J-1 students or exchange visitors play a critical role in meeting the needs of employers. The two-year residency rule might be a problem for some of them.     I appreciate this information, but what if your visa says you are not subject to the two year residency rule and you have done one year of the j1 can i get a new sponsor and have my status changed because that employer offers h1b

    Even if the 212 is applied and you want a waiver it takes more then 1 year and your visa gets expired already and you cant do anything

    I am in US right now on J1 visa on a exchange program funded by US govt. which expires on May7, I want to go back to my country for a few months and then come back as a company wants to have me working for them. Its a reputed startup company and is willing to sponsor my VISA to come back and work for them. Is this possible? How can I make this happen?

    Hello McBean, my wife is on her second J-1 visa, she is not subject to the two-year home 212e rule in both her J1 visa and DS-2019, she served her two years in 2017 when she went back home for five years. Is now eligible to apply for a green card on her new J1 visa not subject to rule 212e?

      I am currently doing the same thing. Adoption is going to take waaaaaay to long you have to do guardianship. Both parent has to sign the child over to you . You have to go to a court hearing in Jamaica and then they grant it to you.. you most definitely will have to use a Lawyer.

    I was under J-1 VISA until my employer let me go and my sponsor also terminated my J-1 VISA. There is a 2yrs stay in the Home country checked on the box of DS-2019 but this was only after I complete my J-1 period which is 18 months but I hardly spent 7 months in the USA. I even have an I-20 issued by a university as my I-94 was going to expire in two days. Should I apply for a J-1 Waiver to change the status to F-1? How long does it take to be approved?

    No sure if you can help or not but is it ok to stay for 5 mth intervals in US? My sister has cancer and needs us to stay to assist her during treatment. My parents stayed months at a time but my mother got diagnosed and can't travel. Hussy rents apts and I work online. we stayed for 5 mths &have to go back to not exceed the visa, would we be able to do that a few more times till she's well? Is there any documentation we'd need to be allowed back in like her medical record?

    I already requested for the advisory opinion. It took two and half months for the response to come in. Now I have to file for a waiver, and I only have my 30 days grace period to do that as my internship period is over. My visa is a one year visa. Can I stay after the 30days Grace period to wait for the results of the waiver? Thank you in advance for your assistance.

      I'm sure you already found this out, but sadly no, I believe you need to return to your home country while the waiver approval is processing. With that said, its been 4 months since you posted that comment, so how did it go?

      @@min1549 So the first part of my no objection was approved. Your home country has to approve it first then prepare a letter to the department of state then to Uscis. Uscis has the final say .
