Not often do you see both the plaintiffs and the defendants so properly behaved and respectful on these shows. Its refreshing to see. And a very well behaved, cute little girl. There is hope for our society. I hope she has no lingering problems from the accident.
I don't think she will have any problems. A young kid's bones heal completely and its like it never happened. Only the surgery scar will be visible for the rest of her life.

I’ve coached and taught 7 year olds enough to know that when they’re excited enough, they don’t look both ways before darting across the street. That family is so fortunate that the defendant wasn’t driving any faster. If any good comes out of this, I hope it’s that the daughter now double checks that it’s extra safe before crossing the road.

Agree. Defendant didn't owe anything. I think its a life lesson for all and a way for her to compensate the girl. I dont think the defendant could have been any more careful because even that split second wave to a friend, could just as well be him looking to the right at kids since kids were running on both sides. Its almost impossible for him to avoid the accident. They all looked like very descent people so I hope this serve them well.

I couldn't imagine how the parents or even the driver must have felt when this tiny little human got hit by a vehicle, I know that was the worst feeling ever. I love Judge Judy. Her wisdom has guided me and I try to lead a responsible and conscientious life due to what she's said to her guests on her show over the years. She handled this case with great care and was gentle to all of them. I hope Journey was able to do something wise with her award money. The defendant seemed like a really good guy. He had the air of a serviceman and was studying medicine. He didn't seem like a careless or reckless person. I hope he's doing well.

They as parents are responsible. Roads are for cars not kids. If it was so busy and a neighborhood party he’s obviously driving slowly. My kids don’t cross the road at 7 without myself, clearly her view was obstructed and excited to get to her friends she’s an innocent child playing but the parents could have prevented that.
Especially when she darted out between two cars, so there’s no way in hell she looked both ways like her parents told her to say. They should’ve been watching her. He was also going a max of 10mph, so there’s no way she checked the road because it’s not as if he shot out out of nowhere.

That judgment was totally fair. It absolutely was on Journey's parents to ensure that she was better taken care of. I'm glad that she got something for her pain and suffering. But hopefully this is a lesson for her parents to be a bit more cognizant of what's going on. Much like the defendant had to learn to be a bit more cognizant of what's going on when he's driving. Exactly how is defendant liable, in plaintiff's eyes. It's parents responsibility to watch your children and not other parents, neighbors or friends but parents responsibility. I do not see how defendant is at fault when child ran out between 2 cars driving and he couldn't see her over hood. If defendant was not speeding and watching road how could he foresee a child running in front of his car in between car in front of him. I get impression child's parents were looking for financial windfall from accident that they were at fault in by not adequately supervising their child around road and in general.

I have thankfully never hit a person, hit a dog 1 time, in kinda same situation driving slow in my neighborhood after dark and dog runs right into street and I hit breaks but it was 2 late. I look at it like as a parent it's always my responsibility to be watching my child at all times, especially outside around a road. If someone hits my 7 yr old in the road then I would blame myself, unless my child was crossing on green pedestrian sign. As a mother of a 9 yo.. I AM BOTHERED. I wouldn’t dare take anyone to court for me not watching my daughter. This is coming from someone who was also hit by a car at 15 and suffered.

Really well done case and I really like to watch Judy interact with kids. She is hard on adults but you can really see she's passionate about children and it shows here. Unfortunate case my mother was in a similar situation and it's hard to blame anyone. Truly an accident.
Not sure how it works in other states but in my state you can borrower someone's car which in essence he was doing and their insurance will cover that driver as long as they have a valid license. But maybe they look at it differently.
Agree, I was insured for any car I drive my insurance company said, however...when I got into a "kerfuffle" with a pedestrian (false claim), the cars owners insurance comes into play first by law apparently. If your not covered, then my insurance company would come into play i was told. Im still not 100% sure, because nothing ever came of the person's claim.
Normally yeah, but it's different when you are living at the same residence as the person who owns the car. Anyone who lives at your residence, who does not have their own car insurance, and will be driving your car, is supposed to be listed on your policy. This is hard to hide when the relationship between the parties are parent and child. It's more gray when there's no family ties. Insurance companies can and will deny a claim over this, as a licensed insurance agent I've seen that happen.
I was confused about this (I'm English) because he got into no trouble with the police as a result of the accident. If he did not have insurance then surely the police would have ticketed him at the least? Unless maybe he had good reason to believe he was on the insurance, as he still seemed to think he was in court, and he just graduated medical school so he's not stupid.

