      It's a slippery slope though, and when a cop has an ego problem and needs to be put in check I 100% absolutely agree with you, but especially with newer recruits cops are still human and make mistakes so it'd have to be a case by case basis.

    • @mrmotofy
      @mrmotofy 26 днів тому +1

      @@percyal1 So if YOU or I make a mistake like take something that isn't ours, drive faster than we should or some other "mistake" and it gets noticed are we not held accountable? Or liable for our actions? If you're going to restrict someone's freedoms arrest or charge them shouldn't one be 100% sure and follow the law? Isn't that the purpose of laws? IMMUNITY is not even a constitutional idea...it's got NO basis in law. It was literally made up by the court system. Never got a vote or public input. Isn't that a serious problem?
      If they're paid to enforce the laws shouldn't they KNOW and understand the basics like can we arrest or not? We generally give them 24/7/365 access to Prosecutors for "questions"
      If there's any doubt they shouldn't be arresting unless it's a violent crime etc. If it's questionable get ID info and send to the prosecutors office to get warrants issued or charges etc. Mail notice to contact and report for it and no contact send local police to knock and announce. Then a warrant as needed.

      @mrmotofy yeah sorry kid but I'm not reading your whole diary entry on something your emotional response will never change, but I already stated it's wrong, as long as they apologize after and don't pull a gun on you there shouldn't be any repercussions, if you sit here and tell me YOU are perfect in every aspect of your life weather it be work or home, you'd be outing yourself as a liar, cops make mistakes, if they own up to it, no big deal move on and learn, I already said if they don't and ego trip then yes they should be punished because THAT is the dangerous part you jackwagon 🤣

      The origins of modern-day policing can be traced back to the "Slave Patrol." The earliest formal slave patrol was created in the Carolinas in the early 1700s with one mission: to establish a system of terror and squash slave uprisings with the capacity to pursue, apprehend, and return runaway slaves to their owner

      But I'd say that uniformed police began in the big cities up north. Their populations were getting huge and there was no dearth of drunks, gangs, poor and unemployed even in the early 1800s. The politicians also used them to bully political opposition and to intimidate voters. See "Boss Tweed" for example.

      The crime is trespass. Which occurs when he knowingly remains on premises that he is not privileged to be. He becomes not privileged when he is asked to leave by an authorised agent for violating the policy. That trespass will be legal if it stands up to constitutional scrutiny for the type of public forum in question.

      @@user-gb7ng2ly3l the case was dismissed as the evidence was materially insufficient for the charges they went with. That's on the prosecutor, but says nothing about if the policy in question would have stood up to constitutional scrutiny.
      They should have charged him with simple trespass which they had facts to support.
      I'm not saying that the policy was constitutional or not, but I don't think it's reasonable to automatically say that it conflicts with the constitution. For limited public forums government entities can create restrictions that are wholly consistent with protecting the forum for its intended purposes, as long as the restriction is also view point neutral. Less intrusive options need not be considered.
      So this becomes a question of was this policy protecting the forum for its intended purposes and is the restriction view point neutral. And I can see arguments that could satisfy that not dissimilar to the first amendment opinion offered by the courts in Reyes vs City of New York.

      Yes I'm being sarcastic. For some reason, despite all the evidence making those statements not just untrue, but outright funny, tons of citizens still believe them. Probably because their tax dollars pay for billions of dollars of copaganda, and every MSM channel in the nation licks boot like a dog trying to eat ice cream. Not to mention all 80 versions of Law And Order, Blue Bloods, LivePad, etc.. No offense to anyone who likes those shows, liking them is fine so long as you understand it's propaganda/entertainment and not reflecting of real life.
