It's a slippery slope though, and when a cop has an ego problem and needs to be put in check I 100% absolutely agree with you, but especially with newer recruits cops are still human and make mistakes so it'd have to be a case by case basis.

If they're paid to enforce the laws shouldn't they KNOW and understand the basics like can we arrest or not? We generally give them 24/7/365 access to Prosecutors for "questions"
If there's any doubt they shouldn't be arresting unless it's a violent crime etc. If it's questionable get ID info and send to the prosecutors office to get warrants issued or charges etc. Mail notice to contact and report for it and no contact send local police to knock and announce. Then a warrant as needed.

Policy violation, you can be asked to leave and arrested for trespass for failing to do so, as long as the policy stands up to constitutional scrutiny for the type of public forum in question the arrest is legal. Public Forum Doctrine

Sean's own NYPD case covers the first amendment position. See Reyes vs City of New York pages 10-21.
The crime is trespass. Which occurs when he knowingly remains on premises that he is not privileged to be. He becomes not privileged when he is asked to leave by an authorised agent for violating the policy. That trespass will be legal if it stands up to constitutional scrutiny for the type of public forum in question.
@@user-gb7ng2ly3l the case was dismissed as the evidence was materially insufficient for the charges they went with. That's on the prosecutor, but says nothing about if the policy in question would have stood up to constitutional scrutiny.
They should have charged him with simple trespass which they had facts to support.
I'm not saying that the policy was constitutional or not, but I don't think it's reasonable to automatically say that it conflicts with the constitution. For limited public forums government entities can create restrictions that are wholly consistent with protecting the forum for its intended purposes, as long as the restriction is also view point neutral. Less intrusive options need not be considered.
So this becomes a question of was this policy protecting the forum for its intended purposes and is the restriction view point neutral. And I can see arguments that could satisfy that not dissimilar to the first amendment opinion offered by the courts in Reyes vs City of New York.
While the officer is literally recording and the many other cameras around the public area. Kind of hypocritical, don't ya think?

And your on video the moment you come out of your house whether it's by ring doorbell leaving your house, going down the road with other people's ring doorbell videoing you and then you get into town and on every corner there's lights with cameras and on the street corners where there's cameras there's also sound. Then you walk down the sidewalk or go into building those cameras everywhere so the majority of the time you are on camera at least 90% of the time when you're outside of your home. If you live in the country it's less time spent on video.
If we are going to play what if game it would make sense to not allow the public to record anything anywhere because of " what if ". Therefore only the government should have the power to record because they are pure in heart and only have the well being and the protection of the people in mind. Yeah Right.

Any time something likes this happens and a lawsuit is brought up it should be on the arresting officer/officers. No more suing the city and hold the officers accountable. This is where qualified immunity must be taken away and thrown in the garbage. Also, more in depth training on laws. I'm thinking 2 years of training and a yearly training camp.

I never understood Nassau and Suffolk county they pay their offers 250k who work in a five mile village and then allows them to write summons and tickets to those same tax payers taking more money from them.
