    Yes, you can travel abroad as a green card holder - that's one of the many benefits of being a permanent resident. However, your trip must be temporary and you cannot remain outside the United States for more than 1 year. This rule was updated during Covid-19 because many could not get a flight home.

    Getting a re-entry permit just like anything else when dealing with immigration is pain the butt. My mom applied to het one over a year ago and still waiting.

    Is the 6 months outside the US counted within a calendar year (Jan - Dec) or any 12 month period? Eg if you left in Nov 23 and returned in Mar 24 is that 5 months or 3 months of the 6 for 2024?

    Um already filed my greencard but not yet have it almost one year now but thinking about go back and forth to our country like my case, I married to a citizen woman due to my first wife pass away in 2015, so my children are in my country and that’s the only reason why I have to go n visit them until they move up here to me! Is it reasonable?

    Thanks for this helpful video, Ismail! To obtain U.S. citizenship I need to live 5 years in a row in the U.S. and more than 6 months a year. The question is, when does this calculation of 6 months begin: the date of the first entry into the U.S. (on an immigrant visa, before receiving the Green Card itself) or the date of issue of the Green Card? Or is it all about a calendar year? I am asking because I need to finish my work, prepare for moving and then move to the U.S., it could take several months. Thank you in advance!

    Let me ask you this. Can i maintain my GC if i live in a border town in Canada and drive weekly into the US to purchase gas and groceries and return to Canada?
    At no point do i exceed 2 weeks, let alone 6 months.

    Is the 6 months accumulative or does it restart every time you re-enter? As in going back and forth between Tijuana and san diego?

      It restarts every time you re-enter. However, frequent travels to same destination, even less than 6 months, may still prompt questioning at the border, because they may presume you actually reside in your country but use your green card to travel here temporarily. Therefore, we always recommend creating and carrying a file containing documents evidencing your close ties to the US, such as tax returns, bank and credit card statements, employment verification, property ownership, family ties, etc. It also doesn't hurt to always have a Re-entry Permit as a back-up in case if you decide or need to stay abroad longer than six months during any of your trips.

    I got the chance to come to US before 3 years through DV. I am lawful resident bu my spouse and children living at back home/Africa. I filed petiton by form I130. in Dec. 2020 and uscis sent the reception notice immediately. I emailed uscis before for late processing of before 1 year and they told me that the case is reviewed but nothing is outstanding and we will let you know when we need additional information. I am still waiting but no update. So, I need some advice how to proceed the next steps.

    Hi, I have an important question sir. My mother is a green card holder and she was having some health issues whose expenses were high back there in the US so she decided to get treatment back at home country. For that purpose she applied for re entry permit and after some time she checked online it was stated that her previous finger prints were applied to her application. She chose to receive travel document at the US embassy back home and then left for back home. Now it's been 5 months and she still didn't receive her document. What she should do now? Can she stay for the period she applied for or she she should go back to US?

      on the uscis website it says that they no longer send you a document. Immigration must have access to her re entry permit on computer. when we re entered i did a screenprint of my wife's case number for her re entry permit just in case there were any questions but immigration wasn't a problem

    I am a green card holder since 2015 but hardly lived there except doing yearly short visits to US.
    Now in my last visit from Canada to US by road from Buffalo boarder the border security took my card and asked me to appear in Buffalo court in end March 2023.
    1- Should I go and contest
    2- if I don't appear, what repercussions it may have for future US travel, even with. Canadian passport

    Hi I got my green card in 1985. In 1986 I went back to my home country to take care of some family issues.I did visit back to USA 2 to 3 times in the next 23 years appox. In 2018 I travelled to USA on visit visa instead of Green Card n stayed there for 3 weeks.

    I ran across a vlogger who got his wife a 10 year green card. 4 months later they went on vacation to the US for 2 weeks. There she got a California ID with her in-law’s address (her proof of US ties). They expect to “reset” the 1 year requirement 2 weeks before it expires. My ex didn’t have a problem 35 years ago because I had a 1 year contract in Brazil. Will this vlogger get away with this loophole?

    My dad was upset for almost two years for health reasons, his green red still active until 2026, if he comes without a permit to reenter will he be let in? That’s what I understand from the video, however after let in he needs to go to court correct?

      That’s correct, he can return, but there is a chance he can be summoned to court. We recommend preparing a file with his medical records, evidence of close ties to the US and affidavits from family confirming that he was absent due to his medical condition. This will increase the chances your father will be allowed to return without being summoned to court. Good luck!

      @@BilbardBad yeah i had green card.after i was out for 7 years they asked why i stayed so long...i had family there so...also they asked what are my plans here in. USA . I said i am gona work hard legally pay taxes and try to preserve residency....so right now i am traveling to USA every year for 3 month...i work as truck driver seasonal job...only in spring...and then i go back to my home country

    I am a permanent resident . I am retired and I received social security disability benefits based on my own work credit. Someone told me that if I stay outside of the US more than 30 days, I would lose my social security disability benefits. Is this true

    what if I've been a residence for 5 years? I've traveled in August 2022 - 2023 February (6 months) and planning to extend 2 more months (so 7-8 months overall)? I'm planning to apply for citizenship when I come back to the US. Would my 5 years reset back to 0 and have to accumulate 5 years again to apply for citizenship even though I still reside in the US? I have proof that I've been living in the same house for 5-6 years, bank account, drivers license, and will pay tax when my W2 comes.

    You talk nonsense , The law is if you stay more than six months it doesn"t count year if you want to apply for naturalization but , a green card holder can not stay 1 year out of US because the green card expires automatically.

      Exactly...he is just scare/fear mongering. The rule clearly states that you may be in violation only if you stay out 1 year and 1 day. Staying out up to 1 year is not a violation of your status as a legal permanent resident.

      You’re right. I have company in US and branch office in Europe. In previous 8 years, two times I was absent 7-8 months because of business purpose, and never had any problem at the border when returned back to the States

    I am a US citizen, but I am confused. I married Singaporean over a year ago. We want to live in the US and start a family. She also wants to become a US Citizen.       I've been married to a US citizen for 17 years. For 12 years she lived with me in the UK but we decided to sell up and buy a property in the US in 2018 where she lives and I stay then travel back for deployments lasting 4 months with 3 months leave. I want to apply for a green Card but will still be deployed 4 months away then coming home for 3 probably until I retire. I'm approaching 53 now. How would this affect my green card?

      Yes, you can return to the USA. If you stay more than 6 months, you may need to show evidence of close ties and prove that you did not intend to abandon your permanent residency. If you did not receive your green card yet, you can still use the I-551 Immigrant Visa in your passport for 1 year after your last entry.
