wait until June to fill in the DS-260 if I win. Because If my appeal proves I am not guilty in the end, that won't show up in my register. Do you think it will be a problem to wait until like july first to fill the ds-260 if I win?

You use the time you came together under custom marriage. That will be the date that applies.
