  • On my lunch time, I got the chance to catch this rare moment.
Engine 205, ladder 405 and fire chief 136 responds to a call downtown Montreal. At the corner of President-Kennedy and Jeanne-Mance, an idiot driver don't want to move. The fireman sit on the passenger side of the engine has to go out in order to let know that driver to move.
    --

State law says you cannot break a traffic law to give way to an emergency vehicle. Now I assume if right on red is allowed in Montreal, he should've just turned right and lived with a slight detour. But yeah in my state, if you run that light to let the truck through, you're getting points on your license and your insurance is going up.

Would not work in the US. Only police here can write traffic summons and you need to prove the registered owner was the one driving. That's why hit and runs almost never get prosecuted because the owner of the car will go to court and say the prosecutor can't prove beyond a reasonable doubt that they were in control of the car when the collision happened. Also in my state, you cannot run a red light to allow an emergency vehicle through because you could cause an accident. If this black car ran that light to let that truck through, he'd get a fat camera ticket, some license points, and his insurance is going up.

It's not left as a judgement call. In Australia, NZ and the UK it is specifically spelled out in law that you cannot go through a red stop light to allow emergency vehicles to pass, no matter how much you want to. They even state that aside from pulling as far to the side as possible without entering the intersection "The onus is on the emergency vehicle to find a way through". It also specifically mentions you cannot drive onto the footpath to create space.
This way the Govt gets their cake and eats it too, no responsibility and no liability. You don't let the Emergency Services through, you're a heartless villain, you do let them through and you're a law breaking scum bag with voided insurance, some fines and all the liability for whatever happens. After all the bit lutan1 mentioned about turning off the sirens and waiting is so that they can't be accused of pressuring you.

@@jeanlongpre_911Action You still have to consider liability. Even in an emergency, you have to get there safely. You can't just drive 100 mph without stopping to a call. The answer to safe faster response times is traffic light preemption, better positioning of stations and units, traffic control on high congestion intersections like NYPD Traffic and Chicago OEMC-TMA perform, and policies/urban design that get more cars off the road by encouraging use of transit, carpooling, walking, and bicycles. In my state you cannot run a red light or break a traffic law to let an emergency vehicle through unless a police officer directing traffic tells you to. A firefighter, EMT, or cop not controlling that intersection can't t make you. Emergency vehicles can't make a vehicle break the law to let them through. Reason being that if you force that civilian, who themselves does not have warning lights, sirens, or EVOC training through the red and they get T-boned or hit a pedestrian, not only do you now have an emergency to attend to and will have to send another unit to the original call, but all injuries, damages, and wrongful deaths caused will be legally the fault of the responding department, and the settlements that will have to be paid out will likely result in a massive downsizing of the department to stay within the budget. Lawsuits are very expensive and one of the biggest money holes for cities and states. A firefighter that forces a driver into a dangerous situation that kills them CAN go to jail for it. Emergency drivers have priority, but they are not above the law or totally immune from consequences. Even in this video, you see the dump truck that could not see the firetruck trying to force the car to run the light going through the intersection anyway. If that car would've gone like the lieutenant told him to, he would've been turned to paste.

In my state that would not be allowed. A firefighter cannot tell you to break a law to let them through. If you run the light to let the firetruck through and get into an accident you are at fault, you're getting a massive ticket, and if a firefighter told you to do it, they're legally liable for a lawsuit too. A very expensive one if someone dies or is severely injured as a result. The only person who can direct you to break a traffic law is a police officer in control of the intersection directing traffic. If the cop is behind you and is not in control of that intersection, they can't tell you to run the red either. It's just too much of a safety risk and liability to make drivers run red lights into busy intersections when they don't have the lights, sirens, and training that makes it safer for emergency vehicle drivers to do it. Ambulances and police cars lit up like Christmas trees get t-boned running red lights what makes you think it's any safer for a regular car to do it? What departments should be doing is installing traffic light preemption so the light changes with enough buffer time for everyone to sort themselves out as the emergency vehicle approaches. It's safer for everyone.

The situation in the UK is that it is illegal to pass a red traffic signal, even if an emergency vehicle is held up. This is enforced and drivers of emergency vehicles are instructed to turn off their sirens if cars are held up at red lights. Giving way to an emergency vehicle is not accepted as a defence for running a red light in any circumstances. Common sense is frowned upon here!

    • @stefangr1
      @stefangr1 5 місяців тому

Common sense is actually wrong here. The problem is that only in a limited number of emergencies arriving half a minute earlier will really make a difference for saving lives. However, if all motorists respond to emergency vehicles by doing everything they can to allow emergency vehicles to pass as quickly as possible, even when that means running red lights, ignoring stop signs, and speeding, this would also result in many additional traffic accidents. Some of these accidents will actually block the road for the emergency vehicle, or will require help from the emergency workers, thereby further delaying the response to the initial incident. What you would ideally want is that cars remain fairly careful, and only break the law when it is relatively safe to do and really helpful for the emergency vehicles. However, you can't really make a law that way as laws are always to some extent one size fits all.

Ok so what happens in Germany if you run the red light to let the fire truck through and t-bone someone (or are t-boned) because other drivers couldn't see what was going on, maybe a blind intersection or corner? Who's at fault? In my state the reason this isn't allowed is because the increased risk of a collision. I used to direct traffic. If I directed a car to run a red to let an emergency vehicle through and they get hit or hit someone doing it, I'm getting fired, my city is getting sued, and depending on how bad the result is--for example if someone dies--I'm getting personally sued into the ground and may even do jail time for involuntary manslaughter.
