  • There is one proposed endeavor USCIS does not love for an EB2 NIW green card petition. Here I tell which one it is, why they hate it and two examples to illustrate this. I also give you a few ideas on how to avoid it so you can minimize the chances for an RFE and denial.

    You should upload a video about IT, I know a lot of friend who are IT managers working in US their cases were denial because they could not demonstrate his job impacts more than his job. That is making a lot of people from IT industry have doubts about eb2 niw

    Hi Oscar! I really appreciate your video!
    I'm a project manager of huge initiatives and my application was denied for the same reason. The law firm didn't prove the broad impact. Now, I'm doing a new application by myself with a business plan.

    Hi, my pd is 20 may 2023. My petition is still pending. I haven’t received RFE. It’s been almost 10 months. Average time is 9 months. What you suggest me to do?

    Hey Oscar, SO I'm a bit confused... I haven't filed a petition for my father yet, He's an Associate professor mainly a teacher but also an exceptional Researcher with over 4400 citations on Many Publications and has been Listed in world top 2% researchers in 2021, 2022, and 2023 by the yearly studies conducted by Stanford University, USA in cooperation with Elsevier.
    Is this a good case for EB-2 NIW, How about EB-1A? Considering he has done lots for review work for IEEE and other popular Journals.

    Congratulations Oscar for such amasing information. It is not enough having Master or PhD degrees or having 50 years of work experience. I read many cases on USCI website about rejecting petitions which claim only these attribute, additionally 90% of Visa are granted to professionals that already are working in the USA

      Indeed, you also need a strong endeavor of national importance. You DO NOT need to be in the USA

      @@OscarsGreenCard While I totally agree that you do not need to be in US for an I-140 approval (since nothing in INA prevents one to obtain such even when outside US), a popular immigration law firm that goes by the name C*** immigration law (and has an internet brand name W********), has observed recently that petitions emanating outside US tend to be taken a closer look or scrutinized harder due to the following factors: (1) recently hired USCIS adjudicators, (2) increase of frivolous applications partly due to hype brought by unscrupulous immigration consultants (which, I believe, you have pointed out in one of your videos). Though anecdotal, I have heard that many of these officers do not anymore exercise a wide latitude of discretion compared to their predecessors in their designation. The recent decline in approval rate, which you have also featured, somehow shows this heightened scrutiny. I think, to some extent, these adjudicators have gatekeeping of visa numbers in mind as a factor when deciding whether to approve or not. I think it would be worthwhile mentioning these trends in your videos especially to people outside the United States.

    Oscar Sir, I am Shahid from Pakistan and I your big fan.
    I am PhD Doctor & have 10 years experience in teaching with specialization Pharmacology ( Healthcare ) also STEM , I have also done research work about 25 Paper published with 50 plus citations .
    My Question is that may I apply as a teacher along with side line my research work ?

    Hi Oscar, great video. What about a technology management consultant with a background working for American cos over the last 10 years but I will be applying from Canada ( I am a Canadian citizen )....is that a strong case for national interest?

    Dhanasar's case shows what you have emphasized repeatedly: National Importance is way much more critical than Substaintial Merit.

      I don't do evaluations, if you have a plan that is of national importance to the US, maybe. But from what you are saying, it may not be the case...you have to evaluate

    I do not understand why teaching is not in National Interest of the US? I teach at a technical college in Georgia and my job is to prepare my students with skills which will get them employed. Trade skills or other social skills. How is it not in the national interest of the US when I am helping people get jobs on a NATIONAL LEVEL? Surely any student from Georgia can be employed in any other state and wouldn't it be in the broader interest of the US, isn't it?

      What they are trying to say is that teaching in itself has got its green card pathway called EB3 skilled green card for localized areas . Having said , your impact must be of national importance in that time and in future . Students being taught help the county they are in at most times for example where as published research benefits many at a national level in real time .

    Dear Oscar congratulations for all information about EB2 NIW visa, however, you forget to mention that EB2 NIW VISA is granted to professionals who already are working in USA, particularly those doing research in different companies. These professionals apply to this visa because the processing time is shorter than the processing process when a company is your sponsor. It is not true you do not need a job offer, at least 90% of people granted with this visa are working in the US, as evidence when you fill out forms they ask you for the address you work or will work, this contradicts all purpose of this visa.

      This may not true since Graduate students from public universities (who are not defined as workers) still get approved.

      This is not true. People never been to US get it. If they are in Rest of World category, they get GC right away along with Approved I-140.

      Keep in mind the forms are the same for all types of employment based green cards, hence the address for work info you are asked to provide.
