  • The plaintiff says the defendant made a right turn on a red light and ran him over while he was on his bike. He claims she then yelled at him and fled, but a witness got her license number. She had no insurance, and he’s suing for what he’s owed for his bike and cab fare. The defendant says the plaintiff set her up and is extorting money. She insists she was at a standstill and he hit her.

    Defendant has no issue with admitting to a hit and run. Disgusting disregard for another. She saw him coming, and proceeded to hit him. And then her reaction was "oh well" and tried to drive off. Then threw his bike. All bc it might delay her 30 seconds.

    The funny thing is he would’ve been awarded more money if he didn’t come across as a scammer. If he was honest, I believe she would’ve awarded him $1000,00. She hit me, she toss my bike, and she fled. Did you go to the hositpal, no, i had the wind knock out of me. With that and the defendant’s attitude he would’ve had a win fall. But American greed is powerful!

      @@trekgirl65 True, its called rough justice. She committed a crime that did cause damage to his property and person. The defendant tossed his bike and she hit and run. He did show the judge the injure caused by the bicycle bar. We know everything took place and if he did go to hospital to produce medical bills and had a real receipt for the bike he could’ve received over 10K, just from the insurance company. She awarded him $200 not because the lack of evidence. She did it because he was trying to pull a fast one over on her with those bogus receipts. She had the power to award him up to the max because of the situation. $200 or 5k that was up to the judge

      It's not that he inflated the price, it's that he faked the whole thing. By his own testimony, he was on the ground grasping for air but his first call was to a lawyer and not a doctor. He's just a scammer. Yea, the defendant behaved badly but she was right from the start that he intentionally hit her so her smile at the end was worth it to not have to pay the bogus "I had this super expensive bike that vanished" claim.

    The defendant is an awful human being! Lady, your work is NOT more important than someone else’s life. He could’ve been really hurt and you didn’t care because you “were inconvenienced”. Karma will catch up to you one day. He definitely needed better evidence though.

    This is my personal opinion. I believe they were both lying. There's a saying that there is one side than the other side and then there's truth in the middle. I believe what happened was that she pulled up it was on The pedestrian crossway because she couldn't see because of some sign and she had done it every morning, the plaintiff was closer than she anticipated and as she pulled up till see he ran into her and flipped over. He probably hit her car when he fell and she got out and assumed he was faking. And she was impatient and thought this guy was going to try to take her for a ride, so she inhumanely treated him like a scam artist and tossed his bike and told him to get out of the way. I believe he got the wind knocked out of him, I don't believe there was any permanent damage. I don't know about the Good Samaritan story because he could have easily gotten the 911 call that was recorded, if he was taken to the hospital and have the injuries that he said he did he could have kept his discharge papers then went back for more detailed records, and since everybody has a phone he could have asked the Good Samaritan to give a statement. But since he didn't do any of that, I believe he just got the wind knocked out of him and because she was a b****to him he jumped on her car and didn't want her to leave because he was angry and though he could get a little extra money. In regards to the receipt you have no clue if his friend sold him that or not. She didn't even question where the bike came from. It's a South Streets of Florida. You leave anything outside for too long somebody's going to take it. I don't know if it was or he still has it and it's just claiming he had to take cabs. This is just my take on it.

    He seems uneducated and probably didn’t have anyone to prepare him for court. You always need evidence in court. The judge just doesn’t take your word for it. He could’ve won more if he had prepared documents but he doesn’t seem like the type to save documents. So sad…

    Defendant was absolutely right. He probably saw her and still rode into the street. Then threw himself on top to become a bigger victim. He called a lawyer before he went to the hospital. What does that tell you? She probably saw him for what he was and didn’t want to stay however she should not have run. If he had evidence he would have brought it, like pictures of the bike or the receipt for a new bike. I am glad she smiled at the end, this was vindication that she was not the bad guy.

    Damn, the defendant definitely gave off the vibes that she had better things to do than to be in court. The way she tried to rush explaining her side, still had her purse on her shoulder, the pinched lips.... lady damn. I think homie was definitely irritated with the level of disregard she showed and tried to soup up and scan more money to stick it to her and teach her a lesson..... but wow, is her personality incredibly disagreeable prickly. I sure wouldn't want her working on my skin!

      She wasn't wrong. He didn't have proof of anything and was clearly trying to trump up a big lawsuit.
      This isn't a criminal court. You don't prosecute in a small claims court.

      @@croedeeja to get an actual receipt you would have to buy a bike from Wal-Mart or a similar store that would usually stock the same bikes every time and have them in their registers system. Bike shops give hand written receipts due to the inventory never being the same, custom builds, and custom order parts or work.

      ​@@kennethsistos323a reputable bike shop would at least invest in a paper receipt pad that has their business name and contact info somewhere. They'd also write something more legit than "special Mongoose mountain bike".

Actual bike shops do get them in the boxes and build them in store, the manufacturer doesn't send a barcode since the shop will most likely add parts and accessories that aren't from that company, making it something completely different from what the info in the barcode is and the shop can't alter that info, they can only add the price.
      Only know this from personal experience purchasing from many well known shops and a few friends owning bike shops.

    The defendant needs a Judge Judy or Judge Mathis' treatment. Either one of them would've torn into her attitude.
    I initially felt bad for the plaintiff, but he turned out to be a really bad plaintiff. Totally unprepared with just the basic for coming to court and shady too.

      Definitely not normal in this area however, something people don't consider is Florida has immigrants from all cultures that migrate here (you can hear the defendant's accent), her approach was inexcusable and she showed no remorse for hitting that man.

    This happened to me before. I grazed someone’s car with mine one day. The two passengers in that car claimed they needed medical…they both got a 6000k medical payout. Ever since then I’ve lost trust in people’s goodwill. That being said, I wouldn’t be surprised if he was lying

    Good for her! The guy was on a side walk and had the red light. He was at fault. And i totally get what she said about "reading the room" knowing He was about to fleece her- and HE DID!.
    She provided her information before leaving the scene (which is why she didn't get a ticket). The Plaintiff even said the police didn't respond till she got to the hospital.
    No ER records, photos, bills. No letter from her insurance company saying she wasn't covered. No statement from the witness. She wasn't cited for leaving the scene. No proof he had a Mongoose)
    $200 was more than he deserved, but much better than $1500!

    The bad news: is that he didn't get the amount that he wanted for that "humongous, life altering, deformity" of a scar on his chest (I had to partially cover my eyes to keep from vomiting and then passing out")!
    The good news: is that with the $200 he can go to Walmart, purchase another Mongoose bike, treat himself out to lunch, and still have money leftover to catch a good movie...with popcorn!
    But on a serious note, the defendant's behavior at the scene of the accident was pretty bizarre!!! Seeing him (coasting) and not stopping, getting out of her car with anger because she hit him, yelling at him to get up off the ground so she can get to work (I believe she said that she was an astronaut and late for takeoff), picking up his bike and tossing it, leaving the scene of the accident AND not having car insurance.
    Gotta also love how his urgent call was to his lawyer!

      That receipt is most likely real. My $1,000 road bike and my dad's mountain bikes came from well known shops with hand written receipts. Only thing on them was the bike name and final price, with the business name hand written in the corner.