Their purpose is to cover your liable damages in the event of an accident/occurrence. Like JJ, the police didn't arrest him because they couldn't show his negligence outweighed the parents, and luckily she didn't die. REMEMBER all insurance contracts are contingent, meaning if ....then .... All insurance companies have guidelines of which the insured has to meet for the insurer to pay out a claim. And almost every insurance company has a rule concerning licensed resident drivers....this is because insurance pricing is determined mostly by risk. Look up "Actuary" and "Underwriter"....but anyhow....since he was not on the policy, the insured (the mother) broke the contingent agreement, therefore the insurance company does not have to pay. That means the damaged party (the family ) has to sue the person who caused the damage (the guy) which is why they came to JJ

This was extremely fair. I appreciate that the driver was very honest about what had happened he didn’t blame the little girl like she ran out into the middle of the road not my fault. It’s a shame that that sweet little girl had to go through any of that. JJ is right, thank god the driver wasn’t speeding through bc it would’ve killed her and that would’ve been horrendous. First time in a long time I have seen parents accept they were partially at fault. Everyone seems like they were trying their best and it really was an accident.
See how patient, fair and kind a response you get when you're respectful and honest? Judy may hold people to high standards, but why shouldn't everyone, and why shouldn't everyone strive to measure up thus? High standards = quality people.

I hit a pedestrian about 5 years ago. I was going about 50 on a very busy road and he was trying to catch the bus and I had no idea he was coming due to another vehicle in the left lane blocking him from my view. I was not at fault he actually received the ticket. I am on the defendant’s side. There really are times there is nothing the driver can do.
things i have learned from this case: make sure you are listed on the insurance as a driver of the car you are borrowing -- the car being insured i guess isn't enough beware of children darting out from parked cars (that one i was always paranoid about to begin with) walk your kid across the street -- at least until they are tall enough to be seen above the hood of a crown vic i think those are my main takeaways. this case just seemed like a series of honest mistakes from everyone involved. i am glad judge judy was able to help them all out (since the show pays the verdict)!
insurance follows the car and not the driver. drivers are listed in order to provide the rating for the policy premium. if you have someone who will drive regularly the insurance company wants to know but even if your car is stolen and in an accident your insurance company will pay (and then sue their car theif)

No one drives with eyes glued to the road. We aren't robots, we are humans. The best that could be done is what he's done, drive slowly.

This sweet little girl is so very precious. I couldn't imagine how the parents or even the driver must have felt when this tiny little human got hit by a vehicle, I know that was the worst feeling ever. I'm so glad she didn't suffer any long term effects. She's just an absolute doll, so glad she's doing well! 💛

I love Judge Judy. Her wisdom has guided me and I try to lead a responsible and conscientious life due to what she's said to her guests on her show over the years. She handled this case with great care and was gentle to all of them. I hope Journey was able to do something wise with her award money. The defendant seemed like a really good guy. He had the air of a serviceman and was studying medicine. He didn't seem like a careless or reckless person. I hope he's doing well.
I LOVE the way that the little girl's mom looked at her daughter when her daughter took the witness stand.

They as parents are responsible. Roads are for cars not kids. If it was so busy and a neighborhood party he’s obviously driving slowly. My kids don’t cross the road at 7 without myself, clearly her view was obstructed and excited to get to her friends she’s an innocent child playing but the parents could have prevented that.

Especially when she darted out between two cars, so there’s no way in hell she looked both ways like her parents told her to say. They should’ve been watching her. He was also going a max of 10mph, so there’s no way she checked the road because it’s not as if he shot out out of nowhere.

I'm thankful that this precious little one was not seriously hurt. I feel bad for the defendant because kids do run out in the street and he must have felt sick. He stayed at the scene unlike a lot of people that take off. God bless all of you ❤️

That judgment was totally fair. It absolutely was on Journey's parents to ensure that she was better taken care of. I'm glad that she got something for her pain and suffering. But hopefully this is a lesson for her parents to be a bit more cognizant of what's going on. Much like the defendant had to learn to be a bit more cognizant of what's going on when he's driving.

Exactly how is defendant liable, in plaintiff's eyes. It's parents responsibility to watch your children and not other parents, neighbors or friends but parents responsibility. I do not see how defendant is at fault when child ran out between 2 cars driving and he couldn't see her over hood. If defendant was not speeding and watching road how could he foresee a child running in front of his car in between car in front of him. I get impression child's parents were looking for financial windfall from accident that they were at fault in by not adequately supervising their child around road and in general.
I will say because looked away there is some negligence for lookout just an insurance capacity

The parents are absolutely mostly to blame, but the defendant shouldn't have even been on the road not being insured. To me the judgement was fair

@@Sara-wv3ms yes maybe he was distracted for a second but if something or a child literally runs in front of your car, at her height you probably wouldn't see her over the hood. I have thankfully never hit a person, hit a dog 1 time, in kinda same situation driving slow in my neighborhood after dark and dog runs right into street and I hit breaks but it was 2 late. I look at it like as a parent it's always my responsibility to be watching my child at all times, especially outside around a road. If someone hits my 7 yr old in the road then I would blame myself, unless my child was crossing on green pedestrian sign. I've been to and hosted many family cookouts and I'm the parent who is always watching my kids and everyone elses. I do agree driver is particularly responsible but parents c as try most responsibility, in my opinion.

As a mother of a 9 yo.. I AM BOTHERED. I wouldn’t dare take anyone to court for me not watching my daughter. This is coming from someone who was also hit by a car at 15 and suffered.
As soon as I heard Judge Judy say she will not give them 5000 as requested I somehow knew she wanted to reward the little girl with 1000.

Really well done case and I really like to watch Judy interact with kids. She is hard on adults but you can really see she's passionate about children and it shows here. Unfortunate case my mother was in a similar situation and it's hard to blame anyone. Truly an accident.
Not sure how it works in other states but in my state you can borrower someone's car which in essence he was doing and their insurance will cover that driver as long as they have a valid license. But maybe they look at it differently.

Agree, I was insured for any car I drive my insurance company said, however...when I got into a "kerfuffle" with a pedestrian (false claim), the cars owners insurance comes into play first by law apparently. If your not covered, then my insurance company would come into play i was told. Im still not 100% sure, because nothing ever came of the person's claim.
Normally yeah, but it's different when you are living at the same residence as the person who owns the car. Anyone who lives at your residence, who does not have their own car insurance, and will be driving your car, is supposed to be listed on your policy. This is hard to hide when the relationship between the parties are parent and child. It's more gray when there's no family ties. Insurance companies can and will deny a claim over this, as a licensed insurance agent I've seen that happen.
I was confused about this (I'm English) because he got into no trouble with the police as a result of the accident. If he did not have insurance then surely the police would have ticketed him at the least? Unless maybe he had good reason to believe he was on the insurance, as he still seemed to think he was in court, and he just graduated medical school so he's not stupid.
@@shendisackett the purpose of the police is to protect citizens, that's not necessarily the purpose of an insurance company. Their purpose is to cover your liable damages in the event of an accident/occurrence. Like JJ, the police didn't arrest him because they couldn't show his negligence outweighed the parents, and luckily she didn't die. REMEMBER all insurance contracts are contingent, meaning if ....then ....
All insurance companies have guidelines of which the insured has to meet for the insurer to pay out a claim. And almost every insurance company has a rule concerning licensed resident drivers....this is because insurance pricing is determined mostly by risk. Look up "Actuary" and "Underwriter"....but anyhow....since he was not on the policy, the insured (the mother) broke the contingent agreement, therefore the insurance company does not have to pay. That means the damaged party (the family ) has to sue the person who caused the damage (the guy) which is why they came to JJ
Most kids or all never look both ways! 🤣 They are playing with their friends and we the drivers always have to pay attention in the neighborhood. This was really just an unfortunate accident.

This was extremely fair. I appreciate that the driver was very honest about what had happened he didn’t blame the little girl like she ran out into the middle of the road not my fault. It’s a shame that that sweet little girl had to go through any of that. JJ is right, thank god the driver wasn’t speeding through bc it would’ve killed her and that would’ve been horrendous. I sure hope her parents are watching her like a hawk now, I know I would be. But then again I would’ve been watching her like a hawk to begin with

I hit a pedestrian about 5 years ago. I was going about 50 on a very busy road and he was trying to catch the bus and I had no idea he was coming due to another vehicle in the left lane blocking him from my view. I was not at fault he actually received the ticket. I am on the defendant’s side. There really are times there is nothing the driver can do.

things i have learned from this case:
make sure you are listed on the insurance as a driver of the car you are borrowing -- the car being insured i guess isn't enough
beware of children darting out from parked cars (that one i was always paranoid about to begin with)
walk your kid across the street -- at least until they are tall enough to be seen above the hood of a crown vic
i think those are my main takeaways. this case just seemed like a series of honest mistakes from everyone involved. i am glad judge judy was able to help them all out (since the show pays the verdict)!
insurance follows the car and not the driver. drivers are listed in order to provide the rating for the policy premium. if you have someone who will drive regularly the insurance company wants to know but even if your car is stolen and in an accident your insurance company will pay (and then sue their car theif)
